Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

1.2 DESCRIPTION OF WORK
The Work consists of temporary storage, characterization, and proper disposal of up to 50 cubic yards of incidental contaminated soil excavated as required by the design drawings and Section 31 00 00 EARTHWORK. This specification does not direct excavation of soil, it only specifies how to handle, characterize, and properly dispose of the soil that, having been excavated for the design, is determined to be contaminated based on visual or olfactory signs or chemical analysis. Soil at the site may have the potential to contain chemical contamination due to the proximity of the project area to to Environmental Restoration Program (ERP) sites. There are four ERP sites that are located in close proximity to the proposed Project area known as “SS-130 Gunnery Butt” (also identified as ZZ004), “SS-132 Old Engine Test Stand”, “AOC 131 New Engine Test Stand”, "SS-216", and "SS-125" as shown on Drawings CD-100, CD-101, CD-113, V-100, and/or V-101.
Site SS-130, the Gunnery Butt, is located west of the north-south runway behind the New Engine Test Stand at Red Horse Road and Cruz Avenue. The site was designated as a munitions response area (MRA), and falls under the Military Munitions Response Program (MMRP). The site was also evaluated under Resource Conservation and Recovery Act (RCRA). Early investigations determined soil contamination due to high Polycyclic Aromatic Hydrocarbons (PAH) present and further evaluation determined the site to be classified as “No Further Action” required with “Land-Use Controls” restrictions placed to prevent residential development.
Remediation activities were undertaken by Hurlburt Field to clean the site to within levels below residential standards. Further investigation and evaluation determined the high PAHs present in the soils were due to the remediation approaches used for stabilization, and a Site Rehabilitation Completion Report was issued in April 2014, closing the site with unrestricted use (Joe Gootee, Hurlburt Field, August 2016).
Site SS-132, the Old Engine Test Stand, is located on Red Horse Road west of the north-south runway across from the north-south parallel taxiway (Hurlburt Field, 2013). According to RCRA Facility Investigation (RFI) results, residual contamination poses no risk to human health or the environment. The EPA and Florida Department of Environmental Preservation (FDEP) approved the “No Further Action” status for the site in 1998. The site was closed with unrestricted land use (Joe Gootee, Hurlburt Field, August 2016).
AOC 131, the New Engine Test Stand, is located west of the north-south runway at the intersection of Cruz Avenue and Red Horse Road (Hurlburt Field, 2013). The site is covered by asphalt and concrete. Runoff from the site has been diverted to an Oil Water Separator (OWS) which goes to the wastewater treatment plant. A No Further Response Action Plan (NFRAP) letter of concurrence was received in July 1997 and no Contaminants of Potential Concerns (COPC) were identified for the soil (Joe Gootee, Hurlburt Field, August 2016).
SECTION 02 61 13 Page 2 Amendment 0001
Buildings 90809, 90731, 90825, 90811, 99104, and 99065 are scheduled to be demolished for this project. Building 90811 to be demolished is the large gun abutment structure and the EA notes it has been remediated and closed and available for unrestricted use. Buildings 99104 and 99065 are small buildings in the propulsion area. Lead and asbestos surveys have been completed for all the buildings. Samples from Buildings 90731, 90825, and 99065 were found to contain lead, and samples from Buildings 90825 and 90809 were found to contain asbestos. The lead and asbestos survey reports are included as Appendix B to the Project Specifications. See Specification Sections 02 82 00 ASBESTOS REMEDIATION and 02 83 00 LEAD
REMEDIATION.
Building 90731, to be demolished, is located within a regulated ERP site, site SS-125 with soil and/or groundwater contamination. Monitoring wells are in the area (within several feet of the building) and must be protected. If wells are damaged or destroyed, the Contractor will be responsible for filing an abandonment permit with the State, and reinstalling replacement wells at the Contractor's expense. An approved Environmental Plan is required prior to starting the building demolition.
Contact Joe Gootee, 850-883-3351, for assistance in developing a plan to address environmental compliance issues.
