NOTE: General requirements specified in this document represent a baseline standard and should not be in conflict with other project-specific requirements. In case of conflict, however, the contractor shall comply with more stringent project-specific requirements.

1. TITLE: Multiple Award Construction Contract (MACC)

2. PROGRAM DESCRIPTION

2.1. The MACC program is required in support of 86th Civil Engineer Group (86 CEG), located on Ramstein Air Base (RAB) and 52nd Civil Engineer Squadron (52 CES), located on Spangdahlem Air Base (SAB). The responsible offices for the contractor performance are 86 CES/CENM, 52 CES/CENM and 52 CES/CEOE.

2.2. All work shall be in conformance with the drawings and specifications provided by 86 CES or 52 CES to include: the furnishing of all materials, labor, plant, tools, equipment, transportation; the execution of services, including engineering/technical design support; and the incidentals thereof.

2.3. The MACC is an Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract for execution of a broad range of design-build, sustainment, maintenance, repair, alteration, renovation and minor construction projects, to include residential and commercial work for the Kaiserslautern Military Community (KMC), SAB areas and all of Germany. The primary bases/geographically-separated units (GSU) are RAB, Einsiedlerhof, Kapaun Air Station, Landstuhl Military Family Housing, Vogelweh, Breitenbach, Pirmasens Husterhoehe, Bann, SAB, Buechel, Geilenkirchen, Grosslittgen and Niederkail Water System Annex and Zemmer Storage Annex.

2.4. Performance of services will be accomplished by the contractor through individual Task Orders (TOs). The project scope on each TO will be identified by the Government. TOs will be awarded in accordance with (IAW) Ordering Procedures (Attachment 2, Special Contract Requirements, Paragraph 3.0) of this contract. A Task Order Request for Proposal (TORFP) will be issued to define specific project requirements involving design-build or build only requirements. TO execution will be directed by one of the following work elements:

(a) Work Element No. 1, Construction Effort Without Design Needed:

The contractor will be provided with a Statement of Objectives (SOO) with minimal supporting documentation. Based on that SOO, the contractor shall provide a detailed Statement of Work (SOW). After the TO award, the contractor shall commence and execute construction IAW with the TO requirements.

(b) Work Element No. 2, Construction Effort With Design Package Provided:

The contractor will be provided an adequate design document package to execute the construction requirement only IAW the TO. The package will include the SOW, drawings, technical specifications, and any other preliminary data.

(c) Work Element No. 3, Partial Design-Build Effort:

The contractor will be provided with a previously accomplished pre-concept or concept design effort, including available drawings, specifications, and/or design analysis. Contractor shall complete a detailed design IAW the “Honorarordnung füer Architekten und Ingenieure” (HOAI - Schedule of Services and Fees for Architects and Engineers) Service Phase 3 (concept design) or Service Phase 5 (final design), including special services IAW TO requirements. Construction shall commence upon approval of design and be completed IAW TO requirements.

2.5. All construction work, specifications, SOWs, drawings, and other contract requirements shall be performed in strict accordance with the most current editions of the relevant standards and regulations, e.g. the Deutsche Industrie Normen (DIN), Eurocode (EN), the Vergabe und Vertragsordnung füer Bauleistungen Part C (VOB Part C), the appropriate Landesbauordnung (LbauO) etc.

2.6. The work will typically include tasks involving a variety of multiple different trades in construction above and below the ground.

2.7. The contractor shall furnish all personnel, labor, equipment, tools, materials, supervision, and other items and services necessary to design, manage, and accomplish a broad range of repair, alteration, and/or new construction work on various real property facilities.

2.8. The contractor shall have a design and construction staff available to respond to the requirements of this multi-discipline IDIQ type contract. The contractor shall provide project management, project design/engineering, on-site supervision, quality control, and administration. During the TO performance period, the contractor shall staff an emergency contact who is available 24 hours per day and seven days per week (24/7). The emergency contact shall be available on site in person within one (1) hour after notification for the KMC area and within two (2) hours for the SAB area. The contractor shall have at least one English-speaking person available on site.

2.9. Upon issuance of a TO, the contractor shall submit relevant work plans, samples, brochures, manufacturer data, subcontractor list, applicable certifications for contractor and subcontractor personnel, product data sheets, drawings, progress schedule and certificates of materials relative to the construction execution to the Contracting Officer (CO) for approval prior to execution of the project, IAW design criteria/specifications and TO requirements. All material submittals, as indicated in the applicable specification sections, shall be submitted at the same time. If the submittal requirement is listed on the drawings, all material submittals of like work shall be submitted simultaneously and with all corresponding specification sections. Failure to submit all material submittals associated with an individual specification section at the same time will be rejected. Timelines for design and/or construction will be specified in each TO.

2.10. For each TO requiring design effort, the Government will specify in the TORFP if a pre-design conference is required. When a pre-design conference is required, the contractor, CO and/or designated representative, using agency representative, and Project Manager (PM), as a minimum, are required to attend. The CO will schedule and chair the conference at a location and time of his/her choosing.

