PART 1 GENERAL
1. PROJECT DESCRIPTION
The purpose of this contract is to provide the necessary construction improvements for the Kuwait Ministry of Defense. The work described in this Design Bid Build (DBB) Site Adapt package consists of three (3) projects: (1) Information Coordination Central # 3 (ICC #3), (2) Site 6 - ALJ and (3) Site 7 - ALS. The majority of the work will be contained in the Basic Contract Line Item Numbers (CLIN) and the remaining work will be contained in the optional CLINs.
The summary of work for this project includes two types of work. One component is to construct facilities that have been fully designed (DBB).
The other component consists of the site improvements and infrastructure necessary to site adapt those fully-designed facilities. The technical requirements for the portion of work to be designed and constructed by the contractor along with further description of Site Adapt work can be found in Section 01 80 00.12 10 TECHNICAL REQUIREMENTS and Section 01 80 05.12 10 AIR OPERATIONS IMPROVEMENTS. Design documents including plans and specifications are provided herein. The contractor will be responsible to perform the necessary designs to adapt them to the specific sites. Project also includes operation and maintenance for all three sites.
Site Adapt Infrastructure improvements include site demolition, grading, site development, site drainage design, fencing, roadway and parking pavement, water, sewer, electrical generation and distribution, and telecommunication infrastructure shall be designed and constructed by the Contractor. The work shall include the preparation of a complete and coordinated set of construction design drawings with supporting documents and calculations, and the construction required to provide fully functional utility systems, communication system, and site improvements as required by the contract documents. Construction activities must not begin until the Government notifies the Contractor that the submitted design is acceptable for release for construction.
The Contractor shall design and build all fire protection systems including fire alarm systems required in the facilities as follows:
Site 6/Site 7 HQ Building - Fire alarm system with full area automatic smoke detection devices and notification system; ECS, Frequency Converter, Power Plant, Prayer Room, and Maintenance High Bay - Fire alarm system with manual initiation devices, smoke detection over the fire alarm panel, and notification devices.

ICC #3 Screen Room Building - Fire alarm system with manual initiation devices, smoke detection over the fire alarm panel, and notification devices.
The fire alarm design shall be in accordance with Section 28 31 64.00 10 FIRE
DETECTION AND ALARM SYSTEM, ADRESSABLE.
All work under this contract includes all labor, materials, equipment, tools, transportation, and necessary supplies to construct the features of work described in this document. The requirements of this contract include that the Contractor must manage the work in a professional manner, perform personnel and support functions to maintain a sufficient work force, and provide the submittals required. Materials and supplies shall be new and standard products regularly used for commercial/institutional construction of similar size, style, and complexity in Kuwait. Equipment to be provided by the Contractor shall be of commercial/institutional quality.
Construction shall comply with the specifications and requirements contained in the contract documents. The design and technical criteria contained and cited in the contract documents establish minimum standards for construction quality.
The Contractor shall perform a topographic survey and geotechnical investigation for each site as required in Section 01 80 00.12 10 TECHNICAL REQUIREMENTS for this project. The Contractor shall remove/relocate existing structures, pavement, utilities, cables, debris, etc. that may occupy the site, as required for construction while maintaining service to existing facilities not affected by this project.
In addition to the U.S. Army Corps of Engineers Design Review and Approvals, the Contractor shall be responsible to obtain Construction Permit(s) as required by the Host Nation laws.
1.1 ICC #3 SITE
1.1.1 SCREEN ROOM BUILDING
The purpose of this project is to construct a Screen Room Building addition located near the existing Kuwait Air Defense HQ, Kuwait.
The Screen Room Building includes construction of a building addition to the existing Command Post #1 to house the prefabricated shielded enclosure, reroute existing utility lines and provision of new power distribution as required to support the new building addition, HVAC, prefabricated electromagnetic shield enclosure and all other necessary work as indicated in the contract documents to make this complete and usable.
Supporting facilities and Infrastructure Improvements includes demolition of existing chain link fence, electrical and communication interface connections, site grading, communication system ductwork and electrical ductwork as indicated in the contract documents.
Site specific utilities may vary for each site. The complete technical description of the scope of work is depicted on the drawings and within the specifications.
The source of power for this the Screen Room Building addition shall be from existing transformer located nearby ICC #3 as identified in Site ICC#3, XE-101 drawing and as described in Section 01 80 00 12.10 paragraph 2.10, "ICC#3 Site and Screen Room Building Addition Site Electrical Design." See

