Your application for a Department of the Army permit received on November 23, 2012, and completed on December 13,2012, has been assigned number SAJ-2012-02475(NW-MAM). A review of the information and drawings provided shows the proposed work is to enhance tidal flow and conductivity within approximately 76 acres of estuarine impounded lagoon areas with the Banana River Aquatic Preserve watershed, at Cape Canaveral Air Force Station (CCAFS).
The work will include: a) the removal of a single aged, obstructed, and poorly functional 24-inch reinforced concrete pipe (RCP), b) the replacement of the existing culvert with two (2) new 38-inch by 60-inch elliptical RCPs to improve tidal flow within the impounded estuarine wetlands,
c) the breaching of an abandoned mosquito control dike at two (2) locations that restore historic water flows as depicted in drawing 7 of 12, and d) the removal of exotic and invasive vegetation such as Brazilian pepper along the interior dike and existing culvert area. The wetland restoration work would result in minor excavation and filling of 0.11 acre of tidal wetlands and open waters. The replacement and improvement of the failing culvert along Centaur Road and the mosquito control dike breaches will allow a north/south flow with tidal waters of the Banana River and enhance water quality, allow natural recruitment of mangrove trees, seagrasses, and other desirable estuarine vegetation, and allow access to estuarine fauna to over 76 acres of impounded estuarine habitats. This activity will result in a net gain in wetland functions, values, and services. The project is located at Centaur Road and two separate locations within the existing interior mosquito control dike, which bisects estuarine impoundments adjacent to launch Complex 40, at Cape Canaveral Air Force Station (Section 23; Township 22 South; Range 37 East), in Brevard River County, Florida.
Your project, as depicted on the enclosed drawings, is authorized by Nationwide Permit (NWP) Number 27. In addition, project specific conditions have been enclosed. Once there you will need to click on "Nationwide Permits." These files contain the description of the Nationwide Permit authorization, the Nationwide Permit general conditions, and the regional conditions, which apply specifically to this verification for NWP 27. Enclosed is a list ofthe six General Conditions, which apply to all Department of the Army authorizations. You must comply with all of the special and general conditions and any project specific condition of this authorization or you may be subject to enforcement action. In the event you have not completed construction of your project within the specified time limit, a separate application or re-verification may be required.
The following special conditions are included with this verification:
1. Self-Certification: Within 60 days of completion of the work authorized, the attached "Self-Certification Statement of Compliance" must be completed and submitted to the U.S. Army Corps of Engineers. Mail the completed form to the Regulatory Division, Enforcement Section, Post Office Box 4970, Jacksonville, Florida 32232-0019.
2. Erosion Control: Prior to the initiation of any work authorized by this permit, the Permittee shall install erosion control measures along the perimeter of all work areas to prevent the displacement of fill material. Immediately after completion of the final grading of the land surface, all slopes, land surfaces, and filled areas adjacent to wetlands and surface waters shall be stabilized using sod, degradable mats, barriers, or a combination of similar stabilizing materials to prevent erosion. The erosion control measures shall remain in place and be maintained until all authorized work has been completed and the site has been stabilized.
3. Turbidity Barriers: Prior to the initiation of any of the work authorized by this permit the Permittee shall install turbidity barriers around all work areas that are in, or adjacent to, surface waters. The turbidity barriers shall remain in place and be maintained until the authorized work has been completed and all erodible materials have been stabilized.
4. Excavated Material Disposal: The Permittee shall place all excavated material in the self-contained, upland disposal site at the locations depicted in drawing 8 of 12. The Permittee shall maintain the upland disposal site to prevent the discharge of dredged material and associated effluent into waters of the United States.

5. Sea Turtle and Smalltooth Sawfish Conditions: The permittee shall adhere to the "Sea Turtle and Smalltooth Sawfish Construction Conditions - March 2006" provided in attachment # 1 of this permit.
6. Manatee Conditions: The Permittee shall adhere to the "Standard Manatee Conditions for In-Water Work -2011" provided in Attachment # 2 of this permit. Additionally, the permittee shall adhere to the dredging guidelines for No-Entry areas as specified in Appendix "C" of the USFWS Manatee Programmatic Biological Opinion by: a) Minimizing impacts to submerged aquatic vegetation, b) not conducting in-water activities when manatees are present,
c) Providing dedicated manatee observers during all in-water activities and ceasing in-water activities if conditions don't allow manatees to be seen within 50 to 100 feet, d) Not conducting night time clamshell dredging, and e) Installing grated bars or rods to all manatee accessible culverts to prevent manatee entrapment according to Appendix "D" and the FWC guidelines "Grates and Other Manatee Exclusion Devices for Culverts and Pipes" provided in Attachment # 5 of this permit .
7. Eastern Indigo Snake Protection Measures: The Permittee shall comply with U.S.
Fish and Wildlife Service's "Standard Protection Measures for the Eastern Indigo Snake" dated February 12, 2004 and provided in Attachment# 3 of this permit.
8. Atlantic Salt Marsh Snake Protection Measures: The Permittee shall comply with U.S. Fish and Wildlife Service's "Standard Protection Measures for the Atlantic Salt Marsh Snake" dated February 12, 2004 and provided in Attachment# 4 of this permit.
9. Cultural Resources/Historic Properties:
a. No structure or work shall adversely affect impact or disturb properties listed in the National Register ofHistoric Places (NRHP) or those eligible for inclusion in the NRHP.
b. If during the ground disturbing activities and construction work within the permit area, there are archaeological/cultural materials encountered which were not the subject of a previous cultural resources assessment survey (and which shall include, but not be limited to: pottery, modified shell, flora, fauna, human remains, ceramics, stone tools or metal implements, dugout canoes, evidence of structures or any other physical remains that could be associated with Native American cultures or early colonial or American settlement), the Permittee shall immediately stop all work in the vicinity and notify the Corps. The Corps shall then notify the Florida State Historic Preservation Officer (SHPO) and the appropriate Tribal Historic Preservation Officer(s) (THPO(s)) to assess the significance of the discovery and devise appropriate actions.

