*** End of Narrative A0000 ***
The purpose of Amendment 0001 to Solicitation W52P1J-16-R-0134 is to complete the following:
1. Provide answers to the following questions that have been received by the U.S. Government:
Question 1. Please provide clarification on verbiage in Section L - Instructions, Conditions, and Notices to Offerors - under
L.4.3.3 Past Performance Questionnaire (PPQ). The third sentence states, "The Offeror shall include these documents in Volume 3, Section 2 of the proposal." It looks as though it should be Volume 3, Section 1. Please clarify that the sentence is correct as it stands or that it should be Volume 3, Section 1.
Answer 1. The third sentence in L.4.3.3. "Past Performance Questionnaire" is incorrect due to an administrative error. The sentence will be revised as follows: "The offeror shall include these documents in Volume 3, Section 1 of the proposal." See Section L for implementation of the new language.
Question 2. Regarding Volume III L.4.3.5 Adverse Contract Performance, Section (f) and the requirements set-forth to answer it. If an offeror is to attach all completed Corrective Action Reports (CARs) to fulfill the requirement for (e) and the completed CARs provide the information on what corrective actions the offeror has taken to avoid reoccurrence is it necessary to add any more information in (f) to fulfill those requirements? Or is the attached CAR sufficient enough for both (e) and (f)?
Answer 2. The U.S. Government requires all corrective actions be identified in (f) regardless of if it was contained in a CAR or
Product Quality Deficiency Report.
Question 3. Request an extension of the due date from June 30, 2017 to July 14, 2017.
Answer 3. The U.S. Government has extended the closing date of this RFP to July 14, 2017.
Question 4. Please clarify if an offeror is to submit as a Firmed Fixed Price Award (page 2 paragraph 4), or as a Not-to-Exceed
Award (page 61 paragraph H.1). Price Matrix as outlined in Attachment 001 does not specify either way.
Answer 4. Not to Exceed prices for all ordering periods will need to be submitted.
Question 5. We believe paragraph C-5 is incorrect. Although we agree with the requirement for propellant reassessment, this should be changed from Propellant Reassessment, paragraph (a) from
"(a) In order to determine the functional serviceability of propellant prior to loading into a component item, the systems contractor/producer is responsible for submitting a sample of the propellant lot(s) with a date of manufacture beyond two years of contract award for testing at:" to
"(a) In order to determine the functional serviceability of propellant, prior to loading into an end item the systems contractor/producer shall submit a sample of propellant lot(s) with a date of manufacture two years or more before loading, for testing at:"
Answer 5. The U.S. Government will revise paragraph C-5, Clause 52.246-4563(a) Statement of Work - Propellant Reassessment to: "In order to determine the functional serviceability of propellant, prior to loading into an end item the systems contractor/producer shall submit a sample of propellant lot(s) with a date of manufacture two years or more before loading, for testing at:"
Question 6. At one time the U.S. Government was going to re-address the conditioning requirements. Will the U.S. Government be submitting an ECP so this can be taken into consideration with pricing out the current solicitation?
Answer 6. The offeror shall price 60mm and 81mm Mortar Propelling Charges as though the conditioning requirements are still in effect.
Question 7. First Article Acceptance Test (FAAT) deliverables; applicable to all FAAT Contract Line Item Numbers (CLINs). Please clarify approval times. We read this to mean the supplier has 180 days after contract award to submit FAAT deliverables, then the
U.S. Government will conduct the FAAT test, obtain test results and provide approval to the supplier, all within the 45-days as

stated.
Answer 7. The offeror's interpretation is correct.
Question 8. Who will be responsible for paying the cost of Charge Establishment/Charge Verification testing at Yuma?
Answer 8. The offeror is responsible. See Section C exceptions.
Question 9. Who will be responsible for the freight cost of the Lot Acceptance Test (LATs)?
Answer 9. The U.S. Government is responsible for the LAT freight cost.
Question 10. Charge Weight Establishment. Who will establish what the charge weight will be, U.S. Government or supplier. In the past this has been the U.S. Government.
