About this file

This document is a federal contract amendment (Standard Form 30) for a design-build demolition project at Norfolk Naval Shipyard in Portsmouth, Virginia. Amendment 0011 incorporates two key updates: responses to pre-proposal inquiries and an updated wage determination. The project involves demolition of Building 195, with specific requirements around stormwater management, groundwater handling, and subsurface debris removal.

Key technical clarifications include using a stormwater management device to meet nutrient removal requirements, removing GPR anomalies only if they impact demolition activities, and cutting existing piles 3 feet below foundation bottoms. The amendment also provides detailed guidance on groundwater management, emphasizing that all excavated groundwater must be containerized, tested, and disposed of at an approved offsite facility that accepts PFAS-impacted waste. The wage determination update specifies minimum wage rates under Executive Order 14026, with covered workers to be paid at least $17.75 per hour in 2025. The proposal due date remains 26 September 2025 at 2:00 PM EDT.

# Page Section Paragraph Question Responses

Part 3 Chapter3 3.2.3

3.2.3 Stormwater

Because the limits of disturbance exceeds 2,500 square feet, this site is subject to Virginia State Stormwater Regulations. Water quality is intended to be met with either a manufactured hydrodynamic separator or with the purchase of offsite utility credits.

Based on the estimated limits of disturbance, 0.1 pounds of phosphorus credits are estimated to be required. Typically, the property owner purchases the nutrient credits please advise on the cost anticipated for the nutrient credits.

These statements above are contrary to G3030 Storm sewer and G303001 storm sewer piping scope descriptions. Please clarify specifically "Provide connection or positive drainage to the existing storm sewer collection system at the point indicated on the drawings in another part of this RFP.

Confirm that the existing outfall has adequate capacity to receive the additional stormwater flow generated by the project."

REVISED RESPONSE - Use a SWM device like a manufactured hydrodynamic separator to meet the required nutrient removal. Contractor will ensure positive drainage is achieved in the post-demolition paved condition to an existing storm drainage inlet with capacity to receive those flows (i.e. not clogged, undersized, or in any condition not conducive to accepting stormwater flows). If the above conditions cannot be met with pavement grades alone, contractor will introduce storm sewer pipes to promote the aforementioned conditions.

This project has not received permission to use water quality nutrient credit purchase from leadership. The contractor must meet all stormwater requirements onsite without the use of water nutrient quality credits.

B-720 thru B-724

Advise on the extent of the removal of GPR anomalies shown on within the RFP documents. Are we to assume these anomalies if encountered in the new cross section of site paved area are to be removed

REVISED RESPONSE - GPR anomalies are not required to be removed unless they are found to impact the demolition of site items identified to be demolished and located within the limit of disturbance as shown on CD100 or if they encounter the new cross section of site paved area.

Contractor should provide cost to remove unforeseen subsurface debris encountered within the planned limits of under Bid Option 0002 on Attachment D?

demolition under Line Item 0002 Option Item No. 1 of the Price Proposal Form.

Scope in Part 3 Ch1 page 2 last paragraph indicates full demo of foundation but Part 3 Ch 2 page 2 last paragraph says to demo just to bottom of pile caps. Then Part 3 Ch 6 ESR F20 page 4 in F201001.2 first paragraph indicates removal of structures to a depth of 30’ below grade.

Please clarify extents of demo below grade.

REVISED RESPONSE - Part 3 Chapter 1 page 2 indicates the demolition of above and below ground elements as described in the DB RFP; therefore, further description within the other sections and drawings describe the extent of demolition for each structural and foundational element. S- 101 and S-301 describes the specific requirements for demolition. It is not the intent for the building structure to be removed completely down to 30' below grade. The deepest known structural element is the deep well plating tank.

Refer to historical drawing 4002735 in Attachment B for DWPT depth provided with the RFP. As a basis of clarification, all existing foundations, pile caps, sump pits, steam pit and deep well plating tank must be completely removed and the existing piles cutoff 3 feet below the bottom of the foundations in the designated areas of demolition.

Please confirm that no timber or concrete piles are to be removed.

REVISED RESPONSE - Refer to sheets S-101 and S-301 for demolition extent of piles, pile caps, grade beams, and pits. The intent is not to fully remove the piles, but to cut them off to the extent shown in the drawings. Note that the extent of demolition is dependent on the proximity to the steam line and is identified in the RFP. As a basis of clarification, all existing foundations, pile caps, sump pits, steam pit and deep well plating tank must be completely removed and the existing piles cutoff 3 feet below the bottom of the foundations in the designated areas of demolition.

Can 21B be used to stabilize the site once demolition is completed prior to new construction activities?

REVISED RESPONSE - VDOT 21A subbase material is required for the full depth of the subbase material specified in the proposed asphalt pavement buildup on civil page CS100. Contractor must install dense binder course per civil sheet CS100 prior to starting new construction activities and repair sense binder course as required.

#57 or #3 stone must be used to stabilize the base of all demolition excavations. The pavement section shown on Sheet CS100 must be revised to 2" VDOT SM-12.5D Surface Course; 8" VDOT BM-25A Base Course; 10" VDOT 21A/B Subbase Course; AASHTO Class 1 Stabilization Geotextile (Elongation <50%); Approved Compacted Subgrade.

2 Bid Form

Please refer to the bid form CLIN 0002. Please provide the approximate depth of the undercut required for this CLIN will not exceed 20' in depth. If the contractor is to remove soils beyond 20' deep, an engineered system will need to be provided., which will not be included in the standard unit price.

