1. Introduction
In accordance with our proposal dated September 21, 2010, the CONXSIS Group, Inc. (CONXSIS) performed an asbestos visual assessment at selected locations of Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas. The assessment occurred on October 14, 2010. No representatives of the client were present during the assessment on October 14, 2010.
The 76,561 square feet building was identified to have been constructed in 1996. A total of 87 samples were collected from the building during this assessment on October 14, 2010.
The objective of the Asbestos Survey is to determine the location and quantity of asbestos-containing materials (ACM) at the Project building and to provide budget estimates for asbestos abatement activities to address the ACM at the below mention building:
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas
CONXSIS’ Scope of Work included:
Reviewed existing asbestos survey conducted by Micro Air of Texas, Inc., dated June 14, 2010.
Field verified the location of ACMs identified in Micro Air of Texas, Inc. survey.
Collected additional samples as necessary for demolition-specific survey data and specifications.
Estimated approximate quantities and general locations of ACM.
Assessed the condition of the ACM identified.
Assigned a hazard rating to each type of ACM.
This report has been prepared for the use of Page Southerland Page, LLP. Our investigation was performed using the degree of care and skill ordinarily exercised under similar circumstances by professional consultants practicing in this or similar localities. No other warranty or guarantee, expressed or implied, is made as to the conclusions included in this report.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 2 OF 22
CONXSIS did not perform destructive sampling procedures at the site; therefore, regardless of the thoroughness of this survey, it is possible that suspected asbestos-containing materials (ACMs) might exist in the building beneath the floors, behind walls, within pipe chases, or in other inaccessible locations. If, during renovation or demolition activities, materials not addressed in this survey are discovered, these materials should be sampled and analyzed for asbestos content prior to disturbance.

2. Summary
CONXSIS performed an Asbestos Survey and Hazard Assessment at Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas on October 14, 2010. The following report summarizes the independent conclusions representing CONXSIS’ best professional judgment based on information and data available to us during the course of this survey. Factual information regarding operations, conditions, and tests data provided by the Client, Owner or their representative has been assumed to be correct and complete. Additionally, the conclusions presented are based on the conditions that existed on the date (October 14, 2010) of the assessment.
The 76,561 square feet building was identified to have been constructed in 1996. A total of 87 samples were collected from the building during this assessment on October 14, 2010.
2.1. Asbestos-Containing Material Listing
No homogeneous materials were identified as asbestos-containing material during the CONXSIS Asbestos Survey on October 14, 2010. In addition, review of the existing asbestos survey conducted by Micro Air of Texas, Inc. dated June 14, 2010 identified no homogeneous material of asbestos-containing materials.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 4 OF 22
2.2. Suspect ACMs
Although not included in CONXSIS’ scope of work, the following is included for informational purposes:
A. The following suspect asbestos-containing materials were not sampled as part of this scope of work:
Suspect fibrous electrical cable covering was not sampled due to the danger of possible electrocution.
Since ordinary demolition activities do not include sanding, grinding, cutting, and abrading, these materials may remain in place during building demolition as long as they remain in good condition and are not friable.
If the material is in poor condition and is friable at the time of demolition or renovation, or if it will be subjected to sanding, grinding, cutting, or abrading, it should first be removed by a licensed asbestos removal contractor and disposed of as asbestos-containing waste.
When removing asphalt-roofing products, the material should be removed using a method that does not subject the material to sanding, cutting, grinding, or abrading (hand tools). Asbestos-containing roofing may be disposed of as construction debris.
2.3. Recommendations
No further action is needed at this time.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 5 OF 22
3. Survey Scope of Work
This survey was conducted for the purpose of identifying asbestos-containing materials (ACM) throughout the building and to conduct a hazard assessment on existing ACM. The survey was non-destructive in nature and limited only to those areas that were readily accessible.
Specific areas to which access was limited by tenant request, unavailability of keys, or by site conditions included the following:
Behind the walls
Beneath the floors
Any suspect ACM not sampled as part of the assessment and any additional suspect materials identified behind walls and beneath the floors should be sampled prior to repair, renovation, or demolition activities.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 6 OF 22
4. Assumptions
The report was prepared based on the following assumptions:
Our on-site inspection only included areas readily accessible and viewable and did not include any destructive inspection actions such as demolition of walls and floors.