2.11. For each TO, the Government will specify in the TORFP if a pre-construction conference is be required. If a pre-construction conference is required, the contractor, CO and/or designated representative, using agency representative, and PM are required to attend. The CO will schedule and chair the conference at a location and time of his/her choosing. At the conference, appropriate design representatives will ensure that all interested parties understand how activities during construction will be executed relative to the design review process and approval provisions.

2.12. For projects with a programmed amount of $500K or more, the contractor shall conduct a value engineering analysis, if deemed necessary by 86 CES/CEN or 52 CES/CEN.

3. QUALITY MANAGEMENT PLAN (QMP)

3.1. The successful offeror(s) for the MACC program shall institute a comprehensive QMP to ensure that all materials and workmanship are in strict compliance with the provisions of the specifications. Any problem, whether identified by the contractor or the Government, the contractor shall provide a written resolution to the CO within five (5) workdays from the date of the identified problem was documented.

The contractor shall use Trend Analysis to identify poor performing subcontractors and provide this data to the PM weekly. The contractor shall inspect and document projects daily.

3.2. The contractor shall adhere to their own QMP to ensure all components of construction in all construction phases meet industry standards.

3.3. The QMP specifically and exclusively relates to the acceptable completion of work and subsequent Government inspections and approval. It is the contractor's responsibility to ensure, inspect, and document that the level of quality established by the standards of the SOW are met.

3.4. Quality Control Manager (QCM): The QCM shall manage the execution of the approved QMP and is responsible for administration of the plan and inspection of work. The QCM shall be available during normal duty hours and within one (1) hour (for the KMC area) and two (2) hours (for the SAB area) after notification to meet in person with the CO or a representative from the using agency.

3.5. Government Inspection: The contractor shall request final inspection for a specific TO at least five

(5) workdays prior to the completion date. The CO or authorized representative will inspect the work on site. In the event that the work is not acceptable, the contractor shall record a list of items noted by the Government to be corrected. A subsequent inspection may take place in order to validate the corrected items. Deficiencies recorded during the final inspection shall be completed within ten (10) calendar days or as directed by the CO. Final invoice will not be accepted until all deficiencies are resolved/corrected and as-built drawings are handed over. Additionally, the Government preserves the right, if necessary, to schedule pre-final inspections prior to the completion date.

3.6. Government Approval of Work: The Government will notify the contractor that work for a specific TO is acceptable or unacceptable. Invoices for a specific job order will not be permitted until the Government has accepted the work. The contractor shall clean up all debris, rubbish and construction material, and return the site to an orderly condition prior to the Government’s acceptance.

4. SECURITY REQUIREMENTS

4.1. The contractor shall comply with security regulations imposed by the Base Commander and the agency occupying the space where the work is to be performed, including obtaining security clearances and adhering to all provisions thereof.

4.2. CONTRACTOR ACCESS TO U.S. INSTALLATIONS

4.2.1. The contractor shall obtain Installation Passes for all contractor/subcontractor personnel who visit or perform work on the KMC Installations or SAB and other geographically separated units cited in the contract. All required forms and documentations for the installation passes are available at 86 CES/CENM or 52 CES/CENM. Depending on security requirements, the procedures or type of documents required may vary. At least 30 calendar days before starting work, the contractor shall complete all the required forms/documentations and submit back to the 86 CES/CENM or 52 CES/CENM for approval.

4.2.2. The Government reserves the right to limit or deny the contractor’s access in case of heightened security.

4.2.3. The Government may deny access to KMC installations or SAB and associated geographically separated units for individuals who have not completed and signed the Security Check Questionnaire (AE Form 604-1B) or whose security check result have returned unfavorable or adverse, or for individuals whose security status determination process is still ongoing.

4.2.4. During the contract period, additional access conditions might arise; for example, taking of finger prints.

4.2.5. The contractor is responsible for returning installation passes when their employees no longer require access to KMC Installations or SAB and associated geographically separated units (due to termination of employment, expiration of installation passes, etc.). If a contractor employee changes his/her employment from one contractor to another contractor, a new installation pass must be requested under the new employer. The same rules applies for subcontractors and the subcontractors’ employees.

4.2.6. Contractor personnel shall wear or prominently display contractor furnished badges clearly identifying his/her employer while visiting or performing work on the installation.

4.2.7. Contractor personnel will only receive Installation Passes when a Security Check is completed and with a positive result.

4.2.8. The prime contractor(s) may be granted with special escort privileges, if required by a circumstance.

4.3. MATERIAL DELIVERIES AND INSTALLATION ACCESS

Large vehicles, such as delivery trucks, are controlled separately when entering U.S. installations.

Waiting periods of up to two (2) hours are possible and shall be considered when pricing TOs. For smaller vehicles, force protection level and security exercises may delay access of contractor personnel up to two (2) hours.

