RFIS 2
1. Recurring work Fixed Price Base Bid versus Non-Recurring Work orders per the bid: if a request is sent in to the contractor, then the contractor is obligate to “Price Quote” the order request? Yes / No Answer: Quotes will not be requested for Recurring work. Quotes for Non-Recurring work will follow annex 0200000 C Management and Administration spec item 2.15
2. If this Price Quote for the order requested is below the min order of $2500 then the gov is not required to accept the price and the contractor is required to perform this work under the Recurring Work Fixed Price Base Bid? Yes / NO Answer: The Contractor owns all recurring work under the Limit of Liability (LOL) and a price quote is not to be submitted unless the LOL is going to be exceeded.
3. If this Price Quote for the order requested is above the min order of $2500 then the gov is required to accept the price and issue the contractor a PO to perform the work AND it is to be invoiced against the budget form the bid of the Non-Recurring Work amounts?
Yes / NO Answer: Quotes for Non-Recurring work will follow annex 0200000 C Management and Administration spec item 2.15
4. Are all Emergency and Urgent calls billable or does any of that time and work obligated to be performed by the contractor under the Fixed Price work? At what part of the emergency call does the “cost” transition form the contractor Fixed Price (if applicable) to the T&M Nonrecurring billable to the Gov cost?
Answer: Service orders are not billable under the LOL. Service orders that will exceed the LOL will follow annex 0200000 C Management and Administration spec item 2.15
5. If the contractor performs an emergency service call to diagnose a problem, do we also own all the costs to repair the problem or does this then fall under the T&M Non- Recurring Work classification?
Answer: Contractor owns all costs up to the LOL. Service orders that will exceed the LOL will follow Annex 0200000 C Management and Administration spec item 2.15
6. We assume all fixed price base bid work is only required to be completed M-F during normal business hours and any calls of “no Heat” or a break down would be on a T&M on call repairs through the Non-Recurring Pricing able to be billed for an additional charge or are these costs to be split between Fixed Price and Non-Recurring Work?
Answer: No. The Contractor is required to provide service based on Annex 2, Management and Administration spec items 2.2.1 and 2.6.1 and Annex 15020000 Section C, spec item 3.1, 3.1.1, 3.1.2, 3.1.3, and 3.5.6. Annex 15020000, all other work will done during normal Government working hours. Contractor owns all work up to the LOL under recurring work.
7. Is it that in all instances the contractor is obligated to perform or “owns” the first $2500 of any and all work in this contract under the Fixed Price Base Bid whether it falls under Recurring Work or Non-Recurring Work? Yes / No - Please clarify?
Answer: The Contractor owns up to the LOL for all work performed under recurring work. For work exceeding the LOL see below:
EXPLANATION OF EXCEEDING THE SERVICE CALL LIMIT AND EXEMPTIONS
When the contractor responds to any type of service call and the problem cannot be repaired for under the service call limit, the contractor shall notify the government and submit an unsolicited Request For Proposal (uRFP). The contractor will deduct the cost of any expended material and labor used during the response to the service call from the service call limit and the remaining will be applied to the cost of the uRFP as credit.
Example 1:
The service call limit is $2,500.00, there is an emergency trouble call and the contractor responds and arrests the emergency expending $1,200.00 combined labor and material.
The additional work to complete the repair will cost $4,000.00 ($1,800.00 in labor and $2,200.00 in material)
The contractor is liable for the 1st $2,500.00 of the repair so $2,500.00 (limit)-$1,200.00 (expended) = $1,300.00 Service Call Credit.
Below is the estimate breakdown to be shown on uRFP
Labor: $1,800.00 Material: $2,200.00 Total: $4,000.00 Service Call Credit: ($1,300.00) Balance Remaining to complete: $2,700.00
Example 2:
The service call limit is $2,500.00, there is a trouble call and the contractor responds and immediately sees the repair will exceed the $2,500.00 limit expending $0.00 combined labor and material.
The additional work to complete the repair will cost $6,000.00 ($2,800.00 in labor and $3,200.00 in material)
The contractor is liable for the 1st $2,500.00 of the repair so $2,500.00 (limit)-$0.00 (expended) = $2,500.00 Service Call Credit.
