Supplemental Qualifications of Bidders

The Bidder/Contractor shall identify a minimum of five (5) completed projects demonstrating experience relevant to the size, scope, complexity, and operational requirements of the Project. At least three (3) of the five (5) submitted projects must satisfy all the minimum qualifying project requirements below. At least two (2) of the three (3) qualifying projects must have been completed within the four (4) years preceding the solicitation due date. All three (3) qualifying projects must have been completed within the ten (10) years preceding the solicitation due date.

1) Minimum Bidder/Contractor Experience Requirements

a) For purposes of satisfying the minimum experience requirements, experience must be demonstrated by the Bidder/Contractor as a business entity and may not be established solely through the individual experience of an owner, officer, employee, principal, consultant, or proposed project team member.

b) The Bidder/Contractor shall demonstrate:

i) A minimum of ten (10) years of experience as a business entity engaged in the construction industry; and

ii) A minimum of ten (10) years of experience as a business entity providing construction services relevant to parks and recreation facilities; and

iii) The licenses, registrations, and qualifications required by applicable federal, state, and local law to perform the Work.

c) Experience obtained by an individual while employed by, associated with, or operating under a different legal entity, business name, or license shall not be counted as experience of the Bidder/Contractor unless the Bidder/Contractor demonstrates continuity of the business entity or successor entity as provided below:

i) Business Name, Ownership, and Organizational Continuity

(1) A Bidder/Contractor that has changed its legal name, ownership, corporate structure, organizational form, or applicable license may rely upon experience obtained before such change only if the Bidder/Contractor provides sufficient documentation to establish the continuity of the business operations and the relationship between the prior and current entity.

(2) The Bidder/Contractor shall identify any merger, acquisition, reorganization, name change, change in ownership, or other material change in organizational structure that is relevant to the experience being claimed and shall provide the effective date and supporting documentation upon request.

(3) Experience attributable solely to an individual or to a separate legal entity shall not be aggregated with the Bidder/Contractor's experience to satisfy the minimum experience requirements.

2) Qualifying Project Experience

a) The Bidder/Contractor shall identify a minimum of five (5) completed projects demonstrating experience relevant to the size, scope, complexity, and operational requirements of the Project.

b) At least three (3) of the five (5) submitted projects must satisfy all the minimum qualifying project requirements below. At least two (2) of the three (3) qualifying projects must have been completed within the four (4) years preceding the solicitation due date. All three (3) qualifying projects must have been completed within the ten (10) years preceding the solicitation due date.

c) Each qualifying project shall meet the following requirements:

i) Contract Value. The project shall have had a completed contract value of not less than One Million Dollars ($1,000,000).

ii) Relevant Scope. The project shall include work of similar type, size, scope, and complexity to the Project. Collectively, the qualifying projects shall demonstrate substantial experience with the principal components of the Project, including, as applicable:

(1) parks and recreation facilities;

(2) athletic or sports fields;

(3) artificial turf play fields;

(4) sports field equipment;

(5) stormwater management and infrastructure;

(6) stormwater retaining structures;

(7) piping systems;

(8) new building construction and/or renovation of existing facilities;

At least one (1) qualifying project shall demonstrate experience performing construction, renovation, rehabilitation, or improvements at an operating facility while maintaining the facility's operations and minimizing unreasonable disruption to users and facility operations.

iv) Schedule Performance. The project shall have been completed within the original or subsequently authorized contract schedule. Documented schedule extensions attributable to owner-directed changes, differing site conditions, permitting, force majeure, or other circumstances not caused by the Contractor shall not disqualify an otherwise qualifying project.

v) Contract Performance. The project shall have been completed within the final authorized contract amount, excluding owner-directed changes and other documented changes beyond the Contractor's control. The Bidder/Contractor shall identify material change orders, claims, or disputes associated with each qualifying project.

vi) Contractor Role. The Bidder/Contractor shall have served as the prime/General Contractor or in another role expressly permitted by this solicitation. Experience obtained solely as a subcontractor shall not satisfy the General Contractor experience requirement unless expressly identified as acceptable for the particular scope.

(1) A single project may be used to satisfy multiple experience criteria, provided the project independently satisfies each applicable criterion.

vii) Project References. For each of the five (5) projects submitted, the Bidder/Contractor shall provide sufficient information for the County to verify the project and the Bidder/Contractor's performance, including:

(1) Project name and location;

(9) Identification of any material claims, disputes, defaults, or terminations involving the project; and

(10) Any additional information specifically requested in the solicitation. The County reserves the right to contact the identified references and independently verify information submitted by the Bidder/Contractor. Failure to provide the required project information or sufficient information to independently verify the minimum qualifying experience may result in the project not being counted as a qualifying project.

viii) Key Personnel Experience The Bidder/Contractor shall identify the proposed Project Manager, Superintendent, and other key personnel identified in the solicitation and provide their relevant experience on projects of similar type, size, and complexity. Experience of proposed personnel may be considered as supplemental evidence of the Bidder/Contractor's ability to perform the Work; however, individual personnel experience shall not be substituted for or aggregated with the Bidder/Contractor's experience to satisfy the minimum firm experience requirements, unless expressly provided otherwise in this solicitation.

ix) Subcontractor Qualifications:

(1) The Bidder/Contractor shall be responsible for ensuring that subcontractors performing major or specialized portions of the Work possess the experience, licenses, certifications, and qualifications required for their respective trades.

(2) For critical or specialized trades identified in the solicitation, the proposed subcontractor shall demonstrate relevant experience performing work of similar type, size, and complexity.

(3) Subcontractor experience shall not be used to satisfy a minimum experience requirement expressly applicable to the General Contractor or Bidder/Contractor unless specifically permitted by this solicitation.

(4) The County may require documentation demonstrating the qualifications and experience of proposed subcontractors for critical portions of the Work.

x) Verification and Responsibility:

(1) The Bidder/Contractor shall be responsible for providing complete and accurate information sufficient for the County to determine whether the Bidder/Contractor satisfies the minimum qualifications established by this solicitation.

(2) The County may verify any information submitted by a Bidder/Contractor, including project history, contract values, schedules, scope of work, references, licenses, and the Bidder/Contractor's relationship to any predecessor, successor, affiliated, or otherwise related business entity.

(3) Failure to provide sufficient information to establish compliance with a stated minimum qualification may result in the Bidder/Contractor's submission being determined in accordance with the applicable provisions of the County's procurement policies and the terms of the solicitation.
