About this file

This document summarizes an amendment to a federal contract solicitation for the dismantlement and disposal of a Surface Ship Support Barge. The amendment provides changes to contract line item descriptions and payment events. Key work includes removing water processing and radioactive equipment from three areas of the barge, removing and disposing of water and equipment from the wet pit, removing wet pit walls and shielding, and completing all material recycling and disposal. Offerors must meet eligibility requirements such as experience with radiological work over $50 million and providing performance bonds. The Navy will evaluate proposals based on technical and price factors and select the best value offer using lowest price technically acceptable procedures. The solicitation response requires technical and price volumes, with the technical volume addressing mandatory eligibility criteria. Pricing shall be provided using the Section B format and a pricing workbook, with payment tied to completion of tasks. The closing date for any questions is January 10, 2020, with proposals due by February 7, 2020.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

INSTRUCTIONS TO OFFERORS

1.0 INTRODUCTION

The Government is seeking proposals for the dismantlement and disposal of the Surface Ship Support Barge

(SSSB). The Government anticipates awarding a single Firm-Fixed-Price contract through a best value source selection process. The Government expects the best value to result from selection of the technically acceptable proposal with the lowest evaluated price and will thus use the Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2.

Proposals shall be based on the requirements contained in this solicitation, including Section J Attachments.

Offerors are required to submit a proposal on a Firm-Fixed-Price basis, including the applicable facilities capital cost of money, for the CLINs listed in Section B. Proposals submitted on any other basis shall be rejected. Only one (1) proposal from each prime offeror will be considered for acceptance.

Proposals shall be submitted in accordance with the instructions herein, and non-conformance with the specified required content may be cause for rejection of the proposal. Offerors are advised that material submitted in excess of the page limits stated herein will not be evaluated. The proposal shall be valid for no less than 365 days from the date of solicitation closing.

Offerors shall conduct a pre-proposal inspection of the vessel in order to assess the scope of work required. Offerors shall rely solely on their own inspections in determining the location of, and the method and extent of hazardous material removal and disposal required under applicable laws and regulations. The Government explicitly does not warrant that the data provided represents a complete and accurate depiction of the location and extent of all hazardous materials.

OFFERORS’ INSPECTION OF THE VESSEL IS MANDATORY AND AUTHORIZED

REPRESENTATIVES OF OFFERORS SHALL SIGN IN WITH ONE OF THE SUPSHIPNN

REPRESENTATIVES LISTED BELOW AT THE TIME OF INSPECTION. OFFERORS WHO DO NOT

INSPECT THE VESSEL PRIOR TO SUBMISSION OF A PROPOSAL IN RESPONSE TO THIS

SOLICITATION WILL NOT BE CONSIDERED FOR AWARD. U.S. CITIZENSHIP IS REQUIRED FOR

PRE-PROPOSAL INSPECTION OF THE VESSEL AT HUNTINGTON INGALLS INDUSTRIES

NEWPORT NEWS SHIPBUILDING (HII-NNS).

Offerors shall refer to Attachment S-3 for instructions regarding access to the HII-NNS facility and Instructions for requesting authorization for Dosimetry. SUPSHIPNN will provide escorts for tour of radiological areas. Questions concerning the SSSB shall be provided formally to the Contracting Officer.

Offerors are advised to complete the required Background Investigation (BI) through General Information Services, Inc., at backgroundchecks.com soonest as it can take 2-3 weeks to process. Once the offerors’ background check is complete, offerors shall submit the NNS Non-Employee Access Badge Request, with the background certificate attached, to the SUPSHIPNN POC listed in Attachment S-3.

Note: Block 12 of the NNS Non-Employee Access Badge Request shall include the range of dates that the SSSB is available for inspection.

After offerors receive approval to access HII-NNS, offerors shall coordinate their pre-proposal ship inspection with the following POCs:

Any visit requests for January 6th through January 10th, 2020, must be sent to the POCs above by 12:00 PM (EST) December

20th, 2019. A visit will be limited to one day and limited to day shift (0700-1500) EST. The Government will authorize no more than two (2) site visits per offeror. Only one organization will be allowed to shipcheck the SSSB on any day unless there is mutual agreement among the organizations that a combined visit is acceptable. There will be no photos or samples allowed and no confined space entry as information on SSSB conditions has been provided in the Reading Room (See Attachment S-2).

2.0 COMMUNICATION WITH THE GOVERNMENT

4.0 GENERAL INFORMATION

Offerors are cautioned that, in accordance with the “Instruction to Offerors-Competitive Acquisitions” clause (FAR

52.215-1), the Government intends to award a Firm-Fixed-Price contract on the basis of initial proposals received, without discussions. Therefore, each proposal shall contain the offeror’s best terms from a price and technical standpoint.

Offerors shall not presume the Government has knowledge outside of information provided in the proposal.

