Request for Information

1. Regarding TAB A, Subfactor 1 – Construction Experience, does the Government prefer that Offerors cite IDIQ contracts or individual task orders to demonstrate our capability to simultaneously perform multiple task orders?

Refer to Solicitation Sections L & M, L.4.1 and M.3.1.

2. Are PAQs (Attachment 6) required for contracts cited under Subfactor 1 – Construction Experience?

Offerors must submit Attachment V - Project reference Sheet (PRS) and Attachment VI - project reference overview sheet for Subfactor 1, construction experience.

Attachment VII, Performance Assessment Questionnaires (PAQs) will not be considered under the evaluation of Factor 1, Subfactor 1 – Construction Experience.

3. There is no requirement for Attachment 6 – PAQ listed in Section L or M. Are Offerors required to send PAQs to references?

For Factor 1, subfactor 1 - Construction Experience see Answer to above question #2.

For Factor 2 - Past Performance, Attachment VII, PAQs, should be completed by the Offeror’s customer. Yes, attachment VII should be sent to the Offeror’s customer. Offerors must submit Attachments V – PRS and VI - Reference Overview Sheet for Past Performance. Attachments V and VI shall be completed by the Offeror.

4. Are Offerors to feature project summaries under TAB A, Subfactor 1 – Construction Experience and provide the corresponding Project Reference Sheets (completed by our references) for each of these featured projects in our proposal under Volume 2, Factor 2 – Past Performance?

Offerors should complete Attachment V, Project Reference Sheets and Attachment VI - Reference Overview Sheet which correspond to projects submitted under Volume I, TAB A, Subfactor 1 – Construction Experience.

Offerors should also complete Attachment V, Project Reference Sheets and Attachment VI - Reference Overview Sheet which correspond to projects submitted For projects submitted under Volume II, Factor 2 – Past Performance.

5. Are PAQs required only for the projects featured under Volume 2, Factor 2 Past Performance?

Yes, See Answer to #2 above, Attachment VII, PAQs will not be used to evaluate Factor 1, Subfactor – Construction Experience. Attachment VII, Performance Assessment Questionnaire PAQs are only considered in the evaluation of projects featured under Volume 2, Factor 2 Past Performance.

6. Attachment 4 – Project Reference Sheet states that Offerors are to complete this form. Questions 9.2 – 11.3 are questions that our references would typically answer regarding our performance, for example: Question 11.3, “Would you work with this contractor again or recommend this contractor for future projects?” Are Offerors required to complete this form or references?

Attachment V – Revised Project Reference Sheet, dated 21 August 2020 should be completed by the Offeror.

7. For ease of evaluation and readability, will the Government please allow 11x17 pages for diagrams, tables, and charts?

Yes, the Government will make the allowance to accept the 11x17

8. If 11x17 pages are acceptable, are they to be counted as one page?

Yes, it will be counted as one page.

9. Attachment 4 – Project Reference Sheet states no more than 5 pages are allowed, RFP instructions in Section L.5.6 state no more than 3 pages are allowed. If we are to complete this form, please confirm Offerors are permitted to utilize all 5 pages of the attachment.

The Solicitation Section L.5.6 has been updated to reflect 5 pages per reference for Attachment V – Project Reference Sheet.

10. If Offerors are proposing as a single prime contractor, are they required to provide a consent letter from previous Joint Venture partners for them to release information regarding previous contracts/projects that we are featuring in our proposal?

Yes, Offerors are required to provide a consent letter from previous Joint Venture partners for them to release information regarding previous contracts/projects.

11. The requirements listed in Section L do not align with the evaluation criteria in Section M. For fairness and ease of evaluation, would the Government please consider aligning the requirements in Section L with the criteria listed in Section M?

Section L gives instructions to Offerors in how to prepare their proposal;

Section M is how the Offeror will be evaluated.

12. What is the “Percentage Applied” field in the table under Section B, MAIDIQ CAP Rates?

This is the Offeror’s escalation rate for the base and out years.

13. The note in Section B states that the Quality Control person can be the SSHO.

This conflicts with Attachment 1, paragraph 8.1.2 which states they have no other duties other than Contractor QC. Please confirm that the QCM can dual role with the

SSHO.

The QCM shall not have any other duties than as the QC. Note 1 in Section B of the Solicitation has been modified. Additionally, disregard statements in Attachment VIII, page 208 which states otherwise. Offerors shall propose and include in their price, a SSHO for the sample project.

