AMENDMENT 0006

Requests for Information

1. (ProjNet Inquiry ID: 11075657) Section 31 23 00 Part 1.7.6, page 12 states "PE samples selected will target assessment of the laboratory's ability to distinguish Aroclor-1268 from similar Aroclors. PE samples obtained from EPA will be scored by EPA using their internal scoring system." Prior to July 2023, custom soil PCB PE samples which contain a mixture of Aroclors 1262 and 1268 were available from a vendor contracted by EPA's Contract Laboratory Program (CLP) to provide PE samples for Superfund sites. The vendor lost this contract to a new PE sample contractor in July 2023. The new contractor is not willing or able to produce similar custom PE samples. We reached out to another company that has historically provided PEs to EPA in the past. They can produce the PE samples that contain concentrations of A1268; however they have the following limitations: they do not have any historical acceptance limits data for Aroclors 1262 and 1268, they can only provide made-to values for the PE samples, with no acceptance limits. Therefore, EPA will not be able to score the PE samples using their internal scoring system. Is having PE samples with only made-to values and no acceptance limits going to be acceptable to USACE when documented in the QAPP?

See revised Section 31 23 00 provided via this amendment (Amendment 0006).

2. (ProjNet Inquiry ID: 11060313) In the RFP, in both Factor 2 (page 71) and Factor 3 (page 72), Factor 3, it is states the Offeror should include a project schedule. Please confirm the project schedule shall go in Factor 3 and not be included in Factor 2.

Project schedule requirement removed from Factor 3 via this amendment (Amendment 0006).

3. (ProjNet Inquiry ID: 11072964) Section 31 23 20 - Temporary River Diversion, 2.2 Diversion Pumps and Piping: Will all pumps within the diversion system need to be placed in critically silenced enclosures due to the proximity of the pumps to the apartment complex and 24 hour pumping cycle?

See revised Section 31 23 20 provided via this amendment (Amendment 0006).

4. (ProjNet Inquiry ID: 11069244) Please specify the laboratory turn around time required for the perimeter air samples (i.e. 24 hour, 48 hour, 5 day, etc.). Laboratory analytical costs are highly dependent on the turn around time.

See revised Section 01 35 29 provided via this amendment (Amendment 0006).

5. (ProjNet Inquiry ID: 11061391) Section 01 35 29, page 9 states: Perimeter air sampling will occur at a minimum of three perimeter air monitoring locations which will be based on the area being worked and wind direction. Does the government anticipate that more than three perimeter air monitoring locations will be required?

If work that requires handling of Raymark Waste is occurring simultaneously at separate locations (i.e. Morgan Francis and Upper Upper Ferry Creek) will perimeter air monitoring be required at both locations? What is the turnaround time required for perimeter air monitoring samples submitted to the laboratory for analysis?

Per spec section 01 35 29 3.4, the contractor is responsible for developing an exposure monitoring/air sampling program. This evaluation will include determining how many air monitors are required for protection of workers and the public. The air monitoring program must provide adequate protection in all work areas, which may involve multiple sets of air monitors during simultaneous operations. See revised Section 01 35 29 provided via this amendment (Amendment 0006).

6. (ProjNet Inquiry ID: 11078413) Does the existing exposed sheet piling in the Upper Upper Ferry Creek at the inlet to the existing box culvert to be removed under the Seed Contract? If so please specify if they can be cut at the proposed surface elevation or removed in their entirety.

Sheet pile weir is to be removed, cleaned, and recycled in its entirety. See revised Drawing C-106 provided via this amendment (Amendment 0006).

1. Each Offeror is required to complete all fields presented in the Seed Task Order’s Bid Schedule provided in the solicitation.

2. Each Offeror shall complete (fill-in and signatures) the solicitation sections indicated below:

Standard Form 33 (SF 33), Solicitation, Offer and Award Acknowledgement of Amendments if any Contract Administration Data – Bidding Schedule Representations, Certification and Other Statements of Offerors

Factor 1 Submission Requirements (Team Experience and Past Performance)

The term “Team Member,” as used throughout this solicitation, refers to the prime Offeror and all joint venture members, subcontractors, and other partners who will be performing any of the key work functions as described below.

