About this file
This document contains questions and answers regarding a solicitation for maintenance, repair and modernization efforts for CVN 68 and CVN 78 Class Aircraft Carriers homeported in and visiting the San Diego, CA area. The Naval Sea Systems Command is seeking to establish an IDIQ contract to support emergent work, continuous maintenance availabilities, pre-refueling complex overhaul availabilities, and Chief of Naval Operations scheduled availabilities. Key details include an extension of the proposal period to February 21, 2023 per Amendment 0001, clarification that the fee percentage is adjusted to a maximum of 5%, and confirmation that the pre-filled government estimates in the Labor Hour Phasing tab are to be used for bidding. The document provides responses to questions on fee structures, criteria for determining fixed fee or award fee delivery orders, incorporation of rates into Attachment J-8, and establishes a question submission cutoff date of January 9, 2023.

Question: Response:
1 RFP Section L Since the solicitation posted on November 23, 2022, we request an extension to February 21, 2023 to provide the full 90 day proposal period.
See Amendment 0001 extension.
2 RFP Attachment L-3 ODC Tab Attachment L-3 "ODC" tab Note 2 states application of "no more than 7% fee" which appears to be inconsistent with the base fee stated in the RFP, page 11 Clause B-232- H003 of NTE 5%. Please clarify.
See Amendment 0001, fee % adjusted to 5%.
3 RFP Attachment L-3 Labor Hour Phasing Tab
The Attachment L-3 "Labor Hour Phasing" tab contains pre-filled Government Manhour estimate values for each CLIN and Fiscal Year of the contract period.
Please confirm it is the Government's intent that the pre-filled Government estimate values are the basis for bidding and are to be used for bidding the cost and price of each CLIN and this is regardless of the scope of work of the Notional Work Package estimate.
Confirmed.
4 RFP Section B The RFP, Section B, CLINs state fee types of CPFF or CPAF/CPIF. Are these CPFF, CPAF or CPIF? Or if the intent is for this to be a flexible fee type contract, please clarify how the fee type for each order will be determined.
With the exception of the DATA (CLIN 0004) & AF/SBSIF CLIN (CLIN 0009), any of the CLINs can be ordered as CPFF/CPAF/CPIF. This was indicated per the contract type column in Section B.
Vendors are required to complete clause fill-in B-232-H003 PAYMENTS OF FEE (S) (COMPLETION) (NAVSEA) (OCT 2018). Vendors may bid NTE 5% Fee which is utilized for either Fixed Fee (CPFF), Base Fee (CPAF), or Target Fee (CPIF).
The intent of the Government that the decision whether a Delivery Order is Fixed Fee, Award Fee, or Incentive Fee will be unilateral or by mutual agreement between the Government and Contractor. To the maximum extent possible, order modifications will be made by bilateral modifications to the contract, which are fully priced and contain definitive delivery schedules. The ACO and the awardee should work in a collaborative manner via a bilateral modification (after a unilateral DO is placed) per the terms set forth in Section G.
5 RFP Section B Note B RFP Section B, Note B, Paragraph E (Page 9) refers to a "Note E" which doesn’t exist in the RFP. Please clarify.
See Amendment 0001, removal of Note E reference.
6 RFP Section B Note C Section B, Note C states, "At the award of the IDIQ, the direct and indirect rates proposed will be incorporated as Attachment J-8. If there is an FPRA/FPRR in place at the time a Delivery Order is being negotiated, shouldn’t they take precedence over proposal rates included in Attachment J-8 that are in accordance with specific Government instructions for escalation stated in the RFP? Please clarify.
The J-8 is an IDIQ tool to allow DO placement if necessary. DOs may still be negotiated per the DO RFP as the work package is defined.

7 RFP Section B Note C Section B, Note C states, "At the award of the IDIQ, the direct and indirect rates proposed will be incorporated as Attachment J-8. Please confirm that the subcontractor fully burdened fixed price rates entered in the Attachment L-3 Labor & Indirect Rates tab will not be included in Attachment J-8.
The IDIQ is a contract established with the Prime and only Prime rates proposed in Att. L-3 will be included in Att. J-8.
8 RFP Section B CLINs It appears by the structure of Section B that the Government intends to place delivery orders on either a CPFF or CPAF/IF fee structure. What criteria will the ACO utilize to determine whether a DO would be CPFF or CPAF? Is it conceivable that an ACO could use wide discretion to make most deliver orders CPFF with only a maximum potential of 5% fee?
Please see the Government response to Question #4.
