ATTACHMENT XX
HAZARDOUS MATERIALS. Contractors shall complete and submit a Contractor Hazmat Profile Work Sheet contained in Attachment XX. Check the applicable boxes on the form to indicate if A) only “exempt items” in Attachment XX will be used or B) that a Contractor Hazmat List (with supporting Safety Data Sheets) will be submitted. Contractor signature on Hazmat Profile certifies contractor will NOT use any “Extremely Hazardous Substances” (EHS) listed in 40 CFR, Part 355, Appendix A or any Class I Ozone Depleting Substances (ODS Class I) listed in 40 CFR Part 82 (see the EPA website http://epa.gov/ozonne/title6/index.html). The Contractor Hazmat Profile form shall be a submittal for all projects on MacDill AFB (MAFB).
Contractors shall identify all the “non-exempt” hazardous materials they intend to use on the project in advance. The contractor shall develop a list of these materials with “not to exceed” quantities in the format provided in Attachment XX. The report shall list, with regard to the subject delivery order, all anticipated hazardous materials usage on MAFB. The “Contractor Hazmat List” form and electronic copies of the associated Manufacturer’s Safety Data Sheets shall be provided as a submittal to the CENM representative and the designated Government Quality Assurance Personnel. This submittal is only required for projects that will require the use of “non-exempt” hazardous materials as stated above.
If the base deems a contractor’s proposed material line item inappropriate because of safety or environmental concerns, CENM shall advise the contractor that he/she must refrain from using that material on the project. The contractor shall be required to provide an alternative material or process that meets the contract requirements.
The base shall complete its review of the contractor’s proposed HAZMAT list and respond within 5 business days. If the base fails to respond within 5 work days from receipt of the submittal, the contractor shall assume the list of non-exempt HAZMAT items is approved.
If the contractor determines he/she will need additional HAZMAT materials after project initiation, he/she shall send an email with the requested item(s) to the CENM and CEIE representative.
The CEIE representative shall expedite base coordination with the goal of responding within 1 business day.
The contractor shall not use supplemental HAZMAT items on the project until they are reviewed.
Costs for delays caused by the contractor requiring review after contract start for items not identified in their HAZMAT items submittal, shall be the responsibility of the contractor.
The contractor shall maintain a copy of the original and supplemental item list and associated MSDS’s at the work site in accordance with 29 CFR 1910.1200.
CENM shall make periodic checks of the contractor’s HAZMAT records and materials on hand to ensure he/she is staying within the reviewed list and quantities.
At completion of his/her work, the contractor shall remove all unused HAZMAT from the worksite and dispose of it off base in accordance with all environmental laws and regulations.
The contractor is responsible for ensuring all empty containers are removed from the base and disposed of or recycled in accordance with the MacDill Integrated Solid Waste Management Plan.
Hazmat Storage
The Contractor shall store all Hazmat in a designated Hazmat storage area. The Contractor shall anticipate receiving at least one assessment during the contract period to ensure their Hazmat storage area is in compliance with Hazmat storage requirements outlined in this section.
The Contractor shall ensure that all Best Management Practices in paragraph 3.8 of this section are in place while Hazmat is being used or stored on base.
The Contractor shall provide adequate containment for all bulk Hazmat ( 55 gl.) being stored on base. Containment shall be chemically inert to the Hazmat being stored and impervious to absorption of the Hazmat. The containment volume shall not be less than 10% of the total quantity being stored or equal to the quantity of the largest container being stored whichever is greater in volume. Separate containment shall be provided for incompatible Hazmat.
Best Management Practices (BMPs)
NFPA and OSHA required or specified flammable material and corrosive material compliant storage shall be used for the extended storage of all Hazmat.
The Contractor shall ensure that the segregation of incompatible materials is accomplished at all times in his or her field office, storage, staging, and work areas.
Ensure the use of protective measures such as drop cloths and tarpaulins when using Hazmat to keep the work and storage areas free from drips and spills.
Keep all containers closed when not in use. At the end of the workday, or when finished using any material, return the container to a proper storage area.
Do NOT store Hazmat outdoors where it can be exposed to precipitation.
Follow all manufacturers’ recommendations for storage and use of Hazmat.
Spill Control and Clean Up
The Contractor shall be responsible for the cleanup and disposal of all spilled materials whether or not they are Hazmat. This includes all materials used to contain and absorb the spill. Spills of Hazmat or Hazardous Waste shall be managed in accordance with all applicable Federal, State and local regulations. Spills will be reported to the contracting officer as soon as possible.
Disposal of wastes generated from spill cleanup shall be the contractors’ responsibility.
