Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: VA-22-00070555
1. Contracting Activity: Department of Veterans Affairs, VISN 10, John D. Dingell Medical Center 2237:
553-23-1-3508-0003.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Scope of Work Statement: Work includes general construction, demolition, and new construction for the Replace Parking Structure Elevators, Project # 553-19-101.
As part of the scope of work, VA Engineering requires Hilti firestopping (FS1) brand for the project.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Hilti firestopping (FS1) is the building standard within the entire Hospital. Hilti firestopping was used to complete the original construction in 1996. For over 16 years the standard for the building has been the Hilti brand. There are other brands of firestopping, but it is not as recognizable as Hilti. We require Hilti firestopping.
4. Description of market research conducted and results or statement why it was not conducted: The Hilti firestopping is recognizable by its red color. Other brands come in different colors. The different products cannot be mixed together in one application. Each brand has been tested separately by U.L.
Mixing of two products would not result in an approved fire rating. Also, during inspections, the inspectors question the integrity of other colors. The staff has been trained to apply the correct amounts of Hilti firestopping to meet regulations. They have not been trained on other products.
Therefore, it is essential to the Government’s requirements to only allow the provision of Hilti firestopping, thereby precluding consideration of a product manufactured by another company.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
