About this file

This document is a justification and approval for a sole source acquisition by the Department of the Treasury Bureau of the Fiscal Service on behalf of the Armed Forces Retirement Home, Washington D.C. campus. The acquisition is for temporary physician and nurse practitioner services from Certified Technical Experts Inc. for the period of December 30, 2023 through June 30, 2024. The services are critical as the AFRH-W is losing its current physician and nurse practitioner, leaving it without sufficient medical staff. The contractor's team has the required skills, training and experience with the AFRH-W's residents and facilities. The contracting officer determined the anticipated price to be fair and reasonable based on prior rates. Due to the urgent need to ensure continuity of critical medical services, a competitive process was infeasible.

DEPARTMENT OF THE TREASURY

INSTRUCTIONS FOR SF-1013 - JUSTIFICATION & APPROVAL FOR FAR SUBPART

13.5 SOLE SOURCE (INCLUDING BRAND NAME) ACQUISITIONS

Treasury Standard Form – 1013 (Rev 5/18)

Prescribed by Treasury: DTAP 1013.501

1. Identification of the requiring activity and the contracting activity:

The requiring activity is the Armed Forces Retirement Home – Washington D.C. Campus and the contracting activity is Bureau of the Fiscal Service.

2.a Nature and/or description of the action being approved:

The purpose of this limited-sources justification is to obtain approval to award a Firm-fixed price Task Order with Certified Technical Experts (CTE) Inc. for the services described in section 3.a below. The need date for these items is 12/30/2023. The period of performance for the base period will be 12/30/2023 – 03/30/2024, and 3/31/2024 – 06/30/2024 for the optional period. The overall Period of Performance for this requirement will be 12/30/2023 – 06/30/2024. See the acquisition file for requisition no. and a copy of the performance work statement.

2.b Name of the vendor. Certified Technical Experts (CTE) Inc.

2.c Requisition No.:

2.d Bridge contract: ☐ Yes No 2.e Brand name: ☐ Yes No 3.a A description of the supplies or services required to meet the agency’s needs:

The proposed acquisition is to acquire Temporary Physician and Nurse Practioner Services for their Washington, D.C. campus.

3.b Includes IT: ☐ Yes No 3.c IGCE/Estimated dollar value:

The IGCE is inclusive of a six (6) month base period and a single six (6) month option period. Refer to the IGCE for additional details.

4. Identification of the authority being used (Check the box that applies):

41 U.S.C. 1901 – Simplified acquisition procedures.

☐ 41 U.S.C. 1903 – Special emergency procurement authority.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

Currently, AFRH-W has one physician and one Nurse Practitioner. The physician is transferring to another agency on December 30, 2023. We are unable to delay the physician any further due to OPM rules on transferring for a promotion. The absence of medical provider is a life safety concern. Recruitment has begun but it will take time to hire and onboard a physician.

At the end of the year, AFRH/W will be losing 80% of its institutional knowledge concerning the higher level of medical care as our two attending physicians are leaving. A new physician on board will take time to get acclimated to our Resident's needs -over 300- and thus, could be easily overwhelmed with the work load. Additionally, during the COVID-19 pandemic, most of our medical staff worked throughout and beyond non-stop without vacations. As a result, most vacation requests from the medical team now exceed four weeks as they are traveling overseas to Africa or Asia which includes our NP. The scenario has resulted in an urgent can compelling need for the organization.

All members of CTE team (physician steam Safety and Health Administration, Infection Control, and Health Insurance Health Insurance Portability and Accountability Act courses required by Centers for Disease Control (CDC) and TJC. It takes more than six

(6) months to train a new team to the level of minimum competency.

According to 24 U.S.C 413c – Availability of physicians and dentists AFRH is responsible:

(1) In providing for the health care needs of residents at a facility of the Retirement Home under subsection (b), the Retirement Home shall have a physician and a dentist-

(A) available at the facility during the daily business hours of the facility; and

(B) available on an on-call basis at other times.

(2) The physicians and dentists required by this subsection shall have the skills and experience suited to residents of the facility served by the physicians and dentists.

Contrary to U. S. Government healthcare facilities are not required to have TJC accreditation TJC standards have specific guidelines and protocol to follow for medical orders and follow

up. Most specific and critical to the mission is the medical practice of the physician. Under 24 U.S.C. 413a - Oversight of health care provided to residents TJC will look closely at our practices if we have a lapse of coverage from a physician and once a new physician has begun to practice. The physician oversees waive testing, provides new resident and new employee physicals, and is required by our congressional statue. The physician must have specific competencies with the ability to explain the concept and demonstrate the practice. Each team member must be able to explain the systematic concept while demonstrating the practice in all levels of the Continuing Care Community. Such ability takes specific knowledge of each the various standards of the levels of care. The yearly/upon hire competency training is required by TJC.