Additionally, offerors are advised that statements such as: “the offeror understands”, “the offeror has a long history of outstanding support”, “standard procedures shall be used”, “well known techniques shall be employed”, or any paraphrasing of the solicitation, shall be considered inadequate to demonstrate experience, knowledge of, or compliance with solicitation requirements. Offerors are encouraged to provide specific and concise information to validate all assertions.

mailto:sonya.diazdeleon@navy.mil

Discussion/Final Proposal Revision

If discussions are applicable, all offerors selected to participate in discussions shall be advised of deficiencies in their proposal, and shall be offered a reasonable opportunity to correct or resolve such deficiencies and to submit such technical and price information, or other revisions to their proposal, that may result from such discussions. If

Discussions are conducted, the PCO will request Final Proposal Revisions (FPRs). Only information included in the

FPR will be evaluated.

Cross Referencing

Each volume shall be written to the greatest extent possible on a stand-alone basis so that its content may be evaluated with a minimum of cross referencing to other volumes of the proposal. Cross referencing within a proposal volume is permitted where its use would conserve space without impairing clarity. Information required for proposal evaluation which is not found in its designated volume will be assumed to have been omitted from the proposal.

Glossary of Abbreviations and Acronyms

Each volume shall contain a glossary of all abbreviations and acronyms used, with an explanation for each.

Glossaries do not count against the page limitations for their respective volumes.

Amendments

The Government may revise the solicitation at any time by means of an Amendment. It is an offeror’s responsibility to ensure it is accessing the Federal Business Opportunities (FBO) website to view potential amendments and procurement notifications for this solicitation.

Teaming Arrangements

Proposals must be submitted by one (1) prime contractor. An offeror may be listed as a subcontractor in multiple proposals but may only submit one (1) proposal as a prime contractor with a unique Commercial and Government

Entity code and Taxpayer Identification Number. To be evaluated as a Joint Venture (JV), offerors must provide a notarized agreement (with the price proposal) delineating roles and responsibilities for all proposed work.

Access to the SSSB and U-NNPI GFI

Offerors shall refer to Attachment S-2 for instructions regarding authorization to access and possess U-NNPI and information regarding Reading Room access to U-NNPI GFI for proposal development.

5.0 PROPOSAL CONTENT

5.1 Cover Letter

The cover letter shall not exceed three (3) pages. In accordance with the requirements outlined in FAR 52.215-

1(c)(2)(i-v), the cover letter shall include the following:

• The solicitation number;

• The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

• A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

• Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation; and

• Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

In addition to those requirements, the offeror shall include the following in the cover letter:

• A statement that the proposal is valid through 365 calendar days from the date specified for receipt of proposals;

• Identification of all enclosures being transmitted as part of the offeror's proposal

• CAGE and Data Universal Numbering System (DUNS) numbers for the Prime contractor;

• Notice of any alterations to the solicitation; and

• Name, address, and telephone number of each proposed first-tier subcontractor with a proposed subcontract estimated at $10 million or more.

5.2 Volume I – Technical Proposal

Volume I, Technical Proposal information, shall be comprised of Factor 1 – Eligibility Factor.

The following Eligibility criteria must be completed by the offeror in order to be considered eligible for award:

a) Provide evidence, the offeror, including any subcontractor or group, has performed as the prime contractor, under NRC license and regulation, radiological work, including decommissioning, dismantlement, materials processing, or radiological material fabrication or repair, with an aggregate contract value of at least $50M (in 2018 dollars) within the past five (5) calendar years from the date of the solicitation. For work on projects that have started but not yet completed within the past five years, the value of the work completed within the past five years may be counted toward meeting the $50M total. Evidence such as the first page of any applicable contract(s) will be accepted.

b) Provide evidence of a written agreement by a third-party institution to provide a performance bond valued at 20% of the total proposed price, to be effective the date the Contractor takes possession of the SSSB.

c) Provide demonstrated ability to provide an easement, or other contractual right for the Navy to dispose of up to 300,000 cubic feet of low-level radioactive waste containing no more than 10% of NRC Class A limits from dismantlement of the SSSB to be effective upon the date the Contractor takes possession of the

SSSB. The Contractor could draw upon this easement during SSSB dismantlement. Since this easement would only be for SSSB dismantlement waste, upon completion of dismantlement, the easement would confer no additional rights and would no longer have any effect. Alternatively, in lieu of this easement, the offeror may elect to provide evidence of a written agreement by a third-party institution to provide an additional performance bond for completion of the contract valued at 30% of the total contract price (i.e., increase the total value of the performance bonds for the contract to 50% of the total contract price), effective the date the Contractor takes possession of the SSSB. If the offeror elects to provide the additional performance bond in lieu of the easement described above, the offeror shall be responsible for providing or purchasing any required radioactive waste disposal services.

