Question

Response

Attachment W does not include wage determination for Mariners required in this contract. Is there a Service Contract Act (SCA) Wage determination for Mariners? If so will it be used and provided for this solicitation for pricing?

Notwithstanding any other provision, minimum wage payment shall be as specified by P.L. 93-259 or the Service Contract

Wage Determination, whichever is greater. The minimum wages to be paid for work performed under the the contract will be as required for Guam.

2 Is there a federal exemption for the Guam Retail Tax (GRT)?

Contact Guam Department of Revenue & Taxation at (671) 635-

1779 or www.guamtax.com

Wage Determination No. 2015‐5693 Revision No: 11 Date Of Last Revision: 07/24/2020 was included in the RFP, however, this wage determination does not contain wage classifications for any maritime operations positions and the Governments required USCG licensed or non-USCG Licensed vessel crew positions per the PWS section 3.5.2 through 3.5.3.3. Will the Government provide the correct wage determination for USCG Licensed Mariners?

Notwithstanding any other provision, minimum wage payment shall be as specified by P.L. 93-259 or the Service Contract

Wage Determination, whichever is greater. The minimum wages to be paid for work performed under the the contract will be as required for Guam

Per the RFP, this solicitation is being issued as a FFP IDIQ. Typically, IDIQ solicitations only request hourly rates per LCAT and distribute Task Orders/Delivery Orders. Then at the Task Order/Delivery Order Level, the Government requests Section B to be submitted since hours will be allocated per Task Order. Will the Government clarify whether the Offerors are required to fill out Section B at the IDIQ submission level due November 16, 2020?

No, the IDIQ portion does not need to be filled out.

QUESTIONS & RESPONSES (RFI's) Sol. No. N4019229R4010 - O&M Services for PMRF

11-December 2020

The Government lists CLIN 0001 as "BASE PERIOD RECURRING - FFP" and CLIN 0002 as "BASE YEAR NON-RECURRING - IDIQ."Please provide clarification to explain the difference in the two CLINs, and how to differentiate the cost?

Recurring is work that is repetitive such as preventive maintenance. Non-Recurring will be under the IDIQ portion, which is unforseen such as repairs. IDIQ CLINs do not need to be priced by the Vendor.

The RFP lists CLIN 9000. 9001, 9002, 9003 and 9004 as "EXHIBIT A, B, C, D, or E." Will the Government specify what needs to be priced out for these CLINS? The solicitation package does not provide EXHIBIT A, B, C, D or E, so it is unclear what is to be priced.

CLINS 9000 to 9004 are used to identify the exhbits and are informational only

RFP 3.6.9 states, "The contractor shall place on order all critical repair parts within one business day and non-critical repair parts within five days." Is it the Government's intent to make these purchases Cost Reimbursable? If it is the Government's intent to make these purchases Cost Reimbursable, will the Government add a CLIN in Section B where these costs can be allocated??

Any and all repairs or replacements will be covered under the IDIQ CLIN via delivery order

Section L-6 near top of page 63 describes two Safety items: (1) Discuss Company’s Safety Culture, and (2) Discuss your technical approach to safety. These two items are described differently later in the same section; Factor 3. Safety at the bottom of page 65 in that the Government is requesting (1) DART & TRC rate and (2) our technical approach to safety. Request you clarify.

Description of Safety Culture will be removed. Only DART & TRC rates and technical approach to safety is required.

Technical Factors in Volume II lists five technical factors; A. Offerer experience, B. Technical Approach, C. Management Plan, D. Safety, E. Past Performance. Only four of these technical factors are represented in the following descriptive paragraph b. VOLUME II on page 64 of the solicitation. Management Plan/Quality Control was left off the list. This same topic; Management Plan/Quality Control was left off the list of NON-PRICE FACTORS described on pages 65-67.

It was also left off the list of evaluation factors for award in M.2 on page 86. Are those deliberate omissions, or an oversight?

There are only four techical factors: Offeror Experience, Management Plan, Safety, and Past Performance.

Section L.3 indicates that digital images will be included as an attachment to the solicitation in lieu of a site visit. Where can those digital images be accessed?

See attachments posted in https://beta.sam.gov/

Section L.6 page 64 in Factor 1, Offerer Experience describes the use of the Project Data Sheet as Attachment JL-2. Please confirm that should be listed as Attachment J.

