About this file
This is an Insurance and Indemnification Memo for RFP 250257 - Towing and Recovery Services submitted to the Orange County Transportation Authority (OCTA) for review and approval. The memo documents email correspondence between Trevor Worthy, Senior Contract Administrator at OCTA's Contracts Administration and Materials Management department, and Edwin Byrne regarding insurance and indemnification requirements for the towing and recovery services contract. The RFP is for a three-year term with a total budget of $435,000. While the specific response deadline, site visit details, and award date are not referenced in this memo, the correspondence demonstrates the internal review process occurring in March 2026 for contract finalization.
The memo addresses insurance coverage requirements for the contractor, with Edwin Byrne recommending specific liability limits based on the risk profile of towing and recovery services. The recommended insurance requirements include Commercial General Liability of $2,000,000 per occurrence/$4,000,000 aggregate, Auto Liability of $2,000,000, Pollution Liability of $2,000,000 per occurrence/$4,000,000 aggregate, and Garagekeepers Liability Insurance of $2,000,000 per occurrence. Byrne confirmed approval of these finalized insurance and indemnification terms on March 10, 2026. The correspondence clarifies that Garagekeepers Liability is a separate insurance requirement distinct from Employers' Liability and Professional Liability categories within the contract's insurance section (Article 9).

Thanks Edwin.
For clarification, is Garagekeepers Liability item 5 under Article 9?

Hi:
Given the risk associated with this service, I would recommend the following changes to limits. The rest is acceptable.
1. CGL: $2M / $4M
2. Auto: $2M
3. Pollution: $2M / $4M
4. Garagekeepers Liability: $2M
