B.F. Sisk Dam SOD Modifications, Phase I - Offeror’s Questions and Answers (Q&A) Amendment 0003
Question 1: Regarding the Proposal Instructions in Section L, under Volume 1 (Business Proposal Contents), please clarify what Proposers are required to submit in response to Item (b): Performance and Payment Bonds. Per Standard Form 1440 and consistent with FAR 52.228-15, the required Performance and Payment Bonds are to be submitted within 10 Calendar Days after award. Are Proposers to provide a letter or similar documentation from the surety(ies) confirming the intent to issue these bonds if awarded the project?
Response 1: Refer to Answer #18 in Amendment No. 0002. (None to be submitted with proposal as Performance and Payment Bonds must be furnished within 10 days of award. Removed from list of Proposal Contents in Volume I, (b) Performance and Payment Bonds).
Question 2: Regarding the Evaluation For Award in Section M, under WBR 1452.215-82, (b), it states: (b) In the evaluation of proposals, all evaluation factors (listed in this provision) other than cost or price, when combined, are considered to be significantly more important than cost or price. The relative importance to be placed on the factors in relation to each other is contained in paragraph (e) of this provision." It does not appear that a paragraph (e) of the provision is identified. Please clarify.
Response 2: Section M, WBR 1452.215-82 revised to include paragraphs (d) and (e).
Question 3: I am looking for a list of attendees from that day’s site-walk.
Response 3: Attachment "Amendment_No__0002_to_140R2021R0004_0002" posted on sam.gov on October 6, 2021, incorporates the in-person site visit sign in sheet and can be currently accessed at https://sam.gov/opp/d32219b223d140a68e2d1f1a8b3ded00/view.
Question 4: Can a copy of the in-person site visit checklist (attendees) be made available to bidders?
Response 4: Answer in Response #3.
Question 5: Please extend the Bid Due Date two weeks to allow Small Business Subcontractors time to review the plans and specifications for bidding. This time extension will increase Small Business participation for this project. A time extension would also allow Contractors more time to - perform exploration and material analysis for the various embankment zones, and incorporate Bureau of Reclamation responses to all Contractor’s questions.
Response 5: The proposal due date is extended from November 4, 2021 at 14:00 (PST) to November 19, 2021 at 14:00 (PST).
Question 6: Please extend the bidder’s inquiries deadline one week to allow further questions from Vendors, Subcontractors and all Small Businesses.
Response 6: The inquiries due date is extended from October 12, 2021 at 12:00 (PST) to October 22, 2021 at 14:00 (PST).
https://sam.gov/opp/d32219b223d140a68e2d1f1a8b3ded00/view
Question 7: The time provided to fully develop a project schedule, schedule narrative, project price, experience narrative, and coordinating responses from references along with significant subcontractor coordination and outreach is insufficient. The proposal schedule is further challenged by Covid-19 protocols. In addition, key areas of the schedule approach cannot be properly written until the schedule and price estimate is well along, further pushing out the timeline to complete a high-quality proposal. For these reasons, we respectively request a minimum four-week extension to the proposal/bid due date.
Response 7: Answer in Response #5.
Question 8: In order to provide subcontractors, suppliers, and small business concerns adequate time to review the many plan sheets and specifications and have any concerns addressed, we ask that the date for pre-bid inquiries be extended a minimum of one week to October 19.
Response 8: Answer in Response #6.
Question 9: Will the Bureau please provide word (.doc/docx) files for the forms (Attachment J2 - Subcontracting Plan, Attachment J3 - Past Performance Questionnaire, Attachment J4 - Past Performance Data Form, Attachment J7 - Offeror Responsibility Information, Section K - Representations, Certifications and Other Statements of Offerors)?
Response 9: These forms are provided only in PDF format.
Question 10: Is there a date we can setup to look at the quarry for the aggregate processing?
Response 10: Answered in Amendment No. 02 in Q&A #8. A second site visit will not be held at this time.
Some of the other areas are open to the public and all contractors are welcome to see the project from the public areas. In addition, there is video footage of the project site and it can be assessed in the recording of the September 29, 2021 virtual pre-site visit meeting through Microsoft Teams at the following link:

Question 11: Please extend the bidder’s inquiries deadline one week to allow further questions from Vendors, Subcontractors and all Small Businesses.
Response 11: Answer in Response #6.

(a) Award will be made to the responsible offeror submitting a proposal which conforms to the solicitation and is most advantageous to the Government considering the factors and any significant subfactors listed in this provision.
(b) In the evaluation of proposals, all evaluation factors (listed in this provision) other than cost or price, when combined, are considered to be significantly more important than cost or price.
The relative importance to be placed on the factors in relation to each other is contained in paragraph (e) of this provision. However, the degree of importance of cost or price may increase with the degree of non-cost or non-price equality between the proposals. If a proposal is determined by the contracting officer to be "technically unacceptable" as a result of evaluating all factors other than cost or price, the proposal may be rejected from further consideration. The contracting officer reserves the right to make award to other than the technically acceptable offeror with the lowest cost or price proposal if it is determined that the technical benefits of another offeror's proposal justify its higher cost or price. The contracting officer also reserves the right to make award to a lower-priced, lower-scored offeror if it is determined that the cost or price premium involved in awarding to a higher-rated, higher-priced offeror is not justified.
Since technical proposals are being solicited to obtain information to be used in the evaluation, the Government reserves the right to use information outside of the proposal to evaluate the capability of offerors and the value of offers.
(c) Pursuant to FAR 15.305(a)(1), a cost or price analysis will be performed to determine price= reasonableness and any instances of unbalanced pricing, using one or more of the techniques at=

Factor 1A is equal to 1B.
Factor 2A is equal to 2B.
Factor 1 (including subfactors) is significantly more important than Factor 2 (including subfactors)
(e) The relative importance of the factors listed in paragraph (d) of this provision is as follows:

WBR 1452.215-86 INTENT TO INCORPORATE TECHNICAL MAR 2021
PROPOSAL - BUREAU OF RECLAMATION
All or part of the successful offeror's final technical proposal may be incorporated, physically or by reference, in any contract resulting from this solicitation. Nothing contained in the successful offeror’s technical proposal shall constitute a waiver to any other requirement of the contract. In the event of any conflict between the successful offeror’s technical proposal and any other requirement of the contract, the conflict shall be resolved in accordance with the Order of Precedence clause.
The successful offeror may be asked to provide an updated technical proposal after negotiations for incorporation into the awarded contract. If after contract award, it is discovered that changes made during negotiations were not incorporated in the work requirements and/or technical proposal, such changes to the Contractor’s documents shall be considered administrative in nature and shall be made by unilateral modification to the contract, at no change in contract cost or price or other terms and conditions.