d) Provide written corporate agreement to perform this contract without nuclear indemnification under Public

Law 85-804.

e) Provide the date, time, and names of the employees present at the mandatory SSSB vessel ship check after

Solicitation issuance.

f) Provide written agreement between the Contractor and dismantlement site owner that proposed dismantlement site operations are allowed.

g) Provide evidence the offeror has informed appropriate State and local officials the offeror’s intent to prepare a proposal to perform the dismantlement and disposal of the SSSB described in this solicitation at a specific location within the jurisdiction of those State and local official(s). At a minimum, the offeror must provide evidence these officials have been informed of the scope of work to be performed and the radiological regulatory framework. The offeror shall also provide an assessment of the feasibility of performing the dismantlement of the SSSB at the proposed location for the work in the context of the outreach conducted by the offeror, including any feedback or comments from the State and local officials that were contacted.

The term ‘appropriate’ in the context of the officials to be contacted noted above may include, but are not limited to, elected officials, duly authorized representative(s) of the agency or agencies that will oversee business and environmental permits required to perform the tasks in the statement of work, emergency response organizations, and State and/or municipal authorities for ports, harbors, and/or economic development zones where the work is proposed be performed. The offeror shall provide justification for the officials determined by the offeror to be ‘appropriate’ in the context of the State and local jurisdiction where the work is proposed to be performed.

h) Provide a plan to prepare and tow via transport barge or heavy-lift the vessel IAW Chapter 8 of the U.S.

Navy Towing Manual (SL740-AA-MAN-010, Attachment J-9). The plan shall address the following:

1) Identification of required permits.

2) Required conditions of the SSSB prior to commencing transport, including but not limited to ballasting requirements, tank levels, hull inspections and repairs.

3) Transfer of possession of the SSSB to the method of conveyance at a location in the James River, just outside of the Huntington Ingalls Industries - Newport News Shipbuilding facility.

Identification of the location for the transfer of possession, to which the Contractor and

Government shall mutually agree.

4) Loading of the SSSB onto the method of conveyance to the dismantlement and disposal facility.

5) Fire and flooding monitoring and prevention measures.

6) Method of securing the SSSB for stability during transport and heavy weather conditions.

i) Provide evidence of the offeror’s self-certification and authorization to access and possess U-NNPI in accordance with Attachment S-2.

5.3 Volume II – Price Proposal

The Price Proposal shall be a separate volume comprised of the offeror’s Executive Summary with substantiating cost information, completed SF 33, Section B Pricing, and the Pricing Workbook Spreadsheet (Attachment S-1).

The price proposal shall not contain non-price factor information. The price proposal shall be comprised of the following documentation:

1. Executive Summary

2. Completed and signed SF 33

3. Completed Section B Pricing

4. Pricing Workbook Spreadsheet (Attachment S-1)

5. Subcontracting Plan demonstrating at least 20% of the total proposed price allocated to small business

5.3.1 Executive Summary

The Executive Summary shall not exceed three (3) pages and shall include a narrative and signed statement, on the offeror’s letterhead, stating that the accompanying Price Proposal:

a) Is for all requirements as stated in the solicitation (including all attachments, appendices, and amendments thereto).

b) Is made without qualification or exception to any terms and conditions appearing in the solicitation including all attachments and amendments thereto. [Qualification of the proposal or taking an exception to any of the terms and conditions may result in the offeror’s proposal being rejected as unacceptable].

5.3.2 Standard Form 33

The offeror shall submit the completed SF 33 with blocks 12 through 18 completed, as well as all sections with applicable “fill-ins”. The representative who signs this form must be authorized to contractually bind the company providing the offer. Submission of a signed offer to the Government constitutes agreement and acceptance of the terms and conditions of the solicitation in a FFP contracting environment.

The proper completion and submission to the Government of the SF 33 Solicitation Set/Model Contract shall constitute an offer and will indicate the offeror’s unconditional assent to the terms and conditions in this Solicitation and in any attachments hereto. Any objection to any of the terms and conditions of this Solicitation may make the offer unacceptable. Offerors are notified that the Government’s acceptance of an offer does not imply acceptance of the pricing rationale or assumptions. The Government intends to award a contract without discussions, but reserves the right to conduct discussions, as permitted by FAR 15.306(d) and 52.215-1.

5.3.3 Section B Pricing

The offeror shall submit proposed pricing for Section B with all appropriate information completed as required by the solicitation. Proposed prices shall be in whole dollars and shall be provided for each applicable Contract Line

Item Number (CLIN) and corresponding Subline item (SLIN) . The proposed price shall represent the contract price. The offeror is responsible for ensuring all required information is completed and provided to the Government.

Award will be made at the proposed price of the successful offeror using that offeror’s proposed Section B pricing.
