About this file

This document is a Justification and Approval (J&A) for a sole source acquisition under FAR Subpart 13.5 to purchase a control panel from Anguil Environmental Systems, Inc. for the Bureau of Engraving and Printing's (BEP) Western Currency Facility (WCF). The control panel will connect to the existing Anguil regenerative thermal oxidizer (RTO), which is critical air pollution control equipment for the printing operations. The J&A justifies a sole source award to Anguil as the manufacturer of the equipment, citing the need for compatibility, continuity of operations, and Anguil's proprietary technology. The contracting activity plans to issue a synopsis on the Government Point of Entry to afford other potential sources an opportunity to submit capability statements, but expects to award a one-year, firm-fixed price contract to Anguil based on a fair and reasonable price determination.

The related federal contract opportunity is a Special Notice announcing the intent to award a sole source contract to Anguil Environmental Systems, Inc. for the RTO control panel. The notice invites interested sources to submit capability statements by July 17, 2024, but states that this is not a request for bids, quotes, or proposals, and the government has determined not to compete this requirement based on market research. The Bureau of Engraving and Printing is the responsible federal agency.

Treasury Standard Form 1013 (Rev 2/24)

Prescribed by Treasury: DTAP 1013.501 Tracking No.

iv. This sole source justification is in accordance with the procedures authorized at FAR

13.501 and FAR 6.302-1.

6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies:

Due to the nature of acquisition and the unique qualifications of the proposed contractor, as described in section 5 above, the Government is unable to solicit sources at this time. The Government will continue to seek competition for these services for subsequent acquisitions.

In accordance with FAR subpart 5.2, a notice of intent to award a sole source contract under the authority of FAR subpart 13.5 will be posted on the Government Point of Entry. This notice will afford an opportunity for all responsible sources to submit a capability statement which shall be considered by the Government.