Confirmed, Attachment J is the Project Data Sheet

Due to restrictions on congregate gatherings in the U.S. due to COVID- 19, the requirement for proximity of personnel in the production of a hard-copy response, and the potential for delays in trans-Pacific shipments, will the Government change the submission method to electronic?

Alternatively, will the Government extend the submission deadline by seven (7) days to accommodate the logistical challenges of a hard-copy submission cited above?

Electronic copies are acceptable;

Paragraph 8 Indefinite Delivery Indefinite Quantity (IDIQ) Work. This paragraph discusses the two types of IDIQ to be performed on an as needed basis consisting of Unit priced tasks (UPT) work (non-negotiated) and Unit priced labor (UPL) work (negotiated). How many Manhours is the contractor pricing for this work? Where is this pricing to be indicated in Section B under Non-recurring IDIQ FFP for base and Option periods?

The Contractor does not need to price the IDIQ CLINs. These CLINs will be estimated and funded by the Government on an as-needed basis

Per Amendment 03, three additional crew titles have been added to Section L, Vol II, Factor 2, Management Technical Approach: (2) Key Personnel of Designated Duty Engineer (DDE), Ordinary Seaman, and Oiler. Will the Government please clarify whether these are additional labor categories or if these are synonymous with existing personnel already stated, i.e. DDE is an on-call Mechanical Engineer?

Synonymous with existing personnel already stated.

RFP states 1800 as the projected man year per FTE. Will the Government explain how it arrived at 1800 hours as a productive man year?

This number is estimated based upon a normal calendar year, minus federal holidays and anticipated sick and planned leave.

RFP cites 1800 as the projected man year per FTE. Will the Government consider utilizing 1880 as a productive man year for the exempt FTE's and 1864 for the SCA FTE's?

Yes

RFP cites 3600 as the projected man hours for 1 FTE for the Boat Captain, Senior Marine Mechanic/Engineer, and First Mate labor categories (LCATs). Is it the Government's intent that 2 FTEs per LCAT are required, or one per LCAT?

RFP should state 1800 as the projected man-hours for the Boat Captain, First Mate and Senior Marine Mechanic/Engineer.

Solicitation Submittal Requirements for Factor 4 Past Performance reference Attachment JL-3 as the PPQ form for completion. Please confirm this is intended to be Attachment B.

Confirmed, Attachment B is the PPQ Form

Will the Government provide the last survey and value of MPC-1?

Does the Government require the contractor to carry vessel hull and P&I insurance on MPC-1?

The MPC-1 is valued at $8,253,185;

Will the Government please consider reducing the minimum number of service projects/work to a quantity of 1?

CLIN 0001 contains the recurring work.

During our review, we noted that response #12 stated the question:

“When an award is made will the newly awarded contractor be allowed time to achieve Secret Clearance requirements?” The government’s response appears to be contradictory and indicates clearances must be obtained prior to the contract start date, not award date. Based on this response, we are kindly requesting clarification via the following questions: 1) Does this mean an offeror/Prime Contractor shall have an active clearance prior to contract award? and 2) If no, will the government accept government-sponsored or contractor-sponsored interim clearances prior to the contract start date?

The government will accept interim clearances prior to the contract start date.

Is the 2500 manhours for Preventive and Corrective Maintenance, cleaning and preservation of the craft wrapped up into the 1920 manhours for each individual?

No. The PM hours are estimated based upon the preventive maintenance required.

The SOW states the Second tier servicing generally required trained technicians and may necessitate the use of special tools or test equipment. Some of the replacement parts and assemblies may have to be procured from specialty houses or the manufacturer's regional warehouse, because of lesser demand rates. How are offerors required to price this? What are the specialty tools and test equipment

Costs for special tools will be charged under the IDIQ CLINs.

3.6.7.1 states the Government will provide the Contractor with the Basic Tools to conduct preventive maintenance. The contractor will be responsible for any additional tools required for corrective maintenance or repairs. How are offerors required to price this?

Costs for special tools will be charged under the IDIQ CLINs.

3.6.7.3 states the contractor shall be responsible for monthly oil sampling, analysis and tracking trends for oil in the following systems:

Port and Starboard Main Engines, Port and Starboard Generators, Steering System, Bow Thruster Hydraulic System and Port and Starboard Crane Systems. How are offerors required to price this? How do we get reimbursed for purchasing Services?

The contractor will need to set up an account with an oil analysis laboratory and estimate the cost.