Below is the estimate breakdown to be shown on uRFP
Labor: $2,800.00 Material: $3,200.00 Total: $6,000.00 Service Call Credit: ($2,500.00) Balance Remaining to complete: $3,500.00
Exemptions to the service call credit:
The contractor will not be asked to give the government the service call credit if the following situations apply.
1.) If the contractor has previously identified and documented a deficiency in writing that will cause failure and the equipment fails due to lack of government response.
2.) If the contractor condemns a unit or piece of equipment and provides an official letter to the government and the contract is modified removing the equipment from the equipment list.
3.) If the contractor responds to a service call and believes there is damage due to vandalism or intentional misuse and after the government investigates they agree with the findings.
8. On the HVAC Bid Pricing Sheet for “Individual Building Pricing Base Year” it lists item
3.1.1 Emergency Service Orders QTY of 6 and Unit of Issue MO then requests a price. Is this supposed to be priced for a total dollar amount for an entire month (MO) then times a quantity (QTY) of per month to get the total cost for 6 months?
Answer: Yes
9. Is there a difference between a “service order” and a “task order” described in the specs?
Which one can we bill for on T&M Non recurring work? Which one do we have to perform as part of the Fixed Fee base Price?
Answer: Service orders fall under Recurring work in Annex 15020000 Section C, spec item 3.1, 3.1.1, 3.1.2, 3.1.3. Task orders are issued as Non-recurring work IAW Annex 0200000 C Management and Administration spec item 2.15.
10. Incidental Repairs – in section 1502000-Facility Investment, section 3.2 PM – Related Information section states that Incidental Repairs work performed under maintenance are not considered a “service work order”. Are incidental repairs then therefor billable under the Non-Recurring work?
Answer: No. Incidental repairs are considered any repairs including replacement discovered during scheduled maintenance. The Contractor owns up to the LOL. Service work orders will not be issued for incidental repairs as to not hold the Contractor accountable for double LOL’s, one for the service call and one for the incidental repairs.
11. A) In section 1502000-Facility Investment, section 3.2 PM – Related Information section states Contractor shall involve Specialty OEM Subcontractors as required to perform maintenance and incidental repairs. Are these subcontractors to be billed under Fixed Contract or Non-Recurring contract at an additional cost to the Gov?
Answer: Recurring Work.
B) If not and in addition to then please confirm that if the Specialty OEM Subcontractor service required is called in for a break / fix work task request issue that we can assume that the cost for these subs would then be billable under the T&M Non-recurring bid?
Answer: If a Subcontractor is needed to assist with a service order, the contractor is responsible up to the LOL.
12. What happens if the Non-Recurring allowance bid is met and depleted? Does the Gov move budget from the next(s) year back to cover the current year?
Answer: Government anticipates the ceiling establish for the base and option periods will be sufficient. If the ceiling price for non-reoccurring work is met then shifting ceiling from the next year is one of the options available to the Government.
13. Is there any buildings on the contract list require contractor to maintain a service personnel onsite 24hrs a day 7 days a week per Annex 0200000-2.2.1 Government Regular Work Hours?
Answer: Annex 0200000-2.2.1 requires Contractor continuous operations, 24 hours a day, every day of the year including holidays, which refers to service call response. Spec item 2.2.1 does not state that the Contractor maintain a service personnel onsite 24 hrs a day 7 days a week.
Note: Annex 15020000-2.3 does require one full time dedicated personnel for maintenance and service calls at NBHC Groton Medical, Dental Clinic, and Veterinary Clinic so they can provide uninterrupted care during normal business hours. One person to cover all three buildings.
14. Annex 0200000-2.3.9 Invoicing Procedures – states there is a sample Invoice Form attached in J-020000-04. Sample attachment title is listed in that section, but the sample is missing. Please provide sample invoice form format.
Answer: See Attachment “J-0200000-04 Invoice Form”
15. Annex 0200000-2.4.2 Gov Furnished Utilities – This assumes that the contractor’s temp office and trailer facilities will be tied to Gov provided utilities and we will pay the Gov for all services needed – 1. please confirm. 2. are the amounts listed in quality of use the average usages specifically from this HVAC service contract or are these just general averages from any contract on the base?