4.4. WORK PERFORMED IN SECURED AREAS

Projects in secured areas may require a local agency check of contractor personnel and all sub-contractors prior to commencement of work. If a check is required, the contractor should allocate time in the work schedule to accomplish this check. The contractor shall price work performed in secured areas according to standard work hour rates unless prior approval for using non-standard work hour rates is granted by the

CO.

4.5. ESCORT IN RESTRICTED AREAS

Contractor personnel must be escorted at all times in a controlled/restricted area by a Government escort.

Escorts for secured areas will be scheduled by the contractor at least 10 workdays prior to start of work.

For certain areas, an entry authorization list must be approved before access is authorized. In this case, the contractor must provide a list of the personnel who will be working in this area. The Government will provide an escort as quickly as possible, however, the contractor should anticipate delays due to the sensitive nature of secured areas.

4.6. UNAUTHORIZED RECONNAISSANCE

The contractor shall inform all personnel working under their authority, including subcontractor and visiting supplier personnel, that access to areas outside the immediate work area is prohibited. Exceptions to this policy include cafeterias and restrooms near the work site, direct haul and access routes, Contracting offices (700 CONS and 52 CONS) and 86 CES/CENM or 52 CES/CENM, and points of supply and storage. Circulation of these personnel shall be limited to official business only. Personnel engaged in unauthorized reconnaissance of other contractor or Government activities will be referred to the CO for disposition. Infractions involving possible compromise of national security will be forwarded to the U.S. Air Force Office of Special Investigations (OSI) or U.S. Army Criminal Investigation Department (CID) for disposition, depending on jurisdiction.

4.7. INFORMATION SECURITY

All paperwork, printed e-mails, drawings and plans shall be shredded in the appropriate level medium, IAW Air Force Instruction (AFI) 10-701.

4.8. RECORDED IMAGES

Prior to taking recorded images (e.g. photographs, videos, etc.) on the military installation, the contractor shall obtain approval from the CO, 86 CES or 52 CES. The following may apply to different locations:

• A general prohibition on recorded images, either or both still images and video.

• Permission to record images after obtaining a permit, with restrictions.

• Permission to record images without having to obtain a permit and without restrictions.

4.9. CLOSURE OF OPENINGS

The contractor shall close every exterior wall and roof opening resulting from work in order to prevent outside intrusion at the end of each workday. To reduce risk of wind and weather intrusion, all closures shall remain in place when the contractor is not actively engaged in working on the sites, including every day, night, weekend, and holiday. Closures shall be constructed of 1/2" minimum thickness plywood anchored in place to stud framing, or similar construction, as approved by the 86 CES/CENM or 52

CES/CENM.

4.10. WORK AT SECURITY FENCES

Work at security fences shall be coordinated with the 86 CES/CENM or 52 CES/CENM prior to start of work. If necessary, a Government escort will be required who will oversee the area while the fence is open. Fences shall be restored at the end of each work day or shall be secured by suitable measures.

Under no circumstances shall work at security fences be started without prior coordination.

5. ENVIRONMENTAL CONCERNS, SAFETY AND OTHER APPLICABLE STANDARDS

Both U.S. and German regulations apply in conjunction with this contract. In case U.S. and German regulations differ, the more stringent regulation shall apply. The following paragraphs detail the most important regulations but are not a comprehensive list.

5.1. Safety: The contractor shall work in compliance with the most current German Federal Safety Laws and Regulations, especially the Unfall-Verhuetungsvorschriften (UVV), the Berufsgenossenschaftliche Vorschriften (BG-Vorschriften), and the Baustellenverordnung (BaustellV).

5.2. Energy Conservation: The contractor shall comply with the mandatory standards and policies relating to energy efficiency contained in the most current edition of the Energieeinsparverordnung (EnEV) and the GebaeudeEnergieGesetz (GEG).

5.3. Environmental Laws and Regulations: The contractor shall comply with all relevant Environmental Laws and Regulations, e.g. Gewaesserschutzbestimmung, Wasserhaushaltsgesetz (WHG), Abwasserabgabengesetz (AbwAG), LAGA-Richtlinien, Bundes-Immissionsschutzgestz (BImSchG), Bundesbodenschutzgesetz (BBodSchG), and Landeswassergesetz (LWG), etc.

5.4. The use of materials classified by Governmental authorities as hazardous material or creating potentially hazardous conditions will not be permitted for use in any project. Specifically, products containing lead, asbestos, polychlorinated biphenyl (PCB), and ozone-depleting chemicals are prohibited.

The contractor shall assume a strict and cautious position when dealing with questionable materials.

5.5. POLYCHLORINATED BIPHENYLS (PCBs)

5.5.1. New electrical equipment shall not contain PCBs, shall be certified to this effect, and shall be stamped or labeled “NO PCB.”

5.5.2. If any material originally specified or approved for use in the work should become listed as suspected or verified as containing PCBs, the contractor shall immediately notify the CO and initiate efforts to postpone the installation until the matter is resolved.

5.5.3. Additionally, all requirements of laws and ordinances concerning “right to know” for the general public, as well as work personnel executing the project, shall be adhered to by all parties and shall be specified.

5.6. ASBESTOS REMOVAL

The contractor or subcontractor performing asbestos removal must be in strict compliance with TRGS regulations. A work plan shall be submitted to the Installation Management Flight, 86 CES/CEI, or the Environmental Management section, 52 CES/CEI, no later than two (2) weeks prior to start of work for their review and coordination.

5.7. FIRE PROTECTION REQUIREMENTS

5.7.1. All U.S. and German fire and safety regulations are to be followed stringently. In case U.S. and German regulations differ, the more stringent regulation shall apply. For this reason, the contractor is required to submit a Host Nation Code Compliance Certification performed by a Host Nation fire protection consultant to 86 CES/CENM or 52 CES/CENM.

5.7.2. Inspection: Construction sites will be inspected periodically by the Fire and Emergency Services Office for compliance with all fire codes and standards listed or referenced in the contract documents within their field of responsibility.

5.7.3. Codes and Standards: If the listed or referenced fire code or standard requires any equipment or material items not specified or shown in the contract documents, the contractor shall not be relieved of the responsibility of providing the items and requesting installation instructions from 86 CES or 52 CES through the CO.

5.7.4. Fire Extinguishers: Extinguishers of a type and quantity acceptable to the Chief, Fire and Emergency Services Office, shall be provided by the contractor and maintained in the construction area, the contractor’s temporary buildings, and at the storage piles of flammable materials. These extinguishers shall be of the type conforming to the most recent editions of the National Fire Protection Association (NFPA) standards and shall remain the property and responsibility of the contractor.

5.7.5. Flame Cutting, Welding, and Soldering: The contractor shall observe all precautions in use of flame cutting, welding (requires a permit – see Paragraph 9.1 of this document), and soldering equipment as no flame cutting, welding, or soldering of any description shall be permitted until the work site has been inspected and the operation approved by the 86 CES or 52 CEF Fire Prevention Inspector. A copy of the 86 CEG/52 CEF installation policy will be provided with instructions on the permit required. The contractor shall place flame cutting, welding, and/or soldering caution signs on site and ensure these signs are obvious to the Government and contractor personnel while work is in progress.

5.7.6. Fire Rating: Where specifications or work descriptions require the contractor to submit proof that the material to be furnished conforms to DIN 4102, a written certificate from any testing agency satisfactory to the CO in coordination with the 86 CES or 52 CES shall be furnished with the material with labels attached when fire labeling is specified. No exceptions are allowed.

5.8. NOISE CONTROL

The contractor shall comply with all applicable U.S. and German noise control laws and regulations.

5.9. DEMOLITION

Removed or demolished material will become property of the contractor and shall be disposed IAW the local laws and regulations, unless specified otherwise in the respective SOO/SOW.

5.10. EXPLOSIVE OPERATED HAND TOOLS

The contractor shall comply with Unfallverhuetungsvorschriften (UVV) when utilizing explosive operated hand tools. Storage of explosive cartridges on the installation shall be in metal containers and limited to a one-day supply. The contractor shall provide adequate controls to prevent loss/theft of cartridges used and stored on the installation.

5.11. COMMUNICATIONS INSTALLATION IN NEW AND RENOVATED FACILITIES

Communications conduit, pre-wiring, and equipment shall be installed IAW Verband Deutscher Elektrotechniker (VDE) standards, the ICDS-CDS-and FO-regulations, the EIA/TIA-568, the Technical System Bulletins (TSB) 36 and TSB 40, DIN EN 50173, and ISO/IEC 11801.

5.12. TREE CUTTING

If tree cutting is required, or if any construction is within three (3) meters of a tree, all actions may only be performed after obtaining permission from the Forestry Department through 86 CES/CEI or 52 CES/CEI. This includes construction, renovation, installation, demolition, trenching, etc. The permission shall be requested as early as possible. All debris, such as branches, stumps, etc., shall be disposed of by the contractor as part of the project.

5.13. HISTORIC LANDMARKS

In the event historical or archeological resources may be affected in the execution of a project, the contractor shall comply with Denkmalschutz- und Denkmalpflegesetz Rheinland-Pfalz regulations.

5.14. CONSTRUCTION AND DEMOLITION MEASUREMENT AND REPORTING

The Solid Waste Measure of Merit (MOM) requires the AF to report all non-hazardous solid waste diversion, including construction and demolition (C&D) debris. Data shall be collected by the demolition contractor and submitted to the Installation Management Flight for reporting. The total amount of debris disposed in landfills shall be reported, and the total amount of debris diverted from landfills by reuse or recycling shall also be reported. 5.15. OTHER APPLICABLE REGULATIONS

5.15.1. Antiterrorism/Force Protection (AT/FP)

All construction work shall be performed in compliance with the Antiterrorism/Force Protection Regulations. In order to ensure this, design documents shall be presented to the 86 AW or 52 FW AT/FP representatives for review. The regulations presently applicable are, among others, UFC 4-010-01, DoD Minimum Antiterrorism Standards for Buildings, and UFC 4-021-01, Mass Notification Systems.