1.1.2 AIR OPERATIONS CENTER IMPROVEMENTS
The purpose of the Air Operations Center (AOC) improvements is to ensure new computer work stations and computer server racks will have the required electrical and communication interfaces to function.
The AOC is located within 50 meters of the existing ICC sunshade as shown on the ICC#3 Site Drawings. AOC renovation work is specified in Section 01 80
05.12 10 AIR OPERATIONS CENTER IMPROVEMENTS and aassociated appendix.
1.1.3 BID OPTIONS- ICC #3 SITE
Options are included in this contract and may be exercised (awarded) if approved by the government and within funds available. The options in this contract are as follows:
1. Replace Raised Access Flooring System: See Appendix A.
2. Replace HVAC Unit: See Appendix A.
1.2 SITE 6 - ALJ
The purpose of Site #6-ALJ is to construct one (1) complete Air Defense Site which is located within the controlled perimeter of an existing Air Base, Kuwait.
Primary facilities includeheadquarters building, toilet building, guard house building, engagement control station (ECS) with concrete ramps, guard towers, frequency converter buildings, equipment pads and Alaska barriers, storage pad, storage facility, car parking sunshade, truck parking sunshade, fuel truck parking and a telecommunication tower and as indicated in the contract documents Supporting facilities and infrastructure site grading, paved access roads, pavement markings, storm drainage infrastructure improvements, single row security fence, Power Plant with switch gear room, tele-communication and electrical distribution systems consisting of concrete encased conduits, fuel storage sunshade, site lighting, closed circuit security system, ground and elevated water storage tanks and piping for potable water, sewer collection system, lift station, and sewer holding tanks and as indicated on the contract documents.
The power source for all facilities shall be the generator(s) power plant, this shall be constructed as designed in contract documents and provided with an automatic transfer switch to allow connection to host nation power in the future.
1.2.1 BID OPTIONS - SITE 6 - ALJ
Options are included in this contract and may be exercised (awarded) if approved by the government and within funds available. The options in this contract are as follows and as shown on the contract drawings and specifications:
1. Construct Prayer Gathering Building
2. Construct Additional Car Parking sunshade
3. Construct Maintenance High-Bay building
4. Construct paved perimeter patrol road and service drive

1.3 SITE 7- ALS
The purpose of this project is to construct one (1) complete Air Defense Site which is located adjacent to the controlled perimeter ALS Air Base, Kuwait.
Primary facilities include headquarters building, toilet building, guard house, engagement control station (ECS) with a concrete ramp, guard towers, frequency converter/PDU , equipment pads and Alaska barriers, storage pad, storage facility, car parking shelter, truck parking shelter, fuel truck parking and a telecommunication tower and as indicated in the contract documents.
Supporting facilities and infrastructure site grading, paved access roads, pavement markings, storm drainage infrastructure improvements, double row security fence, Power Plant with switch gear room, tele-communication and electrical distribution systems consisting of concrete encased conduits, fuel storage sunshade, site lighting, closed circuit security system, ground and elevated water storage tanks and piping for potable water, sewer collection system, lift station, and sewer holding tanks and as indicated in the contract documents.
The power source for all facilities shall be the generator(s) power plant, this shall be constructed as designed in construction documents and provided with an automatic transfer switch to allow connection to host nation power in the future.
1.3.1 BID OPTION - SITE 7 - ALS

3. Construct Additional Car Parking Shelter
4. Construct Maintenance High-Bay building
5. Construct Anti-Vehicle Ditch and Berm around exterior fence
1.4 BID OPTION - OPERATION AND MAINTENANCE SERVICES - (1 yrs up to 3 yrs):
To insure that the facilities are maintained at a high level of readiness it is necessary that the utility systems and equipment are functioning and operating properly. The services shall provide maintenance, spare parts, and repair services as specified in Section 01 11 10 OPERATIONS AND
MAINTENANCE SERVICES.
1.5 PHASING OF WORK
In addition to work being executed in accordance with the Contract Documents described in this package, all work and phasing of work must be approved by the Contracting Officer and coordinated through the USACE Resident Office in Kuwait. It will be imperative that the Contractor take into consideration the potential to have other on-going construction work and coordinate efforts under this contract in conjunction with other work to avoid schedule impacts and other conflicts. The Contractor is expected to mobilize and work at all three project locations simultaneously.

1.6 PERIOD OF PERFORMANCE
The project shall be completed within the time stipulated in Section 00700, Contract Clause 52.211-10, COMMENCEMENT, and PROSECUTION AND COMPLETION OF WORK including any OPTION items awarded. The construction shall be sequenced in accordance with Section 00800, Contract Clause PROJECT SCHEDULING AND
SEQUENCE OF CONSTRUCTION.
If items on the critical path schedule are delayed, contractor must provide a recovery schedule to the COR for approval and be able to increase manpower to complete mission essential facilities as listed below and in the project specifications.
Partial turnover may be required for mission essential facilities. Mission essential facilities include the following:
ICC # 3 Site:
- Construct Screen Room building addition with prefabricated shielded enclosure
- Construct electrical and communication distribution infrastructure to existing communication tower
- Construct AOC improvements as indicated in the contract documents.
Site 6 - ALJ:
- Construct Perimeter Fence and Entry Control points

