About this file

This is a Standard Form 30 Amendment to Solicitation N4008526R0037, a Design-Bid-Build contract for construction at Camp Lejeune, North Carolina, issued by NAVFACSYSCOM Mid-Atlantic Contracting Core. The amendment extends the proposal submission deadline from February 26, 2026, not later than 1400 EST to March 3, 2026, not later than 1400 EST (note: one reference indicates 2:00 EST). This extension is final. The contract Point of Contact is Simone Arrington at simone.m.arrington.civ@us.navy.mil or 757-341-1224.

The amendment modifies three key areas: (1) the Price Proposal Form with updated Government Estimated FF&E (Furniture, Fixtures and Equipment) costs of $350,245.07 for P1574 and $341,463.96 each for P1591 and P1592; (2) amended bid notes clarifying award procedures, option item availability within 365 calendar days post-award, bonding requirements, and Handling and Administration Rate (HAR) procedures capped at 5 percent for FF&E procurement; and (3) responses to Pre-Proposal Inquiries addressing specification clarifications on ASTM C923 gasketed connections (required), FF&E budget allocations by building, Air Barrier Inspector requirements, cost-loaded scheduling specifications, sustainability and commissioning requirements, and various technical questions on mechanical systems, electrical components, and specialty inspections. The Government confirmed it intends to award all three base projects (P1574, P1591, P1592), with electronic bid bond submission accepted and no phasing required across the three operational support facilities.

BLANK PRICE PROPOSAL FORM

1. Line items 0015-0017 The Government Estimated FFE is:

$341,463.96 for P1591, & P1592 $350,245.07 for P1574

2. Bid Note(s) amended to include the following in RED:

General Bid Notes:

1. Award will be made on the total sum of Contract Line Items CLINs) 0001-0004. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

2. The Government reserves the unilateral right to award CLINs 0006, 0007, 0010, 0011, 0013 and 0014 to the Contractor at the proposed price within 365 calendar days after the contract award. CLINs 0005, 0008, and 0012 may only be awarded at time of contract award. A firm fixed proposed price is required for CLINs 5, 7, 8, 11, 12, and 14. No provision is made for economic price adjustment. FAR 52.217-5, Evaluation of Options (Jul 1990) - Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

3. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

FF&E & AV Bid Notes

These notes apply to CLINs 0007, 0011, 0014, 0015, 0016, and 0017

1. The estimated amount for FF&E has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E including freight and installation charges. The Government FF&E Estimate is only an estimated amount.

2. If awarded, line items will be funded separately after completion of FF&E design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in Specification 12 00 01.00 20 Furniture, Fixtures and Equipment (FF&E) Package.

3. Bonding

i. No Bonding for FFE at Time of Construction Contract Award

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded

ii. Additional Bond at FF&E Option Item Award

FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Items award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.

iii. Bonds Required by the Construction Contractor

If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.

4. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The Contractor’s proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.

5. The Government is not obligated to award the Option line item(s). Should the Government choose to award CLINs 0007, 0011, 0014, 0015, 0016, and/or 0017, the line items will be awarded as a negotiated modification to the contract/task order.

The Government reserves the unilateral right to award CLINs 0007 and 0015 within 180 days after the contact award and CLINs 0011, 0014, 0016 and CLIN 0017 prior to the last six months of the contract completion date. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E.

6. The Government is not obligated to award the FF&E and A/V line items. Should the Government choose to award the FF&E and A/V, the line items will be awarded as a negotiated modification to the contract/task order. The contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V. The FF&E and A/V modifications shall be awarded at least six months prior to the contract completion date. A minimum of six months is required for the contractor to purchase, deliver and install the FF&E and A/V without impacting the overall completion date of the project. The contractor’s schedule should assume the award of the FF&E and A/V as a modification. No schedule extensions shall be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contract completion date, the contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the prime contractor demonstrates that accepted Final FF&E and A/V packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E and A/V is not available and the Government’s award of the modification is in the last six months of the contract.

FINAL PPI LOG:

Updated Responses:

2/11/26 General Bid Note #2

General Bid Note #2 states Government reserves the right to award CLINS 5-17 within 365 days after the award of contract. Can the Government concur the contractor will be fully compensated for all costs for any remobilization, demolition of any work in place and rework to accommodate the added tasks?

No, please bid per RFP.

Additionally, Amendment 0005, includes an updated price proposal form. See Attached.

2/12/26

The precast manufacturer will not price the structures if ASTM C923 standard requiring gasketed connections at all storms drain structures. Please confirm this standard will not be required.

Gasketed connections are required. Spec section 33 40 00 2.4.3 requires ASTM C923. Without historical knowledge of the project, watertightness may be needed to limit infiltration into the system (high groundwater). There is a portion of storm that runs directly under a sand filter, which may be triggering this need. Specifying ASTM C923 ensures the system is durable and reliable, and has a lower cost of ownership over its lifespan.

