WAGE DETERMINATION

General Decision Number: ME180095 10/05/2018 ME95

Superseded General Decision Number: ME20170095

State: Maine

Construction Type: Building

County: York County in Maine.

BUILDING CONSTRUCTION PROJECTS (does not include single family homes or apartments up to and including 4 stories).

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.35 for calendar year 2018 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.35 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year

2018. The EO minimum wage rate will be adjusted annually.

Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor

200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

15 9/25/2018 Due to the magnitude and complexity of this project, we request that the PPI cut‐off date be extended to 11/1/18 and the proposal due date be extended to 11/15/18, to allow for the preparation of comprehensive and cost effective proposals.

Please see amendment 0019. 20

43 9/28/2018 Referencing Drawing “Volume 2, E‐101D Partial First Floor Electrical Plan”. Drawings indicate 480V receptacles. However, there is not any NEMA configuration listed beside the symbol. Please provide specifications on the 480V plugs.

Receptacles should be NEMA L12‐20 twist lock 480V receptacles.

55 9/28/2018 RFI items 41 & 42 are two examples of discrepancies between CLIN's on the drawings and how it relates to the bid form. There are several others that fall into this category. How should this be handled?

Submit PPIs for any discrepencies between CLINS on the drawings and Bid Form.

57 9/28/2018 The rubber compounding system supplier has informed us that they will not be able to meet the proposed 10/16 bid date. They are evaluating now but believe they will need at least a month of additional time to properly evaluate the system. Please advise.

Please see amendment 0019. 20

59 10/3/2018 FROM HVAC CONTRACTOR: Given the amount of scope, complexity of the pricing required and manpower availability, it would be most advantageous to delay the bid date at least 4‐6 weeks. Is this possible?

Will elevators need to conform to NAVFAC Elevator Specificiations? If so, there is no pit refuge space allowance as required in Section 3‐2.1. Do we increase the Dimensions in order to obtain the Hoistway Pit Entrapment or do we reduce the Capacity/ Clear inside dimensions?

Per NAVFAC ITG 2013‐01 Elevator Design, 3‐2 Elevator Hoistway, Section 3‐2.1 Elevator Hoistway Pit Entrapment Protection, the horizontal clearance of 20 inches (508 mm) must be maintained from the pit floor to the top of the hoistway. This was the governing statute in place during the design. The A/E has provided a 20”x30” clearance. The UFC for elevators was issued (6/8/18) after the 35% design (4/19/17) for this project, and therefore does not apply.

305 10/19/2018 Specification 112003 section 1.4 SD‐03 Product Data instructs the supplier to provide 2 copies of the native software. Thermwood does not supply copies of their native software and are only a vendor for Mastercam.

345 10/26/2018 FROM THERMWOOD CNC MACHINE SUPPLIER; "I was just following up on the questions that were asked previously (10/8) but then also wanted to further discuss our position on this bid. We have interest in quoting the machine, computers, and install only, this would be the typical package we have quoted and sold to them in the past but will need to take exception to a lot of items on the bid spec as written. Otherwise at this juncture we will no bid the contract." The questions they are referencing are question numbers submitted above 76 through 80.

The SY has purchased several of these CNCs in the past. What we received in the past is acceptable.

2.1.1.5

We noticed that an earlier question was asked about removing perforated plate below the grating and that the answer was that it was ok to remove as long as there was a rotary screen to remove trash. We strongly suggest this requirement is maintained as is, with no modifications. The perf plate acts not only as a first trash seperation, but as protection for the underfloor recovery system. Items like bolts can pass through the grating and do serious damage to screw auger systems long before they ever reach a rotary screen. Perf Plate is as much a system protection device as it is a trash removal system

The perforated plate above the augers is not to be removed. It must be present to protect the augers from material dropped down onto the floor. The gratings must have allowances to be lifted to clean this grating.

2.1.1.5.B

With pneumatic reclaim system this is virtually impossible to achieve 100% of the time, and is setting the booth up for unrealistic expectations. Could mechanical reclaim be allowed as an alternate?