Our ACM quantification process was based on the assumptions identified above.
Our asbestos abatement budget estimate of probable costs is based on standard industry rates for work of a similar nature. Actual asbestos abatement costs can only be determined by a bid or negotiation process with duly licensed asbestos abatement contractor(s) which includes project-specific specifications and a definitive scope of work prepared by a duly licensed asbestos professional.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 7 OF 22
5. Limitations
CONXSIS did not attempt to disassemble mechanical equipment, open pipe chases, or access materials within wall voids. Regardless of the thoroughness of a survey, the possibility exists that some areas containing asbestos were not identified, were inaccessible, or were different from those at the specific locations surveyed. The findings and opinions presented are relative to the dates of our site work and should not be relied upon to represent conditions at substantially later dates. Changes in the condition of ACM may change over time due to renovations and/or repairs.
This report is for the exclusive use of the Client and its agents and use by any unauthorized parties in whole or in part, except as directed by legal jurisdiction, is at the sole risk of the user. If this assessment includes reliance on work products and/or documents prepared by others, CONXSIS has no responsibility for the accuracy of information contained therein.
Although this assessment has attempted to identify the presence or absence of ACM, potential sources of ACM may have escaped detection due to: (1) the scope of this assessment, (2) the inaccuracy of records, interviews, work products or documents made available to CONXSIS for this report, (3) the presence of undetected or unreported renovations and repairs, (4) inaccessible areas, and/or (5) deliberate concealment of detrimental information.
Estimates presented in this report are based upon observations during the survey and owner-provided information. These reasonable estimates may be affected by unanticipated conditions potentially present in inaccessible or un-surveyed areas. CONXSIS does not warrant or guarantee the quantity estimates. The use of such estimates shall be at the user's own risk and shall constitute a release and agreement to defend and indemnify CONXSIS from and against any liability. If questions arise during the planning for renovation, demolition, or other construction activities, CONXSIS should be notified to permit review of the data and present recommendations.
Interior of the following rooms were inaccessible during our Asbestos Survey on October 14, 2010: None.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 8 OF 22
6. Applicable Regulatory Standards
The following regulatory standards and specific asbestos-related statutes/protocols were applied by CONXSIS and its contract laboratory during the performance of field efforts related to this study, analytical review of resulting bulk samples, and reduction of observations and data into this report.
29 CFR 1910.1101 (formerly 1926.58) - Construction Industry
This regulation addresses asbestos exposure during construction and renovation activity and sets forth standards which employers must follow in protecting and documenting the protection of workers. The current survey was based on the Final Rules for Asbestos Exposure in General Industry and Construction, issued August 10, 1996, and effective October 1, 1995.
An employer or owner may demonstrate that PACM (includes thermal system insulation, sprayed-on or troweled-on surfacing material, and debris in work areas where such material is present) does or does not contain asbestos by having conducted an inspection pursuant to requirements of the Asbestos Hazard Emergency Response Act (AHERA), 40 CFR 763, Subpart E, to be discussed below. Material testing is to include analysis of a minimum of at least three bulk samples of each homogeneous area of PACM collected in a randomly distributed manner. The tests, evaluation and sample collection are to be performed by an accredited/licensed inspector or by a CIH. The employer/building owner may demonstrate that a non-PACM material such as flooring material, including associated mastic and backing, does not contain asbestos based upon recognized analytical techniques. The material sampled may be designated as "asbestos free" if such material does not contain greater than 1% asbestos.
29 CFR 1910.134 - Respirator Program
This regulation outlines rules for respiratory protection in a specific work environment. A respirator program must be put into place when asbestos is disturbed (i.e. during the performance of response actions), and as necessitated by OSHA in the designation of a “regulated area" during the performance of Class I, II, or III work. A respirator program must be put into place with the implementation of an Operations and Maintenance (O&M) Program for the safe management of asbestos-containing material (ACM) in place.
29 CFR 1910.1001 - General Industry
This regulation addresses potential asbestos exposure involving general industry applications other than construction and renovation workers. This standard establishes minimum standards for the protection of workers involved in asbestos-related work or employees exposed to asbestos-contaminated places.