2/12/26 33 30 00: 2.2.3 & 33 40 00: 2.4.3

Please consider removing the ASTM C923 requirement as some of our precast providers are refusing to quote the project if this is truly required.

No amendments will be made for these requirements.

Final Bond Requirements

The instructions state that a hard copy of the bid bond must be submitted within three (3) days after the date and time of receipt of proposals. Please confirm whether an electronic copy of the bid bond submitted with the bid package is acceptable, or if an original hard copy is strictly required. If an original hard copy is required, we request consideration of extending the submission window to five (5) days. This additional time would provide reasonable leeway in the event of inclement weather or unforeseen mail delivery delays, while still ensuring timely receipt.

An electronic copy is acceptable

A. Sheet C-005 indicates the laydown areas that have been provided for the project.

B. All offsite areas disturbed by construction, including the laydown area, must be restored to pre-construction conditions.

2/11/26 FF&E/AV Bid Notes #6

Six months seems a bit short for the entire FF&E process from start to completion of installation and punchlist. Can the time frame be lengthened/extended?

The GC will be authorized to begin design of the FFE package at construction kick off. This cost is included in the base bid.

Once the package is completed, if funding is available and ClIN option is awarded, it will be awarded to the GC for FFE procurement and installation at LEAST six months prior to CCD as per tech spec 12 00 01.00 20, paragraph 1.3.1d. A milestone schedule will be discussed at Construction KO/ID Orienation meeting which should align the FFE time line with the CCD. 2/11/26 12 00 01.00 20

General question involving FF&E Packages, Each building has a separate spec sections for the FF&E packages, Will the three buildings be combined into one bid package or will each building be bid separately?

Each building will be a separate bid package as they are separate CLINs. Funding will need to be approved/obligated for each building's FFE package seperately. Fiscal years for each building may vary due to delays in construction.

2/11/26 12 00 01.00 20

Will the FF&E for the three buildings be installed consecutively

This is not a requirement of the contract. Milestones will be provided by the GC at the construction KO meeting but may change due to construction delays.

2/12/26 is it the governments intent to award all three projects. Yes

2/12/26 please confirm that if borrow source is selected that is a commercial entity from which soil material is directly purchased no analytical testing testing will be required per spec 31 00 00 par 3.2.1

All material brought from off- Base must have an Imported Fill Management Plan for review and approval per 01 57 19, Section

1.5.1.1.2 Imported Fill or Offsite

Soil. Will clarify by Amendment.

2/12/26 32 13 13.06

Section 1.3.4.2 Field Technicians - Will this be required for the concrete paving. This is not typical.

Yes

2/12/26 Is ½ inch conduit allowed on this project? Base usually does not allow this

½-inch conduit is acceptable for lighting and power circuits in accordance with specification section 26 20 00, paragraph 3.1.3

2/12/26 Is MC Cable allowed for 6ft lighting whips? MC cable is not permitted for 6-foot lighting fixture whips.

Provide flexible metal conduit (FMC) for these connections instead.

2/12/26 01 32 17 Spec Section 01 32 17 for P1574, P1591 and P1592 requires the contractor to provide a Cost-Loaded Network Analysis Schedule (NAS) for this project and that the purpose of the Cost-Loaded NAS is to report progress, evaluate time extensions, and provide the basis for progress payments.

Spec Section 01 20 00, Paragraph 1.3.1 for P1574, P1591 and P1592 further clarifies that a Schedule of Prices must not be used with cost-loaded Network Analysis Schedule (NAS). A Cost-Loaded Network Analysis Schedule will be extremely expensive for the contractor to produce and update on monthly basis. Historically, the use of Cost-Loaded Network Analysis Schedules have not provided any value-added benefits to the Government or the Contractor on projects of this type. They only add another layer of complexity to complex MILCON projects. Also, the Government will have to appoint their own qualified scheduler to the project who is proficient in Primavera P6 just to analyze the Contractor’s Cost-Loaded NAS for justification of monthly progress payments from the Government to the Contractor. Can the requirements for the contractor-provided Cost-Loaded Network Analysis Schedule (NAS) and Earned Value Report be changed to a Non-Cost-Loaded Network Analysis Schedule and a Schedule of Prices by amendment?

Specifications must be followed.

2/12/26 01 30 00 Para 1.4 Spec Section 01 30 00, Paragraph 1.4 for P1574, P1591 and P1592 requires the contractor to provide monthly, and within one month of the completion of work, digital photographs, 1600x1200x24 bit true color minimum resolution in file format showing the sequence and progress of work. However, contractor personnel are prohibited from taking any pictures within the MARSOC compound area.

Can the requirement for monthly progress pictures be removed from the project by amendment?

No.