Building 90825, to be demolished, is located northeast of active IRP site SS-216. There are no environmental ERP concerns related to demolition of the building; however, there is a possibility of encountering contaminated soil/groundwater. Dewatering is not authorized without an approved dewatering plan. Monitoring wells are in the area (within several feet of the building) and must be protected. If wells are damaged or destroyed, the Contractor will be responsible for filing an abandonment permit with the State, and reinstalling replacement wells at the Contractor's expense. Report suspicious odors, odd soil color, sheens, unfamiliar liquids, buried materials etc., to Mr. Joe Gootee, 850-883-3351, if they are discovered.
Building 90809 located in the existing propulsion area and the environmental sampling reports for lead and asbestos containing materials for the project building demolition are included in Appendix B to the Project Specifications. Existing hazardous materials such as PCB-containing ballasts, mercury-containing fluorescent bulbs or thermostats, and/or radioactive smoke detectors may be present in all buildings to be demolished and must be removed and recycled or disposed prior to demolition. See Specification 02 84 16 HANDLING OF LIGHTING BALLASTS AND LAMPS CONTAINING PCBs AND MERCURY.
The Contractor shall monitor the soil and groundwater for contamination during the construction process. The Contractor shall characterize suspect contaminated soil and/or groundwater during excavation, which shall be stockpiled/stored within the Project limits shown on the Drawings.
According to the Geotechnical Engineering Report (Revision - 3), Special Operations Forces Aircraft Maintenance Unit and Weapons Hangar, Hurlburt Field Air Force Base, prepared by Terracon Consultants, Inc., "The subsoil profile consists of a deep (100 feet) deposit of sand which is variable in organic content, fines (i.e., silt) content and relative density. The near-surface (upper 4 feet) soils are silty, organic and very loose to soft. A similarly loose, silty sand seam occurs within the depth interval of 22 to 30 feet. Otherwise, the sands are medium dense to dense with relative density generally increasing with greater depth. Groundwater lies close to the existing ground surface." The boring logs and
SECTION 02 61 13 Page 3 Amendment 0001 laboratory data from the Geotechnical Engineering Report are provided in Appendix G of the Specifications.
Notify the Contracting Officer within 24 hours, and before excavation, if contaminated material is discovered or if other discrepancies between data provided and actual field conditions are discovered. Backfill material is not available on-site. Required sampling and chemical analysis shall be conducted in accordance with State and Federal requirements.
1.2.1 Scheduling
Notify the Contracting Officer within 24 hours of the discovery of contaminated material. The Contracting Officer will be responsible for contacting regulatory agencies in accordance with the applicable reporting requirements.

3.6.1 Stockpiles
Stockpiles shall be constructed to isolate stored contaminated material from the environment. The maximum stockpile size shall be 50 cubic yards.
Stockpiles shall be constructed to include:
a. A chemically resistant geomembrane liner free of holes and other damage. Non-reinforced geomembrane liners shall have a minimum thickness of 20 mils. Scrim reinforced geomembrane liners shall have a minimum weight of 40 pounds/1000 square feet. The ground surface on which the geomembrane is to be placed shall be free of rocks greater than 0.5 inches in diameter and any other object which could damage the membrane. Pavement may be used as the liner system.
b. Geomembrane cover free of holes or other damage to prevent precipitation from entering the stockpile. Non-reinforced geomembrane covers shall have a minimum thickness of 10 mils. Scrim reinforced geomembrane covers shall have a minimum weight of 26 pounds/1000 square feet. The cover material shall be extended over the berms and anchored or ballasted to prevent it from being removed or damaged by wind.
c. Berms surrounding the stockpile shall be a minimum of 12 inches in
SECTION 02 61 13 Page 6 Amendment 0001 height. Vehicle access points shall also be bermed.
d. The liner system shall be sloped to allow collection of leachate.
Storage and removal of liquid which collects in the stockpile, in accordance with Paragraph "Liquid Storage".
3.6.2 Roll-Off Units
Roll-off units used to temporarily store contaminated material shall be water tight. A cover shall be placed over the units to prevent precipitation from contacting the stored material. The units shall be located as shown on the drawings. Liquid which collects inside the units shall be removed and stored in accordance with Paragraph "Liquid Storage".
3.6.3 Liquid Storage
Liquid collected from excavations and stockpiles shall be temporarily stored in 55-gallon barrels or 500 gallon tanks. Liquid storage containers shall be water-tight and shall be located as shown on the drawings. Liquid will be stored on-site no longer than 30 days.
