This document is Amendment 0004 to a federal construction contract for Lock and Dam No. 25 modernization work, issued by the U.S. Army Corps of Engineers (USACE), St. Louis District. The amendment modifies sections covering special contract requirements, measurement and payment, and technical specifications for steel pipe piles and dredging operations.

The contract requires comprehensive construction services including mobilization/demobilization, erosion and sediment control, deflector wall installation, steel pipe pile furnishing and installation (48-inch diameter), combi-wall (separator wall) installation with backfill, articulating fabric concrete mattress placement, staging area fill, dredge material placement for lock foundation, alluvium and riprap excavation, scour protection stone placement, sanitary outfall piping, land-based site work, timber cribbing demolition, site monitoring instrumentation, and navigation assist vessel services. Steel pipe piles must conform to ASTM A 139/A 139M Grade D or E specifications with extensive nondestructive testing, charpy v-notch testing, macroetch testing, tension testing, flattening tests, and guided-bend testing requirements. Dredging specifications require preliminary and final hydrographic surveys, quality control monitoring with electronic positioning, environmental compliance measures (particularly for mussel and sturgeon habitat protection), and placement tolerances for fill material at specified elevations. The contract includes detailed environmental protection requirements addressing bat habitat clearing windows, bald eagle nests, mussels, sturgeon spawning, and invasive species prevention. Payment is structured on a job basis for most items with unit pricing for dredging (cubic yard) and some structural elements. The work must accommodate ongoing lock and dam operations, maintain navigation safety, and comply with all federal, state, and local environmental regulations throughout contract execution.

The Contractor shall furnish an electronic copy of the warranties to the Contracting Officer.

1.16 ORDER AND COORDINATION OF WORK

The Contractor may start and complete the work in such order and sequence as desired subject to compliance with the following paragraphs. The work tasks, milestones, and lock closure periods shall be entered into the Contractor's network analysis and monitored throughout the contract duration. The Contractor shall strictly adhere to specified Approved Lock Closure Periods. The specified duration of the closure periods will not be lengthened. The Contractor is required to obtain and coordinate the necessary resources to perform the designated work in the allotted closure periods.

1.16.1 General

a. The Contractor is advised that other contracts may be ongoing at the project site during the life of this contract. Coordinate work with the other Contractors and cooperate with the Contracting Officer's Representative and other Contractors to the fullest extent possible so as to not interfere with or hinder the progress of other contracts. The Contracting Officer will have the final decision in the event of a controversy between Contractors.

b. Datum. The existing lock facility was built utilizing the National Geodetic Vertical Datum of 1929 (NGVD29). The project is now using the

DOCUMENT 00 08 00 Page 7 newer vertical datum of North American Vertical Datum of 1988 (NAVD88).

The elevations on historic mapping will differ by the following conversion: NAVD88 elevation = NGVD29 elevation - 0.40 ft. The water surface elevation or pool stage has been historically operated and reported as an elevation according to NGVD29. In historical context, pool stage equated to the NGVD29 elevation. However, once the pool gage datum was converted to NAVD88, it was decided that for operational simplicity, the project would continue to operate the pool according to NGVD29 but would designate this value as "stage" and not elevation. In the present context, pool stage does NOT equate to elevation. For example, at a full pool stage of 434.0 feet, the water surface elevation is 433.6 feet NAVD88.

c. River Bottom Elevation Measurements. The Contractor shall measure the river bottom elevations prior to the start of any dredging or excavation work in accordance with Section 01 32 23.00 08 SURVEY AND ALIGNMENT

CONTROL.

The Contractor shall survey the final river bottom and scour protection elevations in accordance with Section 01 32 23.00 08 SURVEY AND ALIGNMENT CONTROL. The final survey is for verification of the conditions of the separator wall, the riprap section, and lock foundation backfill and to serve as an as-built condition.

The Contractor shall provide a safe working environment for hydrographic data collection where survey may be obtained to the level of accuracy required for the project.

d. All elevations and dimensions shall be verified in the field before work begins. The Contractor is responsible for confirming all dimensions prior to shop drawing preparation and material fabrication.

e. The Contractor shall monitor fluctuations of tailwater elevation and make tie off adjustments such that the floating plant shall not damage the piers. At all times when work is not in progress, the Contractor shall be required to have a 24-hour telephone number where the Government may reach a representative of the Contractor to notify of any problems with the floating plant. The representative must be available to be on site to attend to work barge(s) within 60 minutes of a phone call from the Government 24 hours a day, 7 days a week. The Contractor shall post and keep current a list of telephone numbers for emergency action. The Contractor shall submit the contingency plans for addressing headwater and/or tailwater fluctuations to the Contracting Officer for approval at least 7 days before mobilization.

f. Any disposal sites proposed by the Contractor that are not already identified by the Government as approved for this project are subject to approval by the Contracting Officer. This approval process may require the Government to prepare an environmental assessment at no cost to the Contractor. This may require additional review time and may result in additional requirements to offset environmental effects associated with the use of the site. Proposed sites which involve the excavation or placement of material within a cultural site, wetland, wooded area, floodplain, or other environmentally sensitive area will not be approved.