2/12/26 01 31 23.13 20 Spec Section 01 31 23.13 20 for P1574, P1591 and P1592 requires the contractor to utilize the Naval Facilities Engineering Systems Command's (NAVFAC's) Electronic Construction and Facility Support Contract Management System (eCMS) for the transfer, sharing, and management of electronic technical submittals and documents for the project. eCMS is a web-based program that should be available for the Government’s and Contractor’s use during the project’s normal working hours of 7AM to 3:30PM.

However, eCMS continues to have ongoing technical difficulties that cause the program to be periodically unavailable for use during normal working hours for the Government and the Contractor. In addition, there is no sense of urgency by the eCMS technical support team to restore service to eCMS when support tickets are submitted to them by contractor personnel. Can it be confirmed by Amendment that eCMS will be functional during normal working hours for this project after award?

Per eCMS POC: Please refer to the alternative submittal procedures including the specifications for periods when eCMS is not available. There's no way to predict or guarantee the availability of the application. 1.1

CONTRACT

ADMINISTRATION

Utilize the Naval Facilities Engineering Command's (NAVFAC's) Electronic Construction and Facility Support Contract Management System (eCMS) for the transfer, sharing, and management of electronic technical submittals and documents. The web-based eCMS is the designated means of transferring technical documents between the Contractor and the Government. Paper media or e-mail submission, including originals or copies, of the documents identified in Table 1 are not permitted, except where eCMS is unavailable, non-functional, or specifically requested in addition to electronic submission.

2/12/26 01 33 29 Spec Section 01 33 29 for P1574, P1591 and P1592 requires that the contractor provide sustainability documentation and reporting submittals per the federally mandated High Performance and Sustainable Buildings (HPSB) or HPSB "Guiding Principles" (GP). However, Executive Order 14154 (Unleashing American Energy) eliminated the mandatory requirement for High Performance and Sustainable Buildings via the elimination of Executive Orders EO14030 (Climate-Related Financial Risk), EO 14057 (Catalyzing Clean Energy Industries and Jobs Through Federal Sustainability) and EO 14082 (Implementation of the Energy and Infrastructure Provisions of the Inflation Reduction Act of 2022). These Executive Orders can be accessed at https://www.federalregister.gov/documents/2025/01/29/2025- 01956/unleashing-american-energy . Also, this requirement adds unnecessary costs to the project that have no value-added benefits? Can the requirements for Spec Section 01 33 29 be removed from the project by Amendment since this requirement is no longer mandatory?

No. Compliance with UFC 1- 200-02 was not eliminated. These requirements have their basis in law, as indicated in the executive order. EO 14154 (1/29/25) states:

"Sec. 2. Policy. It is the policy of the United States: ...(d) to ensure that all regulatory requirements related to energy are grounded in clearly applicable law"; "Sec. 3.

Immediate Review... (a) The heads of all agencies shall review all existing regulations," (UFC 1-200-02 c3 was published after EO 14154. No changes would have affected this project.) None of the cited EO's are in conflict with legal requirements for energy savings based on life-cycle cost effectiveness. All sustainability requirements for the project were subject to being life-cycle cost effective during the design process. The contract documents must be complied with.

2/12/26 01 45 00 Para 1.6.4 Spec Section 01 45 00, Paragraph 1.6.4 for P1574, P1591 and P1592 requires that the contractor provide Commissioning (Cx) in addition to the quality control requirements of this section and not as a substitute for quality control requirements. However, Spec Section 01 91 00, Paragraph

1.1 indicates that Government has hired an independent Commissioning Firm for the project. Can it be confirmed by Amendment that the requirements for Total Building Commissioning is the Government’s responsibility?

Commissioning is a process that must be accomplished as a Team.

Commissioning activities required of each member of the Cx Team (including the KTR, the Government hired Cx provider, the DOR and the Government's technical representatives) are assigned in UFGS 01 91 00.15 22 Total Building Commissioning.

An ammendment will be provided modifying UFGS 01 45 00 article 1.6.4 second paragraph sentence "Provide Cx in addition to the quality control requirements of this section and not as a substitute for quality control requirements." will be corrected to: "Provide Cx activities assigned in UFGS 01 91

00.15 22. Cx activities are in addition to the quality control requirements of this section and are not a substitute for quality control requirements."

2/12/26 07 05 23 07 27 10 07 27 26

Spec Sections 07 05 23, 07 27 10 and 07 27 26 for P1574, P1591 and P1592 require the contractor to provide an Air Barrier System and associated testing for the (3) new facilities required for the project. Also, the additional costs to provide and install the required air barrier system will far exceed the cost savings achieved via energy efficiency over the total life cycle of these (3) facilities. Can the air barrier requirements for Spec Sections 07 05 23, 07 27 10 and 07 27 26 removed from the project by Amendment since this requirement is no longer mandatory?
