RFP Para Reference (if question relates to the RFP)
Response

Background: In the workload shown in T.E. 5.2 for “Year 1 (9 Months)” the T.E. shows a total of 57,977 receipts. This figure appears to be derived from the projected workload from the months of June 2020 through February 2021. when compared to a full 12 months of work load shown in “Year 2” this would be approximately 61% of a 12- month year or approximately 7.4 months’ worth of workload. The workload for these months, when averaged provides monthly average receipts of 6442 receipts/month for the months of June 2020 through February 2021, which, on a 12-month year of 93,778 receipts would leave 35,801 receipts for the months of March – May or an average of 11,934/month.

Question: Should the Year 1(9-month) workload be based on projections for the months of February 2021 through October 2021 instead of being based on workload projections that fall outside of the contract period? Would DLA agree that the projection for a 9-month performance period be closer to 75% of a 12-month workload vise 61%?

Attachment J.28/T.E. 5.2 Column C rows 13-22 and Columns D & E rows 28-34
Attach

J. 28 Projected Workload A monthly average of 6,442 receipts/month would equate to 77,304 receipts a year. This would then leave 17,327 receipts for the months of March-May. Which averages to 5,776.

Yes, the 9 month projected workload of 77,304 is closer to 75% of a 12-month workload vice 61%.

2
Background: Attachment J.38 shows Offload and Tally workload of the following number of receipts Year1=57,975; Year 2=93,778; Year 3=93,643; Year 4=93,205; Year 5=93,196 in rows 76-79; however, the same document shows total receipts processed in rows 80-91 as follows: year 1=31,235; Year 2=50,523; Year 3=50,450; Year 4=50,214; year 5=50,209.

Question: Should the number of receipt documents offloaded and tallied (rows 76-79) be consistent with the number of receipt documents processed (rows 80-91)?

Attachment J.38 Columns G, I, K, M, O rows 76-79 and rows 80 - 91
Attach

J. 38 Staffing Matrix Additional Receipt Requirements – Value Added has been added to TE 5.2 Projected Workload and J.38 on line 94 for Wholesale and line 246 for Retail. The addition brings the total more in-line with the offload and tally workload, however, it will not match as some receipts may fall into multiple types of value added processing.

3
Background: In J.28/T.E. 5.1 the historical workload for FY19 MTD to be based on the months of Oct 2018 – Feb 2019. The Historical workload for New Procurement receipts and Redistributions redistribution for the 5-month FY19 MTD period are shown as 8,701 and 14,256 respectively. When normalized for a 12-month period the workload for FY19 is consistent with the workload shown for the 12-month period for FY18. However, when compared to the workload projections in J.28/T.E. 5.2 the workload for New Procurement receipts and Redistribution receipts show a reduction in workload of approximately 30% in both areas.

Question: Does DLA expect the workload for New Procurement and Redistribution receipts to be reduced by 30% from the historical workload provided in the RFP?

Attachment J.27/T.E. 5.1 page 5; New Procurement and redistribution workload; Attachment J.28/T.E. 5.2 Columns D-H rows 56-60 and rows 76-80

J. 28 Projected Workload The projections in TE 5.2 are based on the latest knowledge of workload expectation for San Diego.

4
Background: In attachment J.28/T.E. 5.2 row 51 shows workload data for Supply Discrepancy Reports (SDRs) “all inclusive” and on row 175 shows workload for Retail Re-warehousing Picks, however, there are no corresponding rows in Attachment J.38 containing workload data for these two categories.

Question: Will DLA be adding this workload to Attachment J.38 or will bidders permitted to add the workload deemed pertinent for an accurate staffing estimate?

Attachment J.38 and Attachment J.28/T.E. 5.2
Attach

J. 38 Staffing Matrix Workload added to Attachment J.38 for SDRs (line 95) and Rewarehousing Picks (line 133).

5
Background: Attachment J.38 row 141 show workloads for “All TPICs” to be Y1=60, Y2 thru Y5=86/yr., however Attachment J.28 Row 243 shows workload for all TPICs to be Y1=83,136, Y2 Thru Y5= 110,850/yr.

