Engineering/Logistics Reach Back Draft PWS Paragraph 3.15.1 captures the Government’s Engineering/Logistics Reach Back scope, including:

“The Contractor shall provide XXXX engineering and logistics support reach back hours, per lot, to support PMA-273 Class Desk, APML, NAVAIR Engineering and Logistics, and the Fleet Support Team (FST).”

The Government seeks information to bound the tasking to define the quantity of hours in the final solicitation The draft PWS purposefully annotated the quantity of hours with “XXXX” to facilitate Industry & Government dialogue

Non-OMIT/FFF Data Access Policy – Rights in Commercial Technical Data DFARS 227.7102-1 - DoD shall acquire only the technical data customarily provided to the public with a commercial item or process. Offerors shall not be required to furnish technical data in excess of those categories required by the DFARS.

Draft Solicitation Section L Language:

Paragraph 2.2.1, Data Submission – “Note that this is voluntary and providing the Government with greater information, technical data, or technical data rights than the Offeror is otherwise required to provide under the DFARS is not a condition to award.”

Failure to propose additional access to technical data will not result in a risk or deficiency to the proposal, but proposing access may enhance a proposal.

Non-OMIT/FFF Data Access The Government desires rights to technical data in excess of rights provided by DFARS 252.227-7015.

The Government seeks to accomplish this desire through use of the Attachment L-5 Data Access Agreement. Note that “access” is different than “delivery.”

Government access shall be used only for the following purposes:

Analysis and engineering required to draft/formulate proposed non-standard/non-manual repairs to be provided to Contractor for approval, in the event such repair is required;

Review of revisions to baseline drawings, models, specifications, and lists to enable logistics updates to appropriate databases and configuration management systems;

Review of source data pertaining to sustainment and improvement of products to enable logistics planning and modeling for maintenance, reliability, and sparing.

The Attachment L-5 Access Agreement is not static and allows an offeror to propose the types and uses of data it controls.

Commercial Financing Pre-Solicitation Notice indicates the Government’s interest in understanding “offerors’ overview and preference, if any, for commercial helicopter payment terms and conditions.”

In accordance with FAR 32.202-1, it is the responsibility of the contractor to provide the resources needed for performance. However, the contracting officer may include provision for financing when;

Financing by the buyer is consistent with commercial practice; and Doing so is in the best interest of the Government.

FAR 32.202-2 limits “Commercial Advance Payments” to no more than 15 percent of contract price.

FAR 52.232-30, Installment Payments for Commercial Items, limits such payments to 70% of the unit price.

Draft Section L&M included FAR Clause 52.232-31, Invitation to Propose Financing Terms Clause allows the offeror to propose its own customary financing terms The Government is contemplating specifying financing terms (FAR 32.204) that conform to commercial terms and conditions

Item Unique Identification In accordance with DFARS 211.274-6;

“Use the clause at 252.211-7003, Item Unique Identification and Valuation, in solicitations and contracts, including solicitations and contracts using FAR part 12 procedures for the acquisition of commercial items, for supplies…”

DFARS Clause 252.211-7003 requires the contractor to determine whether to:

Serialize within the enterprise identifier Serialize within the part, lot, or batch number; or Use a DOD recognized unique identification equivalent

“DoD recognized unique identification equivalent” means a unique identification method that is in commercial use and has been recognized by DoD. All DoD recognized unique identification equivalents are listed at http://www.acq.osd.mil/dpap/pdi/uid/iuid_equivalents.html the data requirements of 14 CFR Part 45, Identification and Registration Marking, for only aircraft, aircraft engines, propellers, and propeller blades and hubs are consistent with the data elements required by our IUID constructs

DFARS 252.211-7003 is applicable, but may be satisfied by commercial equivalents

Cyber Security Government is requesting Industry propose its cyber security procedures via CDRL A026 (what you have and how you do it) RMF System Security Plan Information System Continuous Monitoring Strategy The Government is not looking for industry to create a cyber security plan, simply provide the information.

Focus on the “shall” requirements. Not all listed references are “shalls.”

Information delivered via the CDRL deliverable will support the characterization of commercial standards for cyber security The Government will utilize this data to conduct vulnerability assessment and to support risk analysis Government may seek to procure additional data at a later date

Questions to Industry With regard to NIST 800-171, what data/information associated with TH-XX and PSE does industry consider controlled unclassified information?

Besides NIST 800-171 what cyber security standards or processes does industry apply to TH-XX and PSE?

User Interface & Configuration In order to mitigate the impact of configuration changes to user interfaces and downstream impacts to training material, the following PWS requirements for identical user interface, was included:

Paragraph 3.1.4, User Interface – “User Interface Configuration. (CLINs 0X01) All aircraft delivered under this contract shall have identical user interface, to include cockpit and cabin layout, functions, operations, procedures, and associated publications except for updates necessary to support FAA airworthiness and Obsolescence/Diminishing Manufacturing Sources & Material Shortages.”

In order to maintain configuration status accounting for each lot, the following language is intended to embrace commercial changes, while limiting the need to maintain multiple configuration within a single lot:

Paragraph 3.1.5, Final Product Baseline – “Final Product Baseline. (CLINs 0X01) The Contractor Final Product Baseline (FPB)(also known as Baseline Configuration) shall be based on the manufacturing baseline as established by the first aircraft of each of the full rate delivery lots. The Contractor shall deliver the documented FPB by lot to the Government. (CDRL A002).”

Note: Changes from Draft PWS are denoted in Red font

Sections L & M

Overall Compliance Element System Performance Demonstration Offerors are advised that all proposed aircraft shall undergo a System Performance Demonstration (SPD), in accordance with Attachment L-2 (SPD).

The Government will not assign an independent rating for the SPD, as the SPD is only intended to inform the Government’s evaluation of the Aircraft System risk rating.

The aircraft used in the SPD should be as close as possible to the final configuration of the Offeror’s proposed TH-XX helicopter, and shall be at least of the same type and model.

Note: Offerors are advised that conduct of the SPD is not considered Discussions.

Aircraft System Sub-Factor Elements 2.1.2 through 2.1.5 The Government will evaluate the Offerors’ holistic approach to meeting the training mission for the following elements:

Instrument Training: The Offeror shall describe the capability of its proposed configuration to conduct simulated and actual instrument condition training for student naval aviators using a variety of instrument approach procedures in FAA airspace.

Navigation Training: The Offeror shall describe the capability of its proposed system to enable navigation training in visual meteorological conditions at various altitudes including low level flight altitudes in both single aircraft and formation operations.

Warfighter Skills Training: The Offeror shall describe the ability of its proposed configuration to enable warfighting skills training which includes confined area landings, external load operations, search and rescue operations, energy management, and night vision (single ship and formation) operations.

Safety: The Offeror shall provide a detailed engineering analysis or provide its detailed plan to include the requested functionality identified in the ECS (AV-019) and Emergency Landing Conditions (AV-141 and AV-142).

The Government determined that the 11 attributes identified in the Aircraft System Sub-Factor are those that would offer the greatest level of discrimination in the best value decision.

Price Total Evaluated Price Instant procurement (FFP CLINs) C&dD 10 Year Projected Operation & Support Cost

The final RFP will be updated to specify the version of C&dD that will be used for the evaluation

The Government has elected a 10-year projected O&S Cost period given the decreasing level of price fidelity in the out-years.

No adjustments will be made to the numbers from C&dD