5.15.2. Architectural Compatibility

All respective construction measures shall be performed in compliance with the applicable publications in regard to their design and/or shall be coordinated with the 86 CES/52 CES architectural representative.

The applicable current regulation is the Architectural Compatibility Standard (ACS Edition 2008) for Ramstein Air Base and the Architectural Compatibility Guide (ACG 2000) for Spangdahlem Air Base.

5.15.3. Green Procurement

In order to comply with the affirmative procurement requirements of Section 6007 of the Resource Conservation and Recovery Act (RCRA) and Executive Orders 13101 and 13148 (Green Procurement Program (GPP)), the contractor shall use recycled and recovered materials and products identified in the U.S. Environmental Protection Agency (USEPA)'s Comprehensive Procurement Guidelines (CPG).

5.15.3.1. The latest CPG product list and the specific recycled content requirements for each product can be found on the USEPA’s website at http://www.epa.gov/cpg.

5.15.3.2. The contractor shall provide EPA designated products containing recovered material unless the item cannot be acquired:

a. Competitively within a reasonable time frame.

b. Meeting the appropriate performance standards.

c. At a reasonable price.

5.15.3.3. Items identified in the USEPA's CPG shall be viewed as the minimum that can be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the Government, shall also be considered.

5.15.3.4. Material and product submittals for all recycled content items shall list the recycled and recovered materials used and the percentage content listed.

6. CONSTRUCTION SITE MAINTENANCE

All construction sites shall meet the actual Berufsgenossenschaftlichen Vorschriften (BG-Vorschriften), and the Baustellenverordnung (BaustellV).

6.1. The contractor shall maintain all construction sites in a neat and orderly manner. All supplies and equipment on the project sites shall be stored to minimize mechanical and weather damage. All grass, weeds, and other vegetation shall be trimmed and cleared as necessary to prevent fire and safety hazards.

Grass length shall not exceed a height of five (5) centimeters or as directed by the CO. All trash, debris, paper etc. shall be disposed of immediately and placed in proper containers. If requested by 86 CES or 52 CES, a sign with the project title, contractor’s name and point of contact (POC) shall be installed. All construction areas shall be restored to the original condition after removal of the construction site equipment.

6.2. CONTRACTOR PARKING

6.2.1. The contractor shall ensure employees, suppliers, and subcontractors do not park vehicles on grass, in fire lanes or in other restricted areas, nor in parking spaces marked as “Handicapped”, “Government” or “Reserved.” In addition, vehicles may not be driven over grass surfaces, unless indicated during a site visit or pre-construction conference. Any damage done to lawns, shrubs, sidewalks, etc. shall be repaired or replaced by the contractor at no additional cost to the Government.

6.3. CLEAN-UP OF INSTALLATION ACCESS ROUTES OUTSIDE OF THE CONSTRUCTION

LIMITS AND STAGING AREAS

6.3.1. All mud, dirt, debris, foreign objects, or spills of any kind resulting from the contractor's operations (including subcontractors and suppliers) on (a) streets and parking lots used as access to the work or staging areas shall be cleaned daily, or as requested by the CO; and (b) parking aprons and hard surfaces used as access to the work or staging areas shall be kept clean at all times.

6.4. CONTRACTOR GENERATED REFUSE

6.4.1. All contractor generated refuse and waste shall be hauled from the construction site daily, placed in a dumpster, or stored as otherwise approved by the CO. The disposal area selected by the contractor shall be located outside the physical boundary of the installation. All dumpsters shall be emptied before the debris overflows the top of the dumpster. This refuse and waste material shall be hauled in trucks with tight fitting covers to prevent spillage on roadways. The construction site shall be kept neat, orderly, and safe for workers at all times. The contractor shall take positive action to prevent work-generated refuse from entering the sanitary and storm sewer systems. The CO may instruct the contractor to remove the dumpster or replace the existing dumpster with an empty one. The contractor shall comply within four (4) hours of notification. Kreislaufwirtschaftsgesetz (KrWG) shall apply.

6.4.2. Management of Liquid Wastes: The contractor shall not dispose of any excess waste or residual materials on the ground or any storm sewer or drainage system. This includes, but is not limited to: paints, coatings, solvents, petroleum products, etc. Discharge of any material or diluted material into sanitary or industrial sewer systems shall be coordinated with the 86 CES or 52 CES Environmental Flight Coordinator through the CO and shall be approved by the 86 CES or 52 CES Environmental Flight Coordinator. Waste material for disposal shall be disposed in accordance with U.S. and German waste regulations and with local installation policies. Consult with the 86 CES or 52 CES Environmental Flight Coordinator through the CO if the proposed action is not certain to meet these requirements.