The SOW states that In the performance of corrective maintenance, the contractor shall be responsible for procurement of all parts, tools and materials. Any corrective maintenance costing more than $5,000 will require prior approval of the COR. This leads offerors to believe that they should submit invoices for parts purchased. Should that be cost plus? What CLIN does this fall under?

All corrective maintenance will be charged under the IDIQ CLINs

3.6.9 states the contractor shall place on order all critical repair parts within one business day and non-critical repair parts within five business days. Critical repair parts are those that render the MPC-1 unable to perform a mission. Any repair part costing more than $5,000 will require prior approval of the COR.

All corrective maintenance will be charged under the IDIQ CLINs

The contractor shall maintain on hand a stockpile of critical repair parts per Attachment R. How do we know the pricing for these parts? How are offerors required to include this in our pricing?

A recommended listing of critical space parts was provided.

Research may be required to up to date costing of these items.

How should offerors price crane maintenance and testing? What CLIN does it fall under?

All crane maintenance will be charged under the IDIQ CLINs

3.8.1 states the contractor shall be responsible for maintaining and repairing the Mercury Outboard engines and lower units. How are offerors required to price this? What CLIN does it fall under?

All maintenance and repair costs will be charged under the IDIQ CLINs

The Government is not responsible and will not provide any office supplies. What CLIN does this fall under?

These costs should be part of the contractors administrative costs.

Even though we are in COVID restrictions a scheduled site visit will allow us to garner appropriate information required to provide a comprehensive proposal for this solicitation. Can this be accomplished with proper personal Protection and Safe Distancing Procedures implemented? Paragraph L3 of the solicitation (states that digital images are to be provided as an attachment, when will this attachment be provided?

Digital Images were uploaded in Beta.Sam

Is this Projected Man-hours the basis for pricing Recurring Firm Fixed Price for the Base period and Option periods under this solicitation?

Yes

The Quantity provided in the column for Boat Captain, Senior Marine / Mechanic Engineer, First Mate is One (1) with Regular hours 3,600. At the same time, Quantity provided for Deck hand is two (2) with Regular hours 3600. There is inconsistency as the manhours and quantity (of personnel) in the Table.

The RFP should state 1800 as the projected man-hours for the Boat Captain, First Mate and Senior Marine Mechanic/Engineer.

3.6.1.1.1 Maintenance man hours states that it is anticipated to be 2500 m/h per annual which includes preventative and Corrective maintenance, cleaning and preservation. Is this Manhours in addition to Paragraph 3.12 and to be priced by the contractor as Recurring FFP or Non-recurring IDIQ FFP for Base and Option Periods?

No it is not

Tier 1 and 2 are priced as part of the Recurring FFP and Tier 3 to be priced under the IDIQ CLIN, how many man hours are priced under Non-recurring IDIQ FFP?

The IDIQ CLIN does not need to be priced by the Contractor.

This CLIN will be funded on an as-needed basis based on the estimated amount of the Government.

Is this 900 hour per year priced as part of Paragraph 3.12 PROJECTED MANHOURS under Recurring FFP for Base and Option years? If the man hours required for training exceeded, how many additional man-hours are required and where will this cost priced?

The 900 hours per year is for recurring FFP Base and Option Years. Any additional man-hours will be determined based upon

Operations scheduled for the remainder of the year after 900 hours are exhausted.

e. Under Paragraph 3.5.2 When the MPC -1 is at sea up to 12 hours, the contractor shall crew the vessel at a minimum Near Coastal Licensed Master for 200 Ton vessel, near Coastal Designated Duty Engineer Limited 400 HP and Licensed Seaman (3 people). Paragraph

3.5.3 When the MPC -1 is scheduled to be at sea more than 12 hours, the contractor shall include at minimum the following personnel in addition to personnel listed Paragraph 3.5.2, near Coastal Mate for 200 Ton vessel and Ocean licensed Oiler (a total 5 people). Paragraph 3.12 PROJECTED MANHOURS list additional personnel such as Marine Electrician etc. Is this an oversight for personnel required to operate

MPC-1?

No it is not an oversight

Material procurement is not well defined in the solicitation as to how the contractor is compensated for the material purchases. There is no Material cost to be applied in the Recurring FFP or Non-requiring IDIQ FFP portion under Section B of this solicitation. The solicitation does not provide an inventory stock list or usage table. This makes it difficult for O&M Contractor to develop a basis for costing.Under Paragraph 3.5.10 The contractor shall order and maintain an inventory of spare parts, tools and repair materials. Various Attachments in the solicitation provides Equipment list and periodic maintenance requirements for MPC -1 and lists material that is required to be maintained by O&M contractor but does not have a usage or stocking list. How can O&M contractor price any of the spare parts, tools and repair parts as required in Paragraph 3.5.10. Please identify list of items for pricing under recurring FFP or Non-recurring IDIQ FFP.

