1 Section C - PWS 1.2 What does the government consider an acceptable "demonstrated" relationship? PWS paragraph 1.2 was re-written and removed this statement.
2 Section C - PWS 4.3.1 For OCONUS facilities, what is the current list of Army Recognized Airworthiness Authorities?
Specific airworthiness requirements will be defined at the TO level. Currently, only the CLS effort supporting the Mi-17 in the country of Afghanistan has a requirement for Airworthiness and it is covered under the Aviation Engineering Directorate (AED) memorandum TN98085A, dated 15 May 13. This memorandum recognizes the Ministry of Defense(s) of: Russian Federation, Czech Republic and the Republic of Croatia.
3 Section C - PWS 5.1.1.4 What government or reference document should be used for the Safety System Program Plan (SSPP)? See Section C.6 Deliverables (PWS) on page 32 of the Draft RFP
4 Section C - PWS 5.1.4.1 Will the Government provide a DD254 at IDIQ award with sufficient authorization for maintenance of personnel at the SECRET level? Yes
5 Section C - PWS 5.1.5 When is the Transition Plan due to the government? If due with the IDIQ proposal would the government increase the allowed technical page count so it can be included?
Tranisition Plans, when required at the Task Order level, will be specified in the Task Order Request for Proposal.
7 Section L L.D.d Please clarify the definition of Key Personnel between this paragraph, paragraph M.D.d, and paragraph C.5.2.3.a Contracts Manager added to Key Personnel in PWS at C.5.2.3(a)
8 Section L L.D.2. Sec 2
This section identifies Attachment 0009 of the RFP to be completed and included in Volume II Technical. This attachment is over 20 pages when completed. The total page count allocated for Volume II is 30 pages. Please clarify that this attachment is to be included as an attachment to Volume II and not included within the allotted page count.
Attachment 0009 is not inclusive of page counts; section L-D.2 Section 3 updated to state required attachments are not part of the page counts.
9 Section L L.D.2.Sec 4.A
Could the government please clarify what it wishes to have submitted as part of the Proposal Submitted Contract Management Plan? Paragraph C.5.2.3 splits focus between TO requirements and Proposal requirements. PWS language has been revised in C.5.2.3.
10 Section L L.D.2.Sec 4.B Will Sample Task Orders 0002 (Mi-17), and 0003 (IA 407) be included? If so, will they be released in draft form prior to the Final RFP? No and No; this is a change from our approach as briefed at Industry Day
11 Section L L.D.3
Is the Government's definition of "proposed team member" for this paragraph, the same as "Key Subcontractor" or does the government want past performance on every small and large business team member listed?
Teaming is defined in FAR 9.601. Section L.D.(3) was revised to remove "team member" from past performance submission requirement; the Government wants Past Performance from the prime, key subcontractor(s), and JV partners only.
12 Section L L.D.2.Sec 4.A / C.5.2.3.1
This Section requires the Contractor to provide a CMP in accordance with PWS 5.2.3.1. PWS
5.2.3.1 requires the Contractor to supply a Property Management SOP. This Contractor’s SOP for Property Management Plan is 55 pages. The total page count allocated for Volume II is 30 pages. Please clarify that this SOP is to be included as an attachment to Volume II and not included within the allotted page count.
Property management SOP will not be required at the MA ID/IQ as part of the CMP. PWS has been revised.
13 Section M M.2.A.2
For evaluation weighting criteria, does Past Performance + Technical together weigh slightly more than Price, or does individual Past performance and Technical each weigh slightly more than price?
Language in the PWS revised; The Past Performance Factor is equal to the Technical Factor. The Past Performance and Technical factors separately are slightly more important than Price.

14 Section L&M M.E.I Is the Government going to evaluate for Price Realism at the IDIQ and TO Level?
Price realism will not be conducted at the IDIQ level or Sample Task Order (STO) level. Please refer to Section M.-2.E(3) of the solicitation which states, "The FFP O&A and Changes Contract Labor Rate Table(s) will be evaluated for fairness, reasonableness, compliance, completeness, and errors." Also, please refer to Section M-2.A(3) of the solicitation which states, "The pricing of the STO will provide the basis for the SBPP proposal evaluation, but will not be evaluated as a seperate pricing factor." Future Task Order Proposals (TOPs) will be evaluated as described in Section H-20.6 which states, "The source selection process for each TO will be specified in the TORFP and will use the approach that best fits the requirement."

CHANGED IA60039 252.237-7023 01-OCT-2010 CONTINUATION OF ESSENTIAL
CONTRACTOR SERVICES
Section L-15, 252.237-7024 NOTICE OF CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES OCT/2010 and CHANGED LA60006 252.237-7024 01-OCT-2010 NOTICE OF
CONTINUATION OF ESSENTIAL CONTRACTOR SERVICES
L-15 and the change at LA60006 indicates that an Essential Contractor Services Plan should be submitted with the Contractor’s offer, however the instructions do not indicate what volume should contain this plan. Can the Government please clarify that the Mission Essential Contractor Services Plan should be included as an attachment to Volume V and not included in any page restricted volume?
Submission of a plan under DFARS 252.237-7023 and -7024 is not a requirement of the MA ID/IQ proposal, rather, is a TORFP requirement.
16 Section L
L-19.D(3) VOLUME III PAST
PERFORMANCE
In this section it is noted that the offeror must submit two letters for every Key Subcontractor “…The Offeror shall submit the written consent of its key subcontractors to allow the disclosure of its suppliers past performance information to the Offeror. In addition, letters of commitment for this effort shall be included for all key subcontractors for their past performance to be considered.” Can the Government please clarify that the letters requested should be included as an attachment to Volume III and not included in the overall page count?
The Government increased the number of allowable pages in this volume. Yes;
the letters requested should be included as part of the overall page count.
17 Section L
L-19.D(3) Section 7: Past Performance Risk Assessment Questionnaire
This section states, “For all contracts identified in Section 3, Summary of Relevant Contract Experience, a Past Performance Risk Assessment Questionnaire using Attachment 0003 shall be completed and submitted. The Offeror shall complete Part I of the Past Performance Risk Assessment Questionnaire and e-mail the questionnaire to both the Government contracting activity and technical representative responsible for the past/current contract (One Point of Contact (POC) and one contract per questionnaire.) The POCs shall be instructed to electronically complete Part II of the questionnaire and e-mail the entire questionnaire to the Contracting Officer, Mr. Barry Byrd at barry.d.byrd.civ@mail.mil within three days of receipt. The Offerors shall also e-mail a list of all the POCs who were sent a questionnaire using Attachment 0004, Past Performance Assessment Reference Sheet to the Contracting Officer.”
Can the Government please clarify what the Government would like “submitted”?
Should the offeror complete section 1 and only submit page 1 of the Questionnaire in the proposal? If so, please clarify that these Questionnaires would not count against the 20 page allotment for Volume III.
Should the offeror only include a tab for the Government to file completed questionnaires under once received?
Should the offeror include Attachment 0004 under this tab in addition to emailing it to the Government?
Fill out Part 1 (page 1) and submit in Volume III. The pages will count toward the page limitations in Volume III, however, the page count will increase in the final RFP. No, the Government wants offerors to fill out Part 1 (page 1) and submit under Section 7 of Volume III. Attachment 0004 Past Performance Assessment Reference Sheet will likely not be part of the final RFP

19 Section B CLIN 0001 – FFP CLS Services / CLIN 0002 CPFF CLS Services
How will the Government determine whether services will be performed under CLIN 0001 FFP or
CLIN 0002 CPFF?
FFP will be used to the maximum extent practicable except in cases where the customer specifically request costs.
20 Section H H-18.2
H.18.2 Consult the Department of Labor (DOL) website: www.dol.gov for specifc location wage determinations as appropriate
Please provide guidance on whether we should utilize “odd” or “even” numbered wage determinations.
The contractor needs to identify which Wage Determination they recommend in Attachments 0010 and 0011. Contractors should identifiy if they are using a standard or non-standard Wage Determination (WD), the state and county of performance (if CONUS), the WD category mapped to the Contractor's position and the USG's position description, and the proposed O&A and Changes ceiling rate.
EVEN-NUMBERED wage determinations are to be applied only to contracts where an even-numbered SCA wage determination applied to the preceding contract of the same federal agency for the same services in the same location. ODD- NUMBERED wage determinations apply to most SCA contracts. Contractors should inform the Government if it is using "odd" or "even" numbered wage determinations.
21 Section I
WLSS-C related services may occur at sites located in the Continental United States (CONUS) but will be performed predominantly Outside the CONUS (OCONUS).
Given that the work will be performed in OCONUS locations, does the Government intend to incorporate 52.228-3 – Workers’ Compensation Insurance (Defense Base Act) and 52.228-4 -- Workers Compensation and War-Hazard Insurance Overseas. Added 52.228-3 and 52.228-4 to the RFP
18 Section L
L-19.D(2).S4.B.ii, Volume II Technical, Section 4: Technical Approach, B. Sample Task Order, (ii) Task Order Management Plan (TOMP) Attachment 0013, Sample Task Order (STO) Performance Work Statement (PWS) L-19.D(6).i, Volume VI Small Business Participation, (i) Small Business Participation Plan
The Small Business Participation Plan shall be submitted under Volume VI. Small Business Participation. Reference RFP Section L-19.D(6).
Section L will be revised to provide proper guidance on submission of the Small Business Participation Plan.
It is unclear if the offeror should submit the Small Business Participation Plan in both Volume II and Volume VI.
a. In section L-19.D(2).S4.B.ii the RFP requires the offeror to submit a Task Order Management Plan in accordance with the STO PWS (Att 0013). The STO PWS 5.2.5, Task Order Management Plan, states that the offeror should provide a Small Business Participation plan as part of the TOMP.
b. In section L-19.D(6).i the RFP states that the Small Business Participation Plan required for Volume VI should be completed for the Sample Task Order (STO).
“(i) Small Business Participation Plan. All Offerors are required to provide a proposal addressing, in sufficient detail, the information requested in this section. Complete Proposed Utilization of Small Businesses and Small Disadvantaged Businesses Section J, Attachment 0005 and provide it with the Small Business Participation Plan for the STO.
The Small Business Participation Plan applies to both large and small businesses and will be incorporated into any resultant task order. The following will be submitted as evidence of small business participation for the STO (Note: All references to TOTAL CONTRACT VALUE refer to the total value of the STO): Of the proposed TOTAL CONTRACT VALUE, not total subcontract value, identify the proposed dollar value and percentage of anticipated awards to small business.
All percentages shall use TOTAL CONTRACT VALUE as a baseline. Include only first tier U.S.
subcontractors. If the Prime Offeror (to include any U.S. small business concerns who are proposing as part of a joint venture or teaming arrangement) is itself a U.S. small business concern under NAICS 488190, the Offerors own participation as a SB, SDB, WOSB, HUBZone, VOSB, and SDVOSB will also be considered small business participation to the extent it is qualified under NAICS 488190 for the purpose of this evaluation.”
Can the Government please clarify where the offeror is to provide the plan?
Should the offeror include the plan in both Volume II and Volume VI?
Should the offeror only include the plan in Volume VI and refer to it in Volume II eg. “The offeror’s Small Business Participation Plan for the STO can be found in its entirety Volume VI, Section
XXX.”?
Should the offeror only include Attachment 0005 in Volume II and the actual plan in Volume VI or should Attachment 0005 be included in both VII and VI?

22 Section I I-175
(a) Performance-based payments shall form the basis for the contract financing payments provided under this contract and shall apply to Contract Line Items (CLINs) -1-. The performance-based payments schedule (Contract Attachment -2-) describes the basis for payment, to include identification of the individual payment events, CLINs to which each event applies, evidence of completion, and amount of payment due upon completion of each event.
(b)(i) At no time shall cumulative performance-based payments exceed cumulative contract cost incurred under CLINs -3-. To ensure compliance with this requirement, the Contractor shall, in addition to providing the information required by FAR 52.232-32, submit supporting information for all payment requests using the following format:
(Contract Attachment -2-) Is an invalid reference, assume that corrections to the highlighted items will be incorporated into the final RFP. Fill in portions updated
23 Section I I-176
(b) The Government has identified all or a portion of the contractor services performed under this contract as essential contractor services in support of mission-essential functions. These services are listed in attachment TBD (as specified in the TORFP), Mission- Essential Contractor Services, dated TBD.
