QUESTIONS AND ANSWERS - ROUND 2
Q27. Please confirm that even though Solicitation W52P1J-17-R-0023 contains Clause I-145 FAR 52.230-2 Cost Accounting Standards since the contract will be competitively awarded at a zero dollar value the base contract will not be a CAS covered.
A27. Please reference W52P1J-15-R-0023, Executive Summary Property Management, Page 4, Para No. 3 which states "...the U.S.
Government reserves the right to utilize other contract types based on risk and/or other situational factors*." Reference the "*" on the bottom of Page 5 which states, "In the event a cost type task order is issued under the resultant Property Management
Contract, the successful offeror may be subject to the requirements of cost type contacts to include, but not limited to, attaining an approved accounting system. This RFP does include clauses specific to Cost Type contracts; these clauses and related requirements will only be put in to full force and effect at such time as a cost type task order is contemplated/awarded."
Q28. Given the above, will the Government consider removing clause I-145 from the solicitation?
A28. Based on the response to Q1, this clause will remain in the solicitation.
Q29. The solicitation(s) requires Offerors to price IDIQ and/or ID Requirement CLINS on an FFP basis with no minimum quantity guarantees for the 120mm Mortar Family CLINS and with only a $5M minimum guarantee on the M795 CLINs. The solicitation also states that Offerors are to use the production contract workload as a base for the costs associated with operating the facility. The contractor will be required to invest $2 Million per year into the SCAAP facility over the course of the anticipated fifteen year contract.
a. How are Offerors able to recover the $2 Million in overhead expenses if nothing is ordered in any given year?
A29a. The nature of Requirements CLINs and Indefinite Delivery CLINs require offerors to evaluate the information provided in the
RFP and make a business decision. The Requirements CLINs for the 120mm Mortar Family is a means of ensuring any requirements that do arise for those items, up to the defined maximum, are awarded to the successful offeror.
b. Given that the contractor will have to invest $30M ($2 Million per year times 15 years) without a production contract quantity guarantee in each contract year, will the government entertain lowering the $2 Million per year investment requirement?
A29b. The required Contractor Investment will remain at $2M per year.
c. Given the above, will the Government revise the facility investment requirement amount to directly correspond to the dollar value of awards received by the contractor, for example, similar to the ARMS sliding scale arrangement?
A29c. No, the Government will not be lowering the required Contractor Investment of $2M per year.
Q30. The Contractor Investment clause (page 9 of 51, Solicitation W52P1J-15-R-0023) states that the Government may terminate a project based on execution/cost/schedule overrun or other special circumstances. Please confirm that if the Government decides to take this course of action that it will be accomplished with Clause I-84 FAR 52.249-6 Termination (Cost Reimbursement).
A30. Any termination executed under the Property Management contract resulting from this RFP, W52P1J-15-R-0023, will be executed in accordance with the regulatory requirements for terminations. Please note that FAR Clause 52.249-2 Termination for Convenience of the Government (Fixed-Price) has been added to this RFP. Please see Section I for further detail.
Q31. E-8, Critical Characteristics "Guidance for developing this plan and submitting Critical Plans of Action (CPOA) (paragraph g) can be found at: http://www.pica.army.mil/PicatinnyPublic/organizations/ardec/orgchart/quality.html ". This link is not active and it differs from the link provided in C.3.3.11.2.1. Will the Government please provide clarification?
A31. The link to be used for the CPOA is found in Paragraph C.3.3.11.2.1 of the SOW. Clause 52.246-4011 has been amended to include the correct link.
Q32. Reference E-10, 52.246-4015, Ammunition Data Cards (ES6922), June/2014.
a. Does the contractor sign the ADC for components that are not Government Source Inspected (GSI), and is there special requirements for access to sign ADCs on the WARP system?