OPERATIONS AND MAINTENANCE SERVICES

PART 1 GENERAL
If the operations and maintenance (O&M) services bid option is exercised, the contractor will provide services including but not limited to equipment surveys, repair as required, preventive maintenance, and spares as specified. Services and spare parts shall be in accordance with the manufacturer's recommendations.
Unless otherwise stated elsewhere in this contract:
a. The work associated with this section is listed and priced as separate CLINs in the Proposal Schedule.
b. The minimum duration of work under this section shall be for a period of one (1) year and may be extended for additional years as indicated as separate CLINS in the proposal schedule.
c. The work specified in this section shall begin on the day following the date of final acceptance, of the work on this contract.
d. All contract provisions under this contract remain in force throughout the Operation and Maintenance periods. However, the work required under this section is not included in the work which must be finally accepted for reducing the amount of the Bank Letter of Guaranty, or Bond requirements.
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.2 SCOPE OF WORK
1.2.1 General
The contractor will provide equipment, surveys, repair as required, preventive maintenance, and spares per the manufacturers' recommendations for all three project sites. Services shall be in accordance with the manufacturer's recommendations. It is noted that the word "operations" included in the term "operations & maintenance" does not mean that the
SECTION 01 11 10 Page 2 contractor is required to operate the equipment for the user. This word is referring to the requirement for the contractor to keep the equipment properly maintained and operational. Operation and Maintenance Services Bid Items The Preventative Maintenance, Inspection and Service listed in the proposal schedule includes all routine maintenance repairs and installation of spare parts.
The equipment, systems, and/or facilities to be operated and maintained are as follows:
a. Mechanical Equipment: Inspect and maintain the Mechanical Equipment in accordance with the manufacturer's instructions. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning sand, dirt and debris, and inspecting and maintaining installed heating, ventilating, and air conditioning system in accordance with the manufacturer's instructions.
b. Interior/Exterior Plumbing Features: Inspect and maintain the Interior/Exterior Plumbing in accordance with the manufacturer's instructions. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning sand, dirt and debris.
c. Ventilation, Detection, and Alarm Systems: Inspect for proper operations and maintenance. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning sand, dirt and debris from the Ventilation, Detection, and Alarm Systems.
d. Interior/Exterior Electrical service, distribution, and controls:
Inspect for proper operations and maintenance. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning sand, dirt and debris from the Interior/Exterior Electrical service, distribution, and controls.
e. Security Fence: Inspect and maintain the entire length of the security fencing, both inner and outer fence lines, no less than once per week. Clean debris from all fencing, inside and out, including plastic bags and any debris that restricts vision through the fence, tighten or adjust misaligned or loose components, and realign/repair minor damage to concertina wire (requiring less than 1 meter of material or 1 hour of labor). Regular maintenance includes but is not limited to removal of accumulated material at the base of the fence.
Entire fencing system shall be cleaned at least once per calendar year.
Sand removal around the fence will be done by others.
f. Gates: Inspect and maintain the installed gates, swinging and sliding, both vehicular and pedestrian in accordance with the manufacturer's instructions, no less than once per week. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to cleaning debris from all gates, including plastic bags and any debris that restricts vision through the gates;
inspecting safety and electrical components, operation check, and cleaning out accumulations of sand or other material at the base of the gates and in track that prevent proper operation.
g. Closed circuit television (CCTV): Inspect and maintain the CCTV
SECTION 01 11 10 Page 3 system in accordance with the manufacturer's instructions, no less than once per week.
1. Cameras: Inspect for proper operations and maintenance.
Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting and testing of each camera to ensure proper operations, cleaning of body and lenses, and adjustment of mechanical components.
2. Communications: Inspect for proper operations and maintenance. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning sand, dirt and debris from the communications equipment.
h. Security Lighting: Inspect and maintain the installed security lighting, no less than once per week. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting poles, foundations, electrical components, lights, and lenses, and replacing defective bulbs within 24 hours from detection or notification.
i. Guard and Communication Towers: Inspect and maintain the Guard and Communication Towers and all equipment installed within, in accordance with the manufacturer's instructions. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting and maintaining structure, electrical, mechanical, and communication systems for proper operations, cleaning sand, dirt and debris from the interior space of guard towers and equipment, and cleaning windows.
j. Generators: Inspect and maintain all generators including one (1) Emergency Stand-By Generator for the Screen Room Building and two (2) 850 KVA generators for Site 06 and two (2) 850 KVA generators for Site 07, no less than once per week. Regular maintenance shall follow manufacturer's instruction and frequencies including but not limited to inspecting and maintaining motors, fuel lines, electrical components and connections, and controls. Not less than once per month (or as recommended by the manufacturer), generators shall be started to ensure proper operation. Fuel for the Generators will not be required for this O&M Contract and will be provided by the Kuwait Government. All petroleum products and old parts must be disposed of offsite by the Contractor in accordance with all Kuwait regulations.
1.2.2 Operation
a. Operation of equipment shall be in accordance with approved O&M manuals submitted by the Contractor in accordance Section 01 78 23
OPERATION AND MAINTENANCE DATA.
b. Operating schedules shall provide for regular maintenance periods in accordance with the manufacturer's recommendations including periodic start-up and shut-down operations.
1.2.3 Maintenance
a. Preventive Maintenance (PM): The Contractor shall perform preventive maintenance inspections and servicing as follows:

1. The contractor shall perform all inspection and services that are required by the manufacturer and at the frequencies that correspond to the operation conditions and tempo as recommended by the manufacturer and at the recommended frequency.
2. Maintain a schedule for PM activities.
3. Maintain a file of completed checklists showing PM functions performed, date and any corrective action. Reports must be made available to the Base Commander regarding repair status, readiness of all facilities as required by Kuwait.
b. Repair and Overhaul:The contractor shall submit repair and overhaul requests for approval by the Contracting Officer; once approved the contractor shall perform the necessary work to restore a failed or failing system, or piece of equipment to full operating capability.
The Contractor will troubleshoot, repair or replace following items:
1. Mechanical Equipment: Repair or replace damaged or broken components and systems.
2. Interior/Exterior Plumbing Features: Repair or replace damaged or broken components and systems.
3. Ventilation, Detection, and Alarm Systems: Repair or replace damaged or broken components and systems.
4. Interior/Exterior Electrical service, distribution, and controls: Repair or replace damaged or broken components and systems.
5. Security Fence: Repair breaks, holes, or damaged sections of the fence including fabric, posts and foundations, outriggers, barbed wire, and concertina wire.
6. Gates: Repair breaks, holes, or damaged sections of the gates. Repair gate operator mechanical and electrical components.
Other repair or replacement to ensure proper operation.
7. Closed circuit television (CCTV): Repair or replace inoperable cameras, monitoring equipment, electrical or control wiring and components, and heating, ventilating and air conditioning systems. Provide software updates or computer support.
8. Security Lighting: Repair or replace damaged or broken lighting components.
9. Guard Towers: Repair or replace damaged or broken components and systems.
10. Generators: Repair, overhaul or replace damaged or broken components and systems.
c. Emergency Repairs: The Contractor shall be prepared to make emergency repairs twenty-four (24) hours a day, seven (7) days a week.
d. Warranty Service: The Contractor shall be responsible for obtaining warranty service (in accordance with the warranty of construction
SECTION 01 11 10 Page 5 specified in the contract) from equipment manufacturers as applicable.
Work shall not be delayed or remain undone due to conflict of warranty responsibility.
e. Parts and Supplies: The Contractor shall be responsible for providing, procuring and storing all parts (including manufacturers' recommended spare parts) and supplies required to operate and maintain all equipment/systems under paragraph 1.2.1 of this section, for each O&M period. Those parts and supplies used from the supply of spare parts provided under this contract, must be replaced. All parts/supplies stored on site and unused at the time of completion of the contract, shall become the property of the Kuwait Government and shall remain stored on site. Upon completion of the O&M period, the Contractor shall deliver all spare parts and materials procured for the Operation and Maintenance period to the designated location provided by the Contracting Officer and an inventory shall be taken at that time, in coordination with the Contracting Officer's Representative.
The cost of the spare parts & supplies required for the O&M should be included in the CLINs for the O&M period.
The Contractor shall be responsible for providing and storing all parts and supplies required to operate and maintain equipment. Those parts and supplies used from the supply of spare parts provided under this contract, must be replaced. All parts stored on site and unused at the time of completion of the contract shall become the property of the Kuwait Government and shall remain stored on site. Upon completion of the O&M period, the Contractor shall deliver all spare parts and materials noted under item "e" of paragraph OPERATION, herein, and any other parts procured for the Operation and Maintenance period to the designated location provided by the Contracting Officer and an inventory shall be taken at that time, in coordination with the Contracting Officer's Representative.
f. Tools: All Contractor's tools not specified for incorporation into the contract shall remain the property of the Contractor upon completion of the contract. Specialized tools purchased to support this O&M contract shall be turned over to Kuwait at the end of the contract.
g. Housekeeping and Maintenance: The Contractor shall provide within his PM Schedule, housekeeping and maintenance of those rooms or facilities which contain the systems or equipment operated and maintained under this contract. Regular maintenance shall follow manufacturer's instructions and frequencies including but not limited to inspecting for proper operations and maintenance, cleaning dirt and debris and inspecting and maintaining installed heating, ventilating, and air conditioning system in accordance with the manufacturer's instructions.
1.2.4 Maintenance Office
The Contractor shall operate his maintenance organization from a small office space on or near the Security Compound provided. The maintenance office will be procured, operated and maintained by the Contractor. The Contractor will abide by all the security and base access requirements of the Security Compound.

