About this file
This file is a VA contract clause (852.219-75) that establishes limitations on subcontracting for Service-Disabled Veteran-Owned Small Business (SDVOSB) and Veteran-Owned Small Business (VOSB) contracts awarded by the Department of Veterans Affairs.
The clause requires offerors to certify compliance with subcontracting limitations based on the contract type. For services contracts (except construction), contractors may not pay more than 50% of government payments to non-SDVOSB/VOSB firms, with any further subcontracting by similarly situated subcontractors counting toward this threshold. For general construction contracts, the limit is 85% to non-certified firms, with material costs excluded. For special trade construction contracts, the limit is 75% to non-certified firms, also excluding material costs. The clause mandates that offerors acknowledge the certification is subject to Title 18, United States Code, Section 1001, exposing false certifications to criminal, civil, or administrative penalties. Offerors must cooperate with VA audits and provide documentation such as invoices, subcontracts, or task valuations to demonstrate compliance. The complete clause, including the executed certification with signee name, title, signature, and date, must be returned with the bid, quotation, or proposal. The Government cannot award a contract without this completed and executed clause. Non-compliant SDVOSBs/VOSBs may face referral to the VA Suspension and Debarment Committee, fines under the Small Business Act, or prosecution.