A32a. The Contractor does not sign the ADC for components that are not GSI. The government QAR will have that authority through a
Letter of Delegation.
b. Does this contradict the requirement found in C.4.1 Ammunition Data Card which states "The contractor shall upload the LATR for each ADC generated? The Contractor shall generate hard copies of ADCs from WARP. The hard copies shall be signed and dated by the representative of the Government Agency Responsible for Acceptance (GARA) usually the DCMA QAR or other government designee. ADC hard copies shall accompany each Lot shipment."
3 8
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
A32b. No, this does not contradict the requirement found in C.4.1
c. Under the 120mm Component ADCs "Drawing 12577513 Nomenclature Fuze Adapter 102mm" Will the Government please clarify that this is the 120mm Adapter?
A32c. Correct, 12577513 Fuze Adaptor - 102mm, should read 12577513 Fuze Adapter - 120mm. However, please note the 120mm Component
ADCs have been updated per the answer to question d, see A6d below.
d. Drawing 13061384 and 13061385 are assembly drawings, not fuze adapter drawings as listed. Will the Government please clarify what is needed for this component ADC?
A32d. It is the intent of the USG to require separate ADCs for both the shell body and adapter for the 120mm HE and 120mm FRPC Body
Assemblies. The following drawings require ADCs:
Body, HE Drawing 12953514
Adapter Drawing 12577513-1
Body, FRPC Drawing 12957020-2
Adapter Drawing 12577513-2
Q33. Reference E-11, 52.246-4018, MEASUREMENT SYSTEM EVALUATION (MSE), APR/2014 (ACC-RI): Concerned with this solicitation clause as we feel that the cost of implementation is significantly more than the Government is anticipating and we also feel that this clause will have a significant negative impact on the contract schedule given the time it will take our suppliers to implement these changes to comply with this new requirement. We suggest the Government schedule a meeting with the Offerors to discuss the impacts of the implementation of this clause. If this clause is implemented into the solicitation, it is suggested that it be priced separately and that the contract delivery schedules be adjusted accordingly. Significant impacts of this clause include, but are not limited to:
*"Contractor AIE design drawings shall meet the requirements of ASME Y14.100, ASME Y14.5 and ASME Y14.43..." To comply with these requirements, a large majority of existing approved AIE would have to be redrawn and resubmitted to the Government for review and approval.
*"The contractor shall prepare the AIE package submittal in accordance with DI-QCIC-81960..." The data requirements of AIE packages has significantly increased in accordance with this data item description.
*"All Critical/Special characteristics requiring AAIE per the TDP shall utilize inspection equipment with a minimum demonstrated reliability of 99.8% at a 90% confidence level..." Since this is an increase from a minimum demonstrated reliability of 99.5% at a 90% confidence level; this would require re-prove out of all current AAIE approved systems. This increased demonstrated reliability confidence level may also result in AAIE design upgrades to meet these new requirements.
*"All major characteristics requiring AAIE per the TDP shall utilize inspection equipment with a minimum demonstrated reliability of
99.0% at a 90% confidence level..."
A33. MSE has been in effect since April 2014 and is a mandatory replacement for AIE; therefore, it is being implemented on all new
RFPs. Contractors are to take MSE into consideration when pricing FFP proposals and delivery schedules accordingly.
NOTE: The USG IP that will be provided under the Property Management contract resulting from this RFP is not guaranteed to meet all production requirements due to changes in quality requirements from prior production contract awards. Therefore, the USG cannot guarantee that utilization of the USG provided IP will result in conforming product. Please reference W52P1J-15-R-0023 Intellectual
Property, page 15, Section H, Narrative H0003.
a. For new AAIE, what is the timeline for prove out to assure the new equipment does in fact meet this requirement?
A33a. Timelines for submissions of AAIE are outlined within the respective CDRLs.
Q34. E-11, 52.246-4018, MEASUREMENT SYSTEM EVALUATION (MSE), APR/2014 (e) AIE Package Submittals. "(3) Units of Measurement. The units of measurement within the AIE package submittal shall be consistent with the requirements of the Technical Data Package (TDP)." If current AIE design and hardware inspection uses inches, is this requiring replacement of AIE design and hardware inspection in millimeters? If current production hardware and AIE design are in inches, will this require replacement of drawings and hardware, which includes AIE and production equipment (example: lathe program controllers, tracer controllers, dial indicators, etc.) to also be modified for millimeters versus inches?
