About this file

This file is Appendix 4 of the Local Agency Program (LAP) Appendices A and E for the Fort King Road from Hester to North of Coleman Avenue Sidewalk project in Pasco County, Florida. The document outlines nondiscrimination and compliance requirements applicable to the prime contractor and all subcontractors involved in the construction project. The appendix incorporates by reference Title 49, Code of Federal Regulations, Part 21, establishing the contractor's obligations regarding federally-assisted programs administered by the U.S. Department of Transportation. The contractor must comply with all applicable nondiscrimination regulations and ensure that subcontractors, material suppliers, and equipment lessors receive notification of these requirements during all solicitations for work performed under the contract.

The document mandates contractor compliance with multiple federal statutes and executive orders prohibiting discrimination based on race, color, national origin, sex, age, disability, religion, family status, and limited English proficiency. The contractor must provide all information and reports required by the Florida Department of Transportation and federal agencies, including the Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, and Federal Motor Carrier Safety Administration, and must permit access to books, records, accounts, and facilities for compliance verification. Noncompliance sanctions include withholding of payments, contract cancellation, termination, or suspension. The contractor is required to incorporate all nondiscrimination provisions into every subcontract and procurement unless exempt by regulation, and may request the Florida Department of Transportation or the United States to defend the agency's interests in any litigation arising from enforcement of these provisions.
