About this file

Summary

This is a Project Manual and Permit/Bid Set document prepared by IKM Incorporated for the City of Cleveland's Rockefeller Greenhouse Campus Renovations project located at 750 East 88th Street, Cleveland, Ohio 44108. The project involves renovations, alterations, and deferred maintenance improvements to multiple existing buildings and structures on the campus, including the Administration Building, Storage Building, and Forestry Maintenance Garage, which hold historic significance to the City of Cleveland. The scope of work encompasses construction, demolition, renovation, hazardous material removal, construction financing, and facility operations during occupancy. The project is being managed by the Mayor's Office of Capital Projects through the Division of Architecture and Site Development, with Joseph Mestnik serving as the Owner's Project Manager. The construction contract is structured as a lump sum (fixed price, stipulated sum) arrangement. Prospective bidders may examine the currently occupied premises during specified hours: Monday through Friday, 9:00 a.m. to 3:00 p.m. The project team includes IKM Architecture as the design professional of record, along with consultants specializing in landscape architecture (Knight & Stolar, Inc.), structural engineering (Osborn Engineering), mechanical/electrical/plumbing/AV/IT engineering (Algebra AEC), and exterior envelope consulting (Finley Consulting Group, LLC).

The project documents include comprehensive specifications organized by division covering general requirements, existing conditions assessment, concrete, masonry, metals, wood and composites, thermal and moisture protection, openings, finishes, specialties, furnishings, plumbing, HVAC, integrated automation, electrical systems, communications, electronic safety and security, and site improvements. A Hazardous Materials Inspection Report dated June 30, 2023 was conducted by Lawhon & Associates, Inc., documenting asbestos-containing materials, lead-based paint, fluorescent bulbs and light ballasts, refrigerants, mercury, and stored drums with oil staining throughout the campus buildings. The Owner has already obtained necessary permits and approvals from the Zoning Board of Appeals, Planning Commission, and Historic Preservation Commission, while the Contractor is responsible for obtaining all building permits at no cost to the Owner. The project documentation includes detailed architectural, structural, mechanical, plumbing, electrical, and technology drawings for all three primary buildings on the campus.

Hazardous Materials Inspection Report City of Cleveland- Rockefeller Greenhouse

Cleveland, Ohio 44108

1.0 Introduction

Lawhon & Associates, Inc. (L&A) conducted a hazardous materials inspection at City of Cleveland- Rockefeller Greenhouse, 750 E 88th Street, Cleveland, Ohio 44108. The inspection was conducted on May 2, 2023 by Mr. Jordan Mederer Ohio Environmental Protection Agency (OEPA) Certified Asbestos Hazard Evaluation Specialist (CAHES) [AHES #ES35005], And Mr. Aris Neace Ohio Environmental Protection Agency (OEPA) Certified Asbestos Hazard Evaluation Specialist (CAHES) [AHES #ES36144], of L&A.

The consultant’s certifications are attached in Appendix A.

L&A inspected all accessible materials (for the presence of asbestos containing materials) throughout the main greenhouse building, the administration building, nursery and storage buildings (2 each) and garages (2 each). This report should not be utilized as a remediation design or bidding document. This report conforms to the EPA NESHAPs regulations prior to renovation/ demolition for this project.

2.0 Asbestos Containing Material Summaries

Asbestos containing materials are governed by the Environmental Protection Agency’s (EPA) National Emission Standards of Hazardous Air Pollutants (NESHAP) during a demolition. These materials are defined as containing greater than one percent asbestos. The Occupational Safety and Health Administration (OSHA) govern building materials containing any amount of asbestos.

The Clean Air Act (CAA) of 1970 required the EPA to develop and enforce regulations to protect the general public from exposure to airborne contaminants that are known to be hazardous to human health; therefore, EPA promulgated the National Emission Standards for Hazardous Air Pollutants (NESHAP) (Title 40, CFR Part 61) on April 6, 1973. NESHAP is intended to minimize the release of asbestos fibers during certain activities (i.e., renovations, demolition, and installations). It specifies work practices to be followed during renovations of buildings (except apartment buildings that have no more than four dwelling units), which contain a specific amount of friable asbestos.

