STATEMENT OF WORK

for

SMALL SEED PROJECT

ENVIRONMENTAL HAZARDOUS MATERIAL ASSESSMENT, REMEDIATION AND

REPAIRS, AND RADON MITIGATION

AT

STANDING ROCK AGENCY / STANDING ROCK COMMUNITY SCHOOL

EMPLOYEE HOUSING, BUILDING 168

9189 Highway 24, Fort Yates, ND 58538

1.0. INTRODUCTION AND BACKGROUND

The Bureau of Indian Education (BIE) requires the following work be performed at the Standing Rock Community School employee housing within the Standing Rock Sioux Tribe/Standing Rock Indian Reservation, 9189 Highway 24, Fort Yates, ND 58538. The housing complex is beyond the school property in Fort Yates at 168 Standing Rock Ave. See the attachments for floor plans of the homes included in this statement of work.

For reference, a 2009 compilation of previous survey results and reports, recommended mitigations, and locations within Building #168 is provided in the enclosures to this SOW.

Currently, two of the residential units are occupied (168-B and 168-C).

2.0. PROJECT SCOPE

Description of Requirement: This scope is divided into two phases.

Phase 1:

The Contractor shall provide assessments to confirm asbestos containing material (ACM) and lead-based paint (LBP) quantities, extent of mold contamination, and design a radon gas mitigation system. The final deliverables in Phase 1 shall include an assessment report and recommended mitigation work plan as detailed further in section 4.3; and a radon mitigation system design as detailed further in section 4.4.

Phase 2:

After the satisfactory completion and acceptance of deliverables in Phase 1, the Contracting Officer will request a proposal from the Contractor to implement the mitigation work plan and radon mitigation system installation. The proposal will offer prices no higher than the ceiling prices established in the IDIQ Binding Price Schedule.

Services also include the repair and replacement of interior walls, floors, insulation, crawlspaces, ceiling, and roof sections that are directly impacted by remediation efforts, damaged, or contributing to the cause of mold growth (i.e., waterlogged), and radon mitigation system installation.

3.0. REFERENCES

All work shall be managed/overseen by a Certified Industrial Hygienist (CIH) and performed by qualified personnel. The work should follow, at a minimum:

• ANSI/IICRC S520 Standard for Professional Mold Remediation.

4.0. PROJECT REQUIREMENTS

The scope of work is divided into two distinct phases as described below.

Phase 1: Assessment, Mitigation Report and Work Plan for Mold, Lead, Asbestos Containing Material; Radon Mitigation Design

4.1. Initial Investigation & Assessment

Investigate facility and evaluate severity of problem. Examine all areas of building interior for signs of: mold particulate- and evaluate their potential causes, ACM, and lead. Include all interior areas and crawlspaces. Areas of potential concern regarding concealed mold, ACM, and lead shall be identified within scope for investigation and assessment.

4.2. Sampling Plan: Evaluation, Sampling and Analysis

Sampling may be needed for all materials mentioned above, depending on the results of section

4.1. Sampling is not typically necessary for visible mold where the issue is obvious. The contractor shall develop a sampling plan based on 4.1 results, to include ACM, LBP, mold and/or radon, ** and provide documentation supporting all sample locations including maps/drawings, sample site photograph(s), sample site description, and sampling methods. The Contractor shall identify where more invasive sampling methods, including but not limited to bulk sampling, are required to evaluate the presence of concealed mold, LBP, or ACM. Any sampling plan including airborne samples for mold must include at least one outdoor sample for comparison.

The sampling plan will be submitted for approval by the COR. Once approved, the contractor will execute the sampling plan.

** Indian Affairs is aware that the U.S. EPA has not set Standards or Threshold Limit Values (TLVs) for airborne concentrations of mold or mold spores. As such, it is recommended that the vendor use their professional judgement in the development of the mold sampling plan and methodology/protocols for mold and mold spore-related contaminant sample analysis, including comparison to the outdoor air sample.

4.3. Assessment Report and Work Plan

The contractor shall submit a final assessment report that summarizes and evaluates ACM, LBP, and mold assessment findings, and provide a work plan that addresses mitigation/abatement recommendations and required building repairs. For ACM and LBP, the contractor shall assume complete abatement and removal of all material.

Deliverable shall be a written report in pdf format and shall include tables/appendices with individual building sample identification numbers, photographic documentation, evaluation of findings, and laboratory/testing results. Provide cleaning products in the work plan that adhere to the EPA’s Safer Choice standard. All data, findings and recommendations shall be correlated with a specific system (e.g. walls, ceiling, roofing, HVAC, ductwork) and location and represented in a plan view drawing of the facility.

Contractor shall provide the report electronically to the COR and the Bureau of Indian Education, Branch of Facilities Management and Branch of Environmental Management.

The Work Plan submittal shall include:

1. A recommend about which remediation methods are necessary and why. Describe any alternative remediation methods and compare to the recommended methods in terms of feasibility, effectiveness, time, and price. Price will be addressed in general terms for comparison, rather than as a price proposal.

