SECTION L- PROPOSAL PREPARATION INSTRUCTIONS

A. General Instructions: This section provides general guidance for preparing proposals, as well as specific instructions on the format and content of the proposal. Throughout this section, the term "offeror" means the prime contractor submitting the proposal. The offeror's proposal shall include all data and information requested and shall be submitted in accordance with these instructions. Any offeror who submits an incomplete package may be considered unacceptable. The offer shall be compliant with the requirements as stated in the Request for Proposal (RFP). A proposal that is sufficiently documented to support cost/price and technical requirements in a complete, orderly, and specific detailed manner will enable the Government to perform a thorough and fair evaluation. Non-compliance with the instructions of this RFP may result in an unacceptable proposal evaluation and the proposal may be eliminated from consideration for contract award.

B. Type of Acquisition: For this acquisition, the selection will be made using Lowest Priced Technically Acceptable (LPTA) procedures with the technical factor and subfactors evaluated on an acceptable/unacceptable basis. The proposal will be evaluated by government contractors per the evaluation factors in Section M.

C. Discrepancies and Ambiguities: If an offeror believes the requirements in these instructions contain an error, omission, ambiguities, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale no later than 10 calendar days after the RFP release.

D. Mistakes: Mistakes in offeror's proposal shall be handled in accordance with FAR 14.407-4 as referenced in

FAR 15.508.

E. Postponement of Proposal Closing Date: If a determination is made to postpone a proposal closing date, an announcement of the determination shall be posted to the original solicitation posting and, if practicable, before issuance of a formal RFP amendment otherwise communicated to prospective offerors.

F. Post-Award/Pre-Performance Conference: A post-award/pre-performance conference will be scheduled by the Contracting Officer (CO) and held prior to the commencement of any work under the awarded contract. The offeror or their duly authorized representative is required to attend the post- award/pre-performance conference.

G. Contract Document: Sections K, L and M apply to the solicitation phase only; therefore, they will not be a physical part of the resulting contract.

NOTE: All questions and answers will be posted on through https://beta.sam.gov.

NOTE: Not attending the site visit will not result in an extension of the solicitation closing date and time.

Proposal Format and Submission Instructions

A. The proposal package must be completed and sent to the following e-mail addresses:

In addition, it may also be hand delivered in CD form with .pdf format files (to include all parts) to the address in Block 7 of the SF 1442.

Only electronic copies of the proposal will be accepted.

It is the offerors responsibility to ensure that the proposal reaches the office designated for receipt of proposals within the time established in the solicitation.

B. HAND-CARRIED PROPOSALS NOTICE: Offerors are cautioned that Moron Air Base has stringent visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass and be cleared by the Government point of contact prior to entrance. Please contact the POC's listed at least 5 days prior to the Solicitation closing date to coordinate delivery of hand carried proposals. All Third Country Nationals must notify the POC's at least 21 days prior to the solicitation closing date, as they must be approved through ODC Madrid prior to requesting base access.

PART I - CONTRACT DOCUMENTATION AND PRICE PROPOSAL

SF 1442: Complete applicable blanks. The offeror accedes to the contract terms and conditions as written in the RFP Sections A through J. Acknowledge all amendments issued to the solicitation (see Block 19 of the SF 1442)

A. Section B: Insert the proposed price for ALL CLINS and the TOTAL AMOUNT to provide a complete and usable end product in accordance with the terms and conditions stated in this solicitation. Offerors' proposals not conforming to this RFP may be considered ineligible for award. The prices shall be valid through the proposal acceptance period (SF 1442 Block 13 D).

B. Section C through J: Complete applicable blanks, the offeror shall submit only those pages that require a fill-in.

C. Letters of Agreement: The offeror shall provide Letter of Agreement (LOA) signed by both parties for all teaming partnerships, joint ventures, A/E Firm partnerships or significant subcontractors that will be performing as part of this contract. LOA's not signed by both parties will not be accepted. Changes will not be permitted after contract award without a valid justification and approval from the Contracting Officer

PART II -TECHNICAL PROPOSAL

Offerors shall meet the minimum standards of each Technical Factor and subfactor in order for their technical proposal to be determined "technically acceptable." The standards are defined in Section M of the RFP.