NESHAP requires that buildings be inspected for asbestos containing building materials (ACBM) prior to renovation/demolition projects regardless of the age of the structure.

NESHAP also requires owners and operators subject to the asbestos rules to notify delegated state and local agencies and/or the regional EPA offices before demolition or renovation activities begin. In addition, NESHAP requires the removal of all regulated asbestos containing materials (RACM) prior to demolition. Regulated Asbestos- Containing Materials (RACM) are (a) friable asbestos material, which are materials easily reduced to powder with hand pressure (b) Category I non-friable ACM that has become friable, (c) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting or abrading, or (d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations. (Category I non-friable materials consist of materials such as resilient floor covering products, roofing products, gaskets, and packing. Category II non-friable materials consist of all other non-friable materials such as transite.). NESHAP also

Limited Hazardous Materials Inspection Report Page 2 of 9

Cleveland, Ohio requires all ACM (including Category I and II) be removed prior to intentional burning, such as for a fire department training exercise.

The Ohio Environmental Protection Agency (EPA) regulates asbestos activities within the state. Professionals performing asbestos related activities must be certified/ licensed by OEPA.

2.1 Methodology

A list of suspect ACMs was compiled from the investigation of the buildings.

Materials were categorized into RACM, Category I, and Category II materials.

L&A inventoried and procured confirmatory samples of suspect asbestos containing materials.

Materials suspected of containing asbestos were grouped into homogeneous areas for bulk sampling purposes. A homogeneous area is composed of specific material that appears to be the same in color, texture, date of installation or location (e.g., grey spray-applied fireproofing in a specific construction unit).

The number of bulk samples to be procured for each identified homogeneous area of suspected Surfacing Materials, Thermal System Insulations, and Miscellaneous Materials were determined in accordance with 40 CFR 763.

Specifically, Friable and Nonfriable Surfacing Materials (i.e., fireproofing, acoustical plaster, decorative plaster, hard plaster, and textured coatings) were sampled following the guidelines set forth by the USEPA in the document “Asbestos in Buildings - Simplified Sampling Scheme Friable Surfacing Materials.” Based upon the square footage of the homogenous surfacing materials, either a minimum of 3, 5, or 7 bulk samples were randomly procured and analyzed. For Thermal System Insulation (TSI), at least 3 random samples of each homogeneous area of TSI were procured and analyzed and 1 sample of patched TSI if it was <6 linear or square feet. For Miscellaneous Materials (MM), at least 2 random samples of each homogeneous area of MM were procured and analyzed.

Bulk sample locations for suspect materials sampled by L&A, and the name and signature and asbestos hazard evaluation specialist number of each person who collected samples are shown on the Asbestos Bulk Sample Diagram found in Appendix B.

Samples were placed into clean sealed containers and identified with a unique sample number. Sampling tools were decontaminated between each sampling episode.

All samples were sent to certified National Voluntary Lab Accredited Program laboratories. The lab utilized for bulk sample Polarized Light Microscopy (PLM) analysis for this assessment was SanAir Technologies Laboratories, SATL (NVLAP # 600227-0) located at 11709 Chesterdale Road, Cincinnati, Ohio 45246. Samples were analyzed by the EPA Polarized Light Microscopy (PLM) 600 Method. Samples reported with low concentrations of asbestos, < 3% asbestos content, were reanalyzed using the EPA Point Count Method to determine a more accurate content.

3.2 Assumed Asbestos Containing Materials

As a result of the inspection, no materials are assumed to contain asbestos. All suspect asbestos containing materials projected to be impacted have been sampled, previously sampled, or determined to be homogeneous with other suspect materials sampled in other areas of the building. If suspect materials are uncovered/encountered during renovations that are not listed in the tables above or below, those materials should be assumed to contain asbestos and remain undisturbed until further investigation/testing determines otherwise.