6.4.3. Hazardous Chemical and Liquid Petroleum Products Spill Prevention: The contractor shall handle and store hazardous liquid materials in approved areas, and shall comply with the spill prevention and response requirements of regulations and laws mentioned under Section 5.3., “Environmental Laws and Regulations.”

6.4.4. Organic Solvents: The contractor shall limit emissions of organic solvents into the atmosphere.

This rule applies to use, clean up, and disposal of organic, photo chemically reactive and non-photo chemically reactive solvents and materials containing those solvents.

6.4.5. Architectural Coatings: The contractor shall limit the quantity of volatile organic compounds in architectural coatings. This includes any coatings applied to stationary structures and their appurtenances.

6.4.6. Lead Containing Materials: The contractor shall not use paints or coatings containing lead in excess of 0.06 percent by weight of total nonvolatile content IAW Title 16 of the Code of Federal Regulations Part 1303. Paints or coatings within reach of children in recreation and public areas shall have no lead content.

6.5. TRUCKING

Material transportation shall conform to local ordinances and laws. Loose debris on trucks leaving the site shall be loaded in a manner that will prevent dropping materials on roadways. Fasten a suitable cover, such as a tarpaulin, over the load before entering streets. The contractor shall be responsible for the immediate clean-up of any materials that fall from trucks.

6.6. FENCING OF CONSTRUCTION SITES

Fences shall be used to isolate construction sites IAW OSHA CFR 1910, CFR 1926, and Base Appearance Specifications, as well as per instructions by the CO and as recommended of the 86 AW/52 FW Safety Office.

6.7. BARRICADES

6.7.1. The contractor shall barricade access to all interior and exterior construction sites. Barricading shall be used to isolate areas from access. The barricades shall be maintained in good condition and be installed in a manner that people approaching from the predominant direction can clearly read the warning.

Barricades on streets shall meet requirements set forth in “Richtlinien für die Sicherung von Arbeitsstellen an Straßen” (RSA) and need to be requested to 86 CES/CENM or 52 CES/CENM PM through the CO, no later than two (2) weeks prior to the execution of the work. Construction fencing shall be used to isolate exterior areas from pedestrian access and shall be maintained in good condition. Cones shall only be used to temporarily block pedestrian traffic. Extended pedestrian blockages or road traffic shall use rigid barrels or barricades. All barricades, barrels, cones, etc., shall be provided at the contractor’s expense and shall not be a direct cost to any TO unless the CO deems the individual TO is overly extensive as to warrant a separate payment.

6.7.2. All projects involving excavation shall be secured with flashing lights on all sides and have construction fencing completely surrounding the site at a minimum of two (2) meters from the hole.

6.8. OCCUPANCY

6.8.1. The buildings in this contract include multiple-use type facilities. These buildings may or may not be occupied when work is executed. It shall be the contractor's responsibility to ensure the protection of occupant's assets, furnishings, equipment, etc., and to perform the work in a manner that would cause minimal disruption to ongoing activities in occupied areas.

6.8.2. Delivery of materials and equipment shall be made with a minimal interference to Government operations and personnel.

6.8.3. The contractor shall provide non-combustible or self-extinguishing material drop cloths to isolate areas exposed to debris or noise, or to cover material storage during construction in building interiors.

6.8.4. Any temporary construction for facilities used by the contractor in order to prevent interruption of normal work activity or loss of utility services shall be subject to approval of the 86 CES/CENM or 52 CES/CENM PM through the CO.

6.8.5. Smoking is only permitted in designated areas.

6.9. IDENTIFICATION, DAILY SIGN-IN, AND LEAVING THE WORK AREA

When not actively working in the TO work area, the contractor shall post signs clearly marked “WORK IN PROGRESS.” The sign shall include POC names (contractor, 86 CES/CENM or 52 CES/CENM https://www.rehm-arbeitsbuehnen.de/download?file=tl_files/RechtlicheSachen/Richtlinien%20Sicherung%20von%20Arbeitsstellen%20an%20Strassen.pdf https://www.rehm-arbeitsbuehnen.de/download?file=tl_files/RechtlicheSachen/Richtlinien%20Sicherung%20von%20Arbeitsstellen%20an%20Strassen.pdf representative, and contracting representative) and phone numbers. The contractor shall provide construction tape, safety cones, and other materials or equipment to provide a safe and clean environment.