Repair parts and materials will be reimbursed with IDIQ funding.

Under paragraph 3.5.5 the contractor shall maintain certifications of all fire suppression systems on board to include Engine room, Galley and explosive locker. Fire suppression systems and fire extinguishing system certifications are performed by qualified third party Fire protection companies approved by National Fire Protection Association (NFPA). The cost for certification of the system should be borne by the government. Once certified, the O&M contractor can maintain the certifications. The certification cost can be obtained by contractor once fire suppression system details are provided. Where should the O&M contractor price the certification? Under recurring FFP or Non-recurring IDIQ FFP? What type system is onboard and when is the current certification expire?

The fire suppression system on board the MPC-1 is certified.

The MPC-1 is outfitted with FM-200 fire suppression system in the engine room and the Ordnance locker. The certification expires May 2021.

Under Paragraph 3.5.6 the contractor shall maintain the EPIRB’s registration and ensure that they are functional prior to any scheduled underway period. If the EPIRB is not functioning, will government provide new EPIRB as GFE or is it contractor furnished. Again, how will the contractor price this in the contract?

The contractor will purchase and the costs will be reimbursed by the government via IDIQ funding.

Under paragraph 3.5.7 Weight handling equipment is listed in Attachment Q. There are no expiry dates on the certification for WHE and the cranes. Certifications are performed by third party crane and WHE certification companies. How will the contractor price the cost for certification of the crane and WHE?

Shipboard Cranes are ceritifed and will expire certification in November 2021. This would fall under Tier 3 maintenance and conducted annually and will be reimbursed with IDIQ funding.

Under Paragraphs 3.6.2 – 3.6.9 requires the contractor to be responsible for repairs, maintenance and PMS to include purchasing of spare parts, tools and material for these repairs and maintenance. The contractor will maintain a log of all parts that are purchase and shall get approval for any item if any item is more than $5,000. The contractor shall also provide the log to the COR weekly. How can the contractor price the materials without specific material list provided in the solicitation? Once a list is provided, should this pricing to be under Recurring FFP or Non-recurring IDIQ FFP? Without any historical data pricing would be inaccurate at best.

Non-recurring IDIQ FFP

Under Paragraph 3.6.10 the cost for weight test and annual certification of cranes, weight handling equipment, general corrective maintenance of cranes and maintaining a Cat ET Laptop with a current license as a fixed price function. Is there an expense table that can be provided by the government showing past costs for these items?

Annual Crane Certification; $7000 Annual CAT ET Software; $1000

Under Paragraph 3.8 HSMST Maintenance, there are repair parts and materials required for maintenance. Repair parts and material list are required for proper identification of cost associated HSMST Maintenance. Once the list is provided, where should the contractor price this cost? Under recurring FFP or Non-recurring IDIQ FFP?

Non-recurring IDIQ FFP

For 5. Optional MPC-1 Operations are not part of the base line contract. Where is this to be priced in the proposal submission? Under Non-recurring IDIQ FFP?

This should not be priced. It will be determined if and when to 900 hours of estimated operational support is exhausted. Please note, we have not exceeded 900 hours of operational support to date.

What is the normal transit time for PACOM J8 experimental tasking and assist with land-based training support?

Normal one-way transit time for PACOM J8 experimental tasking and assist with land-based training support is most 20 hours.

7.1.1 Facilities, states the Government will furnish or make available facilities described in Attachment D. There are no facilities contained in the Attachment D.

Government intends to provide facilities for the crew to support administrative, maintenance, and land-based operations when the vessel is in port.

Recommend Liine Item No 0001, under Base Period Recurring -

FFP..

PWS 7.1.6 states, “The Government will maintain and repair equipment leased and rented by the Government and provided to the contractor.” Would the government please identify the leased and rented equipment included on Attachment D, or otherwise intended to be furnished to the contractor as GFE?

Government intends to provide facilities for the crew to support administrative, maintenance, and land-based operations when the vessel is in port. This includes a Kik-Space Office and forklift.

The following information is required to provide Offerors sufficient information to prepare an adequate estimate for all ODCs required, given the FFP nature of the contract:
