PPI'S AMENDMENT 0001
PPI #1. According to Solicitation N33191-14-R-0621, part III, REQUIREMENTS FOR OFFERORS, "Offerors must provide a Dun and Bradstreet (DUNS) number and NCAGE code when submitting proposals".
QUESTION: If offerors form a Joint Venture and each of its Members has an active NCAGE, DUNs, and SAM registration, do we need to obtain new NCAGE and DUNs for the Joint Venture when submitting proposal or it is acceptable to use leading MEMBER's NCAGE when submitting a proposal and obtain new NCAGE, DUNs and SAM registration for the Joint Venture prior to award of the contract?
RESPONSE: A true joint venture should obtain a new NCAGE and DUNs when submitting a proposal and shall be treated as a separate entity. If your business arrangement is more of a sub/prime relationship whereby experience(s) of the sub will be utilized for evaluation, a separate NCAGE and DUNs is more appropriate. Registration does not have to be complete before the RFP due date, but should be completed prior to award of the contract.
PPI #2. ITEM: 01.094: Deliver and erect a container system According to specifications this system is required to be with Ü-marking and quality control by the Federal Quality Association and with extended suitability certificate, issued by iSiB Dr. Möll GmbH Darmstadt.
Would government accept a local equivalent of this structure in case that it corresponds to the technical requirements?
RESPONSE: The quality standard of the container system shall comply with German standards DIN 18 800-7:
2002-09, class D. If there is an international standard which guaranties the same quality it can be accepted, but has to be proven and officially released by an international certified technical control association. The contractor shall submit the technical information of the container system to the Contracting Officer for approval prior to its purchase. Only container systems in compliance with required standards, or other international standards proven to have the same or higher level of quality, which is officially certified by an internationally recognized technical control association, shall be approved by the Contracting Officer.
PPI #3. Concerning the installation of electrical systems and wiring: Will the electrical systems, cables, transformers and all the electrical equipment required under this project be acceptable according to local standards?
RESPONSE: It is acceptable to use electrical systems, cables, transformers and all electrical equipment in compliance with local Moldovan standards. The personal protection shall be guaranteed according to the technical specification of the electrical systems, cables, transformers and all the electrical equipment required under this project.
In order to connect the high and low voltage systems, the installation shall comply with local Moldovan standards.
Among other applicable requirements, the high voltage installation:
‐ Shall comply with the specific technical regulations of the Electrical Network Operator, and
‐ Shall be approved by the Moldovan Estate Energy Inspectorate prior to inspection and approval by the
Electrical Network Operator.
In order to comply with these requirements, the contractor shall be responsible to prepare all necessary documents and technical designs in local language in order to allow for the approval of local competent authorities and entities.
Regarding the low voltage installation, Moldovan regulations require that it is approved by the Moldovan Estate Energy Inspectorate prior to connection. This is a requirement of this contract. Similarly as for the high voltage installation, the contractor shall be responsible to prepare all designs, specifications and documents in the local language for the approval of the competent agencies. It is not required by Moldovan regulations to have the low voltage installation approved by the Electrical Network Operator. However, to guarantee the quality of the low voltage electrical installation, this contract shall require a second independent inspection and approval by the Electrical Network Operator, or by an independent company authorized by the Electrical Network Operator. This second independent agency shall verify and approve all designs, equipment and field installation.
PPI #4. Please specify what is the meaning of the following symbols from the attached sketches: PN 66286098283;
PN 66321909864; PN 663530988; PN 6613809693... etc.
RESPONSE: These numbers are grid coordinates and they give the contractor the exact position on the ground.
The grid system is UTM 35N. Following position for example PN 66286098283, that means (from north to south) vertical 66286 and (from east-to west) horizontal 098283.
PPI #5. Please specify what is the procedure to follow regarding the tax exemption, excise duties and other custom taxes for products and goods imported in Moldova from EU countries or the United States for the purposes of this project?
RESPONSE: The procedure is one and applies to all so-called "operators of technical assistance". After the contract award ODC Moldova will work with the Moldovan Government a package of documents comprising the "operator's data sheet", copy of the contract with U.S. Govt, copies of contracts the company will sub-contract (if it will). In this case the company is the "main contractor" and other sub-contracted companies will carry out their activity under the main contractor's umbrella for the same project. The contractor will need to provide all necessary information to ODC Moldova, and work with them in compliance with Moldovan regulations in order to fulfil the requirements of the tax and duties exemptions.
An "operator of technical assistance" will start being exempt from VAT and import duties after the Moldovan Government publishes the updated list in the "Monitorul Oficial", a Moldovan Government publication that publishes all the new laws, government decisions, amendment to the laws/decisions that become effective after they are published. During one calendar year there are two windows open for this list to be updated, usually they are April and October. For estimating purposes, the contractor shall consider 2 opportunities a year, in order to schedule their works.
The assistance, rendered by the U.S. Govt to the Republic of Moldova falls under the provisions of the "Agreement Between the Government of the United States of America and the Government of Moldova Regarding Cooperation to facilitate the Provision of Assistance" signed at 21 March 1994. Article I, Item (A) says:
"Commodities, supplies, or other property, including services, provided or utilized in connection with United States assistance programs may be imported into, exported from, or used in
Moldova free from any tariffs, dues, customs duties, import taxes, and other similar taxes or charges, including value added taxes, imposed by Moldova, or any subdivision thereof. The parties understand that the provisions of this paragraph provide an exemption from the imposition of such taxes and charges on purchases made in Moldova."
The offerors shall be familiar with the Moldovan regulations regarding taxation and import duties and their potential exemptions. The Government shall not be responsible for any taxes and import duties that the contractor is required to pay by Moldovan authorities as a result of their actions or omissions.
Formal Moldova – U.S. agreement is included as Attachment 1 to this Amendment 0001.
PPI #6. What are the requirements, if any, in order to bring workers from outside the Republic of Moldova in order to perform their professional services in this project?
RESPONSE: The requirements to bring Human Resources from outside the Republic of Moldova depend on the type of worker and function to be performed.
1. Specialized workers:
If a company wants to bring in their human resources to implement a project from other countries, they may do this, but they have to follow the existing Moldovan legislation in registering these experts/specialist with the Bureau for Migration and Asylum of the Ministry of Internal Affairs and receive temporary work licenses, ID cards, etc. If a company is from the list of the countries that do not require Moldovan entry visa they still need to properly register as this visa is for short visits only and don't provide authorization to conduct works etc. It is the responsibility of the company to undertake all this registration process, the U.S. Government representatives will provide them with all confirmation paperwork as required by the process. Procedural information can be found at www.bma.gov.md
2. Non-specialized workers:
For less skilled workers, there is an additional step to the procedure described above, which requires objective justifications. The contractor should undertake and discuss with the Moldovan Ministry of Labor, and if such trade exist in Moldova, then there will be additional bureaucratic processes.
These procedures will incur time and cost.
