BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).
Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)
Bidder Inquiry 01: Please direct bidders to the contract plans, specifications, bid schedule, and other relevant bid documents.
Government Response: All documents including the Plans, Specs, and requirements and instructions for bidding, can be found at the System for Award Management (SAM) website at www.sam.gov using Solicitation W912DS24B0002 under “Attachments/Links”. The Plans are labeled “Part A, Part B, Part C and Part D”.
Bidder Inquiry 02: Can you please share any CAD files associated with the project plans, as well as any survey data?
Government Response: CAD Files are not available for public release. Project Survey Data can be found in “Part+A_Plans_SSSI_Area+E_General+Survey+Geotech_Dec+2023.pdf” as posted under the “Attachments/Links” section of this solicitation.
Bidder Inquiry 03: It is requested that the bid date be extended from it’s current bid opening date of February 1, 2024.
Government Response: Amendment 1 extended the bid date to 29 February 2024.
Bidder Inquiry 04: Is this an RFP/ Best Value contract?
Government Response: The solicitation is an Invitation for Bids (IFB), and the bid opening date is scheduled for 29 February 2024.
Bidder Inquiry 05: It’s assumed that the Pipe infrastructure in the streets is to be supported by piles such as CFA’s or Timber Piles. It’s not clear where the pile supports are to be installed and what pipe they are supporting. We are asking for a specific Bid item for the piles that show the total length and also clarity on what pipe they are to support.
Government Response: For pile supports information, refer to structural drawings: S-102, S-104, S-107, S-110, S-112, S-115, S-119, S-120, S-121 & S-122.
Bidder Inquiry 06: Will there be a Prebid and or a Site Visit for this contract?
Government Response: No pre-bid site visit will be hosted by the Government for this solicitation;
however, the entire project area is visible from public property. Contractors are encouraged to view the site at their own availability to aid in the development of their bids.
Bidder Inquiry 07: Sheet LP601 of the Landscape Plans requires some clarification. For example, it has two Wetland Emergent Zone plug charts with the same exact label but different plug mixes. Both are labeled with the same target elevations, yet they both have different quantities of the same species. Which is correct?
Government Response: There are three sets of landscape schedules on LP-601 that are specific to each BMP: BMP SBE-1A, BMP SBE-1B, and BMP SBE-1C. Each Wetland Emergent Zone plug schedule is specific to the BMP indicated (e.g. BMP SBE-1A requires 97,250 wetland emergent zone plugs, BMP SBE-1B requires 89,300 wetland emergent zone plugs, and BMP SBE-1C requires 8,650 wetland emergent zone plugs).
Bidder Inquiry 08: Sheet LP601, the chart for extended detention zone seed mixes appears to be duplicated, with the only difference being the elevation contour is 3.59 on one and 3.5 on the other. What is the intent with these two charts?
Government Response: There are two sets of extended detention zone seed mixes on LP-601 that are specific to BMP SBE-1A and BMP SBE-1B. Each extended detention zone seed mix schedule and elevation note is specific to the BMP indicated (e.g. BMP SBE-1A requires extended detention zone seed mix to be planted between el. -0.66 and 3.59, BMP SBE-1B requires extended detention zone seed mix to be planted between el. -0.66 and 3.5. BMP SBE-1C does not contain an extended detention zone so there is no extended detention zone seed mix specified. Please note, the correct upper elevation of the extended detention seed mix for BMP SBE-1B is 3.59. This has been adjusted on LP601.
Bidder Inquiry 09: Sheet LP601, Upland Zone Seed Mix. There are two identical charts with no distinction. What is the intent here?
Government Response: There are three sets of landscape schedules on LP-601 that are specific to each BMP: BMP SBE-1A, BMP SBE-1B, and BMP SBE-1C. While the Upland Zone Seed Mix schedules are identical, they are to be applied to each BMP as indicated.
Bidder Inquiry 10: Sheet LP601, Note 5, what is the purpose of providing the note saying "Shrub plants to be installed at 25% of acreage in upland zone"? Exact quantities of shrubs are provided, so how is the 25% to be used?
Government Response: The inquiry is correct; the quantity of shrubs was calculated based on 25% of the upland acreage for BMP SBE-1A and SBE-1B, respectively. Provide the quantity of shrubs per the landscape schedule for the upland zone as indicated for BMP SBE-1A and SBE-1B. Layout of the shrubs shall be as indicated in Note 7.
Bidder Inquiry 11: Sheet LP601, Note 5, there is a note on the right hand side of the page states "Shrub plants to be installed at 50% of acreage in upland zone". This is a conflict with the other Note 5 on the same page stating 25%.
Which is correct, and how is this information to be used when exact quantities are given?
Government Response: The inquiry is correct; the quantity of shrubs was calculated based on 50% of the upland acreage for BMP SBE-1C. Provide the quantity of shrubs per the landscape schedule for the upland zone as indicated for BMP SBE-1C. Layout of the shrubs shall be as indicated in Note 7.
Bidder Inquiry 12: Sheet LP601, please clarify Note 11 on the Plant Schedule Notes.
Government Response: The seed mixes are to be applied in their respective planting zones prior to the installation of plant material. Extended detention seed mix is to be applied to both the extended detention and the emergent zones. Upland seed mix is to be applied in the upland zones as well as in areas where the restitution trees are planted as noted on the LP drawings.
Bidder Inquiry 13: Bid Items #30, 15’’ DIP & Bid Item #50, 18’’ DIP. Are these two pipes to be installed on piles?
Government Response: Bid Item #3 15" DIP & Bid Item #5 18" DIP are the total linear footage of multiple pipes and will not be installed on piles.
Bidder Inquiry 14: 18’’ ESVP that is shown on Plan G108, with details on CU111. Where are we to include the costs of this work? Which item should include the cost of this work?
Government Response: The cost of the 18" ESVP shown on CG108 and CU111 should be included in Bid Item #54 Vulcan Street - Storm Sewer.
Bidder Inquiry 15: Can the Contractor reuse the Excavated Materials from this project to fill excavations/trenches to grade? Or must the contractor import clean material for fill?
Government Response: Excavated material is assumed to be contaminated non-hazardous material until acceptably proven otherwise. Onsite source material can be reused if acceptable through appropriate inspection and testing. Refer to Specifications Section 02 61 13 Excavation and Handling of Contaminated Material.
Bidder Inquiry 16: In the solicitation package, the workforce participation goals for the minorities and females are only listed. In terms of minority subcontractors, what is the percentage goal?
Government Response: It is incumbent upon the offeror to provide subcontracting percentages that they feel that are achievable and will maximize Small Business Participation through their subcontracting activities. Responses should be provided in accordance with 52.219-9 Alt I Small Business Subcontracting
Plan (SEP 2023) Alternate I NOV 2016. Any socioeconomic category that the offeror does not feel they can meet should be justified.”
Bidder Inquiry 17: Spec. Section 00 21 13 Instructions to Bidders under Additional Instructions lists five (5) documents to be submitted as the bid proposal submission. Please confirm that these are the only documents that need to be submitted, and also confirm that we do not need to submit the entire 101-page Solicitation.
Government Response: Yes, these are the only documents that are required, the bidders do not need to submit the entire 101 page solicitation.
Bidder Inquiry 18: Spec Section 00 21 13 Instructions to Bidders states: “NOTICE REGARDING BID BONDS, PEFORMANCE BONDS, AND PAYMENT BONDS: The Standard Forms (SF24, SF25, and SF25A) for these bonds have been revised as of August 2016. When including your bid/offer, contractors/sureties shall use the revised versions. No other version will be valid and thus may render your bid/offer nonresponsive.” The bond forms currently found on the GSA website have been updated as of October 2023. Are these forms acceptable? If not, please provide the bond forms to be used, revised as of August 2016.
Government Response: Language is hereby revised to NOTICE REGARDING BID BONDS, PEFORMANCE BONDS, AND PAYMENT BONDS: The Standard Forms (SF24, SF25, and SF25A) for these bonds have been revised as of October 2023. When including your bid/offer, contractors/sureties shall use the revised versions. No other version will be valid and thus may render your bid/offer nonresponsive.
Bidder Inquiry 19: N/A
Bidder Inquiry 20: Please clarify the MBE/WBE/DBE/SBE/SDVOSB (etc.) subcontracting goals for this project.
Please clarify the agency certifications that will be accepted for the classification of MBE/WBE/DBE/SBE/SDVOSB vendors and subcontractors (ie. NYCSBS, Empire State Development, NYSDOT, USDOT, PANY/NJ, etc.).
Government Response: MBE/WBE/DBE and SBE are state certifications that do not apply to this acquisition. The apparent low bidder will be required to proposal goals for SB, SDB, SDVOSB, WOSB, HUBZone in the subcontracting plan.
Bidder Inquiry 21: Please provide an Engineer’s Estimate for this project.
Government Response: This information is not available for public release.

Please clarify the pipe material to be used.