1.16.2 Environmental

a. Bat Habitat. All tree clearing must be coordinated with the USACE environmental compliance section in advance. In Missouri, all tree clearing must be completed from 01 November thru 31 March. No tree

DOCUMENT 00 08 00 Page 8 clearing is permitted in Missouri from 1 April thru 31 October unless otherwise approved by the contracting officer. Approval by the contracting officer may be granted after appropriate coordination by the St. Louis District with the U.S. Fish and Wildlife Service has been conducted, and it is determined that removal can be performed without impacting trees or habitat suitable for protected bat species.

b. Bald Eagle Nests. Should any bald eagle nest be noted within 660' of the project area, the contractor shall immediately contact the contracting officer to determine if any eagle nest buffer zone restrictions will be required for construction operations. Approval by the contracting officer may be granted after appropriate coordination by the St. Louis District with the U.S. Fish and Wildlife Service has been conducted, and it is determined whether an eagle take permit and/or nest buffer zone restrictions are required.

c. Mussels. All work sites must be coordinated with the USACE environmental compliance section in advance for the presence of protected mussel species. Approval by the contracting officer may be granted after appropriate coordination by the St. Louis District with the U.S. Fish and Wildlife Service and state agencies has been conducted, and it is determined that work can be performed without impacting protected mussel beds or habitat.

There shall be no spudding, anchoring, staging, or otherwise disturbing the riverbed at mussel bed locations (see maps at the end of this section). Activities shall not physically disturb mussel beds, nor result in increased sedimentation near mussel beds.

d. Sturgeon Spawning. All work sites must be coordinated with the USACE environmental compliance section in advance for the presence of suitable sturgeon spawning habitat and/or conditions. Approval by the contracting officer may be granted after appropriate coordination by the St. Louis District with the U.S. Fish and Wildlife Service and state agencies has been conducted, and it is determined that work can be performed without impacting sturgeon spawning and/or spawning sites.

The LD25 Illinois abutment is considered an environmentally sensitive area for the endangered Lake Sturgeon. No vessel or barge traffic, staging, spudding, anchoring, or otherwise disturbing the riverbank or riverbed at potential sturgeon spawning sites shall occur within the designated area (LD25 Illinois abutment to 1,200ft downstream on the Illinois side) between 01 April and 15 May annually. Activities in the vicinity of the Illinois tailwaters shall not physically disturb spawning sites, nor result in increased sedimentation near spawning sites between 01 April and 15 May annually. In addition, between 01 April and 15 May annually, tailwater velocities may be heightened along the IL abutment. Usage of the IL abutment may be requested from the Government outside of the 01 April to 15 May time period for ongoing construction activities.

e. Invasive Species.

(1) Invasive mussels and fishes have infested many bodies of water in the United States and can be unknowingly transported by vessels (barges, boats, tugs, etc.), boat trailers, and other equipment that is used in waterways. Contractor shall follow all State inspections and requirements to assist in the prevention of introduction and spread of aquatic nuisance species in rivers, streams, and lakes.

DOCUMENT 00 08 00 Page 9

(2)Inspect and remove weed seeds, plant parts, and/or zebra mussels on all construction equipment, vehicles, and trailers prior to bringing them onto the job site. Wash, including the undercarriage, if necessary.

(3) Inspect and remove weed seeds, plant material and/or zebra mussels on all construction equipment before being taken off the job site. If necessary, use an air compressor to blow clean this material. This should be done where equipment is unloaded or loaded, or at areas that can be easily monitored such as a road, trail head, or parking lot.

(4) Do not clean equipment, vehicles, or trailers in waterways.

1.16.3 Work Areas

b. Dam Operations. The Government will close Gate Bays 1 thru 3 when pool stages are 434 ft or below. When pool stage increases due to increasing flow (approximately an open river upper pool stage of 434 ft), Gates 1 thru 3 will be operated so that the gates are not overtopping. This will result in the gates being partially open and allowing flow underneath. The Government retains the authority to deviate from this plan to ensure the safety of Government owned facilities, navigation, and the general public.

The Government will inform the Contractor of any changes to Gates 1-3, prior to operating the gates.

The Contractor shall frequently monitor river stages and daily river forecasts for the possibility of the Government opening Gate Bays 1 thru 3 in the event of higher flow. The Contractor may anticipate the need for gate openings by observing a rising L&D 25 Tailwater gage approaching approximately a stage of 26.0 feet (432.6 feet NAVD88). It is recommended that the Contractor use the Government's daily forecasts (https://www.mvs-wc.usace.army.mil) to plan for the potential of gate openings. SEE ABOVE SUB-PARAGRAPH ENTITLED DATUM FOR INFORMATION ON DATUM

CONVERSIONS.

c. Requested Gate Operations. All requests by the Contractor, with respect to gate settings, will be coordinated with the Contracting Officer. Gate setting changes will only occur when the Contracting Officer concurs and determines them to be safe.