1.2.5 Contractor Furnished Computerized Maintenance Management System (CMMS)
The contractor shall provide, operate and maintain a computerized maintenance management system (CMMS). The CMMS will be part of the information, management and control system for performing preventive maintenance, checks, services, calibration, maintenance and repair functions to maintain equipment and systems in working order so that they are capable of meeting their design specifications in an efficient and economical manner. CCMS database shall be submitted to the Government upon completion of the contract.
The CMMS capabilities shall include, as a minimum:
1. Work management ability to track and manage all aspects of work requests, labor, planning, scheduling and document and track employee certification.
2. Capability to produce work orders that are used to specify and track all work (preventative maintenance, scheduled and unscheduled maintenance, and repair) being executed on a site, at a facility, or on a piece of equipment.
3. Include a hierarchical relationship to accumulate the work on the components of larger systems and individual facilities at a site.
4. Facilitate planning, scheduling and tracking of Preventive Maintenance and Inspections (PMl's).
5. Capture item specifications warranty information, manufacturer's data, associated service contracts, spare parts, vendor and other purchase information as well as other pertinent data.
6. Create job plans to record and track the work steps, any material to be used as well as special tools and/or trade skills thereto.
7. Materials management which includes reservations of material for specific work orders, identifying and procuring spare parts that are applicable as well as substitutes and inventory adjustments, minimum order quantities, and ideal order and issue quantities.
1.2.6 Technical Library
The Contractor shall utilize the technical data supplied under Section 01 78 23 OPERATION AND MAINTENANCE DATA. This information shall be supplemented and corrected as found necessary through experience gained during the operating and maintenance period.
1.2.7 Personnel
a. The facilities shall be attended and operated continuously by experienced personnel who are fully qualified and skilled in all phases of operating the particular equipment assigned to be operated during each shift. The crews and shifts need not necessarily be comprised of equal numbers of personnel, and the qualifications of each crew/watch need not necessarily be equivalent. Each crew, however, shall be capable of fully operating and maintaining the systems under the normally expected operating conditions during an assigned shift. A selected portion of the remainder of the off-duty staff shall be scheduled to be available, on-call, for emergencies.

b. The operating staff shall be supervised by a chief operator with a minimum of five (5) years relevant experience. The supervisor shall provide continuity among all personnel to improve staff effectiveness and operational procedures.
c. The maintenance staff shall be comprised of personnel with previous experience in the repair of the type equipment covered under this contract.
d. The maintenance staff shall be supervised by a technically qualified and certified by equipment manufacturer maintenance engineer with a minimum of five (5) years relevant experience.
e. Supervisors shall assure that safety practices are promulgated and posted, and that all staff members understand and abide by established safety procedures. Supervisors also ensure the staff is adhering to all security, badging and access procedures.
f. The Contractor shall designate one individual as the overall manager responsible for the O&M portion of this contract, and this individual shall meet the approval of the Contracting Officer. This manager may have dual functions. In addition, supervisors and key personnel shall be approved by the Contracting Officer. The requests for review and approval shall include a resume for each person.
g. The manager, supervisors and key personnel shall be on board thirty
(30) calendar days prior to implementation of OPERATION AND MAINTENANCE (O&M). A list of those to be on board shall be provided to the Contracting Officer 90 calendar days prior to completion of the construction contract.
h. Key staff personnel shall be able to communicate in English and or Arabic language.
1.2.8 Reports and Records
The Contractor shall:
1. Maintain a record of all maintenance performed on major units of equipment.
2. Maintain an inventory record of all supplies and parts including stock levels, materials procured, materials ordered, receipts, issues and requisition status.
3. Maintain a file of completed checklists for all operator maintenance to include lubricant schedule, frequency and type of lubricant required.
4. Prepare monthly operating summaries for each facility.
5. Develop, prepare and maintain operating logs for power generation.
The logs shall contain any operator maintenance performed and the operating status of all equipment; e.g., "operating", "standby", maintenance", etc.
6. Develop, perform, and maintain logs of appropriate weekly fire and safety inspections.

