| Kirtland Helicopter Maintenance - RFP Questions 20 Aug 14 | |||
| Type | Reference | Question | Answer |
| Misc | PWS 3.1.12.13.9 | PWS 3.1.12.13.9 indicates “SP shall replace all common hand tools/tool boxes with items of equal or higher quality, which have a minimum of a five (5) year warranty, at the SP's expense. However, the Government will replace those items listed in Appendix FA indicated as Government furnished.” Since all items in Appendix FA are Government furnished and labeled “GFP (Common Tools),” would USG please clarify which, if any, tools listed in Appendix FA are to be replaced by SP at SP cost? | Updated PWS Paragraph 3.1.12.13.9. to state: At the beginning of the contract the Government will furnish the common hand tools and tool boxes specified in Appendix FA. When tool and (or) tool box replacement becomes necessary due to ordinary wear and tear, the SP shall replace all common hand tools/tool boxes with items of equal or higher quality, which have a minimum of a five (5) year warranty, at the SP's expense. However, the Government will replace those items listed in Appendix FB indicated as Government furnished.All SP procured replacement tools and tool boxes shall become and remain Government property. |
| Misc | PWS 2.1.25.3 | Would USG modify PWS 2.1.25.3 indemnification language so that SP would only indemnify and hold the Government and its employees harmless so long as there was no willful and/or negligent action or inaction on the part of Government or its employees that contributed to SP personnel injury or death? | The Government will not revise PWS 2.1.25.3 to include the suggested language. |
| Misc | CBA | Are position descriptions available for the labor categories covered by the CBA. If not, does the government have position descriptions for the labor categories utilized on the contract? | There are no position descriptions available for the labor categories covered by the CBA. The Government does not have position descriptions for the labor categories utilized on the contract as SP will propose the labor type and mix to perform the work outlined in the PWS. |
| Misc | Section L&M | The solicitation requires SP to provide detailed strategy on how it will manage a small fleet in order to prevent depot, phase, aircraft support and major maintenance from creating aircraft availability conflicts. To create requested level of detail, SP requires a snapshot of current flight hours and tail numbers for UH-1N and HH-60G fleets. Would USG provide SP current listing of HH-60G and UH-1N tail numbers with their current flight hours and possession codes? | The requested information is For Official Use Only (FOUO) and cannot be publically released; however, it can be made available to the successful offeror during mobilization. The information provided in the PWS to include Appendix B, which includes phase hours, depot maintenance inputs, maintenance man-hour per flying hour (MMH/FH), etc. takes into consideration fleet age and hours, and can be used to help formulate small fleet management strategy. |
| Misc | N/A | Will the Government please provide the union seniority list so we may accurately bid vacation and other union required benefits? | The Government does not possess the union seniority list at this time. The Government has requested the information; however, the incumbent service provider is not required to provide a certified seniority list until 10 days before contract completion, in accordance with FAR 52.222-41(n). Should any information become available, the Government will publically post via separate FBO notice. |
| Misc | Section I | Reference: |
DRFP Q1: Draft RFP, Section I, includes FAR Limitation of Liability - Services as maintenance will be provided under contract. SP, however, will also most likely be providing supplies under contract and requests inclusion of FAR 52.246-23 (Limitation of Liability) in accordance with FAR 46.805.
DRFP A1: Supplies provided under the contract are in conjunction with the services to be provided--this is congruent with FAR 52.246-25, Limited Liability - Services. FAR 52.246-23 is not required.
| While FAR Limitation of Liability - Services clause covers “material” provided in conjunction with services, it fails to cover any “tools” the SP would provide under contract. Would USG please reconsider including FAR 52.246-23 (Limitation of Liability) in RFP? | The Government understands your differentiation between "materials" and "tools"; however, in response to your clarified question, the tools referenced are not "supplies", but are GFE provided to the service provider for contract performance. If/when a tool(s) breaks or becomes unserviceable, replacement will be at the service provider's expense. The tool(s) remain GFE - not "supplies" provided under the contract. | ||
| Misc | Section I | Reference: |
DRFP Q1: As some services under contract may be provided on a cost basis (i.e. CLIN 0010), please include FAR 52.249-14 (Excusable Delays) in final RFP and contract in accordance with FAR 49.505(b).
DRFP A1: The Government intends to award a FFP contract and does not intend to include the referenced clause at this time. Some portions of the effort are provided on a cost basis; however, if the events listed in 52.149-14 do not impede the flying mission, support will be required.
Is it USG intent to later amend contract to include FAR 52.249-14 (Excusable Delays) if SP is to provide service under the optional COST CLINs? The Government does not intend to amend the contract to include FAR 52.249-14, Excusable Delays.