3.3 Materials Containing 1% or Less Asbestos

The following is a list of materials sampled and confirmed to contain 1% or less asbestos by PLM Point Count analysis. These materials are not regulated by EPA; however, will still need properly removed in accordance with OSHA

Limited Hazardous Materials Inspection Report Page 4 of 9

Cleveland, Ohio asbestos standards. EPA notification is not required for abatement of these materials.

Materials Containing 1% or Less Asbestos

Drywall/Joint Compound II

Drywall/ Joint Compound (Cactus Room Only) Wood Door Glazing Compound

Glass Block Interior Window Glazing Compound

EPA regulations do not apply to these materials, however OSHA does regulate <1% asbestos materials. The following are the implications for the contractor:

1. Work practice requirements and prohibitions that must be observed REGARDLESS of the exposure levels and of the percentage of asbestos in the installed construction materials are:

29 CFR 1926.1101(g)(1)(ii), which requires: wet methods, or wetting agents, to control employee exposures during asbestos handling, mixing, removal, cutting, application, and cleanup.

The material should be thoroughly wet at all times during handling, mixing, removal, cutting, application, cleanup and up until it is containerized. This will minimize the potential for exposure through dry dust and fiber release.

29 CFR 1926.1101(g)(1)(iii), which requires: prompt clean-up and disposal of wastes and debris contaminated with asbestos into leak-tight containers.

The Contractor should provide a “leak-tight container.” The trailer is required to be equipped with a bladder bag or lined with polyethylene sheeting which should be taped to seal shut. “Prompt clean-up and disposal” means that asbestos material is to be cleaned up as it is removed and before it dries.

29 CFR 1926.1101(g)(3)(i), which prohibits: high-speed abrasive disc saws that are not equipped with point-of-cut ventilator or enclosures with HEPA filtered exhaust air;

To reduce dry dust and fiber release exposure.

29 CFR 1926.1101(g)(3)(ii), which prohibits: compressed air used to remove asbestos, or materials containing asbestos, unless the compressed air is used in conjunction with an enclosed ventilation system designed to capture the dust cloud created by the compressed air;

To reduce dry dust and fiber release exposure.

29 CFR 1926.1101(g)(3)(iv), which prohibits: employee rotation as a means of reducing employee exposure to asbestos.

Contractor cannot manipulate work shifts as a means of artificially reducing the Permissible Exposure Limit (PEL).

At the start of demolition operations involving materials containing <1% asbestos, a contractor must produce an “Initial Negative Exposure Assessment” in accordance with 29

Limited Hazardous Materials Inspection Report Page 5 of 9

Cleveland, Ohio

CFR 1926.1101 (f)(2)(iii)(A-C) to demonstrate that the airborne concentrations of asbestos will not exceed the (PELs).

In order to avoid the need to comply with the elements of the standard that are applicable when either asbestos PEL is exceeded, the contractor conducting the demolition project must produce an initial negative exposure assessment for his/her employees.

There are three potential approaches provided under 29 CFR 1926.1101(f)(2) for producing a negative exposure assessment. These are the use of objective data, previous air monitoring results, or current air monitoring results. If the contractor cannot produce a negative exposure assessment with objective data or previous air monitoring results, then the contractor must conduct asbestos exposure monitoring. Until the contractor is able to produce a negative exposure assessment for his/her employees, the contractor must comply with the elements of the standard that are applicable when either asbestos PEL is exceeded.

2. Disposal: The demolition waste, debris contaminated with less than 1 percent asbestos, in accordance with EPA regulations may go to a C&DD landfill. Each landfill has an internal policy on accepting this waste stream. The Demolition Contractor is responsible for confirming acceptance of this material by their chosen landfill and incorporating associated fees in their bid.

3.4 Non-Asbestos Containing Materials

The following table lists materials sampled with laboratory analysis revealing no asbestos detected. If any additional suspect materials not listed in this table or already confirmed or assumed to contain asbestos, that material must be assumed to contain asbestos until further proves otherwise.