These standards include required work practices, engineering controls, permissible exposure limits, written programs for respiratory protection and medical surveillance, methods for compliance, hazard communication, housekeeping, competent person training and responsibilities, and required record keeping.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 9 OF 22
40 CFR 763, Subpart E - Asbestos in Schools / Commercial Buildings
In October, 1986, AHERA was signed into law. Included in this law were specific provisions directing the USEPA to establish regulations and address standards for identifying, evaluating and controlling asbestos materials in schools (40 CFR, Part 763 Subpart E). This rule requires that all nonprofit elementary and secondary schools, both public and private, inspect their school buildings for asbestos-containing building materials (ACBM), develop a plan to manage the asbestos for each school building, notify parents and staff regarding management plan availability, provide asbestos awareness training to school maintenance and custodial workers among other requirements of the law. AHERA required schools to perform building inspections and prepare management plans for asbestos-containing building materials (ACBM). Later, in 1995, OSHA adopted AHERA inspection protocols and procedures for use in public buildings (per 29 CFR 1910.1101). These protocols are used as the framework for OSHA inspections and inspection procedures utilized for this assessment.
40 CFR 61, Subpart M National Emissions Standards for Hazardous Air Pollutants (NESHAP)
This regulation provides for the control of environmental releases of asbestos caused by renovation and/or renovation activities. These regulations specify control requirements for most asbestos emissions and include work practices being followed to minimize the release of asbestos fibers during handling, removal and disposal of asbestos waste materials. NESHAP regulations are frequently enforced by a State or local agency. The NESHAP Standard requires:
No discharge of visible emissions to the outside air during the collection processing, packaging, or transporting of any asbestos-containing waste material;
Adequate wetting of asbestos-containing material; and
Processing of asbestos-containing waste material into non-friable forms.
25 TAC §295, Texas Asbestos Health Protection Rules
The State of Texas adopted rules (statutes) governing asbestos maintenance, removal and/or any related asbestos response action involving PACM or ACM. These rules, the Texas Asbestos Health Protection Rules (TAHPR), also include licensing requirements for individuals, consultants, abatement firms and building owners when asbestos is present, and/or when testing is performed to locate such material.
Rules were issued under 25 TAC 295.71. Every aspect of asbestos management from inspection to removal, and maintenance in place, is to be performed by a licensed individual trained in accordance with TAHPR requirements.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 10 OF 22
Beginning January 1, 2002, Texas Senate Bill 509, formally codified under 25 TAC 295.34 (l), required municipalities to verify that an asbestos survey has been conducted prior to issuing renovation/demolition permits for the interiors of public or commercial buildings. Such surveys must comply with state and federal laws governing asbestos surveys, must incorporate the areas of the building where renovation or demolition will occur, and must accurately describe the building materials where the renovation/demolition will take place.
In accordance with 25 TAC 295.34 (i), contractor installation of asbestos-containing products (unless there is no alternative building material) was prohibited. Additionally, contractors are required to have material safety data sheets (MSDS’s) for all newly installed building materials (25 TAC 295.34 (j)).
Maintaining and archiving the MSDS’s along with an architect or engineer signed statement stating the absence of ACM in new construction products will serve the purpose of a survey. This effort is intended to alleviate the need for an asbestos survey for the same areas, if they are to be renovated in the future.

7. Survey and Sample Collection Procedure
Based on United States Environmental Protection Agency (USEPA) guidance documents, CONXSIS considered that all material applications identified during the visual assessment were suspect ACM and sampled as described below.
Bulk samples were collected of any materials which were suspected of containing asbestos with the exception of fire doors. Fire doors were not sampled because the damage caused by sampling would render these materials friable and may also void the fire rating. Since these materials were not sampled, they should be assumed to be asbestos containing unless sampled and proven otherwise. Sampling of these assumed ACMs should be performed prior to any renovation or other activity that may cause a material disturbance.
Samples of the remaining suspect ACM were taken in accordance with USEPA recommendations.