7. All of the above reports and records shall remain on site and copies shall be provided to the Contracting Officer upon request.
1.2.9 Reliability Tests
The systems shall be maintained and repaired as required to keep them in a like-new operating condition and at the end of the operating and maintenance period shall be put in a like-new condition prior to turnover to KMOD. The evaluation of the conditions of the facility, including all equipment, will be made by the Contracting Officer based on:
1. Evaluation of records of maintenance and repairs performed.
2. Physical inspection of the facility including all equipment.
3. The Contractor's demonstration of the specified operational capability of the systems by putting all equipment in service on a design load type operation for a forty-eight (48) hour reliability run.
This reliability test shall start ten (10) calendar days prior to completion of the O&M period. All of the above must be made to the satisfaction of the Contracting Officer prior to final payment for
OERATIONS AND MAINTENANCE (O&M) SERVICES.
1.2.10 Quality of Work
The Contractor is responsible for the quality of work performed. The Contractor measures that quality through the Contractor's own Quality Control (QC) Program. QC is work output, not workers, and therefore includes work performed under this contract regardless of whether the work is performed by Contractor employees or by subcontractors. The Government will perform Quality Assurance (QA}. Quality Assurance is defined as the functions and associated contract oversight actions performed by the Government to ensure that contract requirements are performed in accordance with contract specifications and contract terms and conditions, and that an acceptable level of Contractor quality control activities is in place and operational. The Government executes its QA Program through direct observation supplemented by input from customers served by the Contractor.
Successful quality assurance is a team effort. Quality Assurance Evaluators (QAEs) observe and evaluate contractor performance. Quality Assurance will be measured by a mix of 100% evaluation, random sampling, periodic evaluation, and customer input as appropriate to specific tasks.
1.3 PAYMENTS
The payment amount for the O&M portion of this contract will be as designated in the Proposal Schedule.
a. The Contractor shall submit separate monthly invoices to the Contracting Officer for work performed under this contract.
b. Final payment will be withheld until the satisfactory completion of the reliability run (as defined in this section) and shall be no less than 10% of the payment item.
1.4 PERFORMANCE METRICS
The Contractor's performance will be rated per the below metrics. This is not the only tool that will be used to evaluate Contractor's performance, SECTION 01 11 10 Page 9 but it is the first step or action in the process.
Note that the Contracting Officer's Representative will distribute the client or customer questionnaire monthly and will seek their opinions as to the Contractor's performance. These questionnaires will be released to the Contractor at the discretion of the Contracting Officer.
Issues with Contractor performance will be addressed with the Contractor by the Contracting Officer. This will be done in a timely manner so that all issues are quickly resolved.

1.6 CONTRACTOR'S DATA SUBMITTAL SCHEDULE
The Contractor shall complete and submit one copy of ENG Form 4025, "Transmittal of Shop Drawings, Equipment Data, Material Samples, or Manufacturer's Certificates of Compliance" (included as an attachment to this contract) with each data submittal. All submittals will be transmitted by ENG Form 4025 with a copy of the form attached to each submittal copy. The transmittal forms shall be consecutively numbered beginning with the number "1". Any resubmittals shall be identified using an alphabetical suffix beginning with the letter "A" (i.e., if the fifth submittal, No. 5, is resubmitted, the first resubmittal will be No. 5A, the
SECTION 01 11 10 Page 12 second 5B, etc.). All pertinent information required by the ENG Form 4025 shall be supplied. Submittals as specified shall be complete for the equipment being furnished and any inapplicable information shall be marked out or deleted. Submittal packages shall be suitably identified by (i) the type of submittal (i.e., Special Tools and Equipment, Warranty, etc.), (ii) contract number, and (iii) Contract Line Item Number (CLIN). The item numbers in the Submittal Schedule below shall be submitted for each Contract Line Item in this contract as applicable.
Submittals requiring approval by the Contracting Officer or his authorized representative are so designated in the Submittal Schedule below. In the event data submittals are rejected and returned to the Contractor for correction and resubmission, the Contractor shall submit acceptable data to the Government in not more than 10 calendar days after receipt of initial rejection. All costs for resubmission of disapproved submittals shall be borne by the Contractor.
The required submittal (s) shall be forwarded in the designated number of copies at the times listed on the Submittal Schedule below. Note: All times listed in the submittal schedule are CALENDAR DAYS. Submittals should be provided to the COR at the site.