4.0 Other Environmental Hazards

4.1 Lead Based Paint

L&A conducted limited lead-based paint testing of the windows at Putnam Hall. The intent of the testing was to determine if lead-based paint is present on the windows for general compliance with the OSHA Lead in Construction Standard 1926.62 and should not be construed as a full Lead Based Paint Inspection as defined by HUD.

The bulk paint samples were placed into clean, sealed bags and labeled with unique identifiers. The samples were submitted to a laboratory certified under the National Lead Laboratory Accreditation Program (NLLAP). The lab used for lead-based paint sample analysis for this project was SanAir Laboratories (NLLAP #162952) located at 1551 Oakbridge Drive, Suite B, Powhatan, VA 23139. Laboratory Accreditation Certificates and Lead Based Paint Analysis Chain of Custody information can be found in Appendix F. All Bulk Lead Based Paint samples were analyzed by the Atomic Absorption Spectroscopy (AAS) for total concentration of lead. The regulatory limit for this method of analysis is 0.5% lead by weight, as established by EPA/HUD.

If paint with small quantities of lead is turned into dust from abrasion or other means, lead hazard dust may result. A lead hazard is defined as a “material such as lead-based paint, lead-containing dust, lead-contaminated soil, and lead-contaminated water pipes containing a level of lead at or in excess of the level hazardous to human health as set forth in rule 3701-32-07 of the Administrative Code (HUD Guidelines).”

The table below summarizes bulk samples collected and analyzed for lead-based paint content, reported as percent lead by weight. Samples with results exceeding the regulatory limit of 0.5% lead by weight are listed in bold text below.

OSHA recognizes any amount of lead in paint as a potential hazard, even if reported concentrations are below the regulatory limit. All work procedures impacting or disturbing painted window surfaces needs to be performed by all contractors/ workers in accordance with OSHA Standard 29 Code of Federal Regulations (CFR)

1926.62 lead exposure in construction. It is recommended that all contractors that impact painted building materials perform personal air monitoring on their employees to ensure that they are not being exposed to lead above the Action Level (AL) or Permissible Exposure Limit (PEL), or maintain a negative exposure assessment.

4.2 Lead Solder Joints

L&A observed lead solder joints associated with the storm and sanitary piping throughout the buildings. The bulk lead material should be separated from construction demolition and debris waste, containerized and properly recycled, should this piping be demolished as part of the project.

4.3 Florescent Bulbs and Light Ballasts

L&A observed fluorescent light bulbs and associated ballasts throughout the structures. If these are to be impacted by renovation/ demolition activities, they should be removed and recycled because the fluorescent bulbs are assumed to contain mercury, or other potentially hazardous heavy metals. Furthermore, light ballasts potentially contain PCB oils and are normally labeled “Contains No PCBs” if PCBs are not present. All light ballasts will need to be investigated prior to impact from renovation activities. Ballasts not identified with a “Contains No PCBs” label, will need to be disposed of as a regulated hazardous material; ballasts containing a “Contains No PCBs” label should be containerized and recycled. All removal, packaging, and handling of these materials should be performed by a trained contractor. The contractor should remove and package this material and safely transport off-site.

4.4 Refrigerants

L&A observed potential Refrigerant/Freon containing items (such as refrigerators, water fountains, window a/c units, etc.) throughout the structure(s).

Refrigerants/Freon routinely contain chlorofluorocarbons (CFC’s) which are known to deplete Ozone if released into the atmosphere. These items need to have the Freon properly removed and disposed of by a qualified contractor prior to demolition activities.

Limited Hazardous Materials Inspection Report Page 8 of 9

4.5 Mercury

L&A observed mercury containing thermostats in the Administration Building. These items should be removed prior to renovation/ demolition, safely packaged and transported off-site prior to impact from demolition activities.

4.6 Stored Drums/ Oil Staining

L&A observed four (4) 50-gallon drums in the Garage #2. These drums were labeled as anti-freeze, washer solvent or kerosene/oil. These drums should be removed from the structure prior to impact from demolition activities. Additionally, there is oil staining throughout this structure.

5.0 Conclusions