A34. Yes, the AIE package submittal must be IAW with the requirements of the technical data package which is in millimeters.
Q35. Reference E-11, 52.246-4018, MEASUREMENT SYSTEM EVALUATION (MSE), APR/2014 (h) Measurement System Analysis (MSA). Please clarify the 120mm listing.

A35c. This information was incorrect in the initial RFP; the MSE clause has been revised to read as follows, "DTL12967865, Paragraph
No. 4.4.2.2/4.4.2.3, Drawing 12967864/865, Characteristic M103/M120". Please see Section E of W15QKN-17-R-0018 for further details.
Q36. Does the scope of this RFP include maintenance and updating the USG Intellectual Property (IP) for the facility?
A36. Yes, the scope of this RFP does include maintenance and updating the IP. Please refer to W52P1J-15-R-0023, Section H -
Intellectual Property, Narrative H0003, Second Para, Page 15 which states, "Upon request, the contractor shall provide updated IP for all items produced under the contract resulting from RFP W15QKN-17-R-0018, as well as for any other production for the
Government associated with SCAAP. The updated IP shall include any IP for new processes due to updates in the Technical Data, initiated by either the U. S. Government or the contractor. The Government anticipates requesting the IP two (2) years prior to the end of this contract, and a final update within the final few months of this contract. The Government is hereby updating the two references to this contract in the last sentence to the Property Management contract that results from this RFP. Please see Section
H - Intellectual Property, Narrative H0003 for further detail.
Q37. We ask that the Government make available/publish an Excel version of the Attachment 18_GFP List.
A37. An additional version of Attachment 0018 has been uploaded under W52P1J-15-R-0023 in FBO in Excel format. There are no variations/changes in the Excel version from the Adobe version.
Q38. Solicitation W15QKN-17-R-0018, Page 89 of 123, requests that the offeror provide the start weight for steel and copper. Paragraph
(g) on page 89 states that, with regard to the EPA, there shall be no adjustment for changes in the usage quantity of raw material
(Steel/Copper) from that proposed for the production of the M795 Metal Parts. Paragraph (h) on Page 91 states that the contractor must submit adequate information to establish the baseline from which adjustments will be made... to substantiate the cost for raw materials i.e. Steel and/or Copper.
Steel suppliers typically require a minimum buy quantity which, depending on the quantity of metal parts ordered by the Government, could result in variations in the amount of steel required to be purchased versus a straight mathematical weight calculation of, for example, 10,000 units X the steel start weight. How should an offeror account for this potential variation in pricing when completing the Price Matrix? How will the Government account for this variation when calculating EPA costs?
A38. The U.S. Government does not account for any variations in the calculations. The U.S. Government only accounts for the material required to complete the metal parts. Any differences shall be handled between the offeror and its supplier.
Q39. The EPA calculation example on page 88 gives reference to the formula the Government intends to use in determining whether the market value of steel upon order placement when compared a baseline price trips the 5% threshold. The exact wording given to R1 (which we interpret to represent the baseline commodity price) in this example is Cost of Steel and/or Copper associated with Out Year Price per Section B, which is confusing, given the baseline price that would be used the EPA equation appears to be defined elsewhere as the
Present Value of steel and copper. Please confirm that the formula will use the Present Value of steel and/or copper as provided and substantiated via vendor quotation as of the date of proposal submittal.
A39. The baseline cost of steel and copper for M795/120mm (R1 in the example) is calculated using the cost of steel/copper at the present value at the time of proposal submission, which Offerors must provide in paragraph (g) of Clause 52.216-4000. The value of steel/copper used to calculate EPA adjustments (upwards/downwards) will be taken from vendor purchase orders, which shall be provided 30 days after receipt of final invoice in accordance with Clause 52.216-4000.
