DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-18-30
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Command, Mid-Atlantic. The procuring contracting office is the Capital Improvement/Asset Management Acquisition Team located at Naval Station Norfolk in Norfolk, VA, and the administering contracting office is the Facilities Engineering and Acquisition Division of the Public Work Department Maine located at the Portsmouth Naval Shipyard in Kittery, ME.
2. Description of the Action Being Approved.
Authorization to limit competition for provision of the following brand name item is hereby sought. The solicitation will require providing a Thermwood Corporation M90-55 single table, five axis CNC router. Further information regarding the need to use this particular system is provided herein below.
3. Description of Supplies/Services.
The intent of solicitation N40085-18-R-8716 for the P-293 Paint, Blast, and Rubber Consolidation Facility is to consolidate paint, blast, rubber manufacturing, and plastic molding operations into one location within the controlled industrial area(CIA) at Portsmouth Naval Shipyard in Kittery, ME. The work includes constructing a new facility, converting existing buildings, and demolishing the excess footprint.
This acquisition will solicit proposals utilizing full and open competition, as authorized by the approved DD2579 on 20 April 2018. The estimated value of the work included in this construction solicitation is , and the estimated value of the brand name supply that is the subject of this J&A is . The project will be funded by FY18 MILCON funds for construction and FY20 Capital Investment Program (CIP) funds for equipment. The work under this contract is required to be completed within 1256 days after award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C. 2304(c)(1) which permits the use of limited suppliers when it is essential to the Government’s requirements, as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Thermwood M90-55 five axis CNC router allows for rotation over five axes. The B-axis and C-axis rotations about the Y-axis and Z-axis have the greatest range commercially available in a 5 axis router. The B-axis will allow the routing head to route 270 degrees on a part laid horizontal parts to be routed 270 degrees without having to rotate the part, which is very important for heavy parts. The C-axis allows for the full rotation, because if the C-axis has limits it requires frequent unwinding, which the programmer has to plan ahead to position the part on the table introduce unwinding. With a limitless C-axis some controls have automatic electronic unwinding that doesn't generate any motion.
The equipment also has a rotary plate back device which is similar to a mirror post on a lathe.
This feature is required to replicate the historical features that the shop has been tasked to replicate, and would also be necessary for part duplication.
This equipment is the same as three other machines on the shipyard. This equipment is maintained by shop 06, who has been trained on this equipment and stocks any necessary parts for repairs. This equipment would allow sharing of tooling, fixtures and NEMI pods between them, as well as to allow the work to be started on one router and finished on another. This may be necessary for tooling availability.
The equipment has proprietary software that is not available on other 5 axis routers. The shipyard has a proven and significant investment in drawings tied to the proprietary software, that may not be available on another software package.
Thermwood has in-house maintenance for all software and hardware, so no 3rd party support is required.
Authority to name Thermwood M90-55 as a required source is necessary because the product meets the solicitation’s specific needs while being manufactured in the USA, and it is the only product on the market that fulfills all of the requirements outlined above. The specifications for the remainder of the work in the solicitation are non-proprietary and offer only salient characteristics.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on 26 June 2018, and yielded one response, which was not relevant to the source sought notice. The sources sought notice closed on 03 July 2018. A pre-solicitation notice and solicitation will both be publicized on Federal Business Opportunities and Navy Electronic Commerce Online, in accordance with the requirements of FAR Part 5.
The approved J&A will also be made publicly available as required by FAR 6.305.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, this is a one-time exception to full and open competition. There are no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, an assessment of whether competition for future requirements is feasible will be undertaken.

Portsmouth Naval Shipyard is currently the only naval shipyard that manufactures rubber compounds. The existing rubber compounding process is completed manually. The new process control system will integrate decision and process points to allow the process to be integrated with semi-automatic controls. The intention is remove error and waste attributed to process inefficiencies, obsolete equipment, and the lack of environmental control. The PNS Rubber
Compounding Facility is to be comprised of a single 4 liter batch mixer and a single 20 liter batch mixer supported on a modular support platform over a 400 x 1000 mill. Quality controls will be integrated into four weigh stations, and all mixers and mills.
The integrated process controls, quality monitoring, and equipment controls is required to be extremely precise, accurate and flexible. HF Mixing Group has a proven system that was evaluated at the manufacturers site by representatives from PNSY. Test samples of PNSY’s rubber compounds were manufactured and tested satisfactorily in HF’s system.
Market research was completed by NAVSEA Code 986.1, and it was determined that no other company is able to provide all the equipment, control software and hardware that is required to provide a single source fully integrated system that is compliant with the requirements of the process.

A waterjet is a high critical piece of fabrication equipment. Engineers and technicians produce drawings that are sent directly to this equipment for fabrication. This equipment is heavily utilized on the shipyard in multiple fabrication shops. Downtime on this equipment would back up work significantly. Therefore, it is desirable to keep with the same equipment currently on use to allow for designs, material, tooling and mechanics to be shared between all the machines.
This equipment is the same as six other machines on the shipyard. This equipment is maintained by shop 06, who has been trained on this equipment and stocks any necessary parts for repairs.

J&A No. ML-18-39
This Justification and Approval seeks to require inclusion of a brand name in the above-referenced solicitation. That specific item can be fulfilled by the American Darling Model B-62- B fire hydrant
Fire hydrants are a critical, necessary component to support fire-fighting capabilities at PNSY where nuclear submarines undergo maintenance. Fire hydrants require routine preventative maintenance to ensure proper function. Preventative maintenance often includes replacing wearable parts within the hydrant barrel assembly. A fire distribution system consisting of a single standard hydrant model promotes overall system readiness by allowing Water Operations Department to stock replaceable parts and develop skills and expertise in the work involved in maintenance of the hydrants. Each manufacturer of hydrants produces unique assembly of various parts of hydrants. It is infeasible to maintain an on-the-shelf parts supply for multiple model hydrants thereby resulting in a significant reduction is hydrant readiness.
Authority to name the American Darling Model B-62-B fire hydrant as a required source is necessary because the products meets the solicitation’s specific needs, and it is the only product on the market that fulfills all of the requirements outlined above.
