REFERENCE QUESTION GOVERNMENT RESPONSE

Page Section Para.

204 EP503 &

E-601

For at least the Berth Unit Substations, Drawings EP503 and E-601 call for front access only design.

Elevations shown on EP503 depict rear access type UL 1558 switchgear.

Front access UL 1558 style gear would require additional sections for front access cabling and

Additional transition sections are acceptable. However, all NEC clearances must be met. Final dimensions of the platform must be adjusted / coordinated by the contractor's structural and electrical subs with the equipment vendors.

The size of the platforms shown on the structural drawings may be increased, but at no additional cost to the government. Additionally, potentially, transition section equipment. Is adding additional sections beyond what is show in the elevation acceptable?

the minimum required drive aisle distance (fire lane) down the center of the Pier must not be infringed, nor interfere with the mooring systems. Minimum 5 ft clearance required from the center of the mooring fitting, or 3 ft clear from the fixture to an obstruction.

205 EP503 &

E-710

Elevation for Berth Unit Substations on drawing EP503 appear to show 8 feeder breakers.

Switchgear schedules on drawing E-710 show 9 feeder breakers plus a breaker for SPD. Are all Berth secondary low voltage switchgear to have 9 feeder breakers plus SPD breaker? Also, is a back-pan mounted molded case circuit breaker acceptable for the SPD breaker in lieu of drawout individually mounted breaker?

Please see Amendment 0010, continuation page for additional information. SPDs can be fed by a molded case breaker.

206 26 23 00 2.2.2.g Section 26 23 00 paragraph 2.2.2.g lists arc resistant requirement. Is standard non-arc resistant UL 1558 gear acceptable?

Standard non-arc resistant gear is acceptable.

207 26 23 00 2.2.2.4 Section 26 23 00 paragraphs 2.2.2.3 and

2.2.2.4 list current limiting fused type circuit breakers.

Fused breakers are typically not required for 65kAIC systems. Are standard duty non-fused circuit breakers acceptable?

Current limiting fused type circuit breakers are not required.

208 General Anticipated Award Date

Considering the extension to the bid date to August 3rd and requirement to submit a CPM schedule with the Proposal please clarify what is the new anticipated Award Date which we should be using in the schedule

For planning purposes only, referring to the CPM schedule, please use an award date of 15 November 2023.

209 General Please confirm NAVFAC intends to answer the remaining questions which were submitted after May 12th

Confirmed.

210 17 Page 17 of 88 of the Solicitation lists a contract award date of 1 August 2023. Given the bid postponement included in Amendment 0008, please provide an updated anticipated contract award date.

For planning purposes only, referring to the CPM schedule, please use an award date of 15 November 2023.

211 Are respondents permitted to separate sections of the proposals with dividers and include a table of contents without counting the pages toward the prescribed page limits?

Yes.

212 14 03 45 33 2.3.9.3.d Specification Section 03 45 33 Precast Prestressed Structural Concrete 2.3.9.3 Concrete Curing, d. Moist Curing, indicates moist curing requires burlap cover. However, precast pieces will have projection steel and require a raked finish. Will you accept standard PCI MNL 116 curing requirements?

This is a standard UFGS specification. Per 2.3.9.3.a Contractor may cure by a method approved [by the Contracting Officer] in writing.

213 16 03 45 33 2.3.12.2 Specification Section 03 45 33 Precast Prestressed Structural Concrete

2.3.12.2 Major Defects

states that any crack wider than 0.01 inch is cause for rejection. This is extremely small. Can cracks of this size be repaired and the piece still used? Is the specification meant to imply that only cracks wider than 0.01 inch that also cover more than 36 square inches are cause for rejection?

See Amendment 0010, Continuation Page. Change the last sentence of Subpart 2.3.12.2 to "Cracks of a width of more than

0.01 inch by a combined length of more than 36 inches will be cause for rejection of the member; cracks with a width greater than or equal to 0.02 inch may be cause for rejection of the member.”

214 1014 07 41 13 1.8.2 Paragraph 1.8.2 calls for a no-limit 30 year warranty for all prefinished alum covered in spec 07 41 13.

Several manufacturers have stated they can only provide a 20-year finish warranty due to the proximity of the water and exposure to sea-salt spray.

