We are respectfully requesting a bid due date extension of 2 weeks due to the lost time over the holidays. This will allow us and our team to provide the best proposal possible.

At this time the Government does not intend on extending the proposal due date.

In regards to the technical proposal (7) Bridge construction of a vehicular bridge 100‐feet or longer, is it acceptable to use a bridge that has a total structure length of over 100 feet with tie backs or wing walls etc. or does the span have to be 100‐feet or longer?

Regarding Factor 3, Past Performance, does

Will the President's Executive Order (14063) ‐

Use of Project Labor Agreements for Federal

Construction Projects, for projects larger than

$35M be enforced for task orders that meet this criteria? Enforcing this requirement will limit the amount of Contractors that submit on this solicitation.

Federal Acquisition Circular (FAC) 2024‐02 was published in the Federal Register

December 22, 2023 implementing

Executive Order 14063 with an effective date of Jan 22, 2024. It is anticipated the use of project labor agreements for certain federal construction projects may be required at the task order level for projects solicited during the period of performance of this Multiple Award Task Order Contract

(MATOC). If applicable, this requirement will be stated in each subsequent Task

Order. A summary of the final rule can be found at the following link:

https://www.federalregister.gov/documen ts/2023/12/22/2023‐27736/federal‐ acquisition‐regulation‐use‐of‐project‐labor‐ agreements‐for‐federal‐construction‐ projects. Offerors are advised to review solicitations for project specific requirements.

Check General or Technical

5 X

The requirements on the Recent and Relevant

Experience Forms that the projects are in the last 5 years and needing to be able to check at least 4 boxes make this a challenging requirement to meet, so we are requesting one of the following changes:

1. Allow projects to have been completed in the last 10 years (instead of 5 years);

2. Reduce the amount of boxes that need to be checked to two as long as all 7 requirements are met across the projects submitted; or

3. Not require that all 7 boxes need to be satisfied if the Contractor can show ample relevant experience.

The Government does not intend to adjust the recent and relevant work experience requirements.

It was the predecessor to DUNS, now UEI, and stood for Contractor Establishment

Code. Came out in 1998. Nothing related to our YELL MATOC solicitation.

In Amendment A004, form J.4 Past

Performance Form 2 is called out as an attachment but the form is not included in the

Attachments/Links portion of the contract advertisement page. Will this form be included on the advertisement page or is it available for download from another site?

J.4 Past Performance Form 2 was added under Amendment A001 and not revised under Amendment A004. For administrative convenience, in addition to already being included under Amendment

A001, this form will also be uploaded separately as an attachment on SAM.gov.

1/16/2024

15 X

I see that addendum #4 posted with a change to 3500 minimum tons required to meet the paving criteria. The new J2 form that was posted as a part of addendum 4 says 4000 tons.

I just wanted to point out the discrepancy.

The new J2 form that was uploaded for administrative convenience has been updated to match the form that was revised and included under Amendment

A004.

16 X

It appears amendment 5 to this solicitation added the following two FAR clauses:

52.222‐34 Project Labor Agreement (Jan 2024)

Alternate II JAN 2024

52.222‐33 Notice of Requirement for Project

Labor Agreement (Jan 2024) Alternate III JAN

Is it the intent of FHWA to include these FAR

Clauses in all of the bid task orders under this upcoming MATOC?

These will be included at the task order level when the threshold of large‐scale construction project is met.

1/25/2024

17 X

Could FHWA distinguish the difference between the two added FAR clauses as they read differently, however, both are added in amendment.

52.222‐33 Notice of Requirement for

Project Labor Agreement, is a provision applicable during solicitations. 52.222‐34

Project Labor Agreement, is a clause applicable after award.

1/25/2024

18 X

Would FHWA be able to provide insight/information as to who the senior procurement officer will be on this MATOC for exceptions to be granted to FAR 52.222‐34

Project Labor Agreements.

See FAR 22.504. Exceptions to Project

Labor Agreements may be granted by an agencies Senior Procurement Executive

(SPE). Requesting exceptions to this requirement is a Government function, so all requests or recommendations for exceptions to this requirement should be submitted through the appropriate

Contracting Officer.