REVISED RESPONSE - Depth of excavation for structural elements is identified on drawings S-101 and S-301 in Attachment A and throughout the RFP. Soil removal is required only to the extent required for removal of building & structural elements to the extent prescribed in the RFP. It is not the intent for the contractor to remove soils or other structural elements below the identified depths. The deep well plating tanks is the deepest known structure. S-101 and S-301 identify the depth of the tank. The contractor must determine if an engineered system is required. Line Item 0002 should include for any unforeseen demolition, removal, and disposal of debris, structures, etc. if it impacts the removal of B195 as identified or will impact the final paved site. An engineered sheeting and shoring system must be used to minimize the volume of demolition excavation and construction dewatering effluent for the sump pit demolition, steam pit demolition and deep well plating tank demolition.

An engineered sheeting and shoring system must be used to minimize the volume of demolition excavation and construction dewatering effluent for the sump pit demolition, steam pit demolition and deep well plating tank demolition.

2 Bid Form

Please refer to bid form CLIN 0002. Please verify that if the contractor encounters old creosote treated timber in the form of wood piles, the contractor may cut the pile in lieu of removing the entire pile.

If the contractor is to remove the entire wood pile, please provide the approximate depths of the wood piles that are to be removed.

REVISED RESPONSE - Piles are to be removed to the depth as identified on drawings S-101 and S-301 and to the elevations described in the RFP. Unforeseen timber piles not identified for demolition are not required to be removed in their entirety, but should follow the guidance of like conditions and criteria as defined in the RFP. Existing piles must be cut off 3 feet below the bottom of the foundations in the designated areas of demolition.

1 Bid Form

Please provide the levels and type of ground water contamination as the contractor will be required to provide different testing and hauling methods depending on the level and type of contamination.

REVISED RESPONSE - Requirements for groundwater testing and containerization are identified in 01 57 19.00 22 and throughout the RFP. It is the responsibility of the contractor to develop the means and methods of dewatering, testing, containerization, and disposal of groundwater. All excavated groundwater will be considered non-hazardous contaminated fluid.

Existing groundwater contaminant levels collected by the ERP program is included within the NNSY Administrative Record. Please refer to the response for PPI 93 for access to the complete documents and historical analytical data.

Hazardous Material

Please provide the classification of waste that is to be removed for the ground water.

REVISED RESPONSE - Groundwater is required to be sampled and characterized by the contractor.

All groundwater must be containerized, characterized, manifested, and disposed offsite at a facility that will accept the waste and approved by the Installation HAZ Waste manager. The groundwater is known to contain levels of PFAS that limit the number of facilities that will accept the waste (and meets the requirements listed within the OSD PFAS Disposal policy). It is the construction contractors responsibility to appropriately identify an offsite receiving facility that will accept the contaminant impacted groundwater that contains knowns levels of VOCs, SVOCs, pesticides, herbicides, PFAS, metals, and traces of PCBs.

The existing groundwater results from resulting ERP investigations is included within Part 6 of the RFP. The closest facility used by other projects is located within Emelle, Alabama.

Hazardous Material

Please specify where all of the water waste on-site, from the removal of the hazardous materials inside the tanks, throughout the building etc. will be disposed of.

REVISED RESPONSE - The IWTP will pump the tanks down to the lowest point possible. The IWTP will not accept any wastewater once the tanks have been turned over to the contractor, the contractor will be responsible for disposal of all wastewater after this point.

All wastes to be generated by the contractor is required to be specified within the contractors Waste Management Plan, it is the responsibility of the construction contractor to identify the appropriate waste receiving facility. This Plan must be reviewed and approved by the Installation HAZWASTE manager within the Pre-Construction submittal process. All wastes generated from construction activities once the tanks are turned over to the contract must be containerized, sampled/characterized, manifested, and taken to an offsite receiving facility that will accept the wastes in accordance with 01 57 19.

Water generated from dewatering activities must be containerized, tested, and disposed at an approved, offsite facility that accepts PFAS impacted waste and meets the requirements listed within the OSD PFAS disposal policy in addition to the Installations waste management plans.

This is a Design Build project which PPI Question 30 outlines " It is the responsibility of the contractor to develop the means and methods of dewatering, testing, containerization, and disposal of groundwater. All excavated groundwater will be considered non-hazardous contaminated fluid." The specification states " Any non-radioactive, non-RCRA hazardous waste generated from a Contractor or work operations that requires controlled treatment/disposal in accordance with Navy/NNSY policy, and/or local, state, or federal regulations. As examples, waste that qualify as NHRW may include (but is not limited to):

Waste items prohibit from being disposed into dumpsters, Waste items that require special packaging/handling per DOT requirements. HRSD and Federal agencies regulate standards for water discharge and disposal if clean water standards as outlined can be met. With this information, please confirm if water can be made clean by contractor means and methods per applicable standards water may be considered for discharge onsite.

No. All dewatered groundwater must be containerized, tested, and taken to an approved offsite facility that will accept the waste (and meets the requirements set forth within in the OSD PFAS disposal policy).

would be required to inform and support that DOD guidance does not currently exist, as there is no proof that existing incinerators are capable of breaking down PFAS chemicals without generating additional PFAS emissions or other harmful products of incomplete combustion. Please confirm water removed from the site should be considered "Non Hazardous Contaminated Fluid with PFAS" as this water will have to be disposed in the central United States or Canada.

There are several locations that have accepted PFAS impacted groundwater, and the contractor has several options to explore (such as on site treatment to remove PFAS with offsite disposal, utilizing means and methods of construction to minimize groundwater infiltration into excavation areas, or shipping via rail to facilities across the country.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

WAGE DETERMINATION APPEALS PROCESS

1) Has there been an initial decision in the matter? This can be:

a) a survey underlying a wage determination

b) an existing published wage determination

c) an initial WHD letter setting forth a position on a wage determination matter
