Post-Industry Day Questions and Answers

14 September 2016

1. Q: Will FAR 12 Commercial pricing standards be applied to Task Orders requiring material? (repair parts, new or replenish) Most NSRWA aircraft are commercial not military - developmental?

A: The Government will be contracting the effort on a FAR part 15 basis. It is the responsibility of the offeror to determine in accordance with FAR whether the material items needed in support of the Government should be purchased on a FAR part 12 or FAR part 15 basis.

2. Q: How does NSRWA Office plan to award Task Orders - Best Value, Lowest price? What's the criteria?

A: The initial Task Order (TO) awards will be part of the MATOC hybrid 2-step competition which does involve best value. Subsequent TO evaluations will use evaluation criteria tailored to the TO objectives, which will allow for use of either LPTA or Best Value Trade Off.

3. Q: While you stated that the contract award will be a best value - will the follow-on task orders be LTPA?

A: The initial Task Order (TO) awards will be part of the MATOC hybrid 2-step competition which does involve best value. Subsequent TO evaluations will use evaluation criteria tailored to the TO objectives, which will allow for use of either LPTA or Best Value Trade Off.

4. Q: How many primes will you select in each of unrestricted and restricted pools?

A: At the present time, the USG intends to award two or more prime contractors that meet the evaluation criteria for each pool.

5. Q: Since the will be a multiple award ID/IQ contract with a restricted and unrestricted suite, will all task orders be required to be bid by all awardees?

A: No. Pool participants will only propose to Task Orders issued to that pool.

6. Q: Regarding proof of reach back to OEMs w/ NDA or LOA, what overall guidance will you establish if an OEM choose to prime the effort?

A: Performance under the MATOC will require ability to support multiple types (MDSs) of rotary winged aircraft. OEM's that choose to be a prime will be required to demonstrate reach back to the other OEMs as well as their own airframes.

7. Q: Has the contract anticipated budget ceiling been established?

A: Yes.

8. (a) Q: Will the small business goal be a goal or a requirement?

A: Both large and small business are required to submit a small business participation plan with their proposal. A Small Business Subcontracting Plan will be a requirement for large businesses to be eligible for award. See FAR 52.219-9

8. (b) Q: If a requirement, any penalties associated with failure to meet?

A: Penalties for failure to make a good faith effort in meeting the goals in the Small Business Subcontracting Plan shall be governed by FAR 52.219-16 Liquidated Damages

8. (c) Q: Is the goal a composite or broke out by socio-economic category?

A: Sections L & M of the contract detail the required breakout of the socio-economic categories for the Small Business Participation Plan. The socio-economic category breakout for the Small Business Subcontracting Plan shall be completed in accordance with FAR 52.219-9 entitled, "Liquidated Damages--Subcontracting Plan."

8. (d) Q: If by Total Contract Value (TCV), what about CONUS vs OCONUS accounting?

A: The Department of the Army collects data on CONUS and OCONUS small business actions except for Foreign Military Sales, Contingency Contracting, and countries that have Status of Forces Agreements (SOFA).

9. Q: Please explain the "pool" of small business set-asides. Will this be at contract level? What happens if you get no small business proposals at contract level? Need at least 2 small business for set-aside.

A: The USG intends to establish a Restricted Pool (SB Set Aside) and Unrestricted Pool (Other than SB) at the MATOC level. Without 2 qualifying SB offeror's, there will not be a Restricted Pool.

10. Q: Can key personnel be the same for a large business submission and a small?

A: The Key personnel should come from industry team partner that will perform that service, whether a SB or large.

11. Q: Can you please clarify the technical experience requirement with regard to RW vs. OCONUS experience A: Rotary Wing CLS experience can be either CONUS or OCONUS. The OCONUS experience requirement is only CLS (not Rotary Wing CLS).

12. Q: Please provide list and number of aircraft alone with their locations?

A: The number of aircraft by location is ever changing. NSRWA is currently supporting 24 Countries and 16 different Aircraft Platforms. The specific number of aircraft and their location will be defined in each TO.

13. Q: What is the prime requirement for past performance? Slide states 24 months and briefer stated 12 months?

A: IAW Section M. Past Performance for Prime Offeror and proposed key Subcontractors is 36 months of performance within the last 5 years of Rotary Wing CLS experience on a contract of similar scope, no less than 24 months of the 36 months performed by the Prime Offeror. Prime Offeror's must also have 24 months within that last 5 years of OCONUS CLS experience.

14. Q: What is the timeline for this acquisition?

A: RFP release is forecast for 3Q FY17 with proposal receipt 4Q FY17.

15. Q: Recommend establish a cost per flight hour for each mds?

Material/labor component?

A: No cost per flight hour has been established.

16. Q: Is the USG going to submit separate Draft task order RFP?

A: The USG anticipates issuing three DRAFT Task Order PWS(s).

17. Q: What is the small business size standard you will be urging to determine the restricted pool eligibility?

A: NAICS 488190 Small Business standard is $32.5M annual average receipts.

18. Q: If an offeror is using a JV to pursue the opportunity, does it matter which partner of the JV has the AS9100 Quality certification?

A: The Joint Venture (JV) entity will be treated as a Prime Offeror. With regards to the AS 9100 Quality Certification, the JV partner that will be responsible for the performance of the function to which AS 9100 would apply must possess the certification.

19. Q: If an offeror is using a JV to pursue the opportunity, does the Letter of Offer and Acceptance (LOA) or Non-Disclosure Agreement (NDA) with the OEM have to be with the JV, members of the JV, or Subcontractors on the team?

A: The Joint Venture (JV) entity will be treated as a Prime Offeror. With regards to LOAs or NDAs, either the JV entity or the JV partner that will be responsible for the performance of the function to which the LOA or NDA would apply must possess the documentation.

20. Q: During the Industry Day, it was stated that the determination of which category the USG will place work in the Restricted or Un-restricted category would be based on complexity? Can the USG clarify if the decision will be based on a dollar value or will they review the Small Businesses within the MATOC’s capabilities prior to making the determination to keep work from just going to the Unrestricted Category. Concern is why a small business would spend the B&P dollars when there doesn’t appear to be an opportunity to perform. Rationale for stating is that all work being performed currently on CLS is being performed under Large Prime Contractors A: The complexity (level of effort) will correspond to an annual contract cost, which will determine if the Task Order will be issued to the Restricted Pool.

21. Q: The USG has stated that the Offeror has to have had 24 months of OCONUS Past Performance within the last 36 months in order to be evaluated as acceptable. Can the USG clarify OCONUS Past Performance, i.e. Does Hawaii and Alaska apply?

A: Hawaii and Alaska are considered OCONUS.

22. Q: Has the government contemplated the addition of an Armorer Labor Category?

A: Yes.