c. A cultural resources assessment may be required of the permit area, if deemed necessary by the SHPO, THPO(s), or Corps, in accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5).
Based, on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume on non-federal lands without written authorization from the SHPO and the Corps.
d. In the unlikely event that unmarked human remains are identified on non-federal lands, they will be treated in accordance with Section 872.05 Florida Statutes. All work in the vicinity shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archeologist. The Corps shall then notify the appropriate SHPO and THPO(s). Based, on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part 325.7.
Such activity shall not resume without written authorization from the State Archeologist, SHPO and the Corps.
e. In the unlikely event that human remains are encountered on federal or tribal lands, or in situations where Archaeological Resources Protection Act of 1979, or Native American Graves Protection Repatriation Act of 1990 applies, all work in the vicinity shall immediately cease and the Permittee immediately notify the Corps. The Corps shall then notify the appropriate THPO(s) and SHPO. Based, on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part 325.7. After such notification, project activities on federal lands shall not resume without written authorization from the Corps, and/or appropriate THPO(s), SHPO, and federal manager. After such notification, project activities on tribal lands shall not resume without written authorization from the appropriate THPO(s) and the Corps.
10. Regulatory Agency Changes: Should any other regulatory agency require changes to the work authorized or obligated by this permit, the Permittee is advised that a modification to this permit instrument is required prior to initiation of those changes. It is the Permittee's responsibility to request a modification of this permit from the Cocoa Regulatory Office.
11. Performance Standards for the Restoration: To meet the objectives of the approved aquatic habitat enhancement plan, the Permittee shall achieve the following performance standards within enhancement areas as depicted in Drawing 7 of 12 of this permit:
a. At least 80 percent cover by appropriate wetland species (i.e., F AC or wetter).
b. Cover of Category I and II invasive exotic plant species, pursuant to the most current list established by the Florida Exotic Pest Plant Council at http://www.fleppc.org, shall total less than 5 percent.

The Permittee shall achieve the above performance standards by the end of the 5-year monitoring period, with no maintenance during the 5th year of monitoring. In the event that the above performance standards have not been achieved, the Permittee shall undertake a remediation program approved by the Corps in accordance with the Remediation Special Condition of this permit.
12. Remediation: If the restoration fails to meet the performance standards 5 years after completion of the restoration objectives, the restoration activity will be deemed unsuccessful.
Within 60 days of notification by the Corps that the restoration is unsuccessful, the Permittee shall submit to the Corps an alternate restoration proposal sufficient to create the functional lift required under the permit that result in a net gain in functions and services. The alternate restoration proposal may be required to include additional mitigation to compensate for the temporal loss of wetland function associated with the unsuccessful restoration activities. The Corps reserves the right to fully evaluate, amend, and approve or reject the alternate restoration or compensatory mitigation proposal. Within 120 days of Corps approval, the Permittee will complete the alternate restoration or compensatory mitigation proposal.
13. Monitoring and Reporting Timeframes: To show compliance with the performance standards the Permittee shall complete the following:
a. Perform a time-zero monitoring event of the wetland mitigation area(s) within 60 days of completion of the restoration objectives identified in the attached drawings of this permit.
b. Submit the time-zero report to the Corps within 60 days of completion of the monitoring event. The report will include at least one paragraph depicting baseline conditions of the mitigation site(s) prior to initiation of the restoration objectives and a detailed plan view drawing of all created, enhanced and/or restored mitigation areas.
c. Subsequent to completion of the restoration objectives, perform annual monitoring of the wetland mitigation areas for the first 5 years for a total of no less than 5 years of monitoring.
d. Submit annual monitoring reports to the Corps within 60 days of completion of the monitoring event.
e. Monitor the restoration area(s) and submit annual monitoring reports to the Corps until released in accordance with the restoration objectives of this permit.