The term “Offeror’s Team” consists of the prime Offeror and all other proposed Team Members.

Offerors shall submit a minimum of three (3) and a maximum of five (5) environmental remediation projects that best demonstrate the Offeror’s Team experience on recent and relevant projects that are similar in scope, complexity, size, and price to the work required under this solicitation. For all submitted projects, a narrative of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of the RFP (i.e., unique features, construction methods, etc.).

At least one project shall be provided for the prime Offeror (the entity signing the SF33) and for each proposed Team Member. The Offeror may utilize experience of another Team Member that will perform major or critical aspects of the requirement to demonstrate experience under this evaluation factor. If an Offeror is utilizing the experience of a Team Member, then that Team Member's submitted project(s) must show them performing recent work similar to the work they intend to perform on the upcoming contract.

A project is defined as work performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project. In this event, offerors shall submit the work performed under a task order as a project (or it will not be reviewed).

The maximum number of projects that may be submitted is five (5), regardless of the number of Team Members. If more than five (5) projects are submitted, only the first five (5) projects will be evaluated.

If the Offeror is a Joint Venture (JV), recent and relevant project experience shall be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have experience, such projects shall be submitted for each Joint Venture partner.

As applicable, Offerors should submit a signed copy of their current joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement, or letter of commitment for each above member of the Offeror's team (in an Appendix to Volume I) in order to receive credit for their experience and/or past performance.

In addition, if Offerors have an approved DoD Mentor-Protégé or U.S. Small Business Administration Agreement, Offerors should include it. Agreements, letters of commitment, and/or Joint Venture Agreements will not be counted toward the page limit.

Projects provided must be completed within the past fifteen (15) years, as of the issue date of this RFP, to be considered recent.

For each project, Offerors should submit past performance information as follows:

1. For Federal Government projects with a Past Performance Information Retrieval System/ Contractor Performance Assessment Reporting System (CPARS) Evaluation: provide the contract number, contract place of performance, and DUNS number. In the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Task or Delivery Order Numbers.

2. For non-Federal Government projects, commercial projects, and Federal Government projects without a CPARS Evaluation: provide a Past Performance Questionnaire (Attachment B). The Offeror should complete Blocks 1-4 of the PPQ and send it to the non-Federal project client or commercial project client. The client should complete Blocks 5-8 along with the two-page questionnaire. The Offeror should include the PPQ in Volume I of the proposal.

If the Offeror is unable to obtain a completed PPQ from a client for a project before the proposal closing date, the Offeror should complete and submit, with the proposal, the first page of the PPQ, which will provide contract and client information. The Government may make reasonable attempts to contact the client noted for that project to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. Alternatively, Offerors may submit a copy of the client’s signed PPQ for a completed contract or task order. The Offeror may retain PPQs in its files for submission on future procurements. In cases where the validity of the completed PPQ is questioned, contracting personnel may contact the reference for verification or additional information. The standard PPQ for USACE is Form PPQ-0 (9/30/11) provided in the solicitation. USACE does not intend to create or maintain a database of PPQs submitted by Offerors. Therefore, it will be the Offeror’s responsibility to ensure the submission of PPQs in its proposal that are relevant to the solicitation. Alternatively, the Offeror may obtain an updated/new PPQ from its client(s) for submission as provided above.

The Government may use data provided by the Offeror in its proposal, and data obtained from other sources, including data in Government files. The Government reserves the right to obtain past performance information from any source available and has the right to contact customers other than those listed by the Offeror to evaluate past performance. The Government reserves the right to verify statements the Offeror makes regarding its past performance to determine whether they are substantiated.

New Corporate Entities. New corporate entities may submit data on prior contracts involving its officers and employees. However, in addition to the other requirements in this section, the Offeror shall discuss in detail the role performed by such persons in the prior contracts cited. Information on their proposed roles should be included in the project descriptions submitted in response to the solicitation requirements.

