52.212-2 -- Evaluation -- Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) TECHNICAL CAPABILITY – Show capability to perform Maintenance and Repairs on different types of industrial sewing machines. The Government will review the technical capabilities plan. Offerors who provide all submission information and demonstrate the current capability to meet the technical plan or a realistic plan to attain the capability will be given an “ACCEPTABLE” rating. Offerors who do not provide all submission information or do not demonstrate the current capability or are unable to demonstrate an adequate plan to attain the capability to meet the technical requirements of this solicitation, will be given an “UNACCEPTABLE” rating.

(ii) PAST PERFORMANCE - Past performance is a measure of the degree to which the Offeror satisfied its customers in previous relevant contracts, and complied with Federal, State, and local laws and regulations.

(iii) PRICE - Cost Price Data - For evaluation purposes, the total evaluated price will be calculated by adding the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options. The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or exhibit line items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the balance poses an unacceptable risk to the Government.

The Government intends to make award on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for Factor (i) and Factor (ii), the non-price factors. (The Government will not, however, provide additional credit for those proposals that may exceed the standards.) The technical capability to provide sewing machine services meeting the specifications (Factor i) and the ability to meet the delivery date (Factor ii) are equal to price (Factor iii). Offerors proposals will be evaluated under Factor (i) above, which represents the minimum acceptable criteria. Under this factor, the Government will rate the quote as either acceptable or unacceptable. Failure to meet the minimum criteria for this factor will render the entire quote unacceptable and the quote may not be considered for award. See paragraph (b) below. Only those Offers which meet the minimum requirements required by Factor (i) will be further evaluated under Factor (ii), Meet the Period of Performance. Failure to meet the minimum criteria for this factor will render the entire quote unacceptable and the quote may not be considered for award. See paragraph (c) below. For those proposals that are rated acceptable on Factor (i) and Factor (ii), the Government will then evaluate Factor (iii), Price. Award will be made on the lowest evaluated total price. See paragraph (b-d) below.

All moving services must be proposed. No partial quotes shall be accepted.

(b) Technical Capability, Factor (i), will be assessed by evaluating the vendor's provided documentation.

(c) Ability to Meet the need date, Factor (ii), is clearly defined on the PWS. The ability to meet the required need date shall be demonstrated by the offeror's submission of a signed offer which has not taken exception to the required delivery date.

(d) Price. All vendors shall provide a breakdown of pricing on the attached 'ELINs for Quote' (ONLY IF YOU HAVE A SEPARATE SPREADSHEET). The total price for all leases including any fees will be evaluated.

(e) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. At the discretion of the Contracting Officer, the Government intends to evaluate quotes and award a contract without discussions with offerors. Each initial offer should, therefore contain the Offeror's best terms from both a price and technical standpoint.
