About this file
Living Wage Affidavit Summary
This file is a Maryland Living Wage Affidavit form required for state and local contract opportunities in Maryland. The document serves as an official declaration by contractors regarding their compliance status with Maryland's Living Wage Law under Title 18, State Finance and Procurement Article, Annotated Code of Maryland. The affidavit is effective as of July 2024 and must be submitted with all bids and proposals.
Contractors must indicate their status under one of three categories: exemption from living wage requirements, compliance as a living wage contract, or confirmation of no covered employees. Exemptions are available for nonprofit organizations, public service companies, contractors employing 10 or fewer employees with proposed contract values under $500,000, or contractors employing more than 10 employees with proposed contract values under $100,000. Contractors subject to living wage requirements must commit to paying covered employees at least the established living wage rate for hours spent on state contract activities and ensure subcontractors comply with the same requirements, including automatic adjustments to wage rates as established by the Commissioner of Labor and Industry. Contractors with no covered employees must certify their workers will spend less than half their time on the contract, are 17 years of age or younger, or will work less than 13 consecutive weeks on the state contract. The form requires completion by an authorized representative, including company information, signature, witness attestation, and submission with the bid or proposal.