All Tainter and roller gate movements and machinery equipment operations will be conducted by the Government for the Contractor. The Contractor shall schedule any required gate movement within the following parameters:

1) Gate operations will only be performed during the day shift, 0800 to 1600 hours, Monday thru Friday, excluding Government holidays.

2) The Contractor shall provide a minimum 24-hour advance notice to the Contracting Officer's Representative for all gate operations. Notice shall be provided on a working day, i.e., Monday through Friday, excluding Federal holidays.

3) The Contractor shall allow four hours for the Government to complete requested gate position changes.

4) The Government will operate only one gate at a time.

d. Spudding. The Contractor shall take every precaution necessary during use of floating plant spudding operation to prevent damage to the existing facility. Use of spuds for floating plant over existing structures is

Prior to any floating plant work, the Contractor must perform a multi-beam survey of the area and provide results to the Government. At the conclusion of the project, the Contractor shall perform a multi-beam survey and provide the results to the Government; any damage from use of floating plant shall be repaired at no additional cost to the Government. The Contractor shall be aware of depths and required spud lengths.

e. Withdraw any equipment that would be subject to damage by rising river stages, before they are subject to damage. The Contractor shall monitor the prevailing river conditions at the project site, referring to the upstream project river gauge, river forecasts issued by the National Weather Services, and the USGS Stream/River Gage Data, and shall determine when to withdraw equipment and floating plant. The withdrawal of equipment and floating plant shall ultimately be the Contractor's decision and will not be directed by the Government. It shall be the Contractor's responsibility to determine the time necessary to make a complete and safe withdrawal of equipment and floating plant with due consideration given to the location of mooring area, flooding of accessway, roadways, and staging areas; amount of equipment; size of the floating plant, and capacity of towboats and propelling units to operate safely and efficiently at the expected river velocities.

Meet applicable local, state, and federal requirements for disposal of sanitary sewage, and bilge water accumulated aboard floating plant.

h. No priority lockages will be given over other waterway users. Adhere to normal queuing procedures as required unless otherwise approved by the Contracting Officer.

i. No fleeting is permitted upstream of the dam and/or whereas it interferes with the preferred sailing line for approaching vessels without prior approval from the Contracting Officer. Floating plant and other contractor vessels actively working on upstream project features are permitted only during work hours or if manned 24 hours per day, 7 days per week.

j. The Contracting Officer or appointed representative may direct the Contractor to move any vessel which interferes with navigation or poses a safety threat.

k. The Contractor is advised there is a potential for unexpected movement of pool ice during the months of December through March. The Contractor should further be aware that the pool ice can become so thick that work may not be able to be performed upstream of the lock and dam. Any equipment and especially vessels that are captured by the ice will be subjected to severe damage or destruction. The Contracting Officer will attempt to provide advance notice of ice movement as a courtesy to the Contractor. The failure of the Government to issue such a notice will not entitle the Contractor to seek damages against the Government.

Considerable amounts of ice may be encountered while moving equipment on the river and in the locks.

l. The Contractor shall provide measures to protect all Government facilities and equipment, both new and existing, from Contractor work activities, to include but not limited to, contamination by surface preparation, abrasive blast debris, power spraying, weld splatter, concrete splatter, paint overspray, dust or other related debris. n. Existing Work Flat and Safety (Jon) Boats. The Contractor is advised that Government vessels may be required to transit the facility and construction areas at any time, except during dewatering of the 600 ft lock chamber and including during closure periods, to respond to critical operations. In addition, during lock closure periods, the Government will make every effort to configure tows with limited length and width to facilitate safe passage around construction activities. The Contractor is advised that vessels under contract to the Government are considered Government vessels.

The Government stores a work flat downstream of the existing upper miter gate of the 1200 ft lock chamber. The Government must have continuous access to launch and maintain the work flats.

Safety Boats are on davits on the lockwalls. The Government must have continuous access to launch and maintain the safety boats at all times.

Any requested deviation to temporarily block access to the work flat or safety boats must be coordinated with the Contracting Officer. With approval of the Contracting Officer, the work flat or safety boats may be temporarily relocated.

o. The Contractor's methods for disposal of sanitary sewage, and bilge water accumulated aboard floating plant, shall meet applicable local, State, and Federal requirements.

p. The terms of the Government's easement for property at the ferry landing prohibits the contractor's use of the subject property during high water conditions above tailwater gauge 30. The Contractor will be allowed to use the temporary work area easement at tailwater gauge readings below tailwater gauge 30. The Contractor's inability to use the ferry landing due to tailwater above 30 is not grounds for additional time or compensation. The Contractor may make agreements with the landowner outside of the Government easement at no additional cost to the Government. If agreements are made, provide the Government with a copy.

q. The Contractor shall provide 1 navigation assisting vessels with a minimum of 1,000 horsepower to assist commercial vessels entering and existing the lock chamber on the downstream approach of the lock. Each boat shall be equipped with power winches and at least one deckhand.