14. Section L, paragraph L.4.2 refers to the Key Personnel as a Program Manager and Alternate Program Manager; Section M does not include evaluation criteria for resumes for key personnel; Attachment 1 (SOW) states Key Personnel include the Program Manager, Quality Control Manager, and Site Safety and Health Officer, but then further lists staff that may fluctuate based on volume and types of work such as QC Staff and On-Site Staff. Please confirm which positions are considered key personnel and require resumes.

Key personnel includes Program Manager, Alternate Program Manager, Quality Control Manager, SSHO, estimator and scheduler. QC staff shall be provided on an as-needed basis. Qualified QC for disciplines are required as needed.

15. Can the Cost Estimator be a dual role between the Program Manager and/or Project Manager?

Yes, as long as they are qualified and can maintain the workload.

Postponement of a proposal shall not be because estimator has additional duties. For purposes of the Sample project, offeror shall not dual hat.

16. Will the awarded MATOC prime contractors be permitted to no-bid projects on occasion or will they be penalized for not bidding every project on the MATOC?

MATOC prime contractors are not required to bid on every project.

17. Will the MATOC allow for on-boarding and off-boarding of other contractors through the life of the contract?

No.

18. Does the government anticipate a significant number of projects to be under $500k in size?

It is estimated that 1/3 of the project will be under $500K.

19. Is the Sample Project for evaluation purposes only or will the Sample Project be awarded under this solicitation?

As stated in the Solicitation this is a notional project that may or may not be awarded.

20. Section B mandates the contractors use E4Clicks for estimating the task order projects. I believe this is an error. Software estimating like E4Clicks, RS Means, Gordian are historically used in Single Award JOCS or SATOCs when the government is using only one contractor, I have never seen the Government require the use of an estimating software system like E4Clicks for MATOCs. By requiring a software estimating system the government is essentially not allowing the contractor to price given real time local market conditions. The government will find the use of competitive pricing in the local market not using estimating software to be much more cost effective then relying on E4Clicks to price bids.

E4clicks is not an error. The Government does not intend to use it as a pre-priced book as in a JOC. E4clicks or equivalent program is intended to be use as a standard format for line item breakouts. Real time market conditions are expected.

21. Please provide the sign in sheet.

The sign-in sheet was posted to beta.sam.gov on 12 August 2020, named site visit attendees.

22. Is the government going to confirm that the 1st floor will be cleared for the duration of the base bid?

The first floor will not be cleared during the duration of the base bid.

23. Is it the intent of the Contracting Officer to only have us set up a structure of the pricing, or are we submitting actual pricing of the work?

Yes, it is the intent of the Government to have the Offerors to set up structure of the pricing and provide actual pricing of the work.

24. What format is required for pricing structure of this SEED project?

Refer to response to question 23 and 29.

25. Can the RFI date be extended?

No

26. Can the bid due date be extended?

Yes

27. Should the past projects in Volume 2 be the same as volume 1?

The past performance projects in Factor 2 will likely be the same projects listed in Construction Experience, Factor 1, subfactor 1; however, it is not a requirement that they are the same projects.

28. Are past performance questionnaires required for past projects?

Attachment VII, PAQs, will be considered in evaluating Factor 2, Past Performance. The PAQs will not be considered when evaluating Factor 1, Subfactor 1 – Construction Experience.

29. Will the Government provide Offerors a trial seat for e4clicks for bidding purposes?

No, the Government will not provide this.

30. Will the Government please consider extending the due date a minimum of two weeks from the release of initial RFI? The Government’s feedback is greatly appreciated and your clarifications and answers to our questions will have a significant impact on our proposal. Please consider allowing additional time for Offerors to prepare their proposals accordingly.

31. What is the current status of the lockset and keying for B2100?

Refer to Government’s response to question 19.

32. Are Contractors responsible for replacing the exterior expansion joint sealants?

Yes.

33. Please provide the current condition of the exterior landscaping, existing storm water washout cavities at pipes, valves, and curbs.

That should have been observed during site visit.

34. Will new drawings and SOW be issued specific to the work on the 2nd floor reviewed during the site visit?

No.

35. L.3.1(b) – is PDF permissible?

36. L.3.1(c) – including the chart in L.3 - the instructions require us to submit a total of 12 separately bound binders – is this correct?