2. Design of a Radon Mitigation System installation – see task 4.4. below.

3. A narrative description of how the building interior and exterior will be restored to acceptable living standards.

4. A schedule for all recommended tasks.

4.4. Radon Mitigation System Design

The Contractor shall develop a design to reduce radon gas from the building crawlspaces and ground floor to acceptable limits per the EPA limit of 4.0 pCi/L or below.

4.5. Post-Assessment Cleanup

The Contractor shall restore the occupied residential units to the original condition of the site before any invasive or destructive sampling or testing was conducted.

Phase 2 – Work Plan Implementation

4.6. Work Plan Implementation

For all potentially hazardous materials, the contractor shall establish required containment of the area(s) to be remediated, cleaned, encapsulated, and/or removed per applicable regulations and standards for the given material (mold, LBP, ACM).

4.6.1. Mold Cleaning/Remediation and Removed Materials Replacement

Perform cleaning of identified mold areas identified in the previously approved work plan and restore interior and exterior. Cleaning work may include demolishing or removing materials (such as carpet, drywall, ceiling tiles, etc.) that cannot effectively be cleaned using commercial cleaners. Contractor shall provide reinstallation of materials (e.g., new drywall or ceiling tiles).. Contractor shall also include cleaning of the ventilation ductwork to ensure removal of mold that was discovered during Phase 1 or may have infiltrated the system during mold remediation operations. In general, BIE expects the interior to be restored to clean and acceptable living standards.

The Contractor shall provide a disposal container or equipment needed to support the removal of all demolished material, waste, and debris. The site shall identify the staging location for containers and equipment needed during remediation. The contractor shall keep the working area in a clean and proper condition. All rubbish and waste resulting from the execution of the work shall be disposed of as required by law and regulation.

4.6.2. LBP Removal and Replacement

Completely remove LBP from all exposed areas confirmed to contain such material per the approved work plan and EPA guidelines. Prime and paint with applicable non-toxic, water-based paint with closest matching color scheme. Establish required containment per applicable standards and regulations for handling these materials.

4.6.3. ACM Abatement

Completely remove ACM from all areas confirmed to contain such material per approved work plan and EPA guidelines. Establish required containment per applicable standards and regulations for handling these materials.

4.6.4. Radon Mitigation System Installation

Per the approved design from Phase 1, install system. All building penetrations in exterior and interior areas shall be sealed and restored to original appearance, finish, or structure.

4.7. Clearance Sampling

If pre-cleanup sampling occurred, secure post-cleanup clearance sampling to demonstrate effectiveness of cleaning.

Regardless of sampling, no visible mold, mold-damaged materials, or moldy odors should be present after cleanup.

Removal of active containment areas (for LBP and ACM) requires sampling and confirmation of the absence of asbestos and lead per applicable government standards and regulations.

Installation of a radon mitigation system requires post-mitigation radon testing to ensure levels are below 4.0 pCi/L.

4.8. Final Report

The final report shall include a summary of all work completed with pre- and post-work completion photos and clearance sampling results per section 4.7.

The report shall also outline operational recommendations for building staff to follow (i.e., Operation & Maintenance plan with periodic cleanings/annual assessments) to prevent future mold recurrence.

Contractor shall also provide a Certified Industrial Hygienist written determination that the residences meet applicable indoor environmental quality standards for safe human occupancy.

4.9. Standards of Work

All related site work will be conducted by a company currently licensed in accordance with applicable federal, state, and local laws and regulations.

Contractor shall follow all federal, state and local occupational safety and health regulations, including but not limited to engineering controls, personal protective equipment, and safe work practices.

Contractor shall follow all federal, state and local environmental regulations regarding disposal or storage of materials.

If laboratory analysis is warranted, transportation of samples to laboratory shall be conducted under chain-of-custody documentation for analysis and reporting of results. Analysis must be performed by a certified laboratory per federal, state, and local regulations.

Distribution of the results of clearance sampling, testing, and reporting for this facility will be restricted to the COR.

Overtime and weekend work will require approval by the COR.

In the event the site staff restricts the contractor’s access to any areas or directs the Contractor in any way that is not in accordance with this Statement of Work, the contractor shall contact the COR and Contracting Officer.

5.0. FACILITY WORK REQUIREMENTS

Coordinate all site visit work with the COR.

6.0. TERO REQUIREMENTS.

The contractor is responsible for adhering to all federal, state, and local laws and regulations, including those of the Tribal Employment Rights Office (TERO). For this contract, the TERO point of contact for the Standing Rock Sioux Tribe can be contacted at 701‑854‑7295. It is the contractor’s responsibility to contact the TERO prior to the development of a proposal for this work to determine any relevant fees, permits, or other requirements the Tribe may have for working on the reservation.

7.0. SUBMITTALS

Final Submittals: Prior to acceptance and payment, the vendor must provide an electronic copy in PDF format:

8.0. PERIOD OF PERFORMANCE

The period of performance for Phase 1 will end 60 days after award. The period of performance for Phase 2 will end 180 days after Phase 2 award.