Answer 10. The supplier will establish the charge weight.
Question 11. Contract Data Requirements List (CDRLs). Normally these are not separately priced. Will this be an issue if they once again they are not separately priced?
Answer 11. The CDRL's are not separately priced.
Question 12. Demilitarization (page 62 Clause H-2). Please clarify the intent of this clause. If this is in relation to Government
Furnished Material (GFM), at this moment we do not believe there is any GFM to be provided to the supplier and this clause is not applicable. We do not believe it is the U.S. Governments intent to direct the supplier to demil any materials or components that may be excess to the contract once all deliverable have been made to the U.S. Government. It is our understanding that in-process end items, components, subassemblies, propellant, and components that have not been submitted to the QAR for acceptance under a firm fixed price contract remains seller property.
Answer 12. While this is a Firm Fixed Price (FFP) contract where no GFM is being furnished, the U.S. Government needs to be assured that any nonconforming materials, assemblies, etc. are destroyed such it is no longer usable for its intended purpose. As such, the clause language has been revised as follows:
At the conclusion of this contract, all nonconforming unaccepted mortar propelling charges components, subassemblies and material, energetic and non-energetic waste shall be destroyed, such that they are no longer usable or reclaimable for its original purposes.
Once material is destroyed, it shall be disposed of only as scrap.
Upon completion of production under this contract, the contractor shall certify to the Administrative Contracting Officer that demilitarization, as prescribed above, has been accomplished.
2. Section B CLIN 0008 descriptions for CDRL A015 and A018 have been revised to match the corresponding data in the CDRL exhibits.
3. Attachment 0019 has been updated. 60mm M204 information was corrected. The revised document can be obtained via the FedBizOpps website.
4. Attachment 0020 has been updated. 60mm M204 information was corrected. The revised document can be obtained via the FedBizOpps website.
5. The closing date for Solicitation W52P1J-16-R-0134 has been extended from 12:00 PM Central Time on June 30, 2017 to 12:00 PM Central
Time on July 14, 2017.
6. All other terms and conditions remain unchanged.

SECTION H - SPECIAL CONTRACT REQUIREMENTS
Order Placement Procedures for Multiple Award Contracts:________________________________________________________
H.1. In accordance with FAR 16.505 (b), the Offerors may compete for requirements based on price, delivery schedule, manufacturing capacity, storage capacity, and/or past performance. Prices submitted on the Price Matrix (Attachment 0001) will be the not to exceed ceiling prices for future requirements. The U.S. Government will notify offerors of which factor(s) will be utilized in the evaluation of future requirements.
H.1.1. When a requirement arises, eligible offerors will be asked to confirm or revise the prices previously submitted in response to
W52P1J-16-R-0134, through the issuance of a contemplation letter. The prices offered cannot be higher than those proposed on the Price
Matrix in its proposal unless the U.S. Government changes any contract terms or conditions associated with FAT and production schedule / monthly production rate (as set forth in schedule B) or if the quantity is below or above the quantity ranges identified in Attachment
0001. Prices must be confirmed or revised, in writing, within twenty (20) calendar days of the request (unless otherwise specified in the contemplation letter).
H.1.2. Evaluation and Basis for Award of Future Delivery Orders:
a. Basis for Award For Future Delivery Orders: The U.S. Government will select for award the offeror(s) that is(are) the most advantageous and represent(s) the best value to the U.S. Government with appropriate consideration given to the following evaluation factors: Price, Delivery Schedule, manufacturing capacity, storage capacity and Past Performance. The U.S. Government reserves the right to make an award to other than the lowest priced offeror or other than the offeror with the best delivery schedule if the Contracting Officer determines that to do so would result in the best value to the U.S. Government.
b. The exact criteria for awarding future delivery orders will be identified in a contemplation letter issued by the Contracting
Officer to the contractors who have been awarded a basic IDIQ contract resulting from this solicitation. When in the best interest of the U.S. Government, the contemplation letter will also state if multiple awards are desired. This decision will be based on economical quantities, industrial base considerations, military delivery requirements, or other factors. Please note that the prices proposed by offerors in the Price Matrix, Attachment 0001, will be valid for the life of the IDIQ contract.
c. Delivery Schedule: The U.S. Government will conduct a risk assessment to address the uncertainty associated with the proposed delivery schedule being met. The risk assessment will consider both the probability of missing an expected delivery date and the impact of missing an expected delivery date. The risk assessment, in conjunction with the information provided by the offeror, will consider if the proposed delivery schedule is realistic and consistent with its current product capacity. The following adjectival rating will be used for evaluating Delivery Schedule risk:
Low: Has little potential to cause disruption of schedule, increased cost or degradation of performance. Normal contractor effort and normal Government monitoring will likely be able to overcome any difficulties.
Moderate: Can potentially cause disruption of schedule, increased cost or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.
High: Is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.
d. Past Performance: The U.S. Government will assess the degree of confidence it has that the Offeror will successfully complete the requirements in accordance with the contract terms based on the Offeror's demonstrated record of recent and relevant performance.
i. A significant achievement, problem, problem resolution, or lack of relevant data in any element can become an important consideration in the assessment process. A negative finding in any element may result in a lower past performance confidence assessment rating.
ii. In conducting the past performance evaluation, the U.S. Government may use information obtained from other sources, or may use information with regard to other contracts performed by the contractor of which it has knowledge, whether or not those contracts are disclosed to the U.S. Government by the contractor.
iii. If absent any recent and relevant past performance history, the Offeror will be assigned an Unknown Confidence
(Neutral) Past Performance rating and its proposal will not be evaluated either favorably or unfavorably on past performance.
Satisfactory Confidence: Based on the offerors recent/relevant performance record, the U.S. Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence: Based on the offerors recent/relevant performance record, the U.S. Government has a low
9 21
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
expectation that the offeror will successfully perform the required effort.
No Confidence: Based on the offerors recent/relevant performance record, the U.S. Government has no expectation that the offeror will successfully perform the required effort.
Unknown Confidence (Neutral): No recent/relevant performance record is available or the offerors performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
H.1.3. Although the U.S. Government contemplates that subsequent delivery orders will allow the same amount of time for delivery as outlined in W52P1J-16-R-0134, the U.S. Government reserves the right to request that offerors propose an expedited schedule for subsequent orders. When a schedule that is different from the terms of the original contract schedule is requested, the offerors will be permitted to revise its prices above the ceiling prices originally submitted. In this situation, evaluation may include price, delivery schedule, manufacturing capacity, storage capacity, and/or past performance.
H.1.4. The U.S. Government intends to conduct a competition among the awardees for each future requirement. However, in the event all contractors decide to no-bid, the U.S. Government reserves the right to issue a unilateral delivery order if it is determined to be the
U.S. Governments best interest.
H.1.5. The U.S. Government reserves the right to issue a single delivery order, without competing, if it is determined that an exception to Fair Opportunity applies in accordance with FAR 16.505(b)(2).
H.1.6. See FAR 52.216-19 for order limitations. However, the U.S. Government retains the right to place a follow-on order after any award within 30 days for a quantity less than the most recent award. The contractor shall honor the same unit prices for the same supply as found in the previous award, and deliveries shall commence immediately after delivery of the original award at the same monthly rate.
H.1.7. No Protest Rule and Ombudsman: In accordance with FAR 16.505(a)(10), no protest under FAR Subpart 33.1 is authorized in connection with the issuance or proposed issuance of a delivery order except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract or exceeds $25 million. The address, phone number and e-mail address for the ombudsman are:
U.S. Army Sustainment Command
ATTN: AMSAS-GCB/Task and Delivery Order Ombudsman
Rock Island, IL 61299-6500
Phone (309) 782-7287
a. The ombudsman will review complaints from the contractors and ensure all contractors are afforded a fair opportunity consistent with the procedures in this solicitation.
H.1.8. Orders shall be issued by electronic commerce methods.
H.1.9. The U.S. Government reserves the right to split future requirements among awardees.
Demilitarization:_________________