Assume that corrections to the highlighted items will be incorporated into the final RFP.
These will be further defined in the TORFPs; no additional requirements in the
RFP.
24 Section L L-19 D.
For evaluation purposes, only, the Government has incorporated the applicable Area Wage Determinations as outlined in Section J, Attachment 0009 of this RFP.
Attachment 0009 does not include Area Wage Determination information Wording revised in Section L. Contractors will map applicable Wage Determinations to the appropriate labor categories.
25 Section J Attachment 15
(1) Afghanistan -- Contractor employees are subject to General Orders Number 1, as modified from time to time, including without limitation, their prohibition on privately owned firearms, alcohol, drugs, war souvenirs, pornography and photographing detainees, human casualties or military security measures.
(2) Iraq -- Contractor employees are not subject to General Order 1. Contractor employees will follow the policies or directives of the Office of Security Cooperation-Iraq (OSC-I) Installation Managers or Chief of Mission policies and directives regarding consumption of alcohol or any prohibited items for sites that they are assigned.
Provide site for obtaining additional information regarding “General Orders Number 1” for each location.
There is no specific website accessable by the general public. That being said, all information required for this solicitation is provided in the clause referenced in Attachment 0015.
26 Section J Attachment 15
Government support contractors who may be involved in review of proposals submitted in response to this solicitation are as follows:
(INSERT ALL SUPPORT CONTRACTORS (INCLUDING SUBCONTRACTORS) NAMES,
ADDRESSES, POC'S AND TELEPHONE NUMBERS.)
Provide names of Support Contracts involved in review of proposals. In the formal proposal, support contractors (if used) will be identified.
27 Section L L-19
Do not include OCONUS labor differentials/allowances in the FFP O&A and Changes Contract Labor Rate Table-Prime, Attachment 0010, and FFP O&A and Changes Contract Labor Rate Table-Subcontractor, Attachment 0011.
How do we account for location-specific differences in Workers compensation and DBA insurance? Workers compensation would normally be part of our fringe allocation. Recommend DBA be treated as a separate CPFF CLIN or possibly put under CLIN 0006.
The OCONUS labor differentials/allowances shall not be combined with the fully burdened ceiling labor rates. Given there are no specified countries for future contract performance, differentials/allowances are unknown at this time and will not be evaluated as part of the Basic ID/IQ Price Evaluation. The OCONUS labor differentials/allowances will be proposed as Other Direct Costs in any future FFP TO O&A proposals and FFP TO changes proposals.

29 Section C - PWS 1.2
The RFP states that “A demonstrated relationship with the Original Equipment Manufacturer(s) (OEMs) or cognizant airworthiness engineering authority is required for each NSRWA system to ensure continued airworthiness; access to technical and engineering data and support; and access to logistical services and supply chains.”
Section H and the PWS directs the contractor to execute and maintain written agreements with the Original Equipment Manufacturer (OEM’s) in order for the timely and free and direct exchange of proprietary information requarding their platforms and to execute this contract. The OEM has refused to support other contractors in providing them with ACAs and refuses to provide technical information and has stated that they want to Government to come directly to them for assistance. This OEM policy unduly restricts competition and deviates from the customary commercial practices the Government seeks. It also provides unequal access to information where the OEM has access to nonpublic information as part of its performance of a Government contract and where information may provide the firm a competitive advantage in a later competition for a Government contract.
Question: Will the Government change the DRFP to remove the requirement for mandatory ACA agreements with the OEMs or modify the requirements where it is not a sole source to the OEMs?
Section H-17 of the RFP does not require contractors to enter into an ACA with OEMs. The PWS language was revised to highlight that OEM reach back is integral to continued support of NSRWA customer aircraft. Section L & M will require the offeror to provide planned approach to gain/maintain that OEM reach back connection.