6.10. STAGING/MATERIAL STORAGE AREAS

The requirement for lay-down areas or staging areas associated with a task order shall be dependent upon the size of the project and in accordance with specific criteria as detailed in the task order. Prior to starting the work, the contractor shall submit a site plan through the CO for the Base Civil Engineer approval, showing the layout and details of all temporary facilities planned for use on the identified task order. The plan shall include the location of the safety and construction fences, location of all site trailers, equipment and material storage areas, construction entrances, trash dumpsters, temporary sanitary facilities, and worker parking areas as required by the task order. At completion of work, the contractor shall remove the temporary facilities and restore the site to its original condition. For most construction projects, the Base Civil Engineer will provide the contractor with a single staging area directly adjacent the project site. A supplemental storage area will be identified as required by the detailed TO. All staging areas determined necessary by the detailed TO shall be completely screened with two (2) meter-tall construction fencing and include visual screening. All contractor trailers, stored materials, and idle equipment shall be located in the designated staging area associated with each TO. The staging area shall be kept clean and orderly. Tarps are to be used, as necessary, to secure loose materials. The PM is the sole judge as to what constitutes an acceptable staging area. Dumpsters may be located outside the staging area, but must be placed in the locations approved by the PM. Any movement of a dumpster to another area on the project site must be approved by the PM.

7. DRAWING REQUIREMENTS

7.1. EXISTING CONDITION DRAWINGS (INCLUDING UTILITIES)

7.1.1. Drawings documenting existing underground utilities are available upon request. Any utility line shown on the record drawings or made known to the contractor damaged during construction work shall be repaired immediately by the contractor at no additional cost to the Government.

7.1.2. The Government does not guarantee the accuracy or adequacy of existing record drawings. It shall be the contractor's responsibility to verify all existing conditions prior to starting work on each TO.

7.1.3. During the progress of the job, the contractor shall keep a careful record at the job site of all work accomplished from the layouts shown on the drawings. Annotated working drawings shall be available on-site for inspection by the CO or PM at any time. The contractor shall provide documents (drawings or sketches) to describe all of the work accomplished and enter changes and corrections on contract or record drawings promptly.

7.2. WORKING DRAWINGS

The following requirements apply for working drawings:

• The working drawings shall be turned over to the CO within 10 calendar days after final design is approved.

• All working drawings shall be submitted in electronic format using AutoCAD 2015 or above (*.dwg), and Georeferenced to UTM Zone 32N meters; World Geodetic System 1984 (WGS1984); Geoid Model EDM 96. Files in DXF format (.dxf) will be accepted too. This format is to be used for all engineering drawings. All layers and naming shall be in compliance with A/E/C standards from the CADD/GIS Technology Center.

• All working drawings shall be in above mentioned format and delivered on 4 CD-ROMs with appropriate labeling showing the project number, project title, facility numbers and installation name. In addition, one set of printed drawings shall be delivered.

• All civil work that pertains to utility, pavements or groundwork shall be submitted in Geographic Information Systems (GIS). This dataset must be usable with ESRI Arcview 10.3.1 software or above.

• The GIS data set shall be delivered in a File Geodatabase (FGDB) or a Personnel Geodatabase

(PGDB).

• All GIS data and drawings shall comply with the Spatial Data Standards for Facilities, Infrastructure and Environment (SDSFIE). These standards are available upon request via the GeoBase office located in Bldg 510 on Ramstein AB, or the GeoBase office located in Bldg 119 on Spangdahlem AB.

• All GIS data and drawings shall be submitted in UTM Zone 32N meters; World Geodetic System 1984 (WGS1984); Geoid Model EDM 96.

• All GIS data and drawings shall be delivered on CD-ROM with appropriate labeling showing facility numbers and installation name.

• All electronic working drawings, including AutoCAD, GIS files and associated data, shall be titled in English and German.

• Drawings shall include a schematic of the system with the design conditions listed at major points:

temperature, flow rate, etc.

7.3. AS-BUILT DOCUMENTS

7.3.1. The contractor shall include as-built documents as a work element on the AF Form 3064, Contract Progress Schedule, when requested. The total effort (labor, admin, etc.) for as-builts shall not exceed 3% of the total TO value. No more than 97% of the TO value will be paid until as-builts are submitted and approved by the Government. The as-built documents shall include the following documents as applicable:

• As-built drawings

• Technical specifications

• User manuals

• Maintenance instructions

• Weighing documents/debris data

• Test results

• Measurement reports

• Declarations of compliance

• Spare parts list

• Utility lines survey

• Inspection report of an external specialist

• Product approvals

All as-builts shall be delivered on four (4) CD-ROMs with appropriate labeling showing the project number, project title, facility numbers and installation name. In addition, one set of printed drawings shall be delivered.

7.3.2. The following requirements apply for as-built drawings:

• The as-built drawings shall be turned over to the CO within 21 calendar days of final inspection.

• The as-built drawings shall indicate, in addition to all changes and corrections, the actual as-built condition. In order that the location of sub-surface utility lines and appurtenances may be determined in the event the surface openings or indicators become covered over or obscured, utility record drawings shall show the offset dimensions to two permanently fixed surfaced features, and the end of each run, including each change in direction. Valve, splice boxes, connections, changes in dimensions and similar appurtenances shall be located by dimensioning along the utility run from a reference point. The average depth below the surface of each run shall also be recorded.