Note: Offerors are responsible for ensuring their proposal meets the minimum requirements of the Statement of Work. See Section M - Other - Conformance to Specification Requirements.

A. Subfactor 1 - Management, Technical Approach, and Capabilities:

A.1. A-E Design Capabilities: The Offeror shall include in the proposal potential A-E design firm(s) and the capabilities of the A-E design firm. Demonstrating their experience performing both design-build construction projects and design of Hot Mix Asphalt (HMA) on airfield pavements. Provided information must be detailed sufficiently to allow the Government to ascertain the Offeror's capability to perform design and/or design management to the minimum magnitude. Additionally, the A&E firm shall demonstrate a clear understanding of applicable USAFE & NATO airfield design requirements as they related to the overall design scope.

A.2. Management and Technical Approach: The Offeror shall include in his proposal the description of the Offeror's management and technical approach of all involved parties (Prime Contractor, Architect-Engineer Design Firm, and key subcontractors, if any). Describe the proposed management structure of the team, describing how the design and/or construction process will be managed and the authorities and/or the delegations of authority within the team. The Offeror should utilize this section to describe best practices of their company. Key elements include, but are not limited to:

a. Available headquarter management resources assigned to the project.

f. Construction team involvement during the design phase.

c. Design team involvement during construction phase.

d. Problem avoidance and mitigation techniques/strategy.

e. Construction safety best practices.

f. Airfield construction technical requirements and quality control (QC) processes: Including but not limited to milling and paving operations, aggregate sourcing, airfield markings, testing laboratory, asphalt batch plant, and airfield lighting.

A.3. Schedule Plan: The Offeror shall include in their proposal the description of its ability to execute the construction in relation to the design-build project, minimizing the impact on operations. The plan will include a preliminary summary schedule, including all events associated with the work. This plan shall be in the form of a bar chart schedule (Gantt chart), showing relationship between activities, the critical path and floats.

Additionally, the Offeror shall provide a description of potential scheduling issues and solutions in relation to this design-build scope.

B. Subfactor 2 - Past Experience:

The Offeror shall include with the proposal projects that demonstrate the capabilities of the Offeror through past experience. Examples should at minimum describe the magnitude, scope, and Offeror role in each project.

B.1. Three (3) to five (5) example projects demonstrating the design-build project management experience of the Offeror as the prime contractor of a project. Additionally, the offer should choose one (1) of the example projects and provide further information within their proposal. Information should include specific applications of best management practices and lessons learned as it relates to Subfactor A.2 Management and Technical Approach.

B.2. Three (3) to five (5) example projects demonstrating the experience and capability of the Offeror as a Construction Firm when a full design has been provided by the Government. Examples should demonstrate the capability to manage a construction contract of similar type and scope to this project, i.e. airfield pavements.

Additionally, the offer should choose one (1) of the example projects and provide further information within their proposal. Information should include specific applications of best management practices and lessons learned as it relates to Subfactor A.2 Management and Technical Approach .

C. Subfactor 3 - Classification Certificates:

C.1. Classification Certificates: Offeror must include in proposal Current Classification Certificates held by the Bidder and/or key subcontractors, if any, and issued by the Spanish "Registro Oficial de Licitadores y Empresas Clasificadas del Estado" of the "Ministerio de Hacienda" in relation to this design-build contract. The certificate holder must execute the activities related to the certificate as specified. The submitted certificates shall be original or a notarized copy. The classification certificates are as follows:

O24 or O25 G25 or G26 G45 or G46 I11 or greater (I14) I51 or greater (I54) I62 or greater (I64)

D. Subfactor 4 - Agreements with Subcontractors:

D.1. Memorandum of Agreement between the Offeror and each Key Subcontractor, if any: Offeror must include in their proposal a memorandum of agreement between the Offeror and each key subcontractor in relation to this design-build contract, if any, establishing that the key subcontractor will perform the corresponding work activity if the contract is awarded to the Offeror. The memorandum of agreement has to be signed by the Offeror and the key subcontractor and shall be original or a notarized copy.