The number and location of samples collected were based on the type of material, the manner of application, and the homogeneity of the ACM (similarity of color, texture, and type). Each sample was collected and placed into an individual sample container. The sample location was noted on the field survey form and assigned an individual identification number. This number was affixed to the sample container as the sample was collected. The survey form was also used to note the material type and general condition of the material. During the inspection, each suspect material's accessibility, location, and friability were recorded. This information was used to assess the potential hazard of the ACM and to prioritize response action recommendations.
The USEPA defines asbestos-containing materials (ACM) as those that contain greater than one percent asbestos. Friable materials are defined as those that can be crumbled or reduced to powder by hand pressure.
CONXSIS utilized the “positive-stop” method of sample analysis. In this method, analysis is stopped on a group of samples once the first positive (e.g., greater than 1% asbestos) sample is analyzed.
According to the USEPA, if one sample of a homogenous material is identified to be asbestos containing, the entire material must be considered asbestos containing. By using the positive-stop method, CONXSIS reduces the Client’s laboratory analysis cost by not analyzing the additional samples.
Samples collected were carried and submitted under Chain-of-Custody to Steve Moody Micro Services, Inc., Farmers Branch, Texas for analysis of asbestos using USEPA Method 40 CFR, Chapter 1, Part 763, Subpart F, Appendix A, also known as Polarized Light Microscopy (PLM). Steve Moody Micro Services, Inc. is certified by the National Voluntary Laboratory Accreditation Program (NVLAP) and licensed by the Texas Department of State Health Services.

8. Previous Survey / Plans Review
CONXSIS was provided with an existing asbestos survey conducted by Micro Air of Texas, Inc. dated June 14, 2010. Review of the Micro Air of Texas, Inc. asbestos survey identified the following information:
Micro Air performed a comprehensive asbestos survey of Building 74 on June 14, 2010.
Building 74 has a basement level with a swimming pool base, mechanical rooms, a pipe chase with a gravel floor, and a connecting corridor leading to Building 2. The first floor of the building is characterized by four wings (A-Wing, B-Wing, C-Wing and D-Wing). Improvements on the first floor include offices, a pharmacy, swimming pool, recreation center, physical therapy rooms, exam rooms and patient rooms. Building 74 does not have an attic. Finish materials inside Building 74 consist of concrete floors with vinyl floor tile, rubber flooring, sheet vinyl flooring, ceramic tile and carpeting. Walls are sheetrock with cove base; ceilings consist of several different types of lay-in tile. The exterior of the building is brick with a flat roof.
Fiberglass pipe insulation with white mastic wrap was observed throughout the building. Gray mastic is present on some of the metal HVAC ducts. Vibration dampeners were rubber.
A total of 125 bulk material samples were collected during this comprehensive survey, and all of the collected samples were analyzed by PLM.
No asbestos-containing material was identified.

9. Suspect ACM Materials Not Sampled
During the course of the property visit, CONXSIS performed a preliminary review of interior, accessible areas of the subject building for the presence of suspect asbestos-containing materials (ACMs). This limited asbestos survey was conducted for overview purposes only. Additional suspect materials may exist in concealed locations (behind walls and above ceilings, beneath the floors, within machinery, etc.). Also, not all suspect materials may have been sampled due to the condition or the location of the suspect materials. Destructive sampling of suspect ACMs was not performed. Suspect ACMs in an overall undamaged condition were not sampled, as that will damage the materials. CONXSIS will not be responsible for damaging materials or causing the materials to become friable. The USEPA defines asbestos-containing material as material containing greater than one percent asbestos. This review was not a pre-demolition/renovation survey or for regulatory submittal purposes.
No other suspect and/or presumed ACMs were observed within the subject building during the property visit.
Building 74, Spinal Cord Injury Building, VA Medical Center, Dallas, Texas PAGE 14 OF 22
10. Survey Sampling Results
The results of the Survey are presented in the tables on the following pages. The tables describe the entire suspect Asbestos-Containing Materials (ACMs) identified in the building and list respective sample numbers and laboratory results. Sample numbers presented in the tables correspond to the sample numbers on attached Laboratory Analysis Forms. Also presented in the tables is the estimated quantity and assessed friability for each suspect ACM. For each suspect material identified as ACM, the assessed hazard potential is presented along with CONXSIS’ recommended response action. Hazard potential for each material application is based on the material condition and accessibility to the public and maintenance personnel.
