Q1. Is it intentional that, while, in Amendment 5 of the RFP, the contractors were asked about meeting surge rate quantities through procuring long lead time items at contract award, the FAR referenced in the RFP is FAR 52.209-4, which does not allow for procurement of long lead items before the approval of the FAT? This will make meeting surge rate quantities very difficult to accomplish without a known quantity or advanced procurement funding. Is it possible to include DFARS 217.103 or some other allowance which allows advanced procurement of the long lead items at contract award, as well as a forecast of the quantities that will be expected at the surge rate?
A1. As stated in the RFP Amendment 0006 Delivery Schedule Requirements (pg. 21), “the first (1) unit order on the first delivery order issued for surge units shall be delivered no later than 300 calendar days after the effective date of the delivery order.
If the units identified on the first delivery order exceed 1 unit, the contractor shall deliver at a rate of 8 units per 30 day period until such time that the order quantity is completely delivered”.
At first article approval, chances are the Government will issue a delivery order under
CLIN 0004 (Surge Units) that is estimated to have a quantity of more than one (1). As stated above, the awardee will have 300 calendar days to produce the first surge unit.
This should allow for adequate time to order long lead items.
Note: Progress Payments will be authorized for this contract.