Answer: Electricity will be provided at no cost to the contractor. Contractor is responsible for cost associated with connecting electricity. No other utilities are available for office trailer.
16. Annex 0200000-2.7.3 Enterprise Wide Manpower Reporting System (eCMRA) requirement– can the gov provide the information by year from this system for the past years to review? If not can the reports be provided per section 2.9.7 Monthly On-Site Labor Report?
Answer: All questions on eCMRA must be addressed to web address provided in Annex 0200000-2.7.3. Monthly On Site Labor Reports are proprietary to current contractor and cannot be provided.
17. Will allowances be made to allow the contractor to get their own personnel security clearance through JPAS for this contract’s DD254 (or other contract doc) to help minimize the costs of down time and waiting on escorts if the contractor already holds a facilities clearance?
Answer: Government anticipates the contractor will be given adequate notice to ensure personnel can process through DBIDS Program for access to the base. See 0200000- Management and Administration, Spec Item 2.8.4 for information on DBIDS.
18. Annex 0200000-2.10.2.6 Universal Waste – section calls out a waste management plan and states that contractor will reimburse gov for costs of disposal, implying that the gov will provide all dumpsters and ways of waste disposal for this “program” on this contract. Please confirm if gov will provide waste dumpsters? Please confirm or clarify that the section states that there has been no cost to contractor for waste disposal to use the gov dumpsters as shown by the “X,XXX” at the end of the paragraph in 2.10.2.6?
Answer: Spec item 2.10.2.6 has an N/A at the end of the spec item which means spec item 2.10.2.6 is Non applicable to the contract. To clarify, the Government does have dumpsters located around the base for waste disposal at no cost to the Contractor.
19. Annex 0200000-2.15.1 Unit Priced Task (UPT) – states this work is calculated based on contractor provided hourly rates from the HVAC bid sheet Non-Recurring Work exhibit line item unit prices A700-A705. The bid sheet asks for only an hourly labor wage rate, but the UPT description states that this line item is to included labor PLUS all material, equipment, direct and indirect costs and profit in the hourly rate. Please confirm which is the correct required calculation of the hourly rate or are all other items except Labor to be added at actual costs negotiated under material on the final ELIN A706 material?
Answer: There are NO Unit Priced Task (UPT) on the Non-Recurring work exhibit line item. The exhibit line items on the ELIN Non-recurring work tabs are for Annex 0200000 spec item 2.15.2. Unit Priced Labor (UPL). The labor rate on the bid sheet for Non-recurring work is for labor only to include the fully burdened labor including fringe, overhead, G&A and profit for A700 – A705. Material and equipment will fall under A706.
20. Annex 0200000-2.2.2 Wage determinations – section states the wages to be used to calc labor rates for the Fixed Price Base bid and the ELIN hourly rate costs are per section J- 0200000-02. However, this section J-0200000-02 contains four separate sub-sections A,B,C,D but the ELIN line items request pricing specifically based on only two types of wage rates – DBA (A) and SCA (B). Therefore how are the other two provided wage rate schedules in C&D (these are the Collective Bargaining Agreement and Supplemental Agreement) required to be incorporated into this bid? Per FAR 52.222-41 appears to state that the new contract employees are subject to these CBA wages as the revised SCA but these wages are much higher than the bid docs SCA wages provided AND the Collective Bargaining Agreement expires on April 30, 2020. Do these CBA wage rates apply to the new contractor and service new contract?
Answer: The attached Collective Bargaining Agreement (CBA) identifies the employees that are covered by the Agreement. Contractors are advised to review amendment N4008520R25020001, question #16 and incorporate information into proposal as needed. Contractor should be familiar with the requirements of FAR FAR 52.222-17, Nondisplacement of Qualified Workers, and FAR 52.222-41, Service Contract Labor Standards. Service Contract Act and Davis-Bacon Act wage determinations provided for employees not covered by CBA. As regards the expiration of the existing CBA on 30 April 2020, federal regulations (29 CFR 4.1b (b)) will make rates from any new CBA effective for successor contract so long as current contractor presents new CBA to the contracting officer prior to date of award of new contract. In light of the referenced regulation, we recommend that prospective offerors use current CBA wages when calculating price proposals for successor contracts.
