Set-Aside Status
1 The SF 1449 for solicitation is marked in Block 10 that this solicitation is “unrestricted” and not a set aside. However, on page 30 of 52, clause DIAR 1452.280-1 Notice of Indian Economic Enterprise Set Aside is included in the solicitation.
This clause requires Offerors to be both Indian Economic Enterprises and small business concerns. The SF 1449 block 10 conflicts with the IEE clause. Please confirm this solicitation is set aside for IEE concerns that are small businesses under the NACIS code of 562910 with the revenue-based size standard of $25 M.
This solicitation is 100% set-aside for ISBEE firms. Unfortunately SF 1449 block 10 can't be edited to reflect ISBEE set-asides.
Key Dates 2 SF 1449 - Block 6 of the SF 1449 provides a solicitation issue date of 12/02/2024 however the actual issuance date was 11/21/2024. Please confirm the actual issuance date for the solicitation is 11/21/2024

Site Visit 4 May a site visit of the Seed Project location be coordinated prior to the submission date to review the unoccupied areas of the subject building?
Information about a site visit will be included in a follow up amendment, if a site visit can be arranged.
IDIQ Binding Price Schedule 5 Considering Attachment 2 Binding Price schedule, will BIA please confirm travel is to be considered an ODC and negotiated at the task order level?
Please see solicitation L.9.1.1.5 Section 5. L.9.1.1.5.1 states that the prices and rates included in the binding price schedule are to be fully burdened with all markups other than travel, profit, and taxes. L.9.1.1.5.4 discusses travel pricing, which should be proposed at the task order level and must be consistent with Federal Travel Regulations (FTR) as described in the Code of Federal Regulations Title 41. ODCs will be negotiated during task order negotiations. The government will NOT accept subcontractor prices or subcontractor management as ODCs. Any markups related to subcontracting must be included in binding prices.
6 Can BIA please clarify which labor categories on Bid Sheet would be used to price scope items 3.1.8 – 3.1.14 at task orders level.
The three binding labor rates at the IDIQ level are meant to bind negotiations related to tasks that have not otherwise been priced at the IDIQ level. It is anticipated that many or most tasks in the IDIQ SOW will be priced by service, for example, the sampling plan referenced in 3.1.8 will be priced using Item 5 Sampling Plan, not using a binding labor rate.
7 L.9 Factor 4 Price. Are project overhead costs such as project manager, health and safety and quality control to be included in the unit rates provided in Attachment 2 IDIQ Binding Price Schedule or are they to be negotiated for each task order? If these costs are to be negotiated for each task order, where should they be included in the seed task order specifically during Phase 2?
Please see solicitation L.9.1.1.5 Section 5. L.9.1.1.5.1 states that binding rates should include all prime and subcontractor personnel. These rates must include all markups other than travel, profit, taxes, and ODCs. This includes any required project manager, health and safety and quality control personnel. In the seed task order price proposal, these costs should be including in the rates for Phase 1 and Phase 2, as needed.
8 Can BIA please clarify/provide anticipated percentage of SOW scope split between scope items identified in Attachment 2 Binding Price Schedule (Attachment 1 IDIQ SOW 3.1.1 - 3.1.3) and remediation activities that are identified in SOW ( Attachment 1 IDIQ SOW 3.1.4-3.1.14)?
As stated in the IDIQ SOW, page 1, Paragraph 3.1, "the first three services in the list of services below are expected to make up a large portion of task orders." The services identified in IDIQ SOW 3.1.4-3.1.14 are therefore anticipated to be solicited less often or in lesser quantity, however the Government reserves the right to solicit for these services to the extent neccesary to meet its needs, which may be emergent or unanticipated at this time. The items in the Binding Price Schedule are anticipated to represent a signficant portion of work under this IDIQ.
Seed Task Order Pricing and Scope
9 Regarding completion of Attachment 12 SEED TO Price Schedule, is it BIA's intention that the responding contractor build travel and other direct costs into our square foot price? If we leave travel costs out of the response, can BIA confirm travel costs be considered at the award of TO?
The proposed price for Seed TO Phase 1 must include all costs for Phase 1, including any neccesary travel. The proposed price for Seed TO Phase 2 only includes binding unit prices for certain elements of the Phase 2 price. As stated in the Seed TO SOW, page 2, 2.0 Project Scope, Phase 2, after the satisfactory completion and acceptance of deliverables in Phase 1, the Contracting Officer will request a proposal from the Contractor to implement the mitigation work plan and radon mitigation system installation. This Phase 2 proposal, submitted after the completion of Phase 1, will result in negotiations and a modification to adjust Phase 2 pricing. It is anticipated that, in addition to adjusting Phase 2 quantities, 10 Section 4.1 of the Seed Project states “examine all areas of the building interior for signs of: mold particulate – and evaluate their potential causes, ACM and lead. Include all interior areas and crawls spaces ”. Please confirm all assessments are limited to building interiors and not just mold.
Building exteriors (windows, siding, doors, soffits) are also required to be tested for lead. Please see the attached revised Seed TO SOW with this additional requirement in red text in paragraph 4.1.
11 Is the asbestos assessment limited to accessible materials or should the contractor inspect wall cavities, and other generally inaccessible areas for hidden materials including pipe and HVAC insulation?
There is no requirement to inspect/remediate asbestos from wall cavities or other inaccessible areas. Inaccessibility is defined as having to cut sheetrock or use other invasive means, remove built in countertops, tubs, etc. to gain access. However, crawlspaces, attics, mechanical rooms, or other areas that can be accessed without cutting into walls or removing or destroying appurtenances should be assesed in Phase 1 and remediated during Phase 2 to ensure that tenants, maintenance personnel, contractors or others do not inadvertently come into contact with these materials. Please note that asbestos assessment of inaccessible materials may be needed for other task orders under this IDIQ. Limited destructive sampling techniques will be stated in task order statements of work when required.
Page Counts 12 L.6 – Request cover letter, table of contents, and cover pages be excluded from the volume page count.
Cover letter, table of contents, and cover pages may be excluded from the page count. However, these proposal elements must not include novel or unique information. That is, in evaluating factors, the Government will not evaluate information that is solely found in these administrative pages.
13 L-6 – Factor 2 is allocated 10 pages however it is unclear what these pages are to be used for. If the offeror submits federal projects with CPARs than the 10 pages will not be consumed the total page count providing the limited data requested. Non-government projects require submission of PPQs which are exempt from the page count. May offerors use any remaining page count to provide additional detail on past performance in narrative form?
Factor 2 proposals should include the information listed in L.7.2. Information provided allowing the Government to retrieve CPARS information will count toward the page count. Offerors may also provide a narrative providing context for the CPARS or PPQs. Offerors are not required to use all 10 pages allocated to this factor.
Other 14 L.7, Factor 1 – In addition to the 3-5 project descriptions requested in L.7.1.1 will the government review and evaluate a written narrative describing our team and providing additional information our breadth of services/capability? This information would be in addition to the project experience provided in the 3-5 project descriptions. This narrative will be included in the Factor 1 page limit of 10 pages.
The offeror may include information in narrative format within each project description that provides context for the projects presented. For example, the offeror might state within the project description for a specific project the reason a subcontractor project has been submitted, and that subcontractor's anticipated role on task orders. Factor 1 will be evaluated in accordance with M.3.1.