Applicable TJC physician standards are below:

TJC’s expectation is that the physician manages and oversees all emergency life safety operations.

A physician is needed to provide care, treatment, and services, the clinical record contains the following additional information: advance directives Orders, renewal of orders, and documentation that resuscitative services are to be withheld or life-sustaining treatment withdrawn Any informed consent, when required by organization policy

Any records of communication with the patient or resident, such as telephone calls or e-mail Any patient- or resident-generated information (for example, choices, habits, routine) Referrals or communication made to external or internal care providers and community agencies

Any physician’s or other licensed practitioner’s summary and final diagnosis when the patient or resident is admitted either from a hospital or from another health care organization The discharge plan or the reason for lack of an ongoing plan when discharge potential does not exist

Offices where there isn’t Chief Medical Officer or Medical leader there is an Immediate Threat To Life and that particular health care setting will be immediately closed, and TJC accreditation will likely be lost, at least for a period of time.

Due to the unexpected nature of the outgoing physician’s departure, there is no way to ensure urgency will be mitigated in the future aside from the incoming physician being a Government employee.

6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies:

The physician will temporarily meet the need for a position previously filled by a permanent Government employee. The current physician is leaving AFRH-W for a position with another agency on 12/30/2023. AFRH is actively working to recruit and onboard a replacement physician who will once again be a Government employee. This award is a stop-gap measure to ensure there is no lapse in service for this critical need.

Additionally, during the COVID-19 pandemic, most of our medical staff worked throughout and beyond non-stop without vacations. As a result, most vacation requests from the medical team now exceed four weeks as they are traveling overseas to Africa or Asia which includes our NP. The scenario has resulted in an urgent and compelling need for Nurse Practioner services for the AFRH’s Washington D.C. campus.

The absence of medical providers is a life safety concern. Due to the urgent and compelling nature of this requirement as described above, AFRH residents cannot go without these critical medical services, a competitive solicitation is not feasible (FAR 13.501(a)(1)(i)).

The requirement will not be synopsized pursuant to FAR 18.103 – Synopses of proposed contract action. –“ Contracting officers need not submit a synopsis notice when there is an unusual and compelling urgency, and the Government would be seriously injured if the agency complied with the notice time periods. (See 5.202(a)(2).)”

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on FAR 13.106-3(a)(ii) Comparison of the proposed price with prices found reasonable on previous purchases (GSA CALC established labor rates) and (vi) a comparison of the proposed price with the Independent Government Cost Estimate (IGCE).

8. A description of the market research conducted (see FAR part 10) and the results or a statement of the reason market research was not conducted:

In accordance with DTAP parts 1008, 1010 and 1019, Treasury Mandatory Sources and small business sources were considered. See SF 1010 Market Research Summary Report for details.

Due to the nature of acquisition and the unique qualifications of the proposed contractor as described in section 5 above Government market research was not conducted as this acquisition is being solicited as an Urgent and Compelling requirement in accordance with FAR 13.501(a)(1)(i). Due to the temporary need associated with this action, no follow on requirement is needed once the permanent Government position for an AFRH physician is filled. Future instances of Nurse Practioner need will be filled via existing IDIQ vehicles in place for the AFRH, which were previously awarded on a competitive basis.

9.a Any other facts supporting this justification:

(i) why technical requirements are not available to support fuller competition –

Currently, AFRH-W has one physician and one Nurse Practitioner. The physician is transferring to another agency on December 30, 2023. We are unable to delay the physician any further due to OPM rules on transferring for a promotion. The absence of medical providers is a life safety concern. Recruitment has begun but it will take time to hire and onboard a physician.

Additionally, due to increased demand resulting from the COIVD 19 pandemic, AFRH medical staff worked throughout and beyond non-stop without time off. Subsequently, vacation requests from the AFRH medical team now exceed four weeks as they are traveling overseas to Africa or Asia, to include the current Nurse Practioner.

(ii) Facts about why the requirement cannot be modified to enhance competition –

Due to the unusual and compelling nature of this requirement as described above (AFRH residents cannot go without these critical medical services as it is a life safety concern) as well as the mandated requirements of 24 U.S.C. 413a and c, a competitive solicitation is not feasible.

(iii) Procurement history

No procurement history is available for this requirement, as the Physician position was previously filled by a Government employee, not a contractor. The AFRH intends to staff this position accordingly once recruitment and onboarding is complete.

9.b Attachments: ☐ Yes ☐ No

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:

As this requirement is exempt from the requirements for synopsizing actions under FAR 18.103, this section is not applicable.

11. A statement of the actions, if any, the Requiring Activity or Contracting Activity may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