The RFP states that:
a) “The contractor shall execute and maintain written agreements with companies, individuals and organizations identified by the Government as associate contractors. The agreements shall provide for the timely, free and direct exchange of information and data necessary to the performance of this contract and shall be structured to ensure effective communication between counterparts at all levels from senior corporate management to working level employees. The agreements shall include the provision that any proprietary information furnished by an associate contractor pursuant to the work under this contract will be protected from unauthorized release or disclosure beyond the scope of the agreement. Further, the agreement shall hold the Government harmless from liability for the unauthorized disclosure by the contractor of ACA proprietary information.
b) If the contractor requires technical information from an associate contractor, the contractor shall request and obtain any and all such information directly from the associate contractor, pursuant to the written agreement with that contractor.
c) The contractor shall freely and directly exchange technical information and data on the performance of its efforts with associate contractors. The Government may conduct meetings to facilitate the exchange of technical information and data between and among associate contractors and other Government personnel. The contractor shall participate in such meetings, and provide the NSRWA/ACC Government Representatives technical information and data. In the event of a disagreement as to what constitutes a permissible exchange of information or data under agreements, the matter shall be brought to the attention of the Contracting Officer for resolution.
d) The contractor shall furnish the Contracting Officer a copy of all executed associate contractor agreements within five business days of execution. Email copies are acceptable which clearly indicate or state that the agreements have been executed.”
Section H and the PWS directs the contractor to execute and maintain written agreements with the Original Equipment Manufacturer (OEM) in order for the timely and free and direct exchange of proprietary information requarding their platforms and to execute this contract. The OEM has refused to support other contractors with ACAs, and refuses to provide technical information.
They have stated they want the Government to come directly to them for assistance. We contend that the OEM’s policy unduly restricts competition and deviates from the customary commercial practices the Government desires. We also feel this is unequal access to information where the firm has access to nonpublic information as part of its performance of a Government contract and where information may provide the firm a competitive advantage in a later competition for a Government contract as they are currently supporting these customers.
Question: Will the Government change the DRFP to remove the requirement for mandatory ACA agreements with the OEMS or modify the requirements where it is by the actions of the OEM become essentially sole source to them?
28 Section H H-17
Section H-17 of the RFP does not require contractors to enter into an ACA with OEMs. The PWS language was revised to highlight that OEM reach back is integral to continued support of NSRWA customer aircraft. Section L & M will require the offeror to provide planned approach to gain/maintain that OEM reach back connection.
Document Reference Section Question or Discussion Gov Response
30 Section E Inspection and Acceptance
The RFP states that “The contractor shall comply with the higher level quality standard (s) listed below.” There are no quality standards published in this section.
Question: Will the Government provide the quality standards for the program
The Government has revised the information in Section E, paragraph E-7 (a) concerning program quality standard. (a) the Contractor must maintain a current certification for Aerospace Standard (AS) 9100, revision C dated 15 January 2009 or most current version IAW Aerospace Quality Standards website."
31 Section C - PWS 5.2.6.1
The RFP states that “The Contractor shall submit a list of small business suppliers and/or service providers (subcontractors) and shall include how they will utilize those suppliers and/or service providers in performing this work effort. The list of small business suppliers and/or service providers will become part of the resultant contract.” A list of small business suppliers and/or service providers has the potential to be a very large list, considering small material purchases.
Question: Does the Government have a threshold level requirement for this list of small businesses, and does this apply to only small business (no subcategory small business size classification)?
The threshold is the NAICS for this requirement 488190 - $32.5M. The Small Business subcategories are further defined in the Small Business Participation Plan submitted by the offeror per Section L
32 Section C - PWS 5.2.6.1.2
The RFP states that “Contractor shall pay small business subcontractors within 15 days of receiving the subcontractor's invoice and provide proof of payment to COR.”
Question: By what mechanism (e.g., email, report) and at what interval/frequency (e.g., after payment of each subcontractor invoice) should Contractors provide the COR proof of payment to small business subcontractors?
The proof of payment will be the Contractor's self-certification. Prime Contractor's will certify that all small business subcontractors were paid within 15 days of receipt of invoice and this self-certification shall be submitted with the invoice in
WAWF.
33 Section C - PWS 5.2.6.1.2/ 5.2.6.1.3
The RFP states:
5.2.6.1.2 “The list of subcontractors shall be submitted with the proposal and revisions to the list can be made throughout the contract performance.”