37. L.4.3 – should this be TAB C and not E?

Yes, the Solicitation has been updated to make the change from TAB C.

38. L.7.4.1 – says “If applicable” - If the offeror warrants that, to the best of the offeror’s knowledge and belief, there are no relevant facts or circumstances which could give rise to an Organizational and Consultant Conflict of Interest (OCI) as defined in FAR 9.5 and that the contractor has disclosed all such relevant information – is an OCI Mitigation plan required?

The OCI Mitigation plan is only required if applicable.

39. Is e4Clicks required to be used?

IAW the solicitation e4Clicks will ONLY be utilized for proposal formatting.

There will not be any pre-negotiated pricing.

40. When is the due date?

The due date was 31 August 2020 however refer to the Solicitation Amendment 0001.

41. For some of our projects we have USACE/NAVFAC and other PPQs already filled out by our customers, rather than rewrite a PPQ can our customers send the previously filled out PPQs?

No, your customers should complete Attachment VII – Performance Assessment Questionnaire as posted on beta.sam.gov

42. Can you confirm the anticipated PoP?

Refer to Solicitation, Section F.

43. Is an ACM survey available for the space for the Seed Project?

Yes; they are available; see three additional attachments dated 21 August 2020.

44. Will the building be occupied during construction?

No.

45. Is the sample project going to be awarded?

Refer to Government’s response to question 19.

46. What is the ROM for the sample project?

That will not be shared with potential Offerors and this is Government information only.

47. If the sample project is not going to be awarded, how will the government evaluate fair and reasonable pricing for selection of 5 MATOC contractors? We have seen past MATOC offers being unreasonably low just to get on a MATOC, at prices which are impossible to actually perform the work. How will the Government protect against this on this MATOC?

Refer to Solicitation, Sections M.1 through M 2.2. The MAIDIQ CAP rates submitted in response to this RFP identify the maximum binding rates utilized in subsequent task orders. These binding CAP rates will become part of the resulting contracts.

48. We request a time extension of 2 weeks in order to have adequate time to receive and review the Q&A and adjust our proposal accordingly.

49. If Task Orders are awarded on a low price, Firm Fixed price basis, why is the government requiring the use of E4Clicks?

Refer to response to question 29.

50. Why is the Government requiring all 5 MATOC awardees to procure for them E4Clicks? How many copies are we required to provide? We suggest you make this a Task Order award under each MATOC.

Refer to MATOC Statement of Work dated April 7, 2020, Section 6.0 for Proposals. The Government is not requiring the MATOC awardees to procure E4Clicks for the Government.

51. 52.223-9 ESTIMATE OF PERCENTAGE OF RECOVERED MATERIAL

CONTENT FOR EPA-DESIGNATED ITEMS (MAY 2008), paragraph (2) Submit this estimate with each Task Order proposal over $150,000 as applicable.

Please confirm we are required to submit this with our proposal and, if so, where should we include it?

This will be directed at the task order level and not required to be submitted with the proposal.

52. Will the government consider allowing electronic submittals due to COVID?

These can be submitted using DOD SAFE EXCHANGE or other formats available

No, the Government requires mail-hard copies of all proposals.

53. Section L, paragraph L.4.w. TAB B: SUBFACTOR 2- Management Approach states“Job qualifications associated with each Offeror identified key labor category must demonstrate the offeror’s knowledge and understanding of necessary experience, education, and licensing/certification.”

Please clarify what the government is requesting?

Do you want both resumes and minimum position qualifications?

The Government is requesting the Offerors proposed teams provide resumes which will demonstrate they have the necessary experience, education, and licensing/certification.

54. What is a “notional TO”?

The notational project is a representation of what the Government envisions to award under this Multiple Award Task Order Contract. The Government reserves the right to award the Notional Sample Project.

55. L.4.2.1 – TAB B - SUBFACTOR 2.1 –Sample Project Response

Can we include 11 x 17 pages for the sample project schedule? If so, can these be counted as a single page?

Refer to response to questions 7 & 8.

56. The solicitation indicates task orders will range from $250,000 to $3,500,000.

Approximately how much total aggregate amount in awards is anticipated each year of the contract?

Refer to Solicitation, Sections L.4.3 & M.3.3

57. Can the government provide a list of projects under consideration for this

MATOC?