• All as-built drawings shall be submitted in electronic format using AutoCAD 2015 or above (*.dwg), and Georeferenced to UTM Zone 32N meters; World Geodetic System 1984 (WGS1984); Geoid Model EDM 96. Files in DXF format (.dxf) will be accepted too. This format is to be used for all engineering drawings. All layers and naming shall be in compliance with A/E/C standards from the CADD/GIS Technology Center.

• All civil work pertaining to utility, pavements or groundwork shall be submitted in GIS. This dataset must be usable with ESRI Arcview 10.3.1 or above software.

• The GIS data set shall be delivered in a FGDB or a PGDB.

• All GIS data and drawings shall be in compliance with the SDSFIE. These standards can be given to the Contractor upon request, to the GeoBase office located in Bldg 510 on Ramstein AB, or the GeoBase office located in Bldg 119 on Spangdahlem AB.

• All GIS data and drawings shall be submitted in UTM Zone 32N meters; WGS1984; Geoid Model EDM 96.

• All GIS data and drawings shall be delivered on CD-ROM with appropriate labeling showing facility numbers and installation name.

• All electronic as-builts, including AutoCAD, GIS files and associated data, shall be titled in English and German.

• Drawings shall include a schematic of the system with the design conditions listed at major points: temperature, flow rate, etc.

8. GENERAL DESIGN REQUIREMENTS

8.1. DESIGN PHILOSOPHY

When directed by the task order SOO, the contractor shall prepare design documentation reflecting commercial industry standards, practices and products, and shall specify the use of commercially available materials and associated assemblies. Design shall consider all practical alternatives in support of defined TO requirements, with alternative selections based on Life Cycle Cost Analysis per AF Design Criteria (MIL-HDBK-1190). The required design standards will be specified in each TO and shall confirm either German standards/codes or U.S. standards/codes should be applied.

8.2. DESIGN PROJECT MANAGER

The contractor shall appoint a Design Project Manager to serve as a single POC and liaison between the Design Team and the CO for all design work required under the contract. Upon award of individual TOs, the contractor shall provide the name of designated Design Project Manager to the CO in writing.

8.3. REVIEW CONFERENCES AND MEETINGS

Design submittal review conferences shall be held as defined by individual TOs for all scheduled design submittals. In addition to scheduled design submittal review conferences, coordinated conferences may be held as deemed necessary by the Government or the contractor at an agreed upon time and location. The contractor may request such conferences, when it is deemed necessary, by all parties to clarify the design direction or expedite the preparation of established plans and specifications in support of project. The contractor shall be responsible for preparing ‘Confirmation Notices’ of any conversation (telephone, fax, or e-mail) and/or minutes of any meeting with AF personnel concerning the execution of the project.

8.4. CONFIRMATION NOTICES

The contractor shall provide a record of all conferences, meetings, discussions, verbal directions, telephone conversations, faxes, e-mails, etc., participated in by the contractor and his representatives on matters related to the execution of the TO. These records, entitled ‘Confirmation Notices’, shall be numbered sequentially and fully identify participating personnel, subject discussed, and conclusions reached. The contractor shall forward to the CO a reproducible copy of conference minutes not more than five (5) working days after the discussion.

8.5. DRAWING & SPECIFICATION NUMBERS

Each individual awarded TO shall require the contractor to annotate the contract drawings and specifications with a Government provided ‘Drawing Number’ and ‘Specification Number’. The specification number shall be displayed in the upper right-hand corner of each page of the specifications and design analysis.

8.6. ARCHITECT-ENGINEER SIGNATURE

All construction drawings and design calculations developed in support of a TO shall be checked and signed by an architect or engineer (e.g. structural, civil, mechanical, electrical, or fire protection engineers) before submittal for review. All design professionals shall have current registration to practice in Germany.

8.7. REFERENCE PUBLICATIONS

Technical design development and associated specifications shall conform to current AF design criteria IAW Federal; Department of Defense Publications including Air Force Policy Directives (AFPD), Instructions (AFI), Manuals (AFMAN), Joint Manuals (AFJMAN), Handbooks (MIL-HDBK and AFH), and Engineering Technical Letters (AF and Army ETL); and all other documents as specified within each TO. Federal and Military Specifications and Standards (FMSS) are presently in the process of being phased out of use, with non-governmental standards and commercial specifications replacing, per the GSA Acquisition Reform Initiative. Various FMSS have been retained for continued use by means of a waiver from the DoD Standardization Office (DoDSO) and are as indicated within this document (e.g.

FED-STD 595).

Due to the numerous available suppliers of Government technical references, including those accessible electronically through the Internet, neither the Base Civil Engineering Squadron nor the CO will provide copies of technical references to the contractor unless the document has restricted distribution and only available through Government personnel. It will primarily be the responsibility of the contractor to locate applicable sources of technical references as identified within each task order.