21. Attachment G and H are blank and missing Answer: Attachment J-0200000-05G and J-0200000-05H are located on electronic pages 14 and 15 of document titled “0200000 J Management and Administration”
22. What is a considered pre-extended bin supplies and materials? Consumables?
Answer: See Annex 0200000-J attachment 01 Definitions and acronyms: The minor materials and supplies that are incidental to the job, for which the total direct cost of any one material line item shown on the material estimate is $10.00 or less. Examples of pre-expended bin materials and supplies include, but are not limited to, solder, lead, flux, electrical connectors, electrical tape, fuses, nails, screws, bolts, nuts, washers, spacers, masking tape, sand paper, solvent, cleaners, lubricants, grease, oil, rags, mops, glue, epoxy, spackling compound, joint tape, plumbers tape and compound, clips, welding rods, and touch up paint.
23. On the HVAC bid Sheet when performing Non-Recurring Work by the hourly calculations, what determines which wage rate either the Service Contract Rates or the Davis bacon Acts rates would be used to calculate the “price quote” per task order?
Answer: Government will specify SCA or DBA in the Request for Proposal(RFP). If the contractor proposes the wrong labor rate in an Unsolicited Request for Proposal (uRFP) the Government will direct the contractor to revise the uRFP with the correct wage rate.
24. Section 1502000 Facility Investment 3.5.6 Power Outage Follow-up states that the contractor shall ensure all equipment is essential buildings must be checked following power outages. There are 14 buildings listed in the essential matrix. What is the estimate of how often has there been power outages requiring this service over the past contract period of three years?
Answer: Approximately 12 over the past 3 years.
25. Attachment J-0200000-03 Directives, Instructions and References is not clearly readable on our end. Please provide a new copy of the doc as this one appears to be double printed on top of itself.

26. Attachment J-0200000-05 Forms – section 05D, 05E, 05Fappear to be not in the package. Please provide.
Answer: Attachments title “J-0200000-05D contractor incident report system”, “J- 0200000-05E Quality Inspection and Surveillance report reviewed” and “J-0200000-05F On site Labor Summary Report reviewed” were loaded with the solicitation to beta.sam.gov and verified on 1/29/2020.
27. Upon filling out the provided HVAC bid schedule for N4008520R2502 (CNIC Groton), I noticed that at the bottom where the totals are calculated, they do not include all the buildings. The buildings that are not included are DG-50, 429 barracks, 141, 156, 449, 575, 521, and 159. Is this done purposely?
Answer: The bottom portion of the Bid Schedule “CNIC Groton” is calculating correctly.
The purpose is to calculate total price for CNIC buildings.
28. In amendment 1, Q&A #9 regards to J-1502000-03 Building Inventory and how the Government is responsible for the Shops. The Bid schedule has 17 Shops in the bid schedule for 3.3.3 (Hot and Cold Closed Loop HVAC Systems Prescriptive Maintenance), my understanding is that the Government will maintain and service the equipment and the contractor will only do the prescriptive maintenance on these shops.
Answer: The inventories referenced under Spec Items 3.3.3 Hot and Cold Closed Loop HVAC Systems, 3.5.1 Exhaust Hoods & Ducts and 3.5.3 HVAC Water Testing and Treatment Services are correct. If a building/system is listed in the Spec Items’ respective inventory then the contractor is responsible for the maintenance outline in the Spec Item only.
29. Per conversation with Superior Clean LLC. Attachment J-1502000-14 Exhaust hoods and Duct inventory. Buildings 446 and 485 are part of a separate existing contract.
Please confirm they are included in this bid.
Answer: Buildings 446 and 485 are include in solicitation N4008520R2502 and should be accounted for in the contractor’s proposal.
30. Bid schedule: buildings NSMRL 156 and 141 are listed in the service call log. On the bid schedule there is a 3rd NSMRL with no building number on the bid schedule and no matching building on the service Log. Please confirm building number as listed on service log and there are 3 NSMRL Buildings
Answer: There are only 2 NSMRL buildings. 156 and 141. The NSMRL with no building number on the bid schedule is where it combines 156 and 141 for a total.
Same thing applies to BUMED. Bldg. 449, 575, and 521 are totaled on the bottom with a building number of BUMED.
