46. We request the Government expand the window of Past Performance recentness to a more reasonable five or six year window to avoid unduly restricting competition and allow for more participation from industry in order to give the Government the option of selecting from a sufficient pool of qualified firms.
The draft RFP has defined Past Performance recentness in a narrow three year window of experience. This window is so restrictive that several of our most relevant contracts fall outside of the criteria the Government has established and may cause us to decide against proposing on this solicitation.
Based on nature of the work required under the requirement in Turkey and Spain a 3-year window for past performance information to be recent is considered in the Government’s best interest. No change is being made.
47. We request the Government revise the sentences in Section L and M that state “To be recent, the contract must have been performed within the past three (3) years from the date of issuance of this solicitation for a minimum of a one (1) year period” to “To be recent, the contract must have been performed within the past six (6) years from the date of issuance of this solicitation for a minimum of a one (1) year period.” This modest expansion of the contracts considered recent will greatly enhance the participation of industry providing more options for the Government to select the most desirable offer.
The overly restrictive requirement in Section L is found in the Draft RFP on page 117 of 122 in paragraph F.2 Past performance information. The restrictive requirement in Section M is found in the Draft RFP on page 120 of 122 in paragraph C Performance Confidence Assessment.

O&M workload data for Moron AB has been validated and reflects US Goverment estimates based on historical data.
94. Would the Government provide a plug numbers to the RFP that would clarify the following?
1. Where are the lawsuits (what countries, etc)?
2. Is this 75 lawsuits per year?
3. How is the playing field leveled; i.e., will a plug number be given?
4. What CLIN will be used to identify legal costs?
Chapter 1 - General Requirements: Workload Estimates
Spain & Turkey
Retain legal counsel to resolve lawsuits; Approximately 75 lawsuits at any given time
The workload data calls for approximately 75 on-going lawsuits to be handled at any given time during contract performance.
The Government anticipates that the lawsuits will require support in Turkey and Spain.
The cost for retaining legal counsel to resolve those lawsuits need to be considered part of the Fixed-Price Costs in the contract, as identified in the RFP.
95. Would the Government consider reassigning the Chapter 8 Patriot Village Contingency support requirements to Chapter 9 - Contingency Services?
Chapter 9 - Contingency Services: Workload Estimates
Turkey
The Custodial Services and Recurring Maintenance for contingency support via Patriot Village are included in Chapter 8 of the PWS, yet are identified in Chapter 9.0 of the Workload Data.
The Government has reviewed the PWS and determined that Chapter 8 is the appropriate location for Patriot Village Contingency Support. No changes will be made as a result of this question.

100. Would the Government issue a revised Instruction set that reflects the current FFP cost requirements?
Appendix H - Instructions for Cost Element Breakdown
The Instruction document contains definitions that are applicable to a CPFF contract, such as: Cost Performance Summary, Budget-Actual-Variance.
Appendix H has been revised and will be issued with the RFP. All prospective offerors are responsible to retrieve updated information via the FBO website.
101. We request the Government provide additional columns to Attachment 7 identifying the job title from Appendix 2 of the collective labor agreement for Turkey for each listed employee and the site of performance (Incirlik, Ankara, or Izmir) so that offerors may reasonably understand what positions are currently staffed in what locations to determine what positions are overstaffed requiring severance.
Failure to provide this information will provide the incumbent an unfair advantage and result in higher pricing from the competitors.
Section L paragraph L-3. E.2 Price/contract document proposal instructions and
Section J Attachment 7 Turkish National employee listing.
Paragraph 2 of the Price/contract document proposal instructions indicates "Offerors considering mass severance of employees, that are no longer required in performance of the contract, shall propose mass severance as well as retention in the base year."
It goes on to say “Calculation by the offeror shall be based on the provided Turkish/Spanish Employee listings, taking into consideration the maximum possible mass severance cost according to labor law requirements." The information provided by Attachment 7 is inadequate for this purpose.
The requested data is unavailable as it would reveal the incumbent’s manning structure and solution. It is the offeror’s responsibility to propose a technical solution to meet the contract requirements.
102. Please clarify if CLIN 0004 is to provide a full 52 weeks of extended operating hours and tasks or some specific fraction of 52 weeks or if no price is required since the work will be negotiated after award.
Section B supplies or services and prices AND Chapter 9 Contingency services- identifies additional operating hours and tasks for contingency services and CLIN 0004 basic period contingency level I requires a price for 12 months. We understand historically contingency services are ordered as required.
CLIN 0004 and Chapter 9 (Contingency Level I requirements for Moron) have been removed from the final RFP package in their entirety.
103. Please clarify this requirement; not all locations in Turkey have the facilities to provide the requested capabilities in paragraph 1.13.1.
PWS:
1.13 MISSION ESSENTIAL SERVICES: Mission essential services are minimum support required to sustain flying operations and maintain key infrastructure. Provide the services designated as mission essential services in accordance with the terms and conditions of the contract during period of crisis. The mission essential services are:
1.13.1 TURKEY (ALL LOCATIONS): CIVIL ENGINEERING - Base Power Plant, Water Production & Sewage Treatment, Runway Sweepers, Fire Department, Liquid Fuels Maintenance, After Duty Emergency Services for Electrical and Mechanical systems; LOGISTICS – MICAP Delivery (TMO), Vehicle Operations, Emergency Vehicle Maintenance for Fire Trucks, MHE, Wreckers, Refuelers, and Command & Control Vehicles, Air Terminal Operations Center; SERVICES – Dining Facility with all food service options.