A list will be provided at the task order level to the MATOC contract awardees.

58. L.5. VOLUME 2: FACTOR 2 – Past Performance. L.5.3 states “L.5.3. Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed. The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. …Past Performance information described herein is required on the Offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform 20% or greater of the proposed effort based on the total proposed price. “

Is the 20% based on the price for the sample project? Please clarify the basis of the “20% total proposed price”

Yes, the 20% is based on the price of the sample project. The 20% is a reference of the Offeror’s past performance for Factor 2.

59. We do not propose to team or JV on this MATOC. We wish to stand alone on our past performance, and do not require partners in order to meet the requirements or show relevant past performance. The sample project is “notional” and many subcontractors are not interested in proposing

What is the purpose of requiring named subcontractors?

Some Offerors will utilize subcontractors, therefore for those Offerors who do use subcontractors, this information will be required.

60. We are the prime and will hold all required bonds for this MATOC and TO. Will the government accept a list of potential subcontractors to be used?

Yes. However, if the Offeror is using a specific subcontractor that will perform 20% or greater of the proposed effort on the sample project, based on the total proposed price, that specific subcontractor’s past performance must be included.

61. Will the government reconsider the requirement for having subcontractor’s past performance submitted, particularly if we do not need nor wish to qualify using subcontractors past performance?

Refer to the Government’s response to questions 58 & 59.

62. If the government requires subcontractor’s past performance- is this only for the sample project?

Refer to Government’s response to question 58 & 59.

63. Please identify which trades the government requires us to name subcontractors for and provide their past performance. This could be extensive. Please confirm this will not be included in the page count. 30 pages for 5 projects and multiple subcontractors 5 projects each would not be sufficient.

Each Offeror will make the determination as to which trade will require 20% or greater subcontractor support that they use for their past performance (if used on the sample project).

The Government confirms this will be included in the page count.

64. As the prime contractor, we may prequalify subcontractors, but not make a selection unless we are the successful offeror. In this case- how does the government wish us to respond?

Refer to Government’s response to question 58 & 59.

65. Past- Performance: We do not wish to qualify for this with any named specialty subcontractors. Is it sufficient that we name our design partner, and make our selection of subcontractors on a task order basis only? Therefore, please confirm, we are only required to submit our designer’s past performance?

66. We have made many recent requests for Past Performance questionnaires to our clients. Would the government allow our references to submit these other formats? Or CPARS in lieu of the Performance Assessment Questionnaire?

Refer to Government’s response to question 41 and refer to notes section in Solicitation Section M.4.2

67. Please confirm the contractor/offeror is to complete attachment V and include in our Past Performance? This appears to have questions that a reference would normally respond to.

Refer to Government’s response to question 6.

68. M.5.1.1 states “The total of the sample project will equal the total base year.”

Please clarify, we do not understand this

The sample project is representative of all work that could be executed under a MATOC. Therefore Offerors proposed prices should address the sample project price as the total base year price.

69. The specs state the The inspectors shall have no duties other than QC.

Furthermore, “The QCM shall not have duties other than QC. “ However, the solicitation states “Note 1 – the Contractor Quality Control Person can be the SSHO on this project.”

Please clarify- can the QC person have other duties when the size of the task order does not necessitate multiple personnel on-site?

70. Can the Safety Officer have other duties?

No.

71. Are there any task orders for which the government would allow us to multi-hat the superintendent / QC/ SSHO as one person?

Refer to Government’s response to question 13

72. The Bid Form Pages 3-5 CLIN 001,1001,2001,3001 and 4001 Refer to the services described in Section C, Section C Refers to Statement of Work April 7, 2020. Statement of Work Dated April 7, 2020 does not provide any Description of work.

Refer to Government’s response to question 68 in addition to utilizing the sample project price as the base year and for each subsequent year utilizing your escalation percentage

73. At the site visit, we were not invited to view the Ground Floor but were extensively shown the 2nd floor. Is there work required on the 2nd floor? Why were we not allowed to view the 1st floor? We will need another site visit to view the 2nd floor please.

At the site visit all Offerors were afforded the opportunity the view the entire building. This afforded all Offerors a clear understanding of what to propose for the first floor only, therefore no additional site visits will be allowed.

74. The solicitation includes a Statement of Work for Building 5385. And As BUILT Drawings for Building 3330. What is the purpose of including these drawings?