14. Reporting Format: Annual monitoring reports shall follow a 10-page maximum report format for assessing restoration sites. The Permittee shall submit all documentation to the Corps on 8Y2-inch by 11-inch paper, and include the following:
a. Project Overview (1 Page):
(1) Department of the Army Permit Number
(2) Name and contact information of Permittee and consultant
(3) Name of party responsible for conducting the monitoring and the date(s) the inspection was conducted
(4) A brief paragraph describing the purpose of the approved project, acreage and type of aquatic resources impacted, and mitigation acreage and type of aquatic resources authorized to compensate for the aquatic impacts.
(5) Written description ofthe location, any identifiable landmarks ofthe restoration project including information to locate the site perimeter(s), and coordinates of the restoration site (expressed as latitude, longitudes, UTMs, state plane coordinate system, etc.).
(6) Dates compensatory mitigation commenced and/or was completed
(7) Short statement on whether the performance standards are being met
(8) Dates of any recent corrective or maintenance activities conducted since the previous report submission
(9) Specific recommendations for any additional corrective or remedial actions.
b. Requirements (1 page): List the monitoring requirements and performance standards, as specified in the approved mitigation plan and special conditions of this permit, and evaluate whether the compensatory mitigation project site is successfully achieving the approved performance standards or trending towards success. A table is a recommended option for comparing the performance standards to the conditions and status of the developing mitigation site.
c. Summary Data (maximum of 4 pages): Summary data should be provided to substantiate the success and/or potential challenges associated with the compensatory mitigation project. Photo documentation may be provided to support the findings and recommendations referenced in the monitoring report and to assist the PM in assessing whether the compensatory

-7-mitigation project is meeting applicable performance standards for that monitoring period.
Submitted photos should be formatted to print on a standard 8 W' x 11" piece of paper, dated, and clearly labeled with the direction from which the photo was taken. The photo location points should also be identified on the appropriate maps.
d. Maps and Plans (maximum of 3 pages): Maps shall be provided to show the location of the compensatory mitigation site relative to other landscape features, habitat types, locations of photographic reference points, transects, sampling data points, and/or other features pertinent to the mitigation plan. In addition, the submitted maps and plans should clearly delineate the mitigation site perimeter(s). Each map or diagram should be formatted to print on a standard 8 W' x 11" piece of paper and include a legend and the location of any photos submitted for review. As-built plans may be included.
e. Conclusions (1 page): A general statement shall be included that describes the conditions ofthe compensatory mitigation project. If performance standards are not being met, a brief explanation of the difficulties and potential remedial actions proposed by the Permittee or sponsor, including a timetable, shall be provided. The District Commander will ultimately determine if the mitigation site is successful for a given monitoring period.
15. Reporting Address: All reports, documentation and correspondence required by the conditions of this permit shall be submitted to the following address: U.S. Army Corps of Engineers, Regulatory Division, Enforcement Section, Post Office Box 4970, Jacksonville, Florida 32232-0019. The Permittee shall reference this permit number, SAJ-2012-02475 (NW MAM), on all submittals.
16. Water Quality Certification (WQC) and applicable Coastal Zone Consistency Concurrence (CZCC) Requirement: This letter of authorization does not obviate the necessity to obtain any other Federal, State, or local permits, which may be required. Prior to the initiation of any construction, projects qualifying for this Nationwide permit must qualify for an exemption under section 403.813(1), F.S. or 373.406, F.S., or otherwise be authorized by the applicable permit required under Part IV of Chapter 373, F.S., by the Department of Environmental Protection, a water management district under section 373.069, F.S., or a local government with delegated authority under section 373.441, F.S., and receive Water Quality Certification (WQC) and applicable Coastal Zone Consistency Concurrence (CZCC) or waiver thereto, as well as any authorizations required for the use of state-owned submerged lands under Chapter 253, F.S., and, as applicable, Chapter 258, F.S. You should check State-permitting requirements with the Florida Department of Environmental Protection or the appropriate water management district.

17. State Listed Fish or Wildlife Species: This letter of authorization does not include conditions that would prevent the 'take' of a state-listed fish or wildlife species. These species are protected under sec. 379.411, Florida Statutes, and listed under Rule 68A-27, Florida Administrative Code. With regard to fish and wildlife species designated as species of special concern or threatened by the State of Florida, you are responsible for coordinating directly with the Florida Fish and Wildlife Conservation Commission (FWC). You can visit the FWC license and permitting webpage (http://www.myfwc.com/license/wildlifeO for more information, including a list of those fish and wildlife species designated as species of special concern or threatened. The Florida Natural Areas Inventory (http://www.fnai.org/) also maintains updated lists, by county, of documented occurrences of those species.
This letter of authorization does not give absolute Federal authority to perform the work as specified on your application. The proposed work may be subject to local building restrictions mandated by the National Flood Insurance Program. You should contact your local office that issues building permits to determine if your site is located in a flood-prone area, and if you must comply with the local building requirements mandated by the National Flood Insurance Program.

1. The time limit for completing the work authorized ends on the date identified in the letter. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort of if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit you must obtain the signature of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions.
6. You must allow a representative from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