The Requirements can be met. The facilities provide the capabilities to satisfy the needs of the individual locations.
104. Question: Will the Government please provide the Turkish and Spanish SOFAs as attachments to the solicitation?
Question: Will the Government please provide the text of applicable SOFAs?
Reference: RFP Section L, Part I, Subfactor 2
Discussion: Evaluation Factor I, Subfactor 2 asks for “a description of the offeror’s organization and approach to address Status of Forces Agreement (SOFA)”. However, the Turkish and Spanish SOFAs are not included with the solicitation.
It is the responsbility of the offeror to locate up to date information on applicable SOFAs, labor laws, and other applicable regulations necessary to meet the requirements of the solicitation.
105. Question: If a Foreign Employer is used to provide American National employees, for example as a subcontractor, how will OASDI, Medicare, FUTA and SUTA payments be normalized for comparability purposes?
Reference: RFP Section H, H-12
Discussion: The RFP is silent in regards to OASDI (Social Security), Medicare, FUTA and SUTA payments by Foreign Employers? Foreign Employers of American Nationals are not held to the same standard with regards to OASDI and Medicare payments, this could create a difficult environment to evaluate pricing.
Pricing evaluation shall be accomplished in accordance with the solicitation, no preference will be given based on the location of the “employer”.
106. Question: Will the Government set currency exchange rates in the RFP for bidding purposes so that all bids are comparable and performance risk is understood?
Reference: RFP Section H, H-9
Discussion: The RFP is silent in regards to the currency exchange rate to be used for bidding purposes. Without a common exchange rate, it will be difficult to compare bids and/or understand associated performance risk based upon currency fluctuations between proposal submittal and the first day of execution. A bidder could use an unrealistic bid rate which could present significant performance risk.
The solicitation contains a requirement for the offerors to propose, as part of their price proposal, all foreign currency exchange rates (other than EURO Currency), that were applied in calculating the proposed prices. These proposed rates will be evaluated as part of the price evaluation.
107. Question: What on-base housing is available to American Nationals in either Spain or Turkey?
General
Turkey: Accompanied and Unaccompanied housing is available to American Nationals based on availability.
Spain: Currently Spain does not provide housing for AN contractors.
108. Question: Will the Government set the rate at the World Bank Rate at time of contract award and provide equitable adjustment, as applicable, to proposed cost during the period from proposal submission to contract start?
Reference: Special Contract Requirement H-9 (pg 62 of 122); entitled - "Equitable Adjustment for Fluctuations in Value of Foreign Currency.”
Discussion: This requirement addresses fluctuations in value of foreign currency during the period of performance, but is silent in reference to the period from proposal submission until contract start, which under current plan appears to be 17 months
The solicitation contains a requirement for the offerors to propose, as part of their price proposal, all foreign currency exchange rates (other than EURO), that were applied in calculating the contract prices. Those rates shall be the base rates for the Foreign Currency Fluctuation.
Special contract clause in Section H of the RFP describes the Foreign Currency adjustment process.
109. Question: Will the Government please list all required reports in the Appendix B, “Required Reports” to ensure clarity?
Reference: PWS in its entirety
Discussion: Throughout the PWS there are reports indicated that are not listed in the "Required Reports” section of Appendix B.
The list of required reports (Appendix B) is not all inclusive. The contractor is held liable to provide all reports listed in Appendix B as well as all reports driven by the given regulations/policies throughout the PWS.
110. Question: Is the intent to maintain this of level maintenance for housing units during normal change of occupancy (usually about 2 weeks per unit), or is this period extended for units that are intended not to be occupied for longer periods, due to reduction in housing needs? If so, please provide an estimated number of units that will be in this status on an annual basis.
Reference: PWS 3.26.2 (pg. 22) entitled "Grounds Maintenance.”
Discussion: Referenced text states, “The grounds around all vacant MFH units and common areas shall be maintained to housing brochure standards.” No clear definition of what the Government’s intent is for the requirement around vacant housing.
According to PWS, Chapter 3, Grounds maintenance standards will be maintained to housing brochure standards, regardless of occupancy status.
111. Question: Will the Government please readdress the "Contractor Personnel Meals” language to accurately describe the requirement?
Reference: PWS 5.1.9.2 (pg. 44) entitled "Contractor Personnel Meals.”
Discussion: Referenced paragraph directs that contractor personnel that eat at the Government dining facilities must pay for their meal to include the surcharge. It also forbids the bringing of food from other sources into the dining facility or flight kitchen. This provision is understandable for American national personnel. However, situations at both Moron and Incirlik could impact local national (LN) employees that work for the contractor.
At Moron, all Spanish employees (contractor’s and the US Government's) can eat at the dining facility per base policy. The LN employees have historically paid for their meals at the basic rate without paying the "surcharge". The reason for this is because in accordance with Spanish labor law the employees only have to pay for the meals cost without any mark-up, which is what the "surcharge" represents. This was confirmed via a Spanish court decree (decision) when an employee of a previous BMC contractor took the matter to court and won his case.
Historically, the situation in Turkey has not been the same as in Spain. However, it only impacts the Turkish national (TN) employees that work in the Incirlik dining facility. Historically, the TNs that work at the dining facility have eaten their lunch meal for free (the meal has been accounted in the AF system in the same manner as that of an individual on meal card). The reason this came to be was the fact the Government doesn't allow the TNs to bring their own food into the dining facility so they do not really have a place to eat their "brown bag" lunch if they were so inclined.