(and)
5.2.6.1.3 “Along with compliance of FAR 52.244-5 Competition in Subcontracting, the contractor shall report as part of each awarded TO, the level of competition in subcontracting achieved or percent of subcontracts that are competed.”
Seeking rapid approval to include a newly discovered small business subcontractor might hinder the timeline necessary to solicit a quote and meet the contract performance schedule.
Question: Would the Government deconflict the dual requirements to submit a comprehensive list of subcontractors/suppliers prior to contract award and the reporting of the percentage of contracts competed?
For task orders, a list of subcontractors would be required at each Task Order Request for Proposal and become part of the resultant task order. The contractor would then submit a report showing if/how he used the subs he proposed (for the Task Order) or request a substitution to the list proposed. PWS requirements will be revised to deconflict paragraphs.
34 Section E
The above referenced Section E Paragraph 1 states that the Basis IDIQ contract award will establish fully burdened labor rates for each Labor Category. Section E Paragraph 2 goes on to say, “Do not include OCONUS labor differentials/allowances in the FFP O&A and Changes Contract Labor Rate Table-Prime, Attachment 0010, and FFP O&A and Changes Contract Labor Rate Table-Subcontractor, Attachment 0011.”
Question: Will the Government please clarify what differentials can be priced in CLIN XX02? For example, is the contractor allowed to include shift and adder pays in CLIN XX02? Further, besides Hazard and Hardship pays, will the Government please clarify all differentials that are to be priced in CLIN XX03 with no fee?
The Government will remove CLIN XX03 for differentials in the RFP. The preference will be for FFP labor services to the maximum extent practicable. All labor costs should be priced in the CLIN for services XX01 (FFP CLS Services) or XX02 (CPFF CLS Services).
As stated in L-19.C(4)E, "The Offeror shall provide the details of the prime Contract Labor Rate tables and their build-up to include the base labor rate and any applicable indirect rate(s)/burden(s) proposed in accordance with the offerors normal accounting practice." The OCONUS labor differentials/allowances shall not be combined with the fully burdened ceiling labor rates. Given there are no specified countries for future contract performance, differentials/allowances are unknown at this time and will not be evaluated as part of the Basic ID/IQ Price Evaluation. The OCONUS labor differentials/allowances will be proposed as Other Direct Costs in any future FFP O&A proposals and FFP changes proposals.

35 Section J Attachment 13 - STO PWS 4.1.2.3
The sentence states “The contractor shall immediately notify the COR in the event the CLS Program Manager and OCONUS site manager experience a transition in personnel” Appears to be missing some language.
Question: Will the Government clarify the intent of this sentence?
Any Key Personnel changes need approval prior to change-out.
36 Section J Attachment 13 - STO PWS 4.3.2
In Sub Paragraph 4.3.2 Office equipment, Furniture, and supplies but does not refer to the quantities and types of equipment the Government requires.
Question: Does the Government plan to No. The quantity and type is the contractor's choice to outfit their office.
37 Section J Attachment 13 - STO PWS 5.3.4
The Government states “the contractor shall provide and maintain all tools”.
Question: Will the Government provide a list of any additional tooling required?
No. This is the contractor's maintenance plan.
38 Section J Attachment 13 - STO PWS 5.6.2.1
The Government states the contractor shall provide full CLS at Kabul and Kandahar while providing support of launch, Flight, Recovery, and Maintenance operations at additional CS3 locations
Question: Will the Government provide the aircraft parts usage data for the last two years? The Government will provide an authorized stockage list for the STO but does not anticipate providing historical aircraft parts usage data for the last two years.
39 Section J Attachment 13 - STO PWS 5.6.2.1
The Government states the contractor shall provide full CLS at Kabul and Kandahar while providing support of launch, Flight, Recovery, and Maintenance operations at additional CS3 locations are contractor to assume the Government has spares already on site and the incoming contractor picks up the CLS responsibility.
Question: Will the government provide a list of government provided spares for each location in support of this task order? For purposes of the STO, the contractor shall assume no GFP will be provided.
40 Section L
Section L Page 102 D (3) General Information First paragraph, last two sentences
Discussion: The RFP states that “The Offeror shall submit the written consent of its key subcontractors to allow the disclosure of its suppliers past performance information to the Offeror. In addition, letters of commitment for this effort shall be included for all key subcontractors for their past performance to be considered.”
