Since we can only invoice for COMPLETED services order, how can they be a FFP in ELIN File?

Shouldn’t they go to Non Recurring Side as we are only paid for work done? Currently in ELIN File, Service orders of all types are FFP and we price them as FFP which means we get paid for that amount.

The PWS contradicts that saying we only get paid for the work done. This needs to be changed. Please advise how this will be changed?

The intent of this contract is to utilize 100% of the Service Orders listed in the Recurring Work ELIN schedules and order additional Service Orders from the Non-Recurring ELIN schedules as needed.

Per FAR 52.232-1 Payments, "The Government shall pay the Contractor, upon the submission of proper invoices or vouchers, the prices stipulated in this contract for supplies delivered and accepted or services rendered and accepted, less any deductions provided in this contract." As a result of this clause the Contractor shall only invoice for services rendered or completed. The Contractor shall not invoice for incomplete services. This not only applicable to Service Orders but for all Services provided to the Government. The Government cannot pay for services not receieved per the FAR.

Therefore, Service orders will remain in the Recurring Work Section of the Solicitation. N/A

Amend 2 File , M.3 Evaluati on Factors, Para 3.(b) Non- Cost / price Factors of 14

Why are you not allowing major subcontractors past performance to be included? This does not incentivize the prime to team and bring a stronger team on board for SDVOBS. Will you reconsider if the sub has 10 or 20% included in Corporate and Past performance area evaluation?

The Government has reviewed this requirement and it remains unchanged. Projects completed by a proposed subcontractor will be considered unacceptable.

However, an offeror may rely on the prime contractor experience of corporate affiliates, if all submittal requirements of the solicitation are met. In addition, for offerors covered by a Mentor-Protégé Agreement approved by the SBA, only one member of the Joint Venture or partnership must demonstrate prime contractor relevant experience. N/A

(b) Non-cost/pric e factors 9 of 14

Please clarify the definition of a relevant project and requirements for Factor 1 Corporate Experience. The definition of a Relevant Project states that a relevant project is futher defined as Base Operations Support (BOS) services that encompass at least two of the following: 1502000, 1503010, and 1503050. As revised in Amendment 0002, Factor 1 solicitation submittal requirements states that the offeror's submitted projects must aggregately demonstrate experience self-performing or managing 1502000 similar to the requirements of the RFP (at minimum, Service Orders and HVAC systems).

The Relevant Project definition allows for submission of different but significant Sub-annexes relative to the RFP. Offerors must submit a minimum of two relevant projects that encompass at least two of the sub-annex requirements identified in the Relevant Project definition; however, of those three sub-annex requirements, only 1502000 - Facility Investment similar to the requirements of the RFP (at minimum, including Service Orders and HVAC Systems) is required in order to meet the submittal requirements of the RFP.

The intent of the revision in Amendment 0002 was to allow more flexibility in how offerors demonstrate relevant experience. The following examples are intended to illustrate two possible submissions and are not to be construed as a limiting factor for the relevant project submission: 1) submission of one (1) project with Sub-annex 1503010 and 1503050 and a second project with 1502000 and 1503010 or 1503050 or 2) the submission of two (2) projects with Sub-annex 1502000 and 1503010.

Also, It appears that at least one of the Maximo Names has been transposed.

For example Chiller #1 on the 25 tab in building 89 is PAN-98-CAC-01 while the same chiller's Maximo name on tab 05 is PAN-89-CAC-01.
