SECTION 01 11 02
SPECIAL CONDITIONS
1 PERFORMANCE PERIOD:
The performance period estimated by the Government for the completion of the entire work ready for use, including from the preconstruction activities through the finish works, is 527 calendar days, including an average inclement weather days. The required field investigation to detect underground services, including unforeseen utilities, may slow work progress.
1.1 It shall be the sole responsibility of the Contractor to ensure all required submittals are submitted to Construction Management for approval in a timely manner, which shall not incur any delay in completion of the project. For materials or equipment requiring a long term of procurement and delivery, said term shall be included in the period of performance. Delay in delivery/procurement will not justify an extension of the period of performance.
2 GOVERNMENT-FURNISHED MATERIAL (GFM)
The Government will furnish the material and equipment shown below for installation by the Contractor. The materials and equipment will be available to the Contractor already installed in the building(s) or on hand stored on base. Contractor shall install GFM. The Contractor shall notify the Contracting Officer in writing not less than 15 calendar days in advance of the date materials or equipment will be needed. All existing material or equipment to be reinstalled in building(s) shall be carefully removed, stored, and maintained by Contractor.
NOTE: The Contractor must include in its offer, the labor required for removal and reinstallation, or installation of GFM.

3 EQUIPMENT, CONTROLS, AND MATERIAL OF THE UNITED STATES OF AMERICA
3.1 Equipment List
The following listed equipment, controls, and materials shall be manufactured in the United States of America or in another country where the supplier is under license of the United States of America manufacturer and the product meets the same applicable specifications and/or standards. No substitutions will be allowed.
a) Drinking fountain.
b) Fire protection equipment.
c) Safety switches.
d) Electrical conduits, boxes and accessories.
e) Receptacles, plugs and lighting switches/dimmers.
f) Drivers, emergency drivers.
g) Fire doors.
h) Chiller unit.

3.2 Excess
The Contractor shall submit to Construction Management, prior to final inspection (FI), a consolidated inventory of all excess supplies, materials, and equipment imported duty free for use under this contract. The Contractor shall either pay required duties on the excesses or re-export the excesses.
4 CERTIFICATES
The submitted certificates shall be original or a notarized copy. The Contractor shall submit the certificates within 30 calendar days after the Contract Award Date.
4.1 Classification Certificate of the Contractor
Contractor and/or key subcontractors must hold an updated Certificate of Classification issued by the Spanish “Registro Oficial de Licitadores y Empresas Clasificadas del Estado” of the "Ministerio de Hacienda y Administraciones Públicas" covering the following groups, subgroups, and categories. The certificate holder must execute the activities related to the certificate.

Certificate of Classification K92 corresponds to work activities related to fire protection installations with an annual average cost of greater than 150,000 euros and no greater than 360,000 euros.
5 SPECIAL GENERAL REQUIREMENTS
The following special conditions apply:
5.1 Subcontractor: The Contractor could subcontract all the works.
5.2 Reuse of removed, demolished, milled and/or excavated material: The materials removed, demolished, milled and/or excavated during the execution of the project that can be reused are: ground, selected soil, adequate soil, tolerable soil, marginal soil, inadequate soil, graded crushed aggregate, stabilized soil, materials treated with cement (cement-soil and cement-gravel), surface treatment by means of gravel of small size, milled asphalt (cold micro-asphalt and bituminous mixes) and crushed concrete (concrete and lean concrete).
5.2.1 Reuse of removed, demolished, milled and/or excavated material: The materials removed, demolished, milled and/or excavated during the execution of the project that can be reused are: ground, selected soil, adequate soil, tolerable soil, marginal soil, inadequate soil, graded crushed aggregate, stabilized soil, materials treated with cement (cement-soil and cement-gravel), surface treatment by means of gravel of small size, milled asphalt (cold micro-asphalt and bituminous mixes) and crushed concrete (concrete and lean concrete).
The materials removed, demolished, milled and / or excavated during the execution of the project can be reused as long as they meet the project requirements and are previously approved.
If the Contractor does not reuse the removed, demolished, milled and/or excavated material, the Contractor shall transport said material to an authorized dump.
If there is a surplus of the material removed, demolished, milled and/or excavated after its reuse by the Contractor, the Contractor shall transport said material to an authorized dump.
If any workshop of Morón Air Base needs all or part of the material removed, demolished, milled and/or excavated that the Contractor does not reuse or that was surplus after the reuse by the Contractor, the Contractor shall transport the material required by the workshop of the Morón Air Base to the stockpile area designated by the Contracting Office and the rest of the material to the authorized dump.
The representative of the Contracting Office and/or Construction Management shall coordinate with the Chief of Operations and Maintenance of the Base the exact location of the stockpile area of the material required by any shop of Morón air Base.
5.3 Stockpiling area for Contractor material and Contractor offices: The C.O. representative shall coordinate with the base Chief of Operations and Maintenance the exact location for Contractor offices and stockpiling.
5.4 Laboratory: The Contractor shall submit the laboratory certificate within 30 calendar days after the Contract Award Date. All sampling and testing shall be performed by an approved laboratory, independent from the Contractor, that is accredited in accordance with a current UNE-EN 9001:2000 and registered by Junta de Andalucía for the following tests. The laboratory shall be the responsible to perform the entire

quality control of the project, shall be as a consultant and shall provide the technical assistance that can be required.

5.5 Laboratory Tests: Laboratory tests performed more than 6 months before the submission date shall not be accepted.
