*** End of Narrative A0000 ***

The purpose of Amendment 0003 to Solicitation W52P1J-16-R-0134 is to complete the following:

1. Provide answers to the following questions that have been received by the U.S. Government:

Question 1 - Should Paragraph 4.4.2.1 of MIL-DTL-70545A, Major 103 state "Gross weight of propelling charge, max." instead of "Gross weight of propellant charge, max"? MIL-DTL-32276 and DTL12977282 both reference this clause as "Gross weight of propelling charge, max."

Answer 1 - Major 103 should state "Gross weight of propelling charge, max." This is a typographical error and will be corrected via an Engineering Change Proposal.

Question 2 - Sections L and M of the solicitation require respondents to provide a detailed description of the manufacturing process and define the approach which clearly demonstrates that the minimum monthly delivery rate of 160,000 60mm, or 160,000 81mm, or

160,000 120mm Mortar Propelling Charges will be achieved. On the other hand, production deliveries in Section B of the solicitation speaks to delivery rates of up to 160,000 units per month for a single Contract Line Item (CLIN) Group, or 320,000 units per month if an offeror receives a contract for two or more CLIN Groups. Do respondents to the proposal, then, also need to describe the manufacturing process and define the approach which clearly demonstrates that the minimum monthly delivery rate of 320,000 units per month will be achieved for two or more CLIN Groups?

Answer 2 - No, the offeror's do not need to describe the manufacturing process or define the approach to meet the minimum monthly production rate of 320,000 units for two or more CLIN Groups. For evaluation purposes, the offeror shall provide the information as requested in L.4.1.2.1.1(f) for a minimum production rate of 160,000 propelling charges from one CLIN.

Question 3 - In Paragraph 4.4.3.1. and 4.4.3.2. of MIL-DTL-32275, when the term "cartridges" is used, is it referring to Ignition

Cartridges or Propelling Charges? In either case, please identify the item's nomenclature.

Answer 3 - The term is not referring to either. It is referring to the appropriate round (cartridge) that is used for testing each propelling charge as shown in Table XII of MIL-DTL-32275.

Question 4 - On Drawing 9312698, Note 4, please clarify what "Ensure the Acetone has dried sufficiently and the container is completely sealed" is in reference to. Is this required before packing as opposed to marking?

Answer 4 - Prior to packaging, each propelling charge should be sealed with a closure and the surfaces that have had contact with the acetone are dry, to prevent the possibility of a defect.

2. Remove Section A narrative "Instructions to Offerors and Evaluation for Award" Number 21, stating:

"Offerors are advised to carefully read the provisions at Federal Acquisition Regulation (FAR) 52.215-1, 'Instructions To Offerors

Competitive Acquisition'. The U.S. Government intends to award two or more contracts resulting from this Request for Proposal (RFP) without discussions with offerors (except clarifications described in FAR 15.306(a)). Therefore, offerors should ensure initial proposals contain the best terms and that proposals are complete, including all fill-ins and blanks. The U.S. Government does reserve the right to conduct discussions if determined necessary, by the Contracting Officer, and in the best interest of the U.S.

Government."

and replace it with the following:

"Offerors should note the provisions at FAR 52.215-1 Alternate I, Instructions to Offerors--Competitive. The U.S. Government intends to award the contracts resulting from this RFP after conducting discussions with offerors in accordance with FAR 15.306(d); however, the U.S. Government reserves the right to award without conducting discussions should it be determined to be in the U.S. Government's best interest. Offerors shall ensure initial proposals contain the best terms and that proposals are complete, including all clause fill-ins and attachments."

3. Remove Clause 52.215-1, Instruction to Offerors--Competitive from Section L.

In the event the U.S. Government determines discussions are necessary, the Contracting Officer shall establish a competitive range comprised of the most highly rated proposals. Revised proposal submissions for the Technical, Pricing, and Past Performance Factors will be required in accordance with the RFP."

7. Remove Section M.1.1. Discussions (a) stating:

"Each proposal shall contain the offerors best terms for award of a contract under the solicitation. The U.S. Government intends to award two or more contract(s) without discussions. The Contracting Officer may contact offerors for clarification, as described in

FAR 15.306(a) and FAR 52.215.1, without opening discussions. However, the U.S. Government reserves the right to conduct discussions and to permit offerors to revise its proposals if determined necessary by the Contracting Officer."

and replace it with the following:

"Each proposal shall contain the offerors best terms for award of a contract under the solicitation. The U.S. Government intends to award two or more contract(s) after conducting discussions."

8. Remove Section M.1.1. Discussions (b) stating:

"If the Contracting Officer determines discussions are necessary, they will be held in accordance with FAR 15.306."

and replace it with the following:

"Discussions will be held in accordance with FAR 15.306."

9. Remove Section M.1.1. Discussions (c) stating:

"If discussions are to be conducted, the U.S. Government may establish a competitive range comprised of the most highly rated proposals. The competitive range shall be determined based on an analysis of each offerors proposal in accordance with the evaluation criteria. The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the highest rated proposals. All offers in the competitive range will be advised of any significant weaknesses and/or deficiencies in their proposal and will be offered a reasonable opportunity to correct or resolve them and to submit a revision to their proposal as a result of the discussions. At the conclusion of the discussions, a final common cutoff date that allows a reasonable opportunity for submission of written FPRs will be established and all offerors in the competitive range will be notified. The U.S. Government reserves the right to establish a new competitive range determination after each reevaluation if necessary."

Government's requirements and the need to mitigate risk.

c. The offerors whose proposals are technically acceptable and provide the lowest total evaluated price will be awarded an IDIQ contract, and will have the opportunity to compete for future delivery orders during the life of the contract. The acceptable offerors total evaluated prices will be listed in ascending order and awards will be made beginning with the lowest-priced technically acceptable proposal. Although the U. S. g. The U.S. Government intends to award after conducting discussions with Offerors in accordance with FAR 15.306(d). The

Contracting Officer shall establish a competitive range comprised of the most highly rated proposals. Only those offerors within the competitive range will be included in discussions and considered for an award. The U.S. Government however, reserves the right to award without conducting discussions.

h. Offerors within the competitive range will be asked to respond to all ENs. Once all ENs have been answered, the Contracting

Officer will close discussions and request FPRs. Revised proposal submissions for the Technical, Pricing, and Past Performance

Factors will be required in accordance with the RFP.

i. The offeror shall enter ceiling unit prices for all Ordering Periods on the Price Matrix (Attachment 0001). Failure to completely fill out the Price Matrix may result in the proposal being evaluated unacceptable. All unit prices proposed for each

Ordering Period will be evaluated and binding. The ceiling prices will establish not to exceed prices for the 60mm (M204, M235, M236), 81mm (M218, M219, M220), and 120mm (M234A1) Mortar Propelling Charges during each Ordering Period. Offers that do not have the capability to produce all configurations of the 60mm, 81mm, and 120mm Mortar Propelling Charges will not be considered for an award on this acquisition.

L.1.3. All questions concerning this procurement, either technical or contractual must be submitted in writing to the Contracting

Officer and/or Contract Specialist. No direct discussion between the technical representative and a prospective offeror will be conducted. Questions shall be sent to the following points of contact:
