About this file
This is a Living Wage Program submittal requirement document issued by the City of Austin, Texas, pursuant to Rule R161-17.14. The document establishes mandatory wage compliance requirements for all contractors and subcontractors directly assigned to City of Austin contracts. Contractors must certify that all employees and subcontractor personnel assigned to the contract will be compensated at a minimum living wage of $22.15 per hour. The City requires contractors to submit a certification with their offer that includes a comprehensive list of all contractor employees and subcontractors at all tiers, identifying each person by name and job title. This employee roster must be updated and provided to the City as necessary throughout the contract term. Contractors must also provide individual Employee Certifications for all assigned personnel within thirty days of contract execution, with annual recertification on the contract anniversary date. The City reserves the right to request Employee Certifications at any time during contract performance.
Contractors are required to maintain basic employment and wage information for each employee as mandated by the Fair Labor Standards Act, and the City Contract Manager will periodically review submitted employee data to verify living wage compliance. Violations of the living wage provision require contractors to pay affected employees the amount of wage deficiency for each day the violation continues. Willful or repeated violations, fraudulent statements on the certification, or retaliation against employees claiming non-compliance may result in contract termination for cause, suspension or debarment of the violating firm, or legal action. The certification document includes a table format requiring contractors to list employee names, employers, designation as prime contractor or subcontractor, normal hourly rate, and job title for all personnel directly assigned to the contract.