Government Response: The bid item incorrectly identified the type of material for the Oceanside Ave sanitary network. The contract drawings indicating the pipe to be 30" RCP Class III is correct.
Bidder Inquiry 23: Reference Contract Drawing CU-116 The 30” RCP sanitary sewer shown is shown to be replacing the existing 27” sanitary sewer in the same lane. on dwg CU-116, G1 – Plan – Oceanside at station 0+00 to 0+99.23. The new 30” RCP is to receive timber piles. If the new sanitary sewer is in the same lane as the existing, this would require taking the entire existing sanitary sewer run out of service upstream and running a bypass system until the new run is constructed (pipe, manholes, foundations, piles, etc. Please confirm if this is the correct intent for this item of work.
Government Response: This is the correct intent for the item of work. The contractor shall provide temporary fluming and bypassing of existing sewer flows in accordance with the contract specifications. Refer to Specifications Section 01 50 00 for Protection of Existing Flow.
Bidder Inquiry 24: Reference Bid Item 0048 McLaughlin Ave South - Storm Network The bid item description states: “All work necessary to install storm sewer network along McLaughlin Avenue, including but not limited to excavation, dewatering, backfilling, hauling and soil disposal, support of excavation, crushed stone, 24" DIP, flap gate, manholes, pavement restoration and MPT in accordance with the Contract Drawings and Specifications.” Contract Drawing CU-106 indicates this pipe to be 24” RCP Class III. Please clarify the pipe material to be used.
Government Response: The bid item incorrectly identified the type of material for the Sand Lane North sanitary network. The contract drawings indicating the pipe to be 8" ESVP is correct.
Bidder Inquiry 26: Spec. Section 00 21 13 Instructions to Bidders under Additional Instructions, item #5 says “Bidders must check off box (d) in 52.204-8 Annual Representations and Certifications”.
Paragraph (d) on page 42 of 101, does not have a check off box associated with it. Please advise.
Government Response: Spec. Section 00 21 13 Instructions to Bidders under Additional Instructions, item #5 revised to Bidders must ensure 52.204-8 Annual Representations and Certifications is filled out or the SAM reps and certs if up to date.
Bidder Inquiry 27: Please advise if a Maintenance Bond is required for this project. If so, please provide the form of bond and associated terms and conditions.
Government Response: A Bid Guarantee is required with the bid. Performance and Payment bonds are required once the contract is awarded.
Bidder Inquiry 28: The following locations on the drawings state “See S-504 for type of pile and spacing”. The drawing S-504 does not provide that information.
1. Mallory Ave. – Storm Sewer Network – CU-104 – A1-Profile – Mallory Ave. - 18” ESVP storm sewer encased in concrete on piles.

6. 6. Vulcan St. – Storm Sewer Network – CU-111 – A1 Profile – Vulcan St. - 18” ESVP storm sewer encased in concrete on piles. What type of piles?
Please provide the type and spacing of the piles for the above locations.
Government Response: The referenced CU drawings have been revised to "…on piles (See S-504 for piles spacing and type) at existing structures." S-504 has been revised to provide more information on the details about the piles and reference that the pile spacing and type can be found on the plan drawings.
Bidder Inquiry 29: None of the manholes to be installed have any clear indication of what type of piles they are to be supported upon. Please clarify.
Government Response: Manhole details showing piles information for the types of manholes called out in the CU Sheets can be found in the NYC DEP Sewer Design Standards, dated September 2007, latest revision August 2018.
Bidder Inquiry 30: Regarding the various notes on the utility drawings regarding CCTV inspection of existing utilities. The following callouts have no quantity associated with the CCTV inspections:
1. Contract Drawing CU113 Wentworth Avenue – 18” sanitary sewer.
2. Contract Drawing CU113 Wentworth Avenue – 10” sanitary sewer.

Bidder Inquiry 31: Regarding the various callouts for CCTV inspection of existing utilities, are these utilities to be cleaned as well? The Contract Drawings only identify CCTV to be performed, but there are separate bid items for (0058) Television Inspection of Sewer and (0059) Sewer Cleaning. Please clarify.
Government Response: The CCTV inspection of existing utilities also requires the existing utilities to be cleaned. There are two different specification sections that described the CCTV inspections and the sewer cleaning, which is why there are two separate bid items. Refer to Specifications Section 33 01 30.16 TV Inspection of Sewer Lines and Section 33 29 00 Sewer Cleaning.
Bidder Inquiry 32: Reference Contract Drawings S-314 and S-315 for Box Sewers 1 thru 6. Please provide pile information including pile type, size, length and spacing.