Question: Does DLA intend to synchronized the workload data in Attachment J.38 row 141 to reflect all TPC categories reflected in Attachment J.28 Row 243?

Attachment J.38 row 141 and Attachment J.28/T.E. 5.2 row 243
Attach

J. 38 Staffing Matrix Revised Attachment J.38 revises the workload in row 146 to match TE 5.2.

6
Background: The data in the PPP&M section of the J.38 does not match the data in the J.28 for the container fabrication categories.

Question: Will DLA be synchronizing the Workload Data and Categories data in in in the J.38 with the project workload for the same categories in the J.28?

Attachment J.38 Rows 183-187; Attachment J.28/T.E.5.2 Rows 320-325
Attach

J. 38 Staffing Matrix Workload data and category data in the J.38 revised to match J.28 for rows 189 – 193.

7
Background: The workload for “Retail Remarks” is consistent for all years with the exception of Y4 (Column M) where the workload projection drops by approximately 10,000 remarks.

Question: Is the workload projection data for Year 4 correct or is it consistent with the rest of the performance years?

Attachment J.38 Row 281, Column M
Attach

J. 38 Staffing Matrix Workload for retail remark Y4 is corrected to 39,644 in both the J.38 and TE 5.2.

Background: The Attachment J.40 Training Schedule shows all onsite Distribution Operations Training being conducted during the months July, August, and September 2020, however the solicitation shows the Contract Transition start date of November 2020 which eliminates the possibility of awardees to provide input or have access to this onsite training and impact the awardees ability to meet both transition training requirements and the follow-on training requirements of contract performance.

Question: Will there be on site Distribution Operations Training conducted during the transition period?

Attachment J.40 Draft Distribution Operations Training Schedule
Attachment J.40 Draft Distribution Operations Training; J.1 PWS, Para 4.6.1
Training will be provided by DLA Training (DTD) when required. Initial training will be done during transition period. The Schedule that was provided will be changed to accommodate transition.
9
The Under-Run = Share (Government / Contractor) section 0-2 Letters of Concern* = 20 /100. Q: Do you mean 20/80?
Pg. 13 of 90, RFP
Under FP Incentive Firm Ratio Section
Amendment 001 corrects the The Under run share (Government/Contractor) to 20/80 in Section B.
10
RFP states “If higher direct labor rates … or escalation are proposed, offerors may not receive increases when wage determinations are modified.”

Question: Will the government work with the contractor to maintain the pay rate differential if requested?

Pg. 13 of 90, RFP
Service Contract Act section
We are unable to provide increases above the SCA Wage determination rates when they are modified. As noted in the PPC briefing, higher labor rates and escalation may be proposed and will be evaluated.
11
The government states “all deductions as a failure to meet performance requirements as established in the contract will be deducted…” However, the relevant FAR clause gives other actions as remedies, to wit: (d) If any of the services performed do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, for no additional fee. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements …”

Question: Will the government take these actions mentioned in Para (d) above prior to moving to deductions?

Pg. 19 of 90 RFP
F-6, Deduction

It is the Government’s opinion that the services contained in this PWS are of a type that cannot be reperformed if failures are realized. We believe that the structure of the FPIF CLINs in regards to Letters of Concern should control the occurrence of failures. If not, the Government will move to other deductions.

12
The government states: “(b) The Contractor shall notify the Contracting Officer in writing whenever it has reason to believe that-… (2) The total cost for the performance of this contract, exclusive of any fee, will be either greater or substantially less than had been previously estimated.”

Question: Request the government quantify “greater” and “substantially less”?

Pg. 48 of 90, RFP
Limitation of Cost
The inclusion of the Limitation of Costs clause helps the Government identify whether additional funds will be needed prior to the incurrence of the costs. The solicitation contains reporting requirements for each of the CLINs that allow us to monitor the incurred costs. Essentially, we’re going to know if a service provider is over or under running on the FPIF and Cost type CLINs. The clause simply makes the service provider responsible to notify the Government when the Cost type CLINs will reach 75% spent.
13
The government states, “All Government property made available to the Contractor for use is in an “as is” condition C-48 states “The Government may bill the outgoing Contractor for costs incurred to bring GE to safe, usable operating condition, as determined by the Government.”

