52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

Goals for minority Goals for female participation for each trade participation for each trade

17.9% Hillsborough County 6.9% 17.1% Highland County

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

EVALUATION FACTORS FOR AWARD

SECTION M

3.3 Past Performance – Factor 2: The past performance evaluation results in an assessment of the government’s confidence in the offeror’s ability to fulfill the solicitation requirements while meeting schedule, budget, and performance quality constraints. Past Performance will be evaluated as a measure of the Government’s confidence in the offeror’s ability to successfully perform based on previous and current contract and support agreements. Both a recent/relevant rating and a confidence assessment rating will be assigned to each offeror. Past performance information may be obtained through the Construction Contractor Appraisal Support System (CCASS) and Architect-Engineer Contract Administration Support System (ACASS), Past Performance Information Retrieval System (PPIRS), questionnaires tailored to the circumstances for this acquisition, through interviews with program managers and contracting officers, or other sources known to the Government. Data from previous source selections or contractor capability assessments will be used if the data is recent and relevant. To assist the Government’s evaluation, each offeror’s proposal will contain the supporting past performance documentation, which demonstrates multi-project/multi-discipline construction and design-build experience. In conducting a performance confidence assessment, each offeror shall be assigned one of the following ratings:

TABLE 3 – PERFORMANCE CONFIDENCE ASSESSMENTS

Rating Description

Substantial Confidence Based on the offeror’s performance record, the government has high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s performance record, the government has an expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s performance record, the government has a low expectation that the offeror will be able to successfully perform the required effort.

No Confidence Based on the offeror’s performance record, the government has no expectation that the offeror will be able to successfully perform the required effort.

Unknown Confidence No performance record is identifiable or the offeror’s performance record is so sparse that no confidence assessment rating can be reasonably assigned.

The following definition will be used in evaluating the relevancy of the offeror’s past performance:

Relevant – Relevant past performance information must demonstrate design/build and build experience with multiple projects, such as new construction, renovation, alteration and repair, with associated architectural and engineering work, with multiple disciplines, such as airfield, pavement, renovation, repair, additions/upgrades, along with specific work in heating, ventilation and air conditioning (HVAC), electrical, mechanical and other major trades. Projects should be similar in size, scope, and complexity as those anticipated under this contract, i.e., having a project value between $200,000 and $5,000,000 and include projects with the Federal Government, state and local government agencies, and commercial customers.

6.2 Relevancy defined: Relevant past performance information must demonstrate design/build and build experience with multiple projects, such as new construction, renovation, alteration and repair, with associated architectural and engineering work, with multiple disciplines, such as airfield, pavement, renovation, repair, additions/upgrades, along with specific work in heating, ventilation and air conditioning (HVAC), electrical, mechanical and other major trades. Projects should be similar in size, scope, and complexity as those anticipated under this contract, i.e., having a project value between $200,000 and $5,000,000 and include projects with the Federal Government, state and local government agencies, and commercial customers.