These are not applicable. See Attachment IV, Bldg 2100 Drawing Specs

75. Is this a recompete for an existing MATOC? If so, please identify the incumbent contractors and the total number and amount of task order awards for each year under the prior MATOC program.

This is a new requirement.

76. What percentage of the RTOPs are expected to be design build?

There will be TOs where a 35% solution is given; however the overall percentage for the MATOC effort is unknown.

77. Attachment III states “Offerors are to propose repairs and reconfiguration for the specification’s base bid only (first floor and exterior) and not the options (elevator and work on second floor).“

We cannot find anything referencing Base Bid and Options- please provide the pricing sheet for this sample project.

Refer to Government’s response to question 68 & 72. Price the Base Year Bid as the total price of the Sample Project (Bldg. 2100 first floor and exterior).

For purposes of evaluation, price the Option Years as the total price of the same Sample Project (Bldg. 2100 first floor and exterior) plus escalation percentage per year.

78. Attachment III SOW Sample Project, references the following enclosures- please provide all of these as we cannot locate them in the solicitation package:

The Contractor is responsible for verifying the existing conditions and incorporating any additional information required for proposal.)

79. Please clarify exactly what you require in our price proposal

80. How are we to show labor rates- cap rates? Do you have a table?

Refer to Government’s response to questions 68 & 72. Offerors will provide their own table.

81. How are we to show annual escalation?

Refer to Government’s response to questions 68 & 72.

82. How are we to provide our bond rate?

Refer to Government’s response to question 68.

83. We are concerned evaluation of pricing based on the sample project cannot be done on a fair and reasonable basis. Since this is not a seed project to be awarded, subcontractors are not interested in pricing. Furthermore, e4Clicks does not show subcontractor pricing, but rather a means-based estimate. If the government has not done their own internal line item pricing for the sample project, how will we know what the proper quantities and cost should be?

See question 29 response for e4Clicks.

Refer to Solicitation Section B, continuation. Offerors binding MAIDIQ Cap rates shall be derived IAW the table outline. This should not include quantities.

84. Further, a line item means based price does not reflect what the open market will bear on a firm-fixed price construction project. Using a firm-fixed price on a sample project which may or may not be a real project does not appear to be good evaluation of out-year pricing for the MATOC. Can the government please give the offerors a clear understanding of how pricing on a not fully designed sample project with no drawings, and a 2-year old design, can be evaluated as to fair and reasonable pricing?

85. Do we need to submit our proposal in E4clicks?

See question 29 response for e4Clicks.

86. If so, why, as all task orders are awarded on a firm fixed basis?

See question 29 response for e4Clicks.

87. Will the government accept RS Means based pricing for the sample task order, which is the same basis but not proprietary as E4clicks- since it states the contractor is required to buy e4clicks after award?

Yes, if RS Means is equivalent to E4Clicks. See question 29 response for e4Clicks.

88. Is E4clicks to be used on every RTOP pricing?

E4 Clicks will be used for formatting of proposals, there will not be any pre-negotiated pricing. Reference page 4-5 of SOW.

89. Can the Government please clarify the due date and time of the proposal?

Beta.sam shows the due date and time of August 31, 2020, 2PM EDT, but there is no date indicated on the solicitation. Also, if the bid date is August 31, is it possible to extend it so that the proposal is not due on a Monday? We have concerns regarding packages getting lost during the weekend.

90. Reference: L.3.1. Proposal Format, b) Digital copies on CD-ROM Disk shall be provided in Microsoft Word, PowerPoint and/or Excel and shall adhere to all proposal preparation instructions with the exception of the requirement for three ring binders. Will the Government accept PDF instead of Microsoft Word or Powerpoint?

93. For the Organization Structure Change History, do we need to include all organization changes since the start of the company, or do we just include Organization Structure Changes that would affect the Past Performance section?

Organization Structure Change History need only include changes affected in the Past Performance section.

94. The Service Load rating for the Diesel Engine-Generator is listed as 100kW On pg.4 of 26.32.14, but E-601 One-Line lists the "NEW 50kW GENERATOR".

Based on the building specifications and the engineering report from USACE, the emergency generator should have a service load capacity of 100 kW and a starting kVA rating of 20 kVA. The motor/generator specs are to be as specified on page of section 26.32.14.00 10.