1.7 GOVERNMENT REMEDIES
The Contracting Officer shall follow FAR 52.246-4, Inspection of Services-Fixed Price, for contractor's failure to perform satisfactory services or failure to correct non-conforming services.
1.8 EQUIPMENT EVALUATION AND CONDITION
The contractor is required to provide an equipment evaluation every two months. This evaluation will provide the cost of repairs during the reporting period; look ahead 6 month parts requirement; equipment age, down time during reporting period, performance level and overall condition of the equipment.

PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.2 CONTRACTOR ACCESS AND USE OF PREMISES
1.2.1 Activity Regulations
Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. Mark Contractor equipment for identification.
1.2.1.1 Subcontractors and Personnel Contacts
Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.2.2 No Smoking Policy
Smoking is prohibited within and outside of all buildings on installation, except in Contractor's designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation.
Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.
1.2.3 Working Hours
Regular working hours must consist of an 8 hour period , between 7 a.m. and 3:30 p.m., SundaySaturday through Thursday, excluding the following Government holidays:

1.2.4 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
Make application 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the Contracting Officer.
1.2.5 Occupied and Existing Buildings
The Contractor shall be working in an existing building and around existing buildings which are occupied. Do not enter the building without prior approval of the Contracting Officer.
1.2.6 Utility Cutovers and Interruptions
a. Make utility cutovers and interruptions after normal working hours or on Saturdays, Sundays, and Government holidays. Conform to procedures required in the paragraph "Work Outside Regular Hours."
b. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.
c. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm, and compressed air are considered utility cutovers pursuant to the paragraph entitled "Work Outside Regular Hours."
d. Operation of Station Utilities: The Contractor must not operate nor disturb the setting of control devices in the station utilities system, SECTION 01 14 00 Page 3 including water, sewer, electrical, and steam services. The Government will operate the control devices as required for normal conduct of the work. The Contractor must notify the Contracting Officer giving reasonable advance notice when such operation is required.
1.3 SECURITY REQUIREMENTS
1.3.1 Requirements
The Kuwait Ministry of Defense (KMOD) maintains the ultimate authority for establishing, monitoring, and enforcing security requirements on Kuwait bases. All contractor, subcontractor, or vendor personnel and vehicles at any tier working at any location on the project are subject to a thorough search upon entering, departing, or at any time deemed necessary by KMOD Personnel. The Contractor shall be responsible for compliance with all laws, regulations and policies of the Government of Kuwait and all Base Security requirements. The Base Security Officer will not approve access for any worker, to any part of the project, when laws, regulations or policies of the Government of Kuwait have not first been met. The Government reserves the right to deny access or to require the contractor to remove any personnel or equipment deemed to be a threat to security. The Contractor shall work through the Contracting Officer to assure that security regulations are followed.
1.3.2 Security Area
All work under this contract will be confined to the Contractor's staging/laydown area(s), and the project areas. Minimum requirements for Contractor entry and operations are described below.
1.3.2.1 Identification of Employees in the Development Area
The Contractor is responsible for coordinating the demographics of his workforce to account for Kuwait's laws regarding so-called 'countries of concern. The Contractor shall submit a J2 badge application for each individual (to be provided following the Post-Award Conference).
Subsequently, each individual shall go through Screening Process before the issuance of entry badge. Employees shall wear identification badges prominently displayed at all times while in the Project Areas. Failure to wear a properly displayed identification badge may be considered grounds for removal of the employee from the sites. The Contractor shall conduct random inspections to assure that identification badges are properly displayed.
