SUMMARY OF CHANGES

A. Replace Attachment 5.2 – Seed Updated Project Schedule with the attached Updated Seed Project Schedule.
B. Answers to the following questions are as follows:
Q1. Is the firm required to hold active licenses in each state at the time of submission, or can licensure be obtained at a later stage in the process?
Response: State licenses are not required at the time of proposal submission for the base MATOC.
Licensing requirements will be identified in individual task orders. If a task order does not specify, it is the contractor’s responsibility to ensure compliance with any state licensing requirements based on the location and scope of work.
Q2. The updated price schedule provided with Amendment 000004 removed the "Extended Price" column which was in the original price schedule. Do you want us to provide unit prices only? for example, for item "DEMO AND INSTALL DOORS ONLY", it shows Quantity of 46, shall we provide a unit price only?
Response: See updated Attachment 5.2 included with this Amendment.
Q3. Please confirm that the Davis Bacon Wage Determination for the seed project is the most current wage determination as it is dated January 2025.
Response: The Dept of Labor has not updated the wage determination for Oglala Lakota County (Building) SD20250017, since January 2, 2025. The existing wage determination is considered current.
Q4. Where the SOW indicates “or equivalent,” is product data required to be approved before the bid date?
Response: No, the government will not review product data prior to task order award. Add the following clause to Section H:
H.56. Submittals of “Or Equal” and Alternative Products
(a) “Or Equal” Products. In accordance with FAR 52.236‐5, Material and Workmanship, any brand name references in project specifications are intended to establish the required standard of quality, appearance, and function. Unless specified otherwise, all brand name references in any specification issued under this MATOC are considered ‘or equal’ products. Offerors are advised that requests for review or approval of “or equal” products will not be considered during the solicitation phase. Submittals of “or equal” products may be submitted as Requests for Information (RFI) and will only be reviewed after award of the task order.
(b) Alternative Products or Materials. Requests for products or materials that deviate from the stated specifications and are not covered under the “or equal” provision are considered alternatives. Such requests will not be reviewed or approved during the solicitation phase. Following award of the task order, the contractor may submit RFIs to request approval of alternative products or materials. If accepted, such approvals will be processed via a contract modification.