Please confirm a 20 year

See Amendment 0010, Continuation Page. A 20-year finish warranty is within government requirements per section 1-8.12 in Roofing UFC 3- 110-03 and is therefore acceptable.

finish warranty would be acceptable. This is consistent with the finish warranty requirements in paragraph 1.8.2 of secton 07 42 12 "Metal Wall Panels."

215 Response to

PPI#199

The response to PPI #199 in Amendment 9 reiterates that Holiday Testing per 09 97 13.26 must be performed onsite prior to driving and to repair holidays as indicated. The intent of holiday testing is to identify any of the following defects so that they may be properly corrected prior to installation: 1. Runs and Sags – downward movement of coating during application due to gravity; 2. Cissing – small craters in coating or bare unpainted areas; 3.

Cratering – small (millimeters) bowl shaped recesses or bubbles on the surface of the coating; 4.

Pinholes – air or gas bubbles on the surface of the coating that have burst;

5. Overcoating – unnecessarily thick layer of paint or coating to the substrate surface; and 6.

Undercoating – applied coating is too thin.

Holidays can be very small and often very difficult to detect via visual inspection methods.

They are a direct result of coating application methods and will occur during the coating/curing period prior to transport.

Damage to the coating is also possible during transport and handling but such damage is easily detectable via visual inspection. The presence of holidays in a coating

Bid per Contract Documents. The piling may be inspected at the plant after coating application, but that does not waive the requirement to perform onsite prior to installation.

system requires repairs that are best performed at the coating facility under controlled environment.

Requiring holiday testing to be performed on site would significantly increase the cost to both perform the holiday testing (additional handling of all piles), as well as significantly increase the cost of repairing (potentially having to transport the pile back to the coating facility for repair). We respectfully request that you reconsider allowance of holiday testing to be performed at the coating facility and require only visual inspection for transportation/handling defects be required to be performed on site prior to installation.

216 SB502 SB502 Detail A1 showes a pile driving shoe on the drilled shaft casing. The note in detail A1 indicates to seat the casing into rock. Advise if intention is to impact the shaft casing in order to achieve seating into rock or if teeth will be permitted on the end of the casing to allow spinning into rock in lieu of driving shoe?

Teeth will be permitted, include with submittal for Gov't approval, indicate changes on AS-BUILT Drawings, if teeth are used.

217 Please confirm that there is no onsite parking for the GCs staff or craft and all persons must park at a remote yard, not supplied by NAVFAC, and bussed to and from site

The Contractor laydown, storage and parking area is within the limits of construction. Refer to C- 003 Note 3. The Naval Station has an area for additional contractor’s staff vehicle parking within 0.3 miles of the work site.

added to the Instructions to Offerors as part of Amendment 0008?

219 A-241 Detail A1 Reference Keynote #35 and detail A1 on Drawing A-241. The arrow for keynote 35 on A1/A-241 is pointing to an exterior stair on the North Elevation, while the definition of the keynote solely references the concrete foundation wall, not stairs. Are the Admin/Warehouse exterior stairs and ramps being called out to be painted or does this keynote only apply to the exposed foundation along the perimeter of the Admin/Warehouse building?

See Amendment 0010, Continuation Page, "NOAA OMAO drawings_07242023".

Keynote #35 refers to the foundation wall only. Stairs do not need to be painted.

220 Please confirm the gantry crane at the Boat Repair Building is not required to be painted.

The Gantry Crane is to be prefinished and will not need to be field painted.

221 SB-504 Detail A4 Please confirm if the guardrail located along the bulkhead (reference A4/SB-504) is to be painted. RFI #147 and Drawing A-242 confirm the guardrail located at the Admin/Warehouse retaining wall receive paint. Please confirm whether this is also the case at the bulkhead guardrail.

Bulkhead guardrail does not require paint and is to be galvanized per Section 05 50 16, Subpart 2.4.f

222 A-601/A-

Note 11 Note #11 on Drawing A- 601 states the window sills at the Administration space are to be SSF-1 and “other areas to receive gyp window sills.” Drawing A- 603 Window Schedule references sill detail B1/A- 603 for window type W3 (which appears at the Warehouse area). This detail B1/A-603 shows solid surface SSF-1 as the sill, not gyp. Does the

See Amendment 0010, Continuation Page, "NOAA OMAO Drawings_07242023".

Sills for window type W3 in the warehouse can have GWB sills.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