Question: Will the government property be in a condition to make useable?

C-39, Att. J.1
C-3.1B
The government believes the GE is in usable condition. If it is determined that the GE is not usable, the Government will provide replacement equipment or authorize the Contractor to replace under the Equipment CLIN.
14
The government states, “For any penalties or fines resulting from activities after the Contractor assumes performance, payment, as directed by the applicable agency, may be the responsibility of the Contractor, based on fault.” Question: What is the extent of potential fines? Who determines fault?
C-43, Attach J.1
C-3.4.2 Environmental
The extent is unknown as it is dependent upon the situation. Fines would be determined by the state of California and any federal agencies with jurisdiction. Fault would be determined by investigations conducted by the Government. The Contractor may elect to include in their insurance.
15
The government states: “Credit: The Contractor shall insure that any credits for future travel, free travel, free gifts or rebates on current travel offered by airlines or car rental agencies as part of frequent traveler or similar promotional programs that are accrued as a result of travel necessary for performance under the contract, shall be conveyed to the Government.”

Question: Would the government please clarify if the travel statement applies to free gifts, rebates, frequent traveler or promotional programs, etc. owned by the company and not by the employee?

Our corporate policy promotes the use of the lowest airfare cost, Per Diem rates for ME&I / lodging, and price of compact car rental. Therefore, the government is receiving the lowest commercially available price to complete the travel task, and not affected by the employee frequent traveler program.

Pg. 24 of 90, RFP
G-6, Credits
Your employees are permitted to participate in rewards programs offered by airlines and hotels. However, if such rewards are used to fund travel on the contract resulting from this solicitation, the Government would expect to receive the benefit of those rewards. As an example, if an employee on official travel for the awarded contract gets a complimentary room for participating in the reward program, the Government would NOT reimburse the company for the hotel for those nights.
16
Will FAR 52.222-17 apply to this solicitation or be included or incorporated into the final contract, when awarded? Executive Order 13897, issued on 1 Nov 19 by President Trump, changed the rules for the transition of contracts covered by the Service Contract Act of 1965, as amended (see 41 U.S.C. 6701 et seq.). Contractors will no longer be required to make offers of employment to those employees on incumbent contracts whose employment would otherwise be terminated due to the expiration of the incumbent contract, or the award of the successor contract to a different company.

In Amendment 001 the Government has removed FAR Clause 52.222-17 from the solicitation and any resulting contract.

17
The Government recommends submission of a total of five (5) contracts encompassing the prime Offeror and/or any major subcontractors.

Question: Must the offeror (prime and major subs) submit a total of five (5) contracts or may they submit less than 5?

Pg. 71 of 90, RFP
L-4, Vol II
The Government’s recommendation is 5. However, it is understood this may not be possible for all offerors. It is recommended but not required.
18
Will the Government consider revising the threshold contained in Section H-1, Competition in Supplies, to align with the micro purchase threshold amount of $10,000 as updated in the 2019 NDAA?
Pg. 27 of 90 RFP
H-1, Competition in Supplies
No, the Government considered options and determined the threshold in the RFP appropriate.
19
There appears to be a conflict in timing for transition. The Draft training schedule has training scheduled in Jul - Sep 2020 months before the start of the Contract per the Section B Schedule CLIN 0008 (1 Nov 2020 - 31 Jan 2021.)
RFP Page 4 of 90RFP

Attachment J.40 Draft Distribution Operations Training Schedule – July 2020 ITEM NO. 0008 Firm-Fixed Price (Applicable to CLIN 0008) Services to Perform Transition per C.1.8 (unless specifically identified separately in another CLIN, this CLIN encompasses PWS C-1 through C-6 ) PoP 3 months (1 Nov 2020-31 Jan 2021)

Intro to DSS and Receiving Course in July 2020 Amendment 0002 incorporates an updated J.40, Draft Training Schedule.