Question: Given the amount of past performance information required in this volume and the limited number of pages allowed, are these written consent letters and letters of commitment excluded from the 30-page limit of the Past Performance Volume?
The Past Performance limitation will be increased on the RFP. The written letters of consent and commitment were added to Section 10 of Volume III and will not count against page limitation.
41 Section L
Section L Page 103 D (3) Section 1: Executive Summary First sentence
Discussion: Section 1 requires “…a concise executive summary of [the Past Performance] volume and highlights of any key or unique features.”
Question: Given the amount of past performance information required in this volume and the limited number of pages allowed, is Section 1 excluded from the 30-page limit of the Past Performance Volume?
Page allowances will be increased in the RFP. Section 1 will count toward the page limits in the Past Performance Volume.
42 Section L
Sect L, Attachment 0004, Past Performance Risk Reference Sheet
Discussion: Past Performance Risk Reference Sheet, requires offeror “to complete the attachment for each reference that has been sent a Past Performance Questionnaire and submit with its Volume 3 Past Performance submission.” This will take up more than 1 page per contract
– a significant amount of the allotted 30-page limit for this volume.
Question: will the Government please exclude this from the page limit for the Past Performance Volume?
No; the pages will count toward the page limitations in Volume III, however, the page count will increase in the final RFP. In regards to the Past Performance Questionnaire, only submit Part 1 (page 1) in Volume III. Part 2 of the Questionnaire will be completed and submitted by the Respondent separately to the contracting officer. Part 2 will not be part of the page count for Volume III.
43 Section H Sec. H page 41 Paragraph H-16 End User Certificate
Discussion: The RFP states “The contractor shall be responsible to initiate and secure all import/export paperwork. The contractor shall secure all End User Certificate (EUC) documentation, for services rendered, articles sold/leased, or exported under this effort. The contractor shall maintain and track the status and currency of all EUCs on a master list. The list will contain any future EUC efforts. The contract shall provide the list to the Contracting Officer upon written request. PM NSRWA reserves the right to inspect all documentation with respect to the EUC and import/export.”

Attachment 1:
Performance requirement matrix
Performance Objective 1: “The contractor will actively participate in their respective pool by providing responses to Task Order Request for Proposals (TORFPs)" The measures that determine the performance ratings (minimum for a satisfactory score is 70% response rate) could force a contractor to expend limited B&P funds rather than making strategic decisions on where they can make the best use of their expertise to the benefit of the USG and their company. This is also contradicts H-20.3.3 which states the contractor may choose whether or not to submit a
TOP.
The Performance Objective 1 is being evaluated to potentially change the percentage response rate. The objective does not contradict with H-20.3.3.
Attachment 1:
Performance requirement matrix
Performance Objective 4: “Contractors are required to provide realistic and reasonable Cost/Price proposals.” a satisfactory rating requires 100% success rate. Realism and reasonableness is a contracting officer determination. The contracting officer has information available to them to make their determination that is not available to the bidders. Based on this a contractor cannot reasonably know when they are submitting their proposals if the contracting officer will determine their cost/price proposal as realistic and reasonable.
In order to foster a high level of competition and best value to the Goverment, contractors will be accountable to providing responses to a high number of TORFPs as well as providing quality proposals. The Government will discuss if 100% success rate is the proper score for this PRS objective.
Attachment 1:
Performance requirement matrix
Performance Objective 5: “Contractors are required to provide a quality proposal” is not clear – how will this be evaluated and what will drive an unsatisfactory or excellent rating.
Language will be clarified in the PRS. Contractors in the pools will be required to submit TO proposals with a Technical Approach that meets the criteria IAW the Department of Defense Source Selection guide, paragraph 3.1.2.2 table 3 entitled, 'Combined Technical/Risk Rating Method' with a rating of 'Acceptable', 'Good', or 'Outstanding'." The percentage of proposals meeting this adjectival rating over the evaluated period will be given a PRS score of Exceptional, Very Good, Satisfactory, or Unsatisfactory in accorance with the PRS definitions.