Factor 2 Submission Requirements (Seed Task Order Technical Approach)

The Offeror should submit a narrative proposal to describe the Technical Approach for the work required to be performed in the Seed Task Order as described in the Seed Task Order Performance Work Statement (PWS). The Seed Task Order will be awarded to the successful offeror as soon as practicable after the award of the IDIQ. The proposal shall demonstrate the Offeror’s ability to successfully complete all required work and achieve the final restoration/cleanup objectives for the project. The proposal narrative should identify all required work elements, identify significant risks to completion of the tasks, document the approach for completing the work, document the sequencing of the work, and identify measures that will be implemented to mitigate risks. All technical assumptions shall be clearly documented. Resources required to perform each task (such as personnel, Team Members, equipment) should be identified.

Along with the narrative, the Offeror should include a project schedule (Gantt chart or bar chart created using MS Project or similar scheduling software) presenting its plan for the completion of the Seed Task Order.

The narrative and schedule should identify and include schedule milestones, critical design and construction work plan submittals, critical material procurements, and representation of Definable Features of Work (DFOW).

Government review periods, activity durations, and constraints should be clearly identified. The schedule should identify the critical path with relationships. For the purpose of this schedule, the Offerorshould assume a Notice to Proceed date of 30 April 2025.

Factor 3: PRICE

The basis of the price competition is through a representative “Seed” Task Order, which is an actual project and one that is representative of the type of work that will be ordered under the base IDIQ and the evaluation of each Offeror’s binding rate schedule. The price that Offerors submit for the Seed Task Order will constitute the price for the award decision and tradeoff analysis. The Seed Task Order will be awarded as soon as practicable after award of the IDIQ.

Factor 3 Submission Requirements (Price)

The Offeror shall provide a table of contents and shall number all pages consecutively. Volume II should be submitted in a separate file from Volume I. The price proposal should be broken down into sections as defined below.

Section 1: The name(s) and title(s) of the person(s) authorized to negotiate and sign a contract. Also, provide a Certificate of Corporate Authority or other applicable documentation of authorized signature(s) for each authorized individual.

Section 2: The Offer (the SF33) duly executed with an original signature by an official authorized to bind the company.

Section 3: Acknowledgement of all amendments to the solicitation in accordance with the instructions on the Standard Form 30 (amendment form).

Section 4: The completed Section K of the solicitation (i.e., Representations, Certifications, and Other Statements of Offerors). Certification of cost or pricing data in compliance with FAR 52.215-20 will be required for task orders above the Truth In Negotiating Act threshold negotiated under the subsequent contract but is not required in response to the solicitation. All cost and pricing data supplied by Offerors will represent data other than certified cost or pricing data as defined by FAR 2.101.

Section 5: Binding Rates – The Offeror shall complete the binding rate table provided as an attachment to the solicitation. The Offeror’s binding rates for labor shall be submitted for all five years of the contract from the award date.

The Offeror shall provide binding rates regardless of whether the labor is provided by the Prime or by a Team Member.

Section 6: Seed Task Order Price – The Offeror shall prepare a price proposal to accomplish the tasks in the Seed Task Order and in accordance with their Seed Task Order technical approach in Factor 2. The price proposal should be submitted by providing a detailed cost break down including the bid schedule and binding rates for labor, equipment, material, and subcontractors. A detailed project schedule should also be included with the price proposal.

The Offeror shall also submit a price breakdown of man-hours, wage rates, indirect rates, travel, material, subcontractors, other direct costs and profit. This price breakdown will be used to ascertain that the binding rates proposed in Section 5 were used to prepare the Offeror’s price proposal. The Seed Task Order price shall be consistent with rates utilized by the offeror in the Binding Rates.

Price reasonableness will be determined in accordance with FAR 15.305(a)(1). Normally, competition establishes price reasonableness. Comparison of the proposed prices is expected to satisfy the requirement to perform a price analysis. However, the Government may, if necessary, analyze the Offeror’s price breakdown to establish reasonableness of an otherwise successful offeror’s price.

Travel Costs – The Offeror shall comply with the Joint Travel Regulations (JTR) for the Seed Task Order and all task orders negotiated subsequent to the IDIQ award.