20
Given that the RFP was released just prior to two major holidays (Christmas and New Years Day), no announcement of the date and time of the pre-proposal conference/site visit, and the Government’s desire to have the best proposals submissions, will the Government please issue a two week extension to the proposal submission deadline to March 6, 2020
RFP Page 68-90
2. The hour and date for receipt of offers is 1:00 P.M. Eastern Local Time on February 19, 2020
Amendment 001 extends the proposal due date to February 26, 2020.

Amendment 0002 extends the proposal due date to March 6, 2020.

Amendment 0003 extends the proposal due date to March 11, 2020

21
Will the government please extend the question submission deadline from 6 January 2020 to 23 January 2020 to accommodate offeror’s ability to follow up with questions based on the site visit?
L-3 1.a.(page 67 of 90 )
…Question and must be received by 1:00 P.M. Eastern Local Time on January 6, 2020. Questions received after this date and time may not receive a response.
Amendment 001 extends the question period to January 31, 2020.
22
The following file/link for controlled access documents appears to be unavailable in SAM (with approval already granted). The link provides the following error message: “This page isn’t working. beta.sam.gov sent an invalid response.” Would the Government please check the link or consider another way to provide to offerors?

Ref: Section L, Tab 2 - Staffing Approach, Section (a), Subfactor (b) 2b states: "The Offeror shall provide the proposed labor categories for each specific task listed in Column A. Only one labor category shall be listed per row. The Offeror may add additional rows for specific tasks that will be performed by more than one labor category." When inserting additional rows, the workload data (Columns G, I, K, M, and O) does not flow down because of the embedded file link. Additionally, the hours (Columns H, J, L, N, and P) have a calculated formula based on the composite time standard (roll-up) and does not consider the individual time standard into the calculation. As formatted, when new rows are inserted, the J.38 requires the Composite Time Standard (Column D) to be completed for each new row. Adherent to current formulas, this results in equal hours for all labor categories identified for an individual task.

Question: Does the Government prefer the Offeror to insert an additional row per tasks requiring multiple labor categories to serve as the composite time standard (roll-up)? If not, can the Government please provide clarification on how to complete Column D and Columns G-P when inserting additional rows to accommodate multiple labor categories performing an individual task?

RFP Page 75 of 90
Section L, Tab 2 - Staffing Approach, Section (a), Subfactor (b) 2b
Attachment J.38 is revised in Amendment 0002. The Composite time standard column has been removed. When inserting the line, the Offeror will need to hand type in the workload in the workload column and add the calculation in the labor hour cells to calculate the labor hours from the time standard times the workload for added labor categories.
24
For electronic submission of offers, would the Government consider a secure access file exchange service (such as DoD SAFE, https://safe.apps.mil/) for efficient upload, and so offerors are not limited to 6MB per attachment?
RFP Page 68 of 90
L-3, Paragraph 2
Yes, provided there is no special access required for the Contract Specialist to download the files. DoD SAFE is acceptable. However, offerors should submit as much as possible via email.

Amendment 0003 – offerors planning to use DoD SAFE must provide the contract specialist with a point of contact and an email address not less than 48 hours prior to desired upload of files as the specialist must provide a code for use. FAR 15.208 discusses submission of proposals by electronic commerce methods.

25
Regarding Volume II – Past Performance guidance, “Prime Offerors shall provide information for (4) and (5) below,” please confirm “prime offerors” does indeed refer only to prime offerors on this solicitation, and therefore the requirement to provide information for (4) and (5) does not apply to subcontractors on this effort that were prime contractors on the referenced contracts/efforts?
RFP Page 72 of 90
L-4, Volume II Past Performance Proposal
Yes, information for (4) and (5) only applies to the Prime.

On September 19, 2019, the Department of Labor published a Notice in the Federal Register to announce that, beginning January 1, 2020, the Executive Order 13658 minimum wage rate is increased to $10.80 per hour (84 FR 49345). This Executive Order minimum wage rate generally must be paid to workers performing work on or in connection with covered contracts.

Question: For States (like California) where the state’s minimum wages are significantly higher than the wages for labor categories to be used under the current DOL AWD in the solicitation, will the government adjust the labor rates to match the rates of the respective states where the services are to be performed? This is important when competing for qualified talent in the local labor markets.