Both mechanical and pneumatic recovery is acceptable as long as it is applicable to the type of material being used, and will provide for 100% recovery.

2.1.1.5.C

Could the clarification be added that the motors etc should be able to be accessed while blasting operations are happening? We have many systems with this capability and it is critical to ensuring maximum booth uptime

The motors, etc. do not have to have to be made accessible while blasting operations are ongoing. They do have to be easily accessible to maintenance without having to enter a confined space or a crawl space. Preferably there shall be access panels from above to get to all motors, and bearings.

463 10/31/2018 The limited number of bridge crane suppliers that can perform the work for this project have all declined to begin their crane estimates due to some unanswered questions. We have been notified that the crane proposals will take 3 weeks to generate after these questions are answered. For this reason, and others related to the size and complexity of the project, we would like to request a proposal extension date of December 13th and PPI date of November 29th.

Clarification is needed in regards to the SOW section 11 30 02, 2.1.1.2 (c) and 2.5.4 requirement of ATSM E84.

In all our research and discussions with rubber manufacturers, we have found that the ASTM E84 applies to concrete panels or fiber‐cement and a subsection of ASTM E84.84a only applies to "silicone rubber coated glass fabric". We have found that our vendors have rubber curtains for the ASTM E162‐16 rating which is standard. Is this acceptable?

The rubber sheeting in the blast booths must meet the requirements of ASTM E84.

467A 11/2/2018 In addendum 10, Section 00‐21‐16 Instructions to

Proposers “Schedule”, this section instructs the bidders to perform the work in phases and further instructs bidders to get government sign off on each phase prior to beginning the next subsequent phase. Based on the start dates provided it would appear that we can begin and work several area’s concurrently. Is this correct or are we restricted to working phase by phase in order?

Also the total duration of the phase days is 2,238 days, it is our understanding the overall contract duration is still only 1,700 days, please explain this discrepancy.

The phasing shown should typically be adhered to per the sequencing as shown; any changes to this will require approval by the Govt. The phasing has been developed based on major project‐element dependencies.

Work can be performed in multiple areas, provided the contractor performs necessary prerequisite items that would allow contractor to access a particular work area; for example, work in Building 60 cannot commence until all Building 60 occupants are able to relocate to Building 404 (or other locations). Work on demolished buildings that are part of bid options will not be performed until Phase 7, and only when the government exercises the option of this demolition work.

3 A‐901 & 903

On the interior finish schedules for building 404, rooms 101, 103, 104, 115, 134, 135, 205, 216, & 217 had the specialty item 'WT1' (Blinds) replaced with 'NA' in addendum #12 presumably because no aluminum windows are present. Should room 206 and 244 also have 'WT1' removed? Should all of these rooms have no 'SS3' (solid surface) in the window sill trim column as well?

WT1 was removed from these areas as they are industrial spaces and the windows in these spaces are the translucent fiberglass wall system. 206 and 244 will require WT1 as they are office environments and workstation and desk work may require light control. SS3 will not be present in these spaces. Refer to A‐901 through A‐903 for clarifications.

469 11/6/2018 Volume 3 A‐901 & 903

On the interior finish schedules for building 404, should rooms 139, 207, 222, 223, 224, 235, and 243 have specialty item 'WT1' and 'SS3' window sills to match the window schedule on A‐606?

139,207,222,223,224,235,243 will require WT1 and SS3. Finish schedule is amended. Refer to A‐901 through A‐ 903 for clarifications.

470 11/6/2018 Volume 3 A‐901 to 903

Please confirm that none of the borrowed lites, including rooms 241 and 242 as currently noted, require any solid surface window sills (SS3).

Reference D4 for borrowed lite sill details. Solid surface will not be required for borrowed lites.

The women's and men's lavatory rooms 112, 113, 214, 215, 232 and 233 have a 'SS2' note in the Counter and Millwork columns, but there are no counters and only plumbing‐supplied wash basins shown on A‐407 and A‐ 409 partial plans. Please confirm that there is no solid surface work for the finish carpenter in these rooms.

No solid surface work for finished carpenter in these rooms. Finish schedule updated to reflect circumstance.
